Municipal Building, Harmony, NJ Township Committee Meeting December 3, 2019 6:00 p.m.

Regular The Regular Meeting of the Harmony Township Committee was Session called to order by the Mayor. The Mayor made the following announcement, “Adequate notice of this meeting was given in accordance with the Open Public Meetings Act by providing a notice of the meeting to the Star Gazette and The Express-Times, posting a copy thereof on the Township bulletin board and filing a copy thereof in the office of the Municipal Clerk.” The Pledge of Allegiance to the American Flag was led by the Mayor.

HSG Mayor Tipton stated that Kelley Smith is stepping down as Clerk and Kathleen Reinalda steps in during HSG discussion.

Attorney Campbell stated a brief overview as there were discussions about the water level at last meeting. Attorney Campbell stated that the question was that the area in between 262.8 and 246.5 if whether a compromise could be struck where it could be restored within the area in between the two. Attorney Campbell said that since the meeting HSG experts provided a report on November 21st to the Township and all parties which Attorney Campbell explained in summary of the correspondence that for the same reasons HSG can’t restore below 246.5 is the reason why HSG does not want to restore in between 246.5 and 262.8. Attorney Campbell stated that HSG request is that HSG only has to restore above the current existing water level. Attorney Campbell stated that Engineer Finelli took that information and provided a bonding estimate over and above the current bond that is in place and Mr. Finelli would like to see a bond of $200,000 over and above the rest of the work so that would assure the Township that if the water level ever dropped below 262.8 that the Township would have additional funds to make sure that the area was also restored once it was below the water level. Attorney Campbell stated that that’s where we are at this point. Attorney Campbell and Attorney Wilhelm had a discussion and Mr. Wilhelm was asked if his client would be willing to do that and Mr. Wilhelm stated HSG has a bond of a $1,000,000 in place and work has been done since this bond has been put in place.

Mayor Tipton asked Engineer Finelli if he did any analysis on whether the current state of affairs values the remainder on the restoration at approximately $600,000. Engineer Finelli stated he has not since he has been caught up with this particular issue for six months. Engineer Finelli said obviously they looked at the estimate that was provided earlier this year from HSG and he thinks we can certainly have some confidence that if $200,000 additional bond that the Township is looking for, for protection because of the steeper slopes, that we would allow based upon the studies HSG Geotech did and the natural angle of the repose of the material. Engineer Finelli stated that there is, in his opinion, that there is clearly in excess of $200,000 of additional protection which is in place now based upon the work that was completed versus the bond that is in place. Engineer Finelli thinks that the money is there at the moment to give us the bond protection.

1 Attorney Artigliere said the one thing that he keeps hearing is about the compromise, HSG is already getting a compromise because HSG is not complying with the Ordinance at 246.5. Attorney Artigliere stated that the Smiths’ did compromise when there was testimony at the last meeting that discussed the safety and our Engineer was agreeable to saying that level. Attorney Artigliere said when the bond was being discussed, the first question to Mr. Panacucci was about the bond, when the water level drops HSG doesn’t want to come back.

Mayor Tipton asked Attorney Artigliere if he had any objections to the compromise that has been talked about on the Townships side. Attorney Artigliere replied that HSG is suppose to go from 200 up, from the bottom up. The compromise is going to 246.5 because that is relatively a safe level. The issue is as the water drops how long will it take to fix to get it safe. The Ordinance is in place for a reason. Attorney Artigliere stated that a deadline needs to be set and kept and if the project isn’t done in time then there needs to be consequences.

Attorney Artigliere said his clients have not interfered with the work, has not insulted anybody and not engaged in any personal attacks. He said we are just addressing a safety issue that as property owners and the Township will be responsible for when HSG’s business aspect is done. Attorney Artigliere said there’s one comment that somebody said “you can’t restore this below the water level”. Attorney Artigliere stated you can restore it below the water. Attorney Artigliere said it’s not whether you can or can’t it’s an economic issue. He said do you require the person who dug the hole to absorb that cost or do you take the risk that the cost.

Attorney Wilhelm stated that the Committee knows it’s not purely an economic issue despite how it is being characterized. Attorney Wilhelm said if the Smiths’ want to get a rebuttal through their Engineer for the November 21st letter he would understand that but to just simply characterize it as a solely economic issue is not accurate.

Attorney Artigliere said to respond to that he had the Engineer here and he provided testimony. The November 21st letter just reiterated what was said before so there is no reason to go back and forth like a tennis match. Attorney Artigliere said Mr. Panicucci has an opinion, our Engineer has an opinion and the Townships’ Engineer has an opinion and there is an Ordinance that is set that says 3:1 from 200 feet on up so as he said he thinks someone coming in and asking for delays, delays, delays and waivers. He said after reading the letter he was really taken back by the language in that letter saying the Smiths’ reject this.

Mayor Tipton said he agrees with Attorney Artigliere on that view point he was not pleased to see that letter either on the rejection. He says that we are trying to work with everyone here. Mayor Tipton said he understands all of Attorney Artiglieres’ other points and we have been doing this for a long and not a lot of new facts are being revealed. Mayor Tipton asked if the rest of the Committee and the Professionals had any questions or comments.

Mayor Tipton stated the only thing he would like to see before the Committee takes action of this is that the historical data that was discussed. Mayor Tipton stated a 10-year bond will be discussed. Mayor Tipton stated he wants to look back at a 10-year window of how the area has changed over time so the history is better understood. Mayor Tipton stated that the historic data will be discussed at the January’s meeting for the 2019 application and HSG’s 2020 application will then be due at the March meeting instead of February as usual.

WHEREAS, the Governor’s Council on Alcoholism and Drug Abuse established the Municipal Alliances for the Prevention of Alcoholism and Drug Abuse in 1989 to educate and engage residents, local government and law enforcement officials, schools, nonprofit organizations, the faith community, parents, youth and other allies in efforts to prevent alcoholism and drug abuse in communities throughout .

WHEREAS, The Township Council of the Township of Harmony, County of Warren, State of New Jersey recognizes that the abuse of alcohol and drugs is a serious problem in our society amongst persons of all ages; and therefore has an established Municipal Alliance Committee; and,

WHEREAS, the Township Council further recognizes that it is incumbent upon not only public officials but upon the entire community to take action to prevent such abuses in our community; and,

WHEREAS, the Township Council has applied for funding to the Governor’s Council on Alcoholism and Drug Abuse through the County of Warren;

NOW, THEREFORE, BE IT RESOLVED by the Township of Harmony, County of Warren, State of New Jersey hereby recognizes the following:

1. The Town Council does hereby authorize submission of a strategic plan for the Regional Municipal Alliance grant for fiscal year 2021 in the amount of: DEDR $2,546.00 Cash Match $ 637.00 In-Kind $1,910.00

2. The Town Council acknowledges the terms and conditions for administering the Municipal Alliance grant, including the administrative compliance and audit requirements.

RESOLUTION ADOPTING A DOMESTIC VIOLENCE POLICY WHEREAS, on or about October 15, 2019, the New Jersey Civil Service Commission issued a Statewide Domestic Violence Policy (DVP) for Public Employers, which is attached hereto; and WHEREAS, pursuant to N.J.S.A. 11A:2-6a(b)(1), “The [Civil Service Commission] shall develop a uniform domestic violence policy, which all public employers shall adopt and distribute to their employees, regardless of whether a public employer is subject to the provisions of Title 11A, Civil Service, of the New Jersey Statutes;” and WHEREAS, the Township of Harmony seeks to update its Personnel Policies and Procedures Manual to comply with N.J.S.A. 11A:2-6a(b)(1). NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Township Committee of the Township of Harmony in the County of Warren, that the Township of Harmony Policies and Procedures Manual is updated as follows: 1. The Statewide DVP (which is attached hereto) shall be referenced and adopted in the Township of Harmony Personnel Policies and Procedures Manual. 2. The Township of Harmony Personnel Policies and Procedures Manual shall designate Kelley Smith and Brian Tipton as primary and secondary Human Resources Officer (HRO) for purposes of the DVP. 3. The Table of Contents shall be updated to reflect the inclusion Township’s adoption of the Statewide DVP. BE IT FURTHER RESOLVED that a copy of the updated Township of Harmony Personnel Policies and Procedures Manual is on file with the Clerk's office; and

WHEREAS, Harmony Township (hereinafter “Local Unit”) has joined the Statewide Insurance Fund (hereinafter “Fund”), a joint insurance fund as defined in N.J.S.A. 40A:10-36 et seq.; and

WHEREAS, the Bylaws require participating members to appoint a Risk Management Consultant, as those positions are defined in the Bylaws, if requested to do so by the “Fund”; and

WHEREAS, the Local Unit has complied with relevant law with regard to the appointment of a Risk management Consultant; and

WHEREAS, the “Fund” has requested its members to appoint individuals or entities to that position; and

5 2020 FUND YEAR STATEWIDE INSURANCE FUND R:19-100 (A) RISK MANAGEMENT CONSULTANT’S AGREEMENT

THIS AGREEMENT entered into this 3rd day of December 2019 among the Statewide Insurance Fund (“FUND”), a joint insurance fund of the State of New Jersey, Harmony Township (“MEMBER”) and Michael Smith (Ahart, Frinzi & Smith Insurance) (“RISK MANAGEMENT CONSULTANT”) through a fair and open process, pursuant to N.J.S.A.19:44A-20.4.

WHEREAS, the CONSULTANT has offered to the MEMBER professional risk management consulting services as required by the Bylaws of the FUND; and

WHEREAS, the CONSULTANT has advised the FUND that he/she is familiar with the terms, conditions and operations of the FUND; and

WHEREAS, the MEMBER desires these professional services from the CONSULTANT; and

WHEREAS, the MEMBER has complied with relevant law in regard to the appointment of a Risk Management Consultant; and

WHEREAS, the Bylaws of the FUND require that members engage a CONSULTANT and that the CONSULTANT comply with certain requirements set forth therein.

NOW, THEREFORE, the parties in consideration of the mutual promises and covenants set forth herein, agree as follows:

1. For and in consideration of the amount stated hereinafter, the CONSULTANT shall:

(a) assist in evaluating the MEMBER’S exposures and advise on matters relating to the Member’s operation and coverage.

(b) explain to the MEMBER, or its representatives, the various coverages available from the FUND.

(c) explain to the MEMBER, or its representatives, the terms of the member’s commitment and obligations to the FUND.

(d) explain to the MEMBER, or its representatives the operation of the FUND.

(e) prepare applications, statements of values, etc., on behalf of the MEMBER, if required by the FUND.

(f) review the MEMBER’S assessment and assist in the preparation of the MEMBER’S insurance budget.

(g) review losses and engineering reports and provide assistance to the MEMBER’S safety committee, if required.

6 (h) assist in the claims settlement process, if required, by MEMBER or FUND.

(i) attend the majority of meetings of the Fund Commissioners or Executive Committee, if requested, and perform such other services as required by the MEMBER or the FUND.

(j) comply with the obligations imposed upon Risk Managers in the FUND’s Bylaws.

(k) act in good faith and fair dealing to the FUND.

(l) perform other duties for the FUND as may be required from time to time by the FUND.

1. 2. In exchange for the above services, the CONSULTANT shall be compensated in the following manner:

(a) The CONSULTANT shall be paid by the FUND, on behalf of the MEMBER, a fee as compensation for services rendered. Said fee, an apportionment of the MEMBER’s assessment: 6% of workers’ compensation (excluding any fees, PLIGA, and loss ratio apportionment); 7.5% of non WC assessment (excluding any fees, PLIGA, and loss ratio apportionment);

(b) The CONSULTANT shall be entitled to compensation for services provided during any calendar year only if the CONSULTANT has been appointed and holds the position of Risk Management Consultant, as of January 31 of the said calendar year for counties and municipalities holding general elections and July 30 for municipalities holding regular elections.

(c) For any insurance coverages authorized by the MEMBER to be placed outside the FUND, the CONSULTANT shall receive as compensation the normal brokerage commissions paid by the insurance company. The premiums for said policies shall not be added to the FUND’s assessment in computing the fee set forth in 2(a).

If the MEMBER shall require of the CONSULTANT extra services other than those outlined above, the CONSULTANT shall be paid by the MEMBER a fee at a rate to be negotiated by the parties.

3. The term of this Agreement shall be from January 1, 2020 to January 1, 2021. However, this Agreement may be terminated by either party at any time by mailing to the other thirty (30) days written notice, certified mail return receipt.

4. The CONSULTANT shall comply with all laws applicable to producers who provide insurance products to public entities and shall comply with all applicable statutes and regulations relating to joint insurance funds.

5. The CONSULTANT agrees to comply with all affirmative action laws applicable in accordance with Exhibit A and to submit all necessary

7 documentation establishing compliance within seven (7) days of this Agreement.

(a) A photocopy of a valid letter that the vendor is operating under an existing Federally approved or sanctioned affirmative action program (good for one year from the date of the letter); OR (b) A photocopy of a Certificate of Employee Information Report approval, issued in accordance with N.J.A.C. 17:27-1.1 et seq.; OR (c) A photocopy of a completed Employee Information Report (Form AA302) provided by the Division of Contract Compliance and completed by the vendor in accordance with N.J.A.C. 17:27-1.1 et seq.

The successful professional service entity may obtain the Employee Information Report (AA302) from the Statewide Insurance Fund during normal business hours.

The undersigned professional service entity certifies that he/she is aware of the commitment to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq. and agrees to furnish the required forms of evidence.

The undersigned professional service entity further understands that his/her submission shall be rejected as non-responsive if said professional service entity fails to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq.

R:19 - 103 RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF HARMONY, WARREN COUNTY, NEW JERSEY, ENDORSING THE HOUSING ELEMENT AND FAIR SHARE PLAN ADOPTED BY THE LAND USE BOARD

9 WHEREAS, the Township of Harmony filed a Declaratory Judgment Action in the Superior Court of New Jersey, Warren County, captioned IMO Township of Harmony, Docket No. WRN-L-239-15 (the “Declaratory Judgment Action”), in furtherance of the Supreme Court’s March 10, 2015, decision In re Adoption of N.J.A.C. 5:96 & 5:97 by N.J. Council on Affordable Housing, 221 N.J. 1 (2015) (the “Supreme Court Decision”); and

WHEREAS, a Fairness Hearing was held on January 15, 2019, at which settlement agreements between the Township and Fair Share Housing Center (“FSHC”) was approved, and said approval was later memorialized by an Order entered by the Count on January 15, 2019; and

WHEREAS, in accordance with the terms of the settlement agreements and the Court’s January 15, 2019 Order, the Township’s planner prepared a Housing Element and Fair Share Plan; and

WHEREAS, upon notice duly provided pursuant to N.J.S.A. 40:44D-13, the Land Use Board held a public hearing on the Housing Element and Fair Share Plan on November 6, 2019 and adopted the Housing Element and Fair Share Plan on the same day; and

WHEREAS, a true copy of the resolution of the Land Use Board adopting the Housing Element and Fair Share Plan is attached hereto as Exhibit A; and

WHEREAS, the Township Committee of the Township of Harmony wishes to endorse the Housing Element and Fair Share Plan and seeks approval of the Housing Element and Fair Share Plan from the Court.

BE IT RESOLVED, by the Township Committee of the Township of Harmony in the County of Warren, and the State of New Jersey:

1. That it hereby endorses the Housing Element and Fair Share Plan, as adopted by the Harmony Township Land Use Board on November 6, 2019 via the Land Use Board resolution, attached hereto as Exhibit A. 2. That it authorizes and directs its professionals to file with the Court (i) the Housing Element and Fair Share Plan, (ii) the resolutions of the Land Use Board adopting and the Township Committee endorsing the Housing Element and Fair Share Plan, and (iii) any additional documents the professionals deem necessary or desirable. 3. That it authorizes its professionals to seek Court approval of the Housing Element and Fair Share Plan at a properly noticed Compliance Hearing. 4. That it reserves the right to amend the Housing Element and Fair Share Plan, should that be necessary. 5. That a list of names and addresses for all owners of sites in the Housing Element and Fair Share Plan has been included with the Fair Share Plan; and

6. That notice of this endorsement and a copy of this resolution, the adopted Housing Element and Fair Share Plan and all supporting documentation shall be made available for public inspection at the Township of Harmony municipal clerk’s office during the regular business hours for a period of 45 days following the date of publication of the legal notice pursuant to N.J.A.C. 5:96-3.5.

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF HARMONY, COUNTY OF WARREN, STATE OF NEW JERSEY, APPOINTING KELLEY SMITH AS THE MUNICIPAL HOUSING LIAISON FOR THE TOWNSHIP OF HARMONY

WHEREAS, under authorization of the New Jersey Fair Housing Act (N.J.S.A. 52:27D-301, et seq., the Township of Harmony is implementing a program to provide affordable housing units to very low-, low- and moderate-income households within the Township; and

WHEREAS, the Township’s Affordable Housing Ordinance sets forth the duties of the Municipal Housing Liaison that requires a Municipal Housing Liaison oversee the Township’s affordable housing program; and

WHEREAS, the Township of Harmony has selected Kelley Smith to be the Municipal Housing Liaison for the purposes of providing affordability control services for all affordable housing within the Township.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Harmony in the County of Warren, and the State of New Jersey that Kelley Smith is hereby appointed by the Township Committee of Harmony Township as the Municipal Housing Liaison for the administration of the affordability controls of the Township’s housing program.

R:19-105 RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF HARMONY, COUNTY OF WARREN STATE OF NEW JERSEY APPOINTING KELLEY SMITH AS THE ADMINISTRATIVE AGENT FOR THE TOWNSHIP OF HARMONY

WHEREAS, under authorization of the New Jersey Fair Housing Act (N.J.S.A. 52:27D-301, et seq., the Township of Harmony is implementing

11 a program to provide affordable housing units to very low, low- and moderate-income households within the Township; and

WHEREAS, the Township’s Affordable Housing Ordinance sets forth the duties of the administrative agent pursuant to N.J.A.C. 5:80-26.14 et seq. that requires the affordability controls of affordable housing units be administered by an administrative agent acting on behalf of a municipality; and

WHEREAS, the Township of Harmony has selected Kelley Smith to be the administrative agent for the purposes of providing affordability control services for all affordable housing within the Township.

WHEREAS, Mrs. Smith shall be required to complete all training to achieve an Affordable Housing Professional Certificate, which is provided by the Affordable Housing Professionals of New Jersey and the Center for Government Services at Rutgers. This Certificate will serve as the qualification to serve as the Township’s Administrative Agent. Mrs. Smith shall obtain said Certificate by November 1, 2020; and

NOW THEREFORE BE IT RESOLVED, by the Mayor and Township Committee of Harmony Township in the County of Warren, and the State of New Jersey that Kelley Smith is hereby appointed by the Township Committee of Harmony Township as the Administrative Agent for the administration of the affordability controls of the Township’s housing program.

WHEREAS, in accordance with the New Jersey Uniform Housing Affordability Controls pursuant to N.J.A.C. 5:80-26-1, et seq., the Township of Harmony is required to adopt an Affirmative Marketing Plan to ensure that all affordable housing units created, including those created by the rehabilitation of rental housing units within the Township of Harmony, are affirmatively marketed to low- and moderate-income households within Housing Region 2, the COAH Housing Region encompassing the Township of Harmony.

BE IT RESOLVED, that the Township Committee of the Township of Harmony in the County of Warren, and the State of New Jersey does hereby adopt the following Affirmative Marketing Plan:

12 Affirmative Marketing Plan

A. All affordable housing units in the Township of Harmony shall be marketed in accordance with the provisions herein.

B. This Affirmative Marketing Plan shall apply to all developments that contain or will contain very low-, low- and moderate-income units, including those that are part of the Township’s prior round Fair Share Plan and its current Fair Share Plan and those that may be constructed in developments not yet anticipated by the Fair Share Plan. This Affirmative Marketing Plan shall also apply to any rehabilitated rental units that are vacated and re-rented during the applicable period of controls for rehabilitated rental units.

C. The Affirmative Marketing Plan shall be implemented by one or more Administrative Agent(s) designated by and/or under contract to the Township of Harmony. All of the costs of advertising and affirmatively marketing affordable housing units shall be borne by the developers/sellers/owners of affordable unit(s), and all such advertising and affirmative marketing shall be subject to approval and oversight by the designated Administrative Agent.

D. In implementing the Affirmative Marketing Plan, the Administrative Agent, acting on behalf of the Township of Harmony, shall undertake, at the minimum, all of the following strategies:

1. Publication of an advertisement in one or more newspapers of general circulation within the housing region.

2. Posting of an advertisement on the Township of Harmony’s official municipal website.

3. At least one additional regional marketing strategy using one of the other sources listed below.

E. The Affirmative Marketing Plan is a regional marketing strategy designed to attract buyers and/or renters of all majority and minority groups, regardless of race, creed, color, national origin, ancestry, marital or familial status, gender, affectional or sexual orientation, disability, age or number of children to housing units which are being marketed by a developer or sponsor of affordable housing. Pursuant to N.J.S.A. 40:37A- 114.1, preference for affordable housing within a housing project may be provided to homeless veterans, disabled veterans, and family members who are the primary residential caregivers to disabled veterans residing with them. The Affirmative Marketing Plan is also intended to target those potentially eligible persons who are least likely to apply for affordable units in that region. It is a continuing program that directs all marketing activities toward the COAH Housing Region in which the municipality is located and covers the entire period of the deed restriction for each restricted housing unit. The Township of Harmony is located in COAH Housing Region 2, consisting of Essex, Morris, Union, and Warren Counties.

F. The Affirmative Marketing Plan is a continuing program intended to be followed throughout the entire period of restrictions and shall meet the following requirements:

1. All newspaper articles, announcements and requests for applications for very low, low- and moderate-income units shall appear in the Star Gazette, and Express Times.

2. The primary marketing shall take the form of at least one press release and a paid display advertisement in the above newspapers once a week for four consecutive weeks. Additional advertising and publicity shall be on an "as needed" basis. The developer/owner shall disseminate all public service announcements and pay for display advertisements. The developer/owner shall provide proof of all publications to the Administrative Agent. All press releases and advertisements shall be approved in advance by the Administrative Agent.

3. The advertisement shall include a description of the:

a. Location of the units; b Directions to the units; c. Range of prices for the units; d. Size, as measured in bedrooms, of units; e. Maximum income permitted to qualify for the units; f. Location of applications; g. Business hours when interested households may obtain an application; and h. Application fees.

4. The developer must provide satisfactory proof of public dissemination. See “Attachment A” COAH’s Affirmative Fair Housing Marketing Plan for Affordable Housing in Region 2 (attached to and hereby made part of this Resolution).

G. Applications, brochure(s), sign(s) and/or poster(s) used as part of the affirmative marketing program shall be available/posted in the following locations:

1. Township Hall of Harmony Township 2. Harmony Township Web Site 3. Morris County Administration Building 4. Essex County Administration Building 5. Union County Administration Building 6. Warren County Administration Building 7. Morris County Library. 8. Essex County Library 9. Union County Library 10. Warren County Library

Applications shall be mailed by the Administrative Agent and Municipal Housing Liaison to prospective applicants upon request. Also, applications shall be available at the developer’s sales/rental office and multiple copies of application forms shall be mailed to Fair Share Housing Center (510 Park Boulevard, Cherry Hill, NJ 08002), the New Jersey State Conference of the NAACP, Warren/Sussex branch of the NAACP, the Latino Action Network (P.O. Box 943, Freehold, NJ 07728), NORWESCAP, and the Supportive Housing Association for dissemination to their respective constituents.

H. The Administrative Agent shall develop, maintain and update a list of community contact person(s) and/or organizations(s) in Morris, Essex, Union, and Warren Counties that will aid in the affirmative marketing program with particular emphasis on contacts that will reach out to groups that are least likely to apply for housing within the region, including major regional employers identified in Attachment A, Part III, Marketing, Section 3d of COAH’s Affirmative Fair Housing Marketing Plan for Affordable Housing in Region 2 (attached to and hereby made part of this

14 Resolution) as well as the following entities: Fair Share Housing Center, the New Jersey State Conference of the NAACP, the Warren/Sussex, branch of the NAACP, the Latino Action Network, NORWESCAP, and the Supportive Housing Association.

1. Quarterly informational flyers and applications shall be sent to each of the following agencies for publication in their journals and for circulation among their members:

2. Quarterly informational circulars and applications shall be sent to the administrators of each of the following agencies within the counties of Morris, Essex, Union, and Warren:

Warren County Division of Temporary Assistance and Social Services New Jersey Rental Assistance Program New Jersey Division of Aging Services Warren County Division of Aging and Disability Services Warren Housing Authority

3. Quarterly informational circulars and applications shall be sent to the chief personnel administrators of all of the major employers within the region, as listed on Attachment A, Part III, Marketing, Section 3e.

4. In addition, specific notification of the availability of affordable housing units in Harmony (along with copies of the application form) shall be provided to the following entities: Fair Share Housing Center (510 Park Boulevard, Cherry Hill, NJ 08002), the New Jersey State Conference of the NAACP, theWarren/Sussex, branch of the NAACP, the Latino Action Network (P.O. Box 943, Freehold, NJ 07728), NORWESCAP, and the Supportive Housing Association.

I. A random selection method to select occupants of very low, low- and moderate-income housing will be used by the Administrative Agent, in conformance with N.J.A.C. 5:80-26.16 (l). The Affirmative Marketing Plan shall provide a regional preference for very low, low- and moderate- income households that live and/or work in COAH Housing Region 2, comprised of Morris, Essex, Union and Warren Counties. Pursuant to the New Jersey Fair Housing Act (N.J.S.A.52:27D-311), a preference for very low, low- and moderate-income veterans duly qualified under N.J.A.C. 54:4-8.10 may also be exercised, provided an agreement to this effect has been executed between the developer or landlord and the Township prior to the affirmative marketing of the units.

J. The Administrative Agent shall administer the Affirmative Marketing Plan. The Administrative Agent has the responsibility to income qualify very low, low and moderate income households; to place income eligible households in very low, low and moderate income units upon initial occupancy; to provide for the initial occupancy of very low, low and moderate income units with income qualified households; to continue to qualify households for re-occupancy of units as they become vacant during the period of affordability controls; to assist with outreach to very low, low and moderate income households; and to enforce the terms of the deed restriction and mortgage loan as per N.J.A.C 5:80-26-1, et seq.

K. The Administrative Agent shall provide or direct qualified very low, low-

15 and moderate-income applicants to counseling services on subjects such as budgeting, credit issues, mortgage qualifications, rental lease requirements and landlord/tenant law and shall develop, maintain and update a list of entities and lenders willing and able to perform such services.

L. All developers/owners of very low, low- and moderate-income housing units shall be required to undertake and pay the costs of the marketing of the affordable units in their respective developments, subject to the direction and supervision of the Administrative Agent.

M. The implementation of the Affirmative Marketing Plan for a development that includes affordable housing shall commence at least 120 days before the issuance of either a temporary or permanent certificate of occupancy. The implementation of the Affirmative Marketing Plan shall continue until all very low, low- and moderate-income housing units are initially occupied and for as long as the affordable units remain deed restricted such that qualifying new tenants and/or purchasers continues to be necessary.

N. The Administrative Agent shall provide the Affordable Housing Liaison with the information required to comply with monitoring and reporting requirements pursuant to N.J.A.C.5:80-26-1, et seq.

Public Comments Someone from the public asked for an explanation of the plans for behind the fairgrounds. Attorney Campbell gave an explanation of the overlay zone and how it was established.

Public Comments Mayor Tipton stated the Committee is about to open for public comments but he made the following announcement. Mayor Tipton stated somebody has put a letter out about the Trans-Mix redevelopment site and he wanted to let everyone know that was present for this issue that there has been no change or updates.

Mr. Kapral thanked the Road Department for cleaning up a tree that fell across the road on Marble Hill Road.

Paul Williams lives on River Rd. Mr. Williams thanked the Committee and Professionals for the update information.

Mike VanDoren lives on Railroad Ave. Mr. VanDoren asked if the website could be updated as far as putting things such as the minutes on it. Mayor Tipton agreed.

Teresa Chapman lives on Brainards Rd. Mrs. Chapman asked if the Committee could give an exact date for due diligence on Trans-Mix, she thought it was done at the end of August and that it was stated they had a year from that date. Attorney Campbell replied she said they had a year from the due diligence which August sounds right and built into the contract a couple of extensions they can access from the year.

Bob Hill lives on Buttonwood Lane. Mr. Hill said the other part in the letter that went out had to do with the possibility of putting a solar farm down on the old Lippincott Farm. Mayor Tipton replied yes, we are under contract and it is a 30-year lease not a purchase. He said the successful bidder has made its’ application to PJM and each year we receive $50,000 to be under contract, if at some point the application gets denied or they decide it is not feasible they can walk away. Mr. Hill asked if it has been talked about at other meetings. Mayor Tipton replied yes, we passed an Ordinance, did an RFP, bidders submitted and were reviewed, then we voted on it and approved it.

29 Jamie McLain said he wants to thank the Township on the SADC part because he is one of the farms in the hopper. He wanted to make sure that process was still moving forward.

Doug Lipot lives on Alpha Street. Mr. Lipot asked how does he get the paper alley abandoned behind his house? Mayor Tipton replied that something we can do as a Township. Mayor Tipton asked does the alley have a name? Mr. Lipot replied that the alley is off of Pine Street. Mr. Lipot said that everybody has taken over the alley way and he has been having problems that someone is using it and it is not supposed to be used. Mayor Tipton stated that it is still technically a Township street and they will look into it.

Paul Williams lives on River Road. Mr. Williams said the road that goes back to Trans Mix needs a trench there because every time it rains the water runs all onto his property. Mr. Cornely said he will talk to Randy Hoffman about it.

Richard Dalrymple lives on River Road. Mr. Dalrymple would like to know why some of these issues that concern most of our population are not put on the ballot and gave examples of some of the concerns. Mayor Tipton replied for the past thirteen years no one has been coming to meetings, there has been no one at meetings, the Committee has had many, many meetings discussing these things out in the open and that everything does not get “put on the ballot” for a vote.

John Matlock lives on River Road. Mr. Matlock asked what is the name of the company that the Township entered into agreement for the Trans Mix site? Attorney Campbell replied it is Reivax and they also created an entity called Montasano at Harmony, LLC.

There were no further comments at this time. Public comment period was closed by Mayor Tipton.
