ORDER UNDER SECTION 144 CrP.C

WHEREAS, a sudden spike in the cases of COVID-19 has been noticed in past few days which posed a dire need to take mitigation and preventive measures to curtail the spread of COVID-19 in the district;

WHEREAS, it is an established fact that COVID-19 spreads from a COVID positive patient/person to another person through personal contact or air at a very fast rate and hence requires minimizing the personal contacts to counter its spread;

WHEREAS testing. tracing and isolation of COVID-19 positive patients/suspects is the most effective strategy to arrest the spread of COVID-19;

WHEREAS, 1 am of the view that there is a real and imminent threat of the second wave of COVID-19 epidemic in district Kangra due to a recent surge in COVID-19 positive cases and that there is a sufficient ground for proceeding under Section 144 of Cr. PC to impose additional restrictions in the district to minimize social contacts,

THEREFORE I. Rakesh Kumar Prajapati, IAS, District Magistrate, Kangra at Dharamshala in exercise of the powers conferred in me under section 144 of Cr. PC, and in welfare of the public at large, do hereby order and direct that

Restriction/lockdown and Government/Private offices or Institutes/Institutions/Religious places

i. There will be night restriction in district Kangra from 08.00 P.M. to 06.00 AM. wei 20th April, 2021 till further orders and there shall be no movement of persons/vehicles in any case except those stated in the exempted category; i. There shall be complete lockdown within the boundaries of district Kangra on weekends ie. on every Saturday and Sunday till further orders and no movement whether person or vehicle during the lockdown period shall be allowed except those stated in the exempted category; 11. All govermment/private offices or institutes/institutions /PSU/local bodies/ Autonomous Bodies within the boundaries of district Kangra shall remain closed on weekends i.e. on Saturday and Sunday whereas the aforesaid offices or institutes/institutions shall function with 50 percent of its total employees/workforce/human resource on remaining days of the week ie. on Monday. Tuesday, Wednesday, Thursday and Friday. All the employees failing in the category of differently-abled including pregnant woman are exempted from attending offices till 01-05-2021; iv. There will be total ban on entry of general public at large in the places of religious/worship w.ef. 23.04.2021. However, the daily rituals or pooja as per the tradition will continue to be performed;

V. All direct public dealing in the offices of government within the boundaries of district Kangra shall be suspended except in Banks and offices of Central Government/ PSUs. However, public can resort to digital/electronic mode of service; vi. All educational institutions /schools/colleges/universities/institutions/Coaching Centers will remain close up to 01-05-2021. However, examinations if any scheduled will be held in the premisesof educational institutions. Teaching staff is exempted from attending institutions till O1.05.2021. All nursing/medicalldental colleges will however remain open and ensure observance of the COVID-19 SOPs issued by respective departments.

Micro-Containment Zones

i In case five or more than five active COVID-19 positive cases are reported/recorded in any cluster within the jurisdiction of district Kangra, it shall be immediately notified as a micro-containment zone by the concerned Sub Divisional Magistrate with imposition of all restrictions suggested/directed time to time by Centre and State Government for the micro-containment zones and the Sub Divisional Magistrate may deploy any officer/official of any Government Department or PRIs or Members of ULBs within the jurisdiction of the concerned Sub Division for the purpose of surveillance and monitoring of implementation of the guidelines/directions of containment zones; ii. All Block Development Officers in district Kangra and the staff working under the jurisdiction of Block Development Officers in district Kangra upto the panchayat level shall remain under the control and disposal of concerned Sub Divisional Magistrates till further orders and their services shall primarily be utilized to ensure the adherence to the guidelines/directions of micro containment zones, home isolation/ active surveillance and any other required by the concerned Sub Divisional Magistrate to mitigate the spread of COVID-19;

Home Isolation/Quarantine and COVID-19 testingg

i. Any resident of who enters/returns in the boundaries of district Kangra on or after 21" April, 2021 from any of COVID-19 high load States like , Uttar Pradesh, , Karnatka, Gujarat, Rajasthan and Punjab or Kumbh outside the state for Mela 2021 or Vrindavan Dham or any other religious gathering those stated in exempted category with a motive to stay any purpose/reason except more than 24 hours, shall inform within the boundaries of district Kangra for who will concerned ward member or panchayat secretary or panchayat pradhan of the returned/entered in district ensure seven days home isolation/quarantine person Kangra, under home isolation shall ensure to get ii. Every person or suspect or primary contact health care centre himself/herself tested for COVID-19 (RTPCR) at the nearest after seven immediately after completion of home isolation/quarantine period ie. days district shall and the Chief Medical Officer and all Block Medical Officers in Kangra adherence to the ensure necessary arrangements for RTPCR tests with proper time to time guidelines of social distancing and COVID-19 safety protocols issued by State and Centre Government; In case of violation of the guidelines/directions of Home Isolation by any person, the ii. concerned ward member/ Pardhan/ Up Pardhan or any other officials shall be authorized to register case under the appropriate provision of law stated in the order, iv. In case of unavailability of vehicle for the transportation of primary contacts of COVID-19 positive patients for the purpose of testing for COVID-19, the concerned

Sub Divisional Magistrate may hire a vehicle to transport the primary contact to nearest health care centre to get him/her tested for COVID-19 and drop back; All owners of the hotels or home stays functioning within the boundary/jurisdiction of . district Kangra shall get their staff/employees tested RTPCR negative for COVID-19 before 23 April, 2021 and the Chief Medical Officer and all Block Medical Officers in district Kangra shall ensure necessary arrangements for RTPCR tests with proper adherence to the guidelines of social distancing and COVID-19 safety protocols issued time to time by State and Centre Government and in case of violation the owner of the hotel/home stay shall be prosecuted under the appropriate provisions of the law and the hotel shall be sealed for fourteen days; vi. All Sub Divisional Magistrates or Temple Officers of government owned temples within the jurisdiction of district Kangra shall get all employees of concerned government owned temples tested RTPCR negative for COVID-19 before 23 April, 2021 and the Chief Medical Officer and all Block Medical Officers in district Kangra shall ensure necessary arrangements for RTPCR tests with proper adherence to the guidelines of social distancing and COVID-19 safety protocols issued time to time by State and Centre Government, Soclal/ Entertainment/Cultural/Religious/Political/Marreges/Funerals and other Congregations

i. All social/entertainment/sports/academic/cultural/religious/political and other congregations shall be completely prohibited within the jurisdiction of district Kangra and that too with a strict compliance with the conditions of gatherings/congregations stated in order No. 656-81 dated 22na March, 2021 issued by the undersigned with persons not exceeding fifty indoor or outdoor in permitted gathering i.e. in marriages and funerals; ii. All Sub Divisional Magistrates shall constitute flying squads to raid/monitor adherence to the COVID-19 safety protocols/directions/guidelines issued time to by Centre or State governments and district authorities to be followed in marriages and take action under appropriate provisions of law and share daily reports with district authority;

Others

i. All Sub Divisional Magistrates in coordination with concerned Executive Magistrates/Block Development Officers/Food inspectors/ NGOs/Local Community or any other officer/official/person under their jurisdiction shall ensure to provide ration to migrant labourers/persons in case of requirement of the same; ii. Sub Divisional Magistrate, Palampur shall coordinate with the management of Radha Swami Satsang Bhawan, Praour and notify the same as an isolation centre and ensure proper arrangement for stay, food, water , sanitation, safety, security, health and any other required in isolation centre Exempted category

1. All goods carriage vehicles for the purpose of carrying / delivering goods and returning back/ dead vans / ambulance. 2. Shops dealing with items of daily need such as firuits, vegetables, milk & milk products, Pharmacies etc. 3. Government/ Private hospitals/ Pharmaceutical and health related manufacturing units/ their ancillaries together with transportation related activities/ food processing units. 4. Persons visiting hospitals for medical emergency. 5. Petrol pumps, LPG Gas stations, oil agencies their godowns and their transportation

related activities. 6. Police, Military. Para military forces and other security forces which are under the control of state or central government. 7. Tourists and persons visiting for the purpose of business.

8. Onsite construction activities. 9. Officials of Health and Ayush Department including persons working in private health establishment, while on duty.

10. Govt. Officers/©fficials/ persons on emergency duties. 11. Government or Semi-Government employees on duty pertaining fo mitigation of COVID-

19 as certified by concerned Sub- Divisional Magistrate. 12. Officials involved in supply of electricity, water, municipal and essential services while on duty. 13. Restaurants/ dhabas/ eateries/hotels with strict compliance of SOPs issued by Department

of Tourism.

14. Accredited print and electronic media correspondents and persons and vehicles involved

in supply chain of newspaper. 15. Inter-State and Intra-State Stage Carriage Passenger vehicles in-transit with strict Compliance with the orders/SOPs issued time to time by Himachal Pradesh Government regarding COVID-19. 16. Any person with confirmed train or Bus ticket. 17. Any marriage ceremony where movement of person is unavoidable during the restriction hours, subject to verification. 18.Telecom operators and their designated agencies. 19. Loading and unloading of ration at FCI and State Food Depots. 20. ATMs 21. Workers performing mortuary funeral, cremation, burial, cemetery and related services including funeral homes, crematoriums, cemeteries and coffin makers.

The compliance of this order shall be ensured by the Superintendent of Police, Kangra, all the Sub-Divisional Magistrates, Head of Departments, Executive Magistrates, Block Development Officers, PRIs, and Members of ULBs in . Violation of the order shall attract provisions of sections 188, 269 and 270 IPC and the violator shall be prosecuted accordingly.

THIS order shall come into force with immediate effect in the entire territorial jurisdiction of Kangra district and shall remain valid till further orders. ISSUED under my hand and seal of the office on this 20" Day of April,2021
