Inleiding Dit artikel dient om inzicht te geven in de verblijfplaatsen en de werkzaaamheden van Wachmann Iwan Demjanjuk (geboren op 3 april 1920), een uit Oekraïne afkomstige en in Trawniki bij Lublin opgeleide kampbewaker. Dit is van belang in verband met het proces tegen Demjanjuk, die nu de regering van de Bondsrepubliek aan de Verenigde Staten om zijn uitlevering heeft verzocht daar binnenkort terecht zal staan, waarschijnlijk voor medeplichtigheid aan moord op tienduizenden joden afkomstig uit het bezette Nederland, uit het Generaalgouvernement (bezet Polen) en uit de Sovjet-Unie in het vernietigingskamp Sobibor in de maanden april tot en met september 1943.1 Evenals het vernietigingskamp Treblinka is Sobibor in het najaar van 1943 geheel met de grond gelijk gemaakt, om de sporen van de misdaad uit te wissen. Het vernietigingskamp Belzec was in december 1942 buiten gebruik gesteld.2 In het najaar van 1943 werden ook de meeste, niet alle, door de daders opgestelde documenten vernietigd.3 In dit artikel ligt de nadruk niet op de (juridische) finesses van de talrijke rechtszaken waarin Demjanjuk sinds 1977 verwikkeld is geraakt, en ook zichzelf heeft verwikkeld. Demjanjuk heeft van februari 1987 tot april 1988 onder een enorme mediabelangstelling in Israël terecht gestaan. Hij werd er van beschuldigd de gevreesde Oekraïense bewaker “Iwan de Verschrikkelijke” in Treblinka te zijn geweest. Op 25 april 1988 werd Demjanjuk als “Iwan de Verschrikkelijke” in Treblinka tot de strop veroordeeld.4 Hij ging in hoger beroep en werd vrijgesproken.

    Demjanjuk - Munich II Commentary by Andriy J. Semotiuk U.S. and Canadian Immigration Lawyer A fundamental principle of Western jurisprudence is individual responsibility for one's actions. In criminal law, this requires that the charges against the accused, and the accused’s responsibility for the crime, must be proven beyond a reasonable doubt. In the Demjanjuk case there was no finding of individual culpability, there was instead, a PRESUMPTION of it. There was no finding of voluntariness, there was instead, a PRESUMPTION of it. That is why this case was a show trial, not a real trial. Let us be clear. No sensible human being denies the facts of the Holocaust, the loss of 6 million Jewish lives or their suffering, nor the turmoil initiated by Nazi Germany that resulted in the loss of some 50 million lives in World War II. What is being questioned, however, is the role Demjanjuk played in all that. One of the great attributes of the jurists at Nuremberg was their insistence that the accused have the ability to fairly defend themselves according to the rule of law and legal principles. Though flawed in some ways, such as its failure to prosecute even one Allied war crime, the involvement of a Soviet prosecutor and its attempt to shift the blame for the Katyn Forest massacre of Polish Officers on to the Germans, still, even with such deficiencies noted, the Nuremberg trials sought to abide by the rule of law and to find the accused guilty of INDIVIDUAL responsibility for the crimes committed. Unlike in the Demjanjuk case, in the case of the Nuremberg defendants, there was no doubt about their identity, there was no doubt about their presence where the events took place and there was little doubt about their personal involvement.

It was widely covered and commented upon by an international academic and media audience. Reaction to the trial was highly divided, thanks in large part to the exceptional nature of its legal processes in comparison to previous German trials of low-ranking perpetrators of the Holocaust. This thesis questions what the trial’s significance was both in terms of its place in the legal record of German Holocaust prosecutions, and also in German collective memory of the Holocaust. A brief history of German coming-to-terms with the Holocaust is established, as well as the legal record of Holocaust trials in Germany, to set the context for the Munich trial. Separate historiographies cover Demjanjuk’s wartime activities, his previous trial in Jerusalem, and the Munich trial. Particular attention is given to legal scholars, helping to determine the legally noteworthy aspects of the Munich trial. These include the treatment of the matters of functional participation and putative necessity. The most significant aspects of media and academic reaction to the trial are established. These include the defendant’s age and infirmity, his alleged victimisation during the Second World War, his alleged revictimisation by the trial’s processes, and the alleged political motives of the trial.
