POLITICAL PRISONERS

CHARGES

Movie Director Sued for Defamation Movie Director Min Htin Ko Ko Gyi has been sued under Article 66(d) of the Telecommunications Law by lieutenant colonel Lin Htun. This defamation lawsuit has come after U Min Htin Ko Ko Gyi posted criticisms of the army on Facebook. His lawyer requested bail for health reasons - as U Min Htin Ko Ko Gyi had a part of his liver removed for liver cancer three months ago - yet the request was denied.

Activist Nay Myo Zin Arrested and Charged for Defaming the Military Political and social activist Nay Myo Zin was charged under Section 505(a) & (b) of the Penal Code for allegedly defaming the military at a talk held in Ahpyauk Town in Irrawaddy Division in April 1 to support the amendment of the 2008 Constitution. Lieutenant Colonel Toe Linn from Yangon Regional Military Command is a plaintiff and charged Nay Myo Zin at the Taik Kyi Township Court in April 3. On April 19, he appeared before the Taik Kyi Township Court and was arrested and sent to Insein Prison after being denied bail by the court.

Four Men Arrested and Charged under the Unlawful Association Act On April 22, Ngapudaw Township Court in Irrawaddy Division charged four men including Thein Aung Myat who has published and sold the Rakhita Calendar under the Section 17(1) of the Unlawful Association Act. On April 6, Thein Aung Myat was arrested along with his friend, driver and a local while he was selling the Rakhita Calendar in Higyi Island in Irrawadddy Division. They were detained at the Ngapudaw Police Station via Higyi Island Police Station and a lawsuit was filed against them under Section 17(1) of the Unlawful Association Act by the Ngapudaw Police Station. On April 23, they four men were sent to the Pathein Prison, said wife of Thein Aung Myat. The Irrawaddy Region police force, Lieutenant Colonel Tun Shwe, said they were mainly arrested because terms written in the calendar are also used by rebel groups.

Satirical Performers Charged For Performance Five members of a traditional satirical performance team were charged for not having their scripts reviewed by censors before performing. Zeyar Lwin, Paing Ye Thu, Dee Yay, and Yadanar Myint were those charged under Section 66(d) of the Telecommunications Act at Mayangone Township. While Ma Kay Khine Tune was charged under Section 505(a) of the Penal Code.

Five Auk Thar Kan Villagers Charged Under Unlawful Association Act Village administrator Thein Kyaw Naing and Sein Tun, Hla Thein Maung, Ba Tun, Maung Phyu Chay and Ko Naing, from Auk Thar Kan in Mrauk-U Township, Arakan State, were arrested in March. Village administrator Thein Kyaw Naing was released in March 31 but the other five villagers’ hands were tied, placed on their back and taken by the military. After they had been arrested, the five villagers were charged under 17(1) of the Unlawful Association Act.

Five Activists Charged under PAPPL On April 22, Myawaddy Police Force arrested activist Naw Ohn Hla and four protest leaders Maung Oo, Thandar a.k.a Sandar Myint, U Nge a.k.a Than Hlaing and Naw Thein a.k.a Nan Khin Thein under Section 19 and 20 of the Peaceful Assembly and Peaceful Procession Law at Myawaddy in Karen State and investigated them at Myawaddy Myoma Police Station and granted them bail. Although they asked for a permission to stage a protest, their protest exceed what permission they had for its actions. Therefore, a lawsuit was filed against them, said a police officer of the Myawaddy Myoma Police Station. On April 21, Naw Ohn Hla and four other protest leaders staged a protest for not abolishing the Shwe Mya Sandi Housing.

Lawsuit File against Sayadaw U Thawbita At the beginning of April, Lieutenant Colonel Aung Myo Kyaw of the Central Command, had submitted a lawsuit to the Amarapura Township Court against Sayadaw U Thawbita, a leader of the 2007 Saffron Revolution, for defaming the Tatmadaw (military) in social media posts under Section 505(b) of the Penal Code. the Amarapura Township Court Judge, Zaw Min, said police is now investigating the case. Sayadaw U Thawbita has already been charged under section 66(d) of the Telecommunications Law by the Lieutenant Colonel Myo Khaing Win in September 2018 for the same case.

Irrawaddy Editor Sued By Military The Burma Army has sued the Irrawaddy editor for covering the conflict between the Burma Army and in . The case was filed by Yangon Region Command under Article 66(d) of the Telecommunications Law against the Irrawaddy editor U Ye Ni on April 12. U Ye Win has been granted bail.

ARRESTS

Letkar Villagers Arrested by Myilitary On April 11, Letkar Village Administrator Aung Than Myint, Tun Sein Hla, Maung Saw Thein and Tun , Four Letkar Villagers in Mrauk-U Township, Arakan State, and Kyaw San Aung, Kyaw Naing and Tin Moe Kyaw a.k.a Ye Htut and three Lay Nyin Taung Villagers, were arrested and taken to serve as guides for the military. In the afternoon four Letkar villagers were released yet the other three Lay Nyin Taung Villagers are still in detention.

Five People Detained For Suspected AA Relations During a military clearance on April 1 in Kanzout Village, Township, Rakhine State, two monks and three civilians were detained under the Unlawful Association Act for suspected ties to the Arakan Army (AA). The detained are U Thuwana from Thirimytiz monastery in Township, U Nyama from Gandamadaung monastery in Mrauk-U Town, Mya Tun from village in , along with Thein Hand and Kyaw San from Ponnagyun Town.

Three Paletwa Civilians Still Missing Six Months After Clashes

Fighting between the Burma Army and Arakan Army (AA) in Peechaung area of Chin State’s Paletwa Township 6 months ago left three civilians missing. The three people, Kho Lo, 60 years old, 14 year old Benjamin and 15 year old Maung Kyaw Naing are still missing. Locals state no one witnessed where they went, also the Burma Army and AA have not provided information on where they could have gone amidst the conflict.

SENTENCED

Two Members of an Armed Group Sentenced to Two Years in Jail U Aung Swee Oo and U Maung Oo, members of the All Burma Students’ Democratic Front (ABSDF), were sentenced under the Unlawful Association Act on April 11. The court in Mohnyin Township Kachin State gave them two years in prison. The two individuals were arrested when they went to Mohnyin Township to attend an ABSDF member’s funeral. The ABSDF has signed the Nationwide Ceasefire Agreement. According to the ABSDF chairman stated that both people had documents showing they were allowed to travel. The group has strongly opposed the court’s verdict.

Chin Let Wa Villagers Sentenced Three Years Imprisonment On April 10, Paletwa Township Court in Chin State sentenced three Chin Let Wa Villagers, Thar Tun, Zaw Min Htike and Tun Aye, to three years imprisonment under Section 17(1)(2) of the Unlawful Association Act. In January, they had been arrested because some people had informed the military that they were in connection with the Arakan Army (AA).

RELEASES

Burma Army Releases Child Soldiers The Burma Army has released 7 children and 25 youth that served as soldiers. Since the Burma Army signed a Joint Action Plan with the U.N in 2012 to diminish the recruitment of children they have released 956 child soliders.

Kachin Activist Nang Pu Released From Prison On April 5, activist Nbau Nang Pu was released four months into her six month term from Myitkyina Prison due to health concerns. She was a leader in a campaign to support internally displaced communities within Kachin State’s conflict zones.

Two Presidential Pardons 9,500 prisoners were released as part of Burma’s annual presidential pardons. According to President Win Myint, the pardon was granted on humanitarian grounds. Only two political prisoners walked free under this pardon, Maran Gan from Mandalay Prison and Zaw La from Myingyan Prison.On April 26th the second presidential pardon occured, releasing 6,948 prisoners. Lum Zawng and Zau Jat are were confirmed to be released in this second amnesty. They were sentenced to 6 months in jail and fined 5,000 Kyat for insulting the Burma Military during a protest. The third released political prisoner is Ze Hkwang. The President’s Office spokesperson stated most people released this time were incarcerated for drug related crimes.

CONDITIONS OF IMPRISONMENT

Aye Maung and Wai Hin Aung Transferred to Insien Prison Dr. Aye Maung and Wai Hin Aung were transferred to Insien Prison without their families and lawyers being notified.

Prison Strikes and Rioting Inmates in Shwebo Prison and Mopalain Labour Camp were left out of the presidential pardons this year.In response to this, inmates created a demonstration calling for equal pardons across all prisons - which turned into a riot. Most of those who partook were sentenced under articles 15 and 16 of the 1993 Narcotic Drugs and Psychotropic Substances Law, and saw it unfair that people given similar sentences were pardoned.

RESTRICTIONS ON CIVIL AND POLITICAL RIGHTS

Many Local Civilians Killed After Military Attack A helicopter attack on April 3rd has reportedly killed between 6 to around 30 local civilians in Rakhine State’s Township. Some witnesses and locals state that the victims had no relation to the Arakan Army (AA), while the Burma Army states those killed were working with the AA. Local reports have detailed the death toll to be around 10, while the United Nations’ sources state it might be as high as 30.

Media Outlets Receive Anonymous Threats According to some media outlets, they have received threats for reporting on clashes between the Arakan Army (AA) and the Burma Army. Eleven Media stated that the threatening emails and phone calls claimed to be from the AA - the AA has denied this, and denounced the threats.

Two Young Boys Shot Dead On March 31, in Shan State’s Si Sai Township, Lon Pho Village, the Pa-O National Army accidentally shot and subsequently killed two Pa-O eight year old boys studying at a monastery.

Thirteen Construction Workers Abducted The Arakan Army (AA) has stated they abducted 13 construction workers from Hsu Htoo Construction Co. that were building a road in Paletwa Township. Later, five people were released. The AA claims these workers were former military intelligence and still operating under the armed forces. They have been taken to ensure that they are not working for the army and can be trusted. The AA states they are not against the road development.

Two villagers injured by artillery On April 1 an artillery shell explosion in Northern Rakhine State, ’s Phet Wing Chaung village injured two civilians. The two injured are Zaw Min, 35 years old, and Maung Thu, 15 years old.

13 Accused Did Not Show Up at Court Due to Security Concerns 13 people, detained in Prison for Unlawful Association, were unable to appear at their trial in Kyauktaw due to security. This lack of security has also been used to deny the detained visitations from their lawyer. This was meant to be the fourth court hearing, and the detainees have been charged since February 18.

7 Villagers Killed By Burma Army On April 5, two Burma Army soldiers arrived in Kya-In Seikkyi Township, Anin Kwin village, to ask for a motorbike around midnight. When the villagers refused, the soldiers opened fire, killing 7 people, 3 of whom were children. The two men have been captured by the Burma Army, and will be prosecuted. One soldier was from Light Infantry Battalion 275, while the other is from Light Infantry Battalion 339.

Rights commission to probe police in Ayeyarwady over death Zaw Yan, a farmer and land rights activist, was arrested on March 21 by Wakema Township police and died while in their custody. The man’s family filed a complaint, and now The Myanmar National Human Rights Commission is investigating the matter.

Police Block Charity Group In Zaygyi Market in Sittwe The New Generation of Rakhine Youth Charity Association was stopped by police for not having the appropriate paperwork to collect funds for refugees.

NSCN-K demand release of leaders In March the Burma Army arrested 10 leaders and 6 soldiers of the National Socialist Council of Nagaland Khaplang. Now, the NSCN-K is demanding for their release so they can continue peace talks with the Burma Army. 5 leaders have been released, but the other 5 remain in custody.

Demands to Release 3 Men Held by KIA Four Lisu men were allegedly arrested a month ago by the Kachin Independence Army (KIA) in Kachin State’s Hpakant Township. One man, Phaw Li Hsa, was able to escape and stated the arrested men were tortured for 10 days. The remaining three men, Gwar Tee, Phaw Yaw Si, and Moli Dwet, are still missing. The Lisu National Development Party (LNDP) has demanded for their immediate release

Two Civilians Injured in Northern Rakhine State Artillery fire injured 2 civilians on April 17 in Mrauk-U Township, Northern Rakhine State. U Maung Tun Aye and his daughter Ma Htay Htay Aung were in their houses when hit by the artillery. The shooting came from the Burma Army Light Infantry Battalion No. 377 and 388, and continued for 2 days.

Pregnant Woman Hit By Gunfire On April 21, in Rakhine State’s , then pregnant Saynu Wara Begum was shot by a stray bullet. Saynu Wara Begum survived, but lost her unborn child. There has been ongoing conflict in the area between the Burma Army and Arakan Army, but it is uncertain from which side the shot came from.

Reuters Journalists Appeal Rejected Reuters reporters Wa Lone and Kyaw Soe Oo were given the Pulitzer Prize for their writing on the killing of 10 Rohingya men in Northern Rakhine State, after military-led fighting began there. They are now the fourth journalists to receive this prize in Burma.They also submitted an appeal after being sentenced to 7 years in jail for violating the Official Secrets Act, but it was rejected by Burma’s top court. Currently, the two men have spent over 16 months in detention since their arrest.

Two young villagers suspected for landmine explosion 9 APRIL 2019

In Kain Gyi Village, Township, two explosions occurred on a bridge and road.Two men from Mawrawady village were questioned by the Burma military. The men have not been arrested, the local authority has assured they are not guilty and will be released after questioning.

Three People In Military Detention Found Dead On April 10th, 27 men were taken by the Burma Army in Rakhine State’s Mrauk-U Township under suspicion of ties to the Arakan Army (AA). Three of the men - Zaw Myo Tun, Thein Tun Sein, and Maung Than Nu - died under military custody. A military spokesperson stated the three men passed from a heart attack, suicide, and addictions withdrawal. There has been criticism, with some locals and professionals believing the men died of torture.

Tanintharyi Woman Injured In Landmine Blast A landmine exploded on April 23rd in Ahlae Sahkan, Tanintharyi Region’s Yayphyu Township, injuring a 63 year old woman. Daw Hninsi, the women injured, had her left leg wounded and is receiving treatment at a hospital in Dawei.

Chin Group Calls For Release of Villagers A conflict on February 2 in Kintalin village, Paletwa Township, Kachin State saw 54 people abducted by the Arakan Army (AA). Although two people were able to escape, 52 remain abducted in an outpost near the Myanmar, Bangladeshi and Indian border. The Khumi Affairs Consultative Council (KACC) has demanded the AA release these residents. A spokesman for the AA stated that residents were not taken by force, but instead helped them when their village was being attacked - taking them to the border outpost for safety.

Complaint Submitted to MNHRC for the Solitary Confinement of a Prisoner On April 2, wife of prisoner Bilar, Aye Thandar Maw, submitted a complaint to the Myanmar National Human Rights Commission (MNHRC) because her husband Bilar who is serving a prison sentence in Myaung Mya Prison in Irrawaddy Division is being sent to the solitary confinement and kept in shackles for 14 days. In the beginning of March, Bilar had complained about prison staffs beating a prisoner in relation to drugs been thrown into the Myaung Mya Prison He was later placed in solitary confinement. MNHRC member Yu Lwin Aung said they will investigate this case soon.

Villagers Investigated for Naming Minister and MP on Buffalo Toys On April 3, seven villagers from Township in Arakan State were investigated at the Ramree Police Head Quarter for giving a name of “Minister” and “MP” to two buffalo toys when buffalo fight match was held at the funeral of the monk from April 1 to April 2. However, a lawsuit has not filed yet and will report to the president office whether action were taken or not. Currently, these seven villager go around the town like house arrest.

Mother and Daughter Struck by a Bullet in Mrauk-U Township On April 9, Hlaw Nu and her one year and nine months daughter Myat Aye Khin from Chaung Thit Village in Mrauk-U Township in Arakan State were struck by a bullet. As Hla Nu had heard the shooting at night at 10:00 pm, she felt unsafe and went to the monastery with her daughter. While they were in monastery, they were struck by a bullet.

On April 13 at night 10:00 pm at Baung Dook Village in Mrauk-U Township, Arakan State, 61 years old Maung Kyaw Sein was shot dead and 63 years old Kyaw Thein was injured by the military. As Kyaw Thein was seriously injured, he was urgently transferred from Mrauk-U Hospital to Sittwe Hospital. Even though villagers said the military had shot at the villagers, the military denied such allegations.

Mother and Daughter Killed in Missile Attack On April 12, 78 years old Pa Don died and her daughter, 40 years old Ma Kyan, was injured as a missile exploded on two houses and farmland situated three miles away from War Gyi Taung Village, in Arakan State. The spokesman of the Chin Human Rights Group Salai Hlan said military gave one lakh and Ann Township General Administration Department gave 50,000 Kyat to Ma Kyan who are receiving treatment in Ann Township Hospital

LAND DISPUTES

Tension Between USDP and Famers The Union Solidarity and Development Party (USDP) has leased around 80 acres of land in Kyaukse Township, Mandalay region which has angered local farmers who claim the land is ancestrally theirs. To signify their connection to the land, the farmers held a plough protest where they tilled the contested land to showcase their claim. According to a USDP spokesperson, the land was claimed legally under the Vacant, Fallow and Virgin Lands Act.

Lashio farmers demand return of confiscated lands About 200 farmers in Northern Shan State protested for the return of land confiscated by the army in the 1990’s. Primarily taken at Khur Ning and Khur Kham villages, about 100 acres of land have remained unused, and are now being sold back to the public. Instead, the farmers want the unused land to be given back.

50 Farmers Protest to Return the Confiscated Land On April 7, approximately 50 farmers from Mae King Kone Village in Patheingyi Township, Mandalay Division staged a protest to return their land which were confiscated by Army Engineering Battalion #910. In 1992, Battalion #910 confiscated over 200 acres of land which were owned by 35 farmers.

Farmers Protest to Return Land Rent by Military On April 7, approximately 100 farmers from Si Pine Kone Village in Patheingyi Township, Mandalay Division staged a protest to return over 80 acres of their land which were rented by Army Engineering Battalion #910 to extend the Mandalay Beer Factory. In 1992, Si Pine Kone Village which was located near Battalion #910 was ordered to move the village due to close to the battalion. After the village had been moved, farmers rented these land from the military.

Press Conference Held for Arbitrarily Land Confiscation On April 8, land owners held a press conference in Rangoon to take action effectively against the buyer and seller of their land. In 1996, respective authorities had arbitrarily confiscated over 12 acres of land in Mogaung Township, Kachin State and sold these land as city land under the current government. Even though

the original owners filed a complaint to the land records department and other respective departments, actions has not taken. Therefore the owns held a press conference, said Nwae Nwae Win, one of the land ownesr.

Conflict Occurred for Land Confiscation in Kanbalu Township On April 16, a conflict occurred between authorities from agricultural department and farmers who stay contested land near Bu Kone Village, Kanbalu Township in Sagaing Division. Farmers built a hut to stay on their confiscated land because they want to cultivate bean, corn and sesame. As staffs from agriculture department attempted to demolish the hut by using tractors and farmers inhibited them, a conflict occurred between them, said Khayay whose 40 acres of land had been confiscated. In 1980, agricultural department had confiscated 5000 acres of land to cultivate corn plantation owned by the state. As the corn plantation was not successful, 3000 out of 5000 acres of land were transferred to the army’s ration battalion, said farmers. In 2015 and 2016, farmers who rented the land from the army were given leases over 900 out of 2000 acres of land. The original farmers were not given their land back, said Khayay.

Farmers Prohibited to Cultivate on their Ancestral Land Even though seven officials of #360 artillery battalion had prohibited farmers from cultivating on their ancestral land in Demoso Township, Kayah State on April 20, farmers continued cultivation. The farmers cultivated 280 acres of land which had been seized by Major Win Min Aung, former battalion commander of #360 artillery battalion. Although farmers asked to meet with the new battalion commander, they have not met yet. On March 1, officials of #360 artillery battalion met with five farmers including East Dawso Village Administrator and asked them to submit a letter to the government and that they will allow to cultivate farmers if they receive the order. Therefore, farmers submitted the letters to the respective departments in line with his requests.

Locals Face to Difficulties in Land Cultivation Due to Military Locals from Lashio in Northern Shan State have faced trouble because they were not allowed to access their land by traveling through other land which the military has confiscated. The #7005 armored Battalion had dug a wide drain as they do not want farmers to go through land which were confiscated by them in Naung Kham Village in Hue Mon Village Tract. Therefore, Khay Kham Villager had covered the drain in April 19 to cross over it. However, the military redug the drain again in April 20. (23 April 2019 - BNI/Burmese)

INSTITUTIONAL REFORMS

Discussion to Organize Ministry of Justice On April 1, The Union Legal Aid Board held a discussion with the legal experts to discuss how to improve justice provision at the office of the National League for Democracy (NLD). They had discussed the establishment of the Ministry of Justice, appointing experienced lawyers in positions of vacant judges and how to organize the judicial commission. A total of 60 people including lawyers and NLD members attended the discussion.

Permanent Secretary of MOH Said Three Prisons and One Detention Center Built Permanent Secretary of Ministry of Home Affairs, Khaing Tun Oo, said three prisons and one detention center is being built to solve the overcrowding issues in prisons. He disclosed this information when the officials of the Ministries had discussed the first three years of their activities with the states newspapers.
