Taking Intellectual Property into Their Own Hands Amy Adler* & Jeanne C. Fromer** When we think about people seeking relief for infringement of their intellectual property rights under copyright and trademark laws, we typically assume they will operate within an overtly legal scheme. By contrast, creators of works that lie outside the subject matter, or at least outside the heartland, of intellectual property law often remedy copying of their works by asserting extralegal norms within their own tight-knit communities. In recent years, however, there has been a growing third category of relief-seekers: those taking intellectual property into their own hands, seeking relief outside the legal system for copying of works that fall well within the heartland of copyright or trademark laws, such as visual art, music, and fashion. They exercise intellectual property self-help in a constellation of ways. Most frequently, they use shaming, principally through social media or a similar platform, to call out perceived misappropriations. Other times, they reappropriate perceived misappropriations, therein generating new creative works. This Article identifies, illustrates, and analyzes this phenomenon using a diverse array of recent examples. Aggrieved creators can use self-help of the sorts we describe to accomplish much of what they hope to derive from successful infringement litigation: collect monetary damages, stop the appropriation, insist on attribution of their work, and correct potential misattributions of a misappropriation. We evaluate the benefits and demerits of intellectual property self-help as compared with more traditional intellectual property enforcement. Emmanuel Raymundo Abstract On February 25, 2011, the fashion luxury company Christian Dior suspended John Galliano, who had been its creative director since 1996, after his arrest over making anti-Semitic remarks at a Paris bar. Quickly following his suspension, a video from December 2010 was distributed showing Galliano hurling anti-Semitic invectives at several bar patrons. On March 1, 2011, Dior fired Galliano. At stake in the considerable interest and speculations regarding who takes over at Dior is control of a €24.6B business empire and access to a historic couturier’s archive. In this sense, its designer will influence the label’s “books” both financial and what will be stored in its physical repository as part of the brand’s creative and artistic repertoire. Despite fashion’s apparent ubiquity, the anticipation surrounding who takes over at Dior is proof that despite fashion’s professed democratization, there still exists a fashion hierarchy with Dior occupying its upper echelon. Since Galliano’s dismissal, fashion insiders have moved from breathlessly feverish in their speculations to desperately calling out for relief in the face of an unexpectedly drawn-out waiting game that is now over a year old and otherwise an eternity in fashion’s hyper accelerated production cycle. To purposely counter fashion’s accelerated internal clock, the purpose of this commentary is to keep fashion in a reflective state rather than a reflexive stance and uses fashion on film, and specifically Robert Altman’s Prêt-à-Porter (1994), to give cultural and historical context to all the online speculation and chatter. -

CHAPTER 3 RUS SIAN RAP IN THE ERA OF VLADIMIR PUTIN Philip Ewell T has always held a special place in the hearts of Rus sians. From the poetry recitations by Evgeny Evtushenko in the s that lled stadiums to the inspired lyr ics of Rus sian bards like Vladimir Vysotsky, Rus sians have sought not only beauty but also repose in artistic literary forms. is is not sur- prising given Rus sia’s troubled po liti cal history over the centuries, which reached its height in the twentieth century with the repressive Soviet era. Countless vol- umes have been written over the years on censorship in the USSR and on the ensuing balancing act that Soviet artists endured at the hands of the authorities. at Soviet and post- Soviet Rus sian rappers felt that same repression is not in doubt. After working for Industry for five years, he began his involvement with oil shale in 1948 when he joined the U.S. Bureau of Mines and was assigned to Rifle, Colorado, to work at Anvil Points. During the middle fifties, he was assigned to the Atomic Energy Com mission to study the extraction of ura nium from the Chattanooga Shales in Tennessee. He became Research Director of the U.S. Bureau ofMines in 1967 and served in this capacity until he retired in 1979. During these years his involvement with oil shale intensified. The time—l2:00 P.M.1 The place—Paris, France. The event—world renowned fashion designer Gabriel “Coco” Cha- nel’s comeback fashion show. Fashion editors, designers, and journalists from England, America and France waited anxiously to document the event.2 With such high anticipation, tickets to her show were hard to come by. The Russian hip hop scene is extremely racist. It’s being led by racists like @sdthaking and i1official (@Talib Kweli 2020)1 The above tweet was posted at the end of February 2020 in the middle of a heated Twitter controversy between famous us rapper Talib Kweli and the Russian hip-hop community, in which he described the en- tire Russian rap scene as racist, Nazi and state sponsored.2 Thе scandal quickly spread to other social media platforms and got extensive cover- age online and even on the official Russian tv channels.
