    File OF-GEN-06 FRR 14 August 2020 To: All Pipeline Companies regulated under the Canadian Energy Regulator Act Commission of the Canada Energy Regulator (Commission) Pipeline Financial Resources Requirements Update on Approval of Financial Resources Plans Background Subsection 138(1) of the Canadian Energy Regulator Act (CER Act) requires pipeline companies to maintain financial resources equal to their absolute liability level. The Pipeline Financial Requirements Regulations (Regulations), which came into force on 11 July 2019, set out absolute liability limits for the non-major oil pipeline companies1 (i.e., all other oil, gas, and commodity pipeline companies). On 29 March 2019, the National Energy Board (NEB) issued the Pipeline Financial Requirements Guidelines (Guidelines). Included in the Guidelines was a schedule for companies to submit their financial resources plans for review and approval. By 16 April 2019, the first Financial Resources Plans from companies with an absolute liability class of Oil Class 2 and 3 were filed with the NEB for review. This was followed by companies with an absolute liability class of Gas Class 1, 2, 3, and 4 filing their Financial Resources Plans. Companies with an absolute liability class of Other Commodity filed their Financial Resources Plans by 11 June 2019. Companies whose Financial Resources Plans were previously approved are listed in Appendix I under the headings “Approved as of” for the following dates: 17 July 2019, 28 August 2019, 18 December 2019, and 3 June 2020. The Commission continues to consider the Financial Resources Plans from Oil, Gas, and Other Commodity companies filed to-date. This letter updates and replaces the Commission’s previous letter dated 3 June 2020.

    Executive Profile C. Gregory Harper President & CEO Spectra Energy Partners, LP Greg Harper is president and chief executive officer of Spectra Energy Partners, LP, the $1.6 billion master limited partnership formed by Spectra Energy. Harper also serves on the Board of the Partnership. Harper previously served as group vice president of Spectra Energy Transmission, responsible for the analysis and preparation required to establish and support Spectra Energy as a publicly traded midstream natural gas business. Prior to his return to Spectra Energy Transmission, Harper served as group vice president of energy marketing and management for Duke Energy Americas. He managed the commercial activities for Duke Energy’s North American wholesale energy business. Harper joined the company in May 1987 as an engineer for Texas Eastern Transmission Corp. After a series of promotions, he was named division engineer for Panhandle Eastern Corp. and manager of business development for Texas Eastern marketing. Harper was promoted to director of LDC markets and producer services in 1997, and general manager of Texas Eastern and Algonquin Gas Transmission in 1999. He became vice president of East Tennessee Natural Gas (ETNG) in 2000, and served as vice president of business development and ETNG for Duke Energy Gas Transmission. He was named senior vice president of energy marketing for Duke Energy North America in January 2003, and group vice president of energy marketing and management in January 2004. He was named to his current position in May 2007. The Owensboro, Ky., native received a bachelor of science degree in mechanical engineering in 1987 from the University of Kentucky in Lexington.

    NOTICE OF AVAILABILITY OF THE DRAFT ENVIRONMENTAL IMPACT STATEMENT (EIS)/ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE CALNEV (KINDER-MORGAN) PIPELINE EXPANSION PROJECT (SCH #2008031071) The Bureau of Land Management (BLM), together with the County of San Bernardino (County), California, has prepared a Joint Environmental Impact Statement/Environmental Impact Report (EIS/EIR) for the proposed Calnev Pipeline Expansion Project from Colton, Calif. to Las Vegas, Nev. The BLM and the County of San Bernardino have prepared the EIS/EIR to evaluate potential impacts associated with the proposed Calnev Pipeline Expansion Project and Alternatives. This project is proposed by Calnev Pipeline, LLC, a subsidiary of Kinder-Morgan Energy Partners. The Draft EIS/EIR for the Calnev Pipeline Expansion Project is available for public review and comment. The Pipeline Expansion Project includes the construction, operation, and maintenance of 233 miles of new 16-inch diameter pipeline on approximately 2,841 acres of land under multiple ownership (BLM manages 1,239 acres of the land the proposed pipeline would cross) from the North Colton Terminal to the Bracken Junction near McCarran International Airport in Las Vegas, which would parallel the existing system for most of the route (see attached map). In addition to the new pipeline, the proposed project would include a new pump station, electrical substation, and ancillary facilities near Baker, Calif.; a new 3-mile lateral from the Bracken Junction to McCarran International Airport; and new or modified connections to new or modified laterals, valves, and ancillary modifications. The proposed pipelines primarily traverse undeveloped lands administered by the BLM. Other federally managed lands in the proposed project area include land under the jurisdiction of the U.S.
