The Person County Board of Commissioners will meet in recessed session on Monday, May 6, 2013 at 6:00 pm in the Commissioners’ meeting room 215 at the County Office Building. The purpose of the meeting will be for closed session discussion jointly with the City of Roxboro of matters relating to the location or expansion of industries or other businesses in the county per General Statute 143-318.11(a)(4).

The Board of Commissioners for the County of Person, North Carolina, met in regular session on Monday, April 1, 2013 at 7:00 pm in the Commissioners’ meeting room in the Person County Office Building.

Chairman Clayton called the meeting to order, led invocation and asked Vice Chairman Jeffers to lead the Pledge of Allegiance.

DISCUSSION/ADJUSTMENT/APPROVAL OF AGENDA:

A motion was made by Vice Chairman Jeffers, and carried 5-0 to add the following items to the agenda for consideration:

• a Resolution to maintain and support the current integrity and funding for the Parks and Recreation Trust Fund (PARTF); and a

• Discussion and consideration for appointments to fill the two resigned alternate seats on the Board of Equalization and Review.

A motion was made by Commissioner Blalock, and carried 5-0 to approve the agenda as adjusted including the following two Closed Sessions:

• A Closed Session per General Statute 143-318, 11(a)(5) to consider the acquisition or lease of real property; and

• A Closed Session per General Statute 143-318.11(a)(2) for the purpose to consult with the county attorney in order to preserve the attorney-client privilege.

INFORMAL COMMENTS: There were no comments from the public.

APPROVAL OF MINUTES: A motion was made by Vice Chairman Jeffers, and carried 5-0 to approve the minutes of March 11, 2013.

April 1, 2013 1 4 OLD BUSINESS:

DISCUSSION OF ZONING ORDINANCE PERTAINING TO NONCONFORMING USES AND ACCESSORY USES: Assistant County Manager, Sybil Tate and Planning Director, Paula Murphy guided the Board’s discussion in further review of sections 101-2, 102-1, 60-5 and 60-6 of the current Zoning Ordinance. Ms. Tate reminded the Board a public hearing on the recommended changes was conducted at the Commissioners’ January 7, 2013 meeting.

Non-conforming

Existing: 101-2 No building may be extended or enlarged or the amount of land devoted to a use increased unless such extensions or enlargements comply with all the provisions of this ordinance.

Planning Board Proposed 101-2: Any structure existing at the time of adoption of this Ordinance which does not comply with setback or yard requirements, or which exceeds height requirements, may be continued in use but shall not be enlarged or extended unless such extensions or enlargements comply with all the provisions of this ordinance. No unenclosed portion of a building may be enclosed if the setback or height requirements are not met.

Ms. Tate stated the intent of this proposed section is to “grandfather-in” existing non-conforming structures, provided that no additional changes are made. Ms. Murphy explained property line setback requirements. Ms. Murphy confirmed that residents can request a variance from the Board of Adjustment for non-conforming uses.

It was the consensus of the Board that the Planning Board Proposed 101-2 is acceptable for amendment to the Zoning Ordinance.

Existing: 102-1 Nothing in this ordinance shall prevent the restoring or strengthening of a nonconforming structure to a safe condition, provided that the square feet of the structure shall not be increased.

Ms. Tate stated there were no changes recommended by the Planning Board to this section. The intent of this section is to allow individuals to improve non-conforming structures for safety reasons, but not increase their size.

It was the consensus of the Board that section 101-2 is acceptable as currently written in the Zoning Ordinance.

April 1, 2013 2 5 Accessory Structures

Existing: 60-5 Unless otherwise specified in this ordinance, accessory buildings may be allowed within five feet of rear and side yard lot lines provided they are five feet or more from the main structure.

Planning Board Proposed 60-5: Accessory structures shall be located at least five feet from any principal structure and side and rear property lines.

The intent of this section is to ensure that accessory structures are at least five feet from property lines and the main structure. Five feet allows for mowing and maintenance of buildings.

Commissioner Puryear stated agreement for accessory structures to be at least five feet from property lines but disagreed with restrictions for accessory structures related to the main structure and in the side and rear yards. Commissioner Puryear noted many county residents are out of compliance and inquired about striking this section from the Zoning Ordinance in its entirety.

Commissioner Puryear suggested the text amendment for section 60-5 to read as follows: Accessory structures shall be located no less than five feet from the property lines.

County Attorney, Ron Aycock confirmed if the text amendment(s) are approved by the Board of Commissioner, the amendments would apply to future development only (not applicable to existing structures).

Ms. Murphy stated the zoning requirements would be applied to permanent and mobile structures to the same standard.

It was the consensus of the Board that section 60-5 is amended in the Zoning Ordinance as follows: Accessory structures shall be located no less than five feet from the property lines.

Existing: 60-6 Unless otherwise specified in this ordinance, every principal building hereafter erected or moved shall be located on a separate lot and in no case shall there be more than one principal building and three permitted accessory buildings on all lots under three acres. There shall be allowed one additional accessory building for every acre over three acres. Industrial operations located in the GI district shall be exempted from this provision.

April 1, 2013 3 6 Ms. Tate and Ms. Murphy confirmed there was not a recommendation from the Planning Board for amendment to section 60-6.

Vice Chairman Jeffers asked if county staff has spoken with Lowes, Talberts, i.e., vendors that sell accessory buildings to see if they inform buyers that a permit is required. Ms. Murphy stated staff have not talked with Lowes but could take a letter out to them noting they have told other vendors that sell the unenclosed metal carports and storage buildings that permits are required.

Ms. Murphy confirmed that a well house if not counted as an accessory structure.

Vice Chairman Jeffers stated the Board wanted suggestions on changing this section to which the Planning Board did not recommend any changes nor did they offer any options or compare to other counties. Ms. Murphy stated she could provide the Board with the following data from other entities:

Warren County: allows accessory building in the side and rear yards total sq. footage not to exceed 75% of permit principle use Vance County: allows one accessory building per 20,000 sq. ft. building not to exceed 1,000 sq. ft. one additional accessory building per 20,000 sq. ft. (comparable to two per acre per Ms. Murphy) accessory building size limits City of Roxboro: not more than 20% of the rear yard

Commissioner Blalock asked what the smallest conforming lot size is. Ms. Murphy stated one acre minimum with City water and sewer.

Vice Chairman Jeffers suggested the following amendment changes:

Commissioner Puryear suggested three accessory building per one acre.

Vice Chairman Jeffers stated comparison data with Scotland County, New Hanover County, and other rural counties would have been helpful.

Ms. Tate offered for management staff to take the Board’s feedback to craft a proposed section 60-6.

April 1, 2013 4 7 Chairman Clayton and County Attorney, Ron Aycock confirmed the Board had its public hearing on this matter in January and is not required to have another public hearing unless desired by the Board.

New proposed section: 60-6A: 60-6A - Accessory structures shall be placed in the rear or side yard and not the front yard of all lots under ten acres. Parcels of property containing ten acres or larger may place an accessory building in the front yard provided such building is located at least 50 feet from any street right of way line and a minimum of twenty five feet from any side property line.

Ms. Tate stated the Board’s discussion of this section has been primarily around the size of the lot and asked if the Board would like to keep the lot size at ten acres or reduce it to five acres. Commissioner Newell asked a question related to an existing structure, i.e. barn in the front yard. Ms. Murphy stated zoning could not approve with the structure in the front but what is being done to get around it is a surveyor puts an easement so that the barn or structure is not in the front.

Commissioner Puryear stated what the Board just discussed with section 60-5 eliminating the reference of side and rear yards destroys section 60-6A and questioned why 60-6A was needed. Ms. Murphy stated most zoning areas do not allow buildings in the front yard as a standard zoning practice. Unintended consequences may include visibility issues, aesthetics, lower property values, and more importantly a public safety access issue.

Chairman Clayton suggested adding a clause for a parcel of property containing five acres or larger for an accessory building located in the front yard located fifty feet from the street allowable. Chairman Clayton advocated for existing structures to remain in place.

Mr. Aycock added the language as written … “Parcels of property containing ten acres or larger may place an accessory building in the front yard provided such building is located at least 50 feet from any street right of way line and a minimum of twenty five feet from any side property line” suggest action to put something there as opposed to keeping something there thereby noting the language may already exempt existing structures on the property.

There was a discrepancy to which the agenda abstract stated ten acres and the Planning Board recommendation stated five acres.

Commissioner Puryear stated 60-5 already deals with this issue and suggested striking section 60-6A in its entirety as a proposed amendment.

Chairman Clayton stated he was not in favor of adding accessory buildings to the front yard but in favor or exempting existing structures.

April 1, 2013 5 8 Ms. Tate offered for management staff to take the Board’s feedback and review other counties’ policies related to accessory structures in the front yards and provide suggestions to the proposed section 60-6A.

Commissioner Blalock inquired about construction that does not need a permit and having it written in the ordinance. Ms. Tate stated staff is willing to waive the zoning fee for any project under $200 and intends to make it a part of the fee schedule which is adopted as part of the budget.

Commissioner Puryear asked how many feet is the right of way from a road. Chairman Clayton stated 30 ft. from the road centerline. Ms. Murphy stated the setbacks have changed road types, i.e., 40 ft. setback for dwellings on US and NC Highways and 25 ft. from other roads right of way. Commissioner Puryear suggested the road right of way plus the 50 ft. as proposed in section 60-6A is a bit much. Ms. Murphy stated it could be changed to 5 ft.

It was the consensus of the Board to have management staff bring back a proposal related to the Zoning Ordinance pertaining to nonconforming uses and accessory uses at the Board’s regular scheduled meeting on May 20, 2013.

INTERLOCAL AGREEMENT BETWEEN THE CITY OF ROXBORO AND PERSON COUNTY FOR PLANNING ADMINISTRATION: County Manager, Heidi York stated staff presented the concept of a joint city- county planning department as well as a joint planning commission and board of adjustment at the meeting with the City of Roxboro. The draft Interlocal Agreement was reviewed. Elected officials provided their feedback at that time and agreed to review the final agreement at the March meeting. The revisions to the draft Agreement include adding an effective date of July 1, 2013 and as requested in Section III related to the Board of Adjustment, to change the frequency of their meetings to “The Board of Adjustment shall hold meetings as needed.” The proposed agreement remains cost neutral to both the city and the county and enhances the one-stop shop concept for customer service related to permitting. On March 11, 2013, the Board voted to table action on this item until the Board met in April. Ms. York reminded the Board the Agreement creates a shared administrative body between the City and County governments for a joint Planning Department as well as jointly combines both entities’ Planning Board and the Board of Adjustment listing the terms and number of seats for each entity. Ms. York noted the Agreement before the Board does not address a shared Zoning Ordinance.

Ms. York noted the City Council had tabled action on this item in March to seek feedback from their Planning Board members. Ms. York further noted City Council will be taking up this item on their April 9, 2013 agenda.

April 1, 2013 6 9 Chairman Clayton asked about current county Planning Board members that reside in the City. Ms. York confirmed city residents would be eligible for appointment by the Board of Commissioners.

Vice Chairman Jeffers suggested combining the city and county staffs but not combine the Planning Boards and Boards of Adjustment at this time.

Ms. York stated the Agreement allows for the processes to be in place when the decision was made to proceed with the shared Zoning Ordinance with one joint Planning Board and Board of Adjustment as well as the joint Planning Department.

Vice Chairman Jeffers stated he was not sold on the joint boards at this time.

Commissioner Blalock stated city and county zoning issues are quite different.

Ms. York reminded the Board the Home Builders Association was interested in a Unified Development Ordinance much more so than the Planning administration.

Ms. York stated her recommendation of the Interlocal Agreement before the Board. Ms. York asked the Board’s consideration in implementing in phases: phase one to combine the planning staff with the next phase to combine the advisory boards.

It was the consensus of the Board to request a joint meeting with the City of Roxboro once the County hears back from the City as suggested by Vice Chairman Jeffers.

NEW BUSINESS: THE WEEK OF THE YOUNG CHILD PROCLAMATION: Chairman Clayton read and presented the Week of the Young Child Proclamation to the Board for adoption.

A motion was made by Vice Chairman Jeffers, and carried 5-0 to adopt a Proclamation designating April 14-20, 2013 as the Week of the Young Child.

RECOMMENDED CAPITAL IMPROVEMENT PLAN FOR FISCAL YEAR 2014-2018: County Manager, Heidi York and Finance Director, Amy Wehrenberg presented to the Board the Recommended Capital Improvement Plan (CIP) for Fiscal Year 2014- 2018. Ms. York stated the CIP includes projects costing $50,000 or greater from county departments, PCC and Person County Schools. Ms. York noted the CIP is a planning tool for implementing large, capital projects reflecting the priorities of the Board. Ms. York requested feedback from the Board reminding that one strategy identified at the Board Retreat is not relying on Fund Balance to fund capital projects as much as in the past. Ms. Wehrenberg stated this is the fifth year of implementation on the CIP in that funds are actually dedicated and allocated for the budget year. The remaining four years are for planning purposes only and can change as the capital priorities of the Board changes.

Ms. Wehrenberg told the Board the CIP is basically divided into three sections. The first group of documents includes the Manager’s letter and summary information on completed and ongoing projects. The second section houses the requested and recommended projects for this year’s CIP plan and various associated summaries. And the final section includes an analysis of Person County’s current and proposed debt service and a schedule of the outstanding debt service payments. Ms. Wehrenberg noted criteria for a capital project are that they are non-recurring in nature, and that the total project cost exceeds $50,000. Exceptions to this threshold are the roofing projects which were part of the roofing study. Since many of the roofing projects are done in phases, some of these costs are actually below the $50,000 limit.

Ms. Wehrenberg highlighted the funding schedule on pages 11-13 outlining the projects, the project costs anticipated for funding and the funding sources available during Fiscal Year 2014-2018. Ms. York stated the recommendation for the upcoming fiscal year reduces the Fund Balance appropriation by approximately on half. Ms. Wehrenberg stated the top section, which is the list of revenue sources, includes the local support, or County’s General Fund – Fund Balance Contribution, needed to fund the projects listed in each year. Other sources of funds available include the amount of funds estimated to be leftover in the CIP Project Fund at the end of each fiscal year, cost shares for the Paperless Document Management System from the State’s reimbursement to DSS and the City of Roxboro, a PARTF grant for the proposed Recreation and Senior Center, and debt proceeds from some proposed installment purchase financings including the Recreation and Senior Center, the old Helena School improvements, and multiple roofing projects. The news indicates a reduction in the PARTF grant proceeds is part of the Governor’s current budget proposal, so this is something Person County will have to monitor as the State’s budget develops.

According to the Recommended CIP, the amount of local funding needed by the County to fund the projects listed in the 2013-2014 year is $1,145,685 which is about half of the amount that was required for the current year’s projects due to the Board’s stated desire during the Commissioner’s Retreat to scale back given the current restraints on fund balance and other much-needed initiatives that will likely be part of next year’s budget. Ms. Wehrenberg noted that due to the set-aside of funds in the current year for future projects that were adopted in last year’s CIP, staff estimates $254,545 are available to fund requested projects. Although small in comparison, this certainly helps to reduce the amount needed from local funding. The revenue amount showing for $20,387 represents a dedicated cost share from the City of Roxboro and funding from the State’s reimbursement to DSS for a Paperless Document Management System that will benefit all County departments and particular City functions as well. The efficiencies that this system offers department-wide, along with the indirect labor cost returns make this an attractive project. The PARTF grant listed under the cost share at the top of page 11 is the amount of grant proceeds that have been applied for by the Recreation Department to assist in the construction of the Recreation and Senior Center in the amount of $353,000 netted against the proposed amount of debt proceeds for $5,050,000. If the grant amount

April 1, 2013 9 12 is reduced, Person County would need to adjust the amount of debt proceeds to support this project.

Ms. Wehrenberg stated the total amount of projects recommended for next year is $6,823,617. Almost 75% of this amount includes the debt financing proposed for just over $5M for the projects highlighted in blue. Projects recommended to be funded with this debt include the Huck Sansbury Complex Roof, the Kirby Civic Auditorium’s Roof, the construction and renovation of the new Recreation and Senior Center, and the remaining roof construction and repair for the High School.

Ms. Wehrenberg suggested another item that the Board may want to consider rolling into this financing is the purchase of a building for the merging of Person Industries and the Material Recycling Facility operations. This project is being looked at due to the end of the Recycling Center’s 5 year lease arrangement coming up in the spring of next year. The current lease amount is around $107,000 per year, which is slightly less than a 15 year annual debt service payment given the current low interest rates. Ms. Wehrenberg noted this project is currently listed in the “Projects not Recommended” schedule on page 10 for $2.2 million as this was the estimate to purchase and up fit the current Recycling facility. Ms. Wehrenberg stated other more feasible options have recently surfaced for the merge and relocation of these two facilities that the Board may want to consider at some point.

Ms. Wehrenberg added other projects separate from the financing include the boiler replacement in the County Office Building that continues to be a cost drain due to the numerous repairs that have been required in the current year, the renovation of the cafeteria and adjacent buildings at the Old Helena School for the location of an EMS and Sheriff’s satellite facility to service the higher call volume in the southern part of Person County, contingency funds for the Recreation and Senior Center Project, a campus-wide fire alarm system at PCC, a new roof at the Early Intervention facility, window replacements at Oak Lane Elementary, and the installation of security equipment at all of the Schools. Also included in the budget year are set-asides for $400,000 for future roofing projects. Details of the set-aside projects are included on page 14. Projects in the planning years for FY 2015 through 2018 include more roofing repairs, window replacements, construction of a new Airport hangar, updated elections voting equipment, a proposed financing covering the Old Helena Elementary School and multiple roofing projects, and fire alarm replacements at Northern and Southern Middle Schools.

Ms. Wehrenberg noted the table on page 13 represents the sources of revenue required or available, for any recurring costs, or operating costs, associated with these projects. The Operating Impact Costs portion of the grid included estimated operating costs that will occur if these projects are approved. Ms. Wehrenberg stated typically, the total sources of revenue for recurring costs balance to the total operating impact costs, which are represented by the rows highlighted in green. However, in fiscal year 2016, there is a negative recurring cost figures, indicating more cost savings associated with these projects than operating costs which results solely due to the reduction in the total

April 1, 2013 10 13 debt service of almost $2 million in that year, netting a total operating cost reduction of $1,631,730. Ms. Wehrenberg noted this assumes the two financings currently proposed on the plan in FY 2014 and in FY 2017.

Ms. Wehrenberg explained the County current and future debt service as outlined in a chart on page 18. The current debt projects are listed with a description and borrowing terms for each. Also listed are the outstanding balance and the last year that a debt service payment is required for each project. The largest payoff of debt will occur in Fiscal Year 2016 of the 2008 refinancing for almost $4.7M. Between now and Fiscal Year 2015, over $5.4M of debt will be paid off for 3 out of the 5 projects currently listed. This sharp drop-off of debt prompted an analysis of our current debt capacity, which is included in the next section on page 19. The two ratios that are typically used for measuring debt service levels and the capacity for taking on additional debt are the Debt to Assets Ratio and the Debt Service Ratio. The analysis of each ratio is included and results are displayed in bar graphs on page 19. The overall results show that Person County’s debt to assets ratio has radically declined from 47% in Fiscal Year 2008 to 29% as of 2012. This large pay down of debt coupled with conservative spending in uncertain economic conditions have driven the debt to assets ratio to a much lower level. This low % of debt compared to the assets is an indicator to credit agencies that Person County is not managing or maintaining its assets. Ms. Wehrenberg anticipated that this percentage will begin to increase once the large drop-off of debt occurs in Fiscal Year 2016.

Ms. Wehrenberg noted Person County’s debt service ratio which is a measure of financed obligations is minimally lower than its population group and state-wide counties. The maximum benchmark for a debt service ratio is typically 15%. Person County’s ratio was calculated to be 9% for Fiscal Year 2012. It is anticipated that this percentage will begin to decline unless new debt is issued or overall expenditures are reduced. If this percentage is too high or too low, it is another indicator that Person County is not managing financial resources in relation to the amount that is available for other services.

Ms. Wehrenberg spoke to the detail of the proposed financings in the CIP plan. The offering of historically low interest rates makes borrowing funds a valid and cost- effective option. Given the large debt reduction in Fiscal Year 2016, it would be prudent to consider taking on new debt for costly projects that the Board deems worthy of completing over the next five years.

Ms. Wehrenberg added that the interest rate environment is on the precipice of changing at any time, and when it does, rates are inevitably going up. Ms. Wehrenberg noted that since the CIP was prepared banks are holding more to 15 year terms versus the 20 year terms which would mean that Person County would need to reevaluate the debt service payments on any new debt pursued by the Board for financing capital projects in the next fiscal year.

April 1, 2013 34 37 Vice Chairman Jeffers inquired about a project not recommended and requested the costs of upgrading the equipment for the metal shop related to the Public Schools request for the classroom conversion at Person High School.

Vice Chairman Jeffers asked Ms. Wehrenberg if she knew about the USDA Rural Development quarterly fixed rate loans with a 20 year term. Ms. Wehrenberg stated she did not have any knowledge of that type of loan but would be interested in learning.

Ms. York stated the CIP is scheduled to be adopted at the Board’s meeting on April 29, 2013 and suggested if the Board so desired, an additional work session to discuss the CIP again, could be held on April 15, 2013 at 4:00 pm prior to the joint meeting with the School Board at 6:00 pm.

It was the consensus of the Board to not hold an additional work session to further discuss the CIP.

Commissioners Newell and Puryear both stated opposition to the CIP due to inclusion of the Recreation and Senior Center project.

CDBG MONTHLY REPORTING: County Manager, Heidi York presented to the Board the CDBG monthly activities report for March 2013 and a Monthly Performance Status Report for April 2013 that is due to be submitted to the Division of Community Assistance.

A motion was made by Vice Chairman Jeffers, and carried 5-0 to accept the monthly report as presented.

April 1, 2013 36 39 A RESOLUTION TO MAINTAIN AND SUPPORT THE CURRENT INTEGRITY AND FUNDING FOR THE PARKS AND RECREATION TRUST FUND (PARTF): Recreation, Arts and Parks Director, John Hill informed the Board that the Governor’s proposed budget removes the dedicated funding source for PARTF impacting the ability to fund local government PARTF grants this year and in the future.

Mr. Hill stated in Fiscal Year 2010, Person County received $327,500 from PARTF to support the construction of Person County’s Mayo Lake facility. Mr. Hill noted Person County has applied for $353,000 in PARTF funding for Fiscal Year 2014 to be used toward the new Senior Center/Recreational Center as well as anticipated applying for an additional $500,000 from PARTF for Fiscal Year 2015 to also be used toward the Senior Center/Recreational Center.

Mr. Hill requested Board approval of the proposed resolution which is intended to encourage the General Assembly to restore the funding source in order to maintain dedicated funding for PARTF now and in the future.

A motion was made by Vice Chairman Jeffers, and carried 3-2 to support a Resolution to maintain and support the current integrity and funding for the Parks and Recreation Trust Fund. Chairman Clayton, Vice Chairman Jeffers and Commissioner Blalock voted in favor of the motion to support. Commissioners Puryear and Newell voted in opposition of the Resolution due to the Senior Center/Recreational Center project as a designated recipient of funds.

April 1, 2013 39 42 DISCUSSION AND CONSIDERATION FOR APPOINTMENTS TO FILL THE TWO RESIGNED ALTERNATE SEATS ON THE BOARD OF EQUALIZATION AND REVIEW: Chairman Clayton requested Board consideration of Vice Chairman Ray Jeffers who had volunteered to serve as well as Commissioner Blalock’s nominee of citizen, Faye Boyd to be appointed to the Board of Equalization and Review’s alternate seats to fulfill the terms of the unexpired terms of Edwin Knott and Leigh Woodall.

A motion was made by Commissioner Puryear, and carried 5-0 to appoint Vice Chairman Ray Jeffers and citizen, Faye Boyd to be appointed to the Board of Equalization and Review’s alternate seats to fulfill the terms of the unexpired terms of Edwin Knott and Leigh Woodall.

CHAIRMAN’S REPORT: Chairman Clayton updated the Board on a legal issue with Cardinal Innovations related to their mental health board members’ loyalty oath. County Attorney, Ron Aycock explained the Cardinal Innovations’ loyalty oath requires its board members to have a higher degree of loyalty to the Cardinal Innovations organization over the commissioners’ responsibility to their county.

Chairman Clayton added that commissioners have refused to sign the loyalty oath which resulted in Cardinal Innovations refusing to seat Commissioner Dorosin, representative for Orange, Person and Chatham counties to the board. Mr. Aycock added that Cardinal Innovations also feels Commissioner Dorosin who is an attorney representing a client in a case with another county for an unrelated health issue has a conflict of interest thereby giving another reason not to seat. Mr. Aycock stated he has conferred with the county attorneys representing Orange and Chatham counties and their recommendation is for each county attorney to submit letters to Cardinal Innovations with a copy to the Attorney General disagreeing with the position taken.

Commissioner Newell suggested withholding the local IPRS $300,000 funds as leverage. Chairman Clayton noted his preference to start with the county attorney letters to Cardinal Innovations as the first step. It was the consensus of the Board to proceed with the County Attorney to submit a letter to Cardinal Innovations on behalf of Person County.

MANAGER’S REPORT: County Manager, Heidi York highlighted an email sent to Board members earlier in the day from the General Assembly’s Bill Drafting Division determining the local bill request to Representative Wilkins to tag onto House Bill 200 for Mecklenburg would not work for Person County due to revaluation year and that the method was determined sound with an appeal process forthcoming.

April 1, 2013 40 43 Ms. York reminded the Board their next meeting is scheduled for 6:00 pm on April 15, 2013 for a joint meeting with the Board of Education in the County Auditorium. Ms. York noted the Board of Education would be presenting their budget request to the Board of Commissioners.

Ms. York stated a Community Conversations meeting is scheduled for April 29, 2013 at 6:30 pm to be held at the Bushy Fork Grange Hall. Ms. York stated the Capital Improvement Plan (CIP) is scheduled to be adopted on April 29, 2013 at the Community Conversations meeting.

Chairman Clayton added a comment related to a ribbon cutting scheduled for April 3, 2013 at 10:00 am at a new barber shop located in the former Pete’s Sandwich Shop location.

COMMISSIONER REPORT/COMMENTS: Commissioner Newell had no report or comments.

Commissioner Blalock stated a recent complaint from a citizen related to the number of junk cars, tractors, containers, etc. are allowed on a residential property and requested the Board address such in the near future. County Manager, Heidi York stated she would bring back a proposal for screening beyond unregistered vehicles for consideration. Vice Chairman Jeffers commented the Board had last discussed pursuing other options for enforcement of such.

Commissioner Puryear asked the County Attorney when a resolution could be reconsidered by the Board of Commissioners. County Attorney, Ron Aycock stated a resolution could be reconsidered by the Board of Commissioners at any subsequent meeting unless there is a motion to lay the issue on the table in which there is a sixty-day waiting period. Related to House Bill 200, Mr. Aycock commented there is a constitutional provision requiring all laws related to property tax to be uniform throughout the state. Mr. Aycock further noted the General Assembly could not enact a bill specific only to a single county pertaining to property tax.

Commissioner Blalock requested a summary of actions taken by the Board of Equalization and Review. Tax Administrator, Russell Jones confirmed a collective summary including a list of properties appealed with any such changes or no change in value would be provided to the Board of Commissioners.

Vice Chairman Jeffers relayed appreciation from the Woodsdale Volunteer Fire Department for continued local support of funding into the next fiscal year as well as stated the success of increasing the occupancy and sales tax through his involvement with a recent Dog Show in Person County noting over 130 entries and participation for the three-day event.

The Board of Commissioners for the County of Person, North Carolina, met in recessed session on Monday, April 15, 2013 at 6:00 pm for the purpose of a special joint meeting with the Board of Education in the County Auditorium.

In attendance representing Person County was Chairman Clayton, Vice Chairman Jeffers and Commissioners Blalock and Newell. County Manager, Heidi York, Finance Director, Amy Wehrenberg and Clerk to the Board, Brenda Reaves were also present. Commissioner Puryear was absent.

In attendance representing the Board of Education was School Board Chairman, Gordon Powell, Vice-Chairman Margaret Bradsher and members Jimmy Wilkins, Freda Tillman and Jennifer Kafer. Superintendent, Dr. Larry Cartner, Executive Assistant and Clerk, Teresa Shotwell, Finance Officer, Kim McVey, and Executive Director for Human Resources & Operations, Dan Holloman were also present.

Chairman Clayton called the meeting to order, welcomed the group and led the group in a moment of silence and prayer for those affected by the Boston bombings.

OVERVIEW OF THE PERSON COUNTY SCHOOLS’ BUDGET REQUEST: School Board Chairman Powell stated the two governing boards have very different charges but the common ground centers around the county’s children which provide an opportunity to discuss mutual goals and needs within the school system.

Dr. Larry Cartner, Superintendent for Person County Schools stated the Board of Education’s priorities are 1) school safety and will support the Sheriff’s request for additional School Resource Officers (SROs), 2) increase employee supplements as no increase has been given since 2006 and approximately $1,000,000 in reductions have been made in the local budget prior to current draft.

Dr. Cartner stated 2013-2014 budget considerations included a 5% decrease in personnel due to the federal sequestration, a loss of $276,000 in state allotment and a request of local funding to increase by 4.5%. Dr. Cartner based the funding levels on an ADM of 4,739 students noting a possible discretionary reversion may be required.

April 15, 2013 1 46 Dr. Cartner noted the charter school growth included eleven new schools with one of these a virtual in Durham County, two new schools in Orange County and two new schools in Granville. Dr. Cartner reminded the Board of Commissioners that the per pupil allotment follows the Person County student to the charter school that is attended whether in or out of the county.

Dr. Cartner, Finance Officer, Kim McVey, and Executive Director for Human Resources & Operations, Dan Holloman presented the Board of Commissioners with the Schools’ 2013-2014 $9,658,310 budget request which represented a 4.5% or $415,966 increase over the current fiscal year funding level. The proposed increase was noted to be used in the following areas:

Personnel +195,864 Projected benefit increases, overtime for teacher assistants plus two additional technology positions Instruction + 45,000 Common Core initiative supplies Technology + 19,500 1:1 initiative hardware/software Operations +46,294 Projected increases in worker’s comp, unemployment & property/bond insurance and public utilities +99,600 Projected increase in charter school payments Maintenance + 5,500 Projected increase with utilities Custodial + 4,108 Projected increase with contract supplies NC Wise +100 Workshops

The budget request did not include the certified and non-certified supplement increase, the additional SROs or the $1,001,900 for all capital and lottery projects.

Vice Chairman Jeffers asked Ms. McVey the balance of the schools’ fund balance. Ms. McVey reported the undesignated portion of the Fund Balance is at $791,000 as per their June 12, 2012 audit representing approximately 7-8% of their budget. County Manager, Heidi York commented that school districts across the state will typically retain up to 10% in their fund balance. Ms. York and Ms. McVey confirmed all monies in the schools’ fund balance represent local funding. Dr. Cartner added that teacher’s laptops will be replaced using a fund balance allocation split between this year and next year.

Commissioner Newell questioned the charter school settlement in FY2011-2012 which depleted $800,000 from the schools’ fund balance. School Board Chairman Powell stated the $800,000 appropriation from fund balance was a result of the Sugar Creek legal settlement and the annual allotment totaled $2,286,543. School Board Chairman Powell noted an unsettled amount remains with the legal case.

April 15, 2013 2 47 School Board Member Kafer stated the $99,600 in additional charter school payments reflected 71 students at a $1,400 per pupil rate.

Dr. Cartner and School Board Chairman Powell estimated 1,000 Person County students currently attend Roxboro Community School and Bethel Hill Charter School with 25 or less attending charter schools outside of Person County.

Commissioner Newell requested the School Board and staff provide a copy of the Central Office budget that was not included in the budget presentation. Dr. Cartner stated he would send along the requested data and told the group that local funding of the Central Office budget included two director positions, clerical positions, part of the Superintendent salary and maintenance positions.

Vice Chairman Jeffers asked why fund balance was not used for capital needs. School Board Member Wilkins stated they decided not to use fund balance so to retain at least one month of operating.

Vice Chairman Jeffers asked why the proposed supplement was not included in the budget request. School Board Member Wilkins stated the budget request represented what was a necessity to run the schools noting it would be wonderful if the Board of Commissioners would fund an increase for the school employees. School Board Chairman Powell added the supplement increase for certified employees and a first-time supplement for non-certified employees was requested as a way to retain good employees in Person County. Mr. Holloman commented the average turnover at Person County Schools is at approximately 17% mostly due to retirements noting some teachers will be enticed to leave for a higher supplement in another county. Mr. Holloman stated the average teacher salary package for 0-5 years is approximately $38,000.

Commissioner Blalock asked if all furniture had been removed from the old Helena site noting there was furniture needs at Northern Middle School. Dr. Cartner stated all usable furniture had been removed from the old Helena site.

Mr. Holloman stated no school buses were due to be replaced however; the capital needs list has two aging activity buses that have many miles for replacement.

April 15, 2013 3 48 OVERVIEW OF CAPITAL PROJECTS FUNDING: County Manager Heidi York gave the group an overview of the Person County Capital Improvement Plan 2014-2018 that will be before the Board of Commissioners for adoption at their April 29, 2013 meeting. In particular, Ms. York gave the group an updated of the status of ongoing projects for FY2013 for the Public Schools as follows:

• Exterior wall waterproofing at PHS ($250,000) – The waterproofing is 10% complete and will be finished during the summer of 2013. • Paving at Person High and Southern Middle ($150,000) – Expected completion is summer of 2013. • North End Elementary roofing ($577,646) – Bids will be received in April 2013. • Replacement of cooling tower at Person High ($60,000) – Bids have been received and are higher than expected. • Paving tracks at Person High and Southern Middle School ($200,000) – Expected completion is summer of 2013. • Southern Middle and Person High School roofing ($3,082,538) – Southern Middle School roofing is over 50% complete and should be completed by May 2013. Person High School roofing has not started, but is expected to be complete in fall of 2013. The re-roofing costs for these two schools were funded with loan proceeds, and include a 100% federal interest credit through an approved Qualified School Construction Bond (QSCB).

Ms. York announced to the group that a potential Golden Leaf grant to help fund the school’s laptop program in the amount of $200,000 looked promising.

Ms. York stated she was recommending set aside funds in the budget in the amount of $14,000 to develop a grant program through which schools could earn additional resources by increasing recycling.

Vice Chairman Jeffers asked if the future lottery funds could be used for school debt. Dr. Cartner stated lottery funds are requested as a part of the budget package under 2013-20014 Capital Requests at $305,000.

Ms. York confirmed the Person County School’s request for school security equipment in the amount of $99,122 was included in next year’s CIP to be fully funded and available in July based on Board approval.

The group discussed the request for placing additional SROs in the schools to which Sheriff Dewey Jones made comments. Ms. York stated the additional SRO positions are not in the schools’ request as the positions would be added to the Sheriff’s personnel budget. Ms. York added the schools are currently funding ten months’ salary and benefits for two of the six SROs. Sheriff Jones stated there is one SRO at each of the middle schools and three at Person High School and a DARE/GREAT officer dedicated to programming at all the elementary schools. Sheriff Jones stated he would need eight additional officers to place one at each school in the district noting if four additional officers were dedicated, then each would split time between two schools. Sheriff Jones explained the specialized training required for a SRO to interact with school personnel and students requiring a seasoned officer.

Commissioner Blalock stated consideration that issues may arise on the school bus; School Board Vice Chairman Bradsher stated any large group activity at school or the community could be at risk of an emergency situation.

School Board Chairman Powell suggested a Task Force, consisting of all involved from law enforcement to school personnel, be created to prepare for a potential emergency situation. Sheriff Jones stated the Local Emergency Planning Committee (LEPC) has been revamped to plan for such situations noting group training would be of benefit to all county partners. Ms. York stated she would forward a meeting schedule to the School Board Chairman.

Commissioner Blalock inquired if the school facilities had opportunities for additional revenue for other related activities. School Board Vice Chairman Bradsher stated the facilities are being used all seasons for school related activities.

April 15, 2013 7 52 Dr. Cartner told the group the Alternative School construction is 70% complete with the move planned during the summer. Dr. Cartner noted the Alternative School has one director position, four teachers and two assistants on staff and serves an average of 30 to 50 students daily with a capacity of 80 students.

Agenda Title: Interlocal Agreement between the City of Roxboro and Person County for Planning Administration

Summary of Information: At the Board of Commissioners’ April 1st Board meeting, the draft Interlocal Agreement with the City of Roxboro for joint planning administration as well as combining the appointed boards was discussed. The Board of Commissioners was not in favor of combining planning boards at this time. The City Council of Roxboro also received the Agreement and shared the consensus of the Board to not combine the planning boards at this time. They directed the City Manager to move forward on combining the departmental staffs and to begin working towards the development of a Unified Development Ordinance for the City and County. The Interlocal Agreement has been redrafted to reflect these changes and is back before the Board of Commissioners for consideration and discussion. In addition, Michael Ciriello, Planning Director for the Kerr-Tar Regional Council of Governments, is available to answer any questions related to a Unified Development Ordinance and the process that lies ahead for the City and the County.

Recommended Action: Review the draft agreement and adopt if appropriate.

Interlocal Cooperation Agreement Between Person County and the City of Roxboro for Planning Administration

This is an Interlocal Cooperation Agreement between the CITY OF ROXBORO (hereinafter called “the CITY”), a North Carolina municipal corporation, and the COUNTY OF PERSON (hereinafter called “the COUNTY”), a political subdivision of the State of North Carolina. This agreement is made pursuant to Article 20 of Chapter 160A of the North Carolina General Statutes.

The City and County agree as follows:

SECTION I. POLICY

A. The Governing Bodies hereby find and declare that interlocal cooperation for comprehensive planning and plan implementation is a necessity: Such planning allows for more orderly and coordinated growth, provides a mechanism for consistent analysis of planning issues across political boundaries and therefore gives a more sound basis for policy decisions which affect both political entities. The Governing Bodies recognize that comprehensive planning and its implementation are vital to the public interest. Therefore, it is found that such activities as planning investigations and surveys, formulation of development goals and objectives, and development or means to carry out plans in a cooperative, coordinated and efficient manner are necessary in order that the two governments may more competently perform their duties, and in order that the citizens of the respective jurisdictions may have a better understanding of planning issues and be better able to participate in decision-making.

B. The purpose of this Agreement is to establish a joint planning endeavor and to provide for the organization and administration necessary to effectuate that endeavor. The joint endeavor shall consist of a joint Planning Department and Unified Development Ordinance. The organizations of City and County Planning Commissions and Board of Adjustments shall not be affected by this agreement.

SECTION II. ADMINISTRATION

A. Establishment of Person-Roxboro Planning Department. There is hereby established the Person-Roxboro Planning Department, which shall consist of joint Director and such subordinate employees as may be funded in the Annual Budget. The Planning Department is designated as the administrative body for performing the professional planning functions and providing information, reports, and recommendations to the City and County Planning Commissions, City and County Managers and governing bodies.

B. Responsibility of Department/Selection of Director/Responsibilities. The Planning Department shall provide such management, regulatory, administrative, and support services as are required or provided for under an approved work program and Annual Budget.

1 75 1. Director. The administrative head of the Planning Department shall be the Planning Director. The process for the appointment, evaluation and termination of the Planning Director shall be as follows:

a. Appointment of the Planning Director. The City Manager and the County Manager, acting in concert, shall appoint the Planning Director.

b. Evaluation and Supervision of Director. The City and County Managers shall meet at least annually with the Director to evaluate the performance of the Director.

c. Termination of Director. The Planning Director may be terminated by the City Manager and County Manager, acting in concert.

2. Duties of Director. Pursuant to and consistent with City and County Planning Documents, City evaluation system, annual budgets, the Planning Director shall perform the following duties:

a. Appoint, reappoint, assign and reassign all subordinate employees of the Agency and prescribe their duties;

b. Coordinate the activities of the Agency in its functions with other local, State and Federal agencies;

c. Represent the Planning Department, City and County Planning Commissions, City or County Manager, or governing bodies, before any agency or local government, the State, any other State or the United States with respect to:

i. Functions, analysis or recommendations of the Planning Department;

ii. Adopted policies of either Planning Commission or Governing Bodies;

iii. Other matters as may be directed to the Planning Director from time to time by the City or County Managers, or the Governing Bodies.

d. Prepare and submit to the City and County Managers the Department’s Annual Budget for each governmental entity. The Planning Director will prepare revisions to the annual Budget, as needed for subsequent action by the City and/or County Manager(s) or the Council or Board, as may be required.

e. Perform professional planning duties as administrative head of the Planning Department, including but not limited to the following:

i. Meet with City and County officials and discuss planning issues, including the development of capital improvement and infrastructure plans, and the development of policy options in response to those issues;

ii. Meet and discuss with City and County departments and other public agencies or private groups planning programs in process, under consideration, or established as community objectives. 2 76

iii. Meet and consult with individuals and groups affected by planning issues, programs, and activities, in order to encourage citizen participation in the planning process;

iv. Advise the City and County Managers concerning planning issues and activities of City or County government, which have planning implications;

v. Provide management, leadership, and oversight for all planning and implementation activities of the Planning Department;

vi. Facilitate the understanding of planning issues and processes by the City and County Planning Commissions, City and County governmental agencies, and general public.

vii. Perform such other duties as may be prescribed by the governing bodies or City or County Managers, or which may be required to carry out the terms of this Agreement

f. Regularly advise the City and County Planning Commissions, City and County Managers and governing bodies concerning the activities and program progress of the Person-Roxboro Planning Department.

C. Applicable Policies and Procedures for Employees

1. Joint Employees. The Planning Department staff shall be considered joint City/County employees.

2. Policies. In order to facilitate administration of the department, the Planning Director shall follow the personnel procedures of the City. The personnel procedures of the County shall be followed by the Planner and Planning Technician positions.

D. The budget and financial procedures of the County shall be followed by the Planning Department.

E. The County shall continue to own and operate the real property where the joint Planning Department is located. If additional property is purchased and subsequently disposed of, the proceeds of the sale of any jointly purchased property shall revert to the City and County in the same proportion as each contributed to the initial purchase of the property.

G. Budget. Beginning with the FY13-14 budget, the Planning Director shall prepare and submit the proposed Annual Budget to the City and County Managers. The total budget for the department will consist of the cumulative total of the City and County budget allocation. The Planning Director will prepare a budget request for the City and County’s budget process to address the specific funding priorities for each entity. Expenditures will be credited to the proper Finance Department for payment processing. The Planning Director will also be responsible for coordinating the City and County Managers on any budgetary concerns that may arise. The City and County Managers will meet to discuss the department’s budget as needed to address any concerns or future goals.

H. Method of Funding; Reimbursement of Budget Expenses

3 77 1. The expenses of the departmental salaries shall be apportioned as follows: • Planning Director – 70% from City funds/30% from County funds • County Planner – 100% from County funds • Planning Technician – 50% from City funds/50% from County funds

2. The Planning Director’s salary shall be paid by the City. The County Planner and Planning Technician’s salaries shall be paid by the County. These expenses shall be apportioned as stated in item 1 of this section. It is the understanding of all parties that the apportioned salaries for the department as outlined in item 1 of this section are cost neutral to both parties. The Finance Directors for the City and County will review the salaries and allocation percentages in Item 1 annually to verify this continuing neutrality of cost. Should a discrepancy greater than $1,000 annually occur through raises, promotions, reclassification or any other means, the Managers shall review and adjust the budgets or contract accordingly. The only exceptions to this will be through lapsed salaries that occur during the filling of a vacant position.

I. Legal Representation and Liability

The City Attorney’s Office and County Attorney’s Office, respectively, shall provide legal support and representation for the Planning Department and its employees on issues arising from actions taken within and on behalf of their respective jurisdictions and for issues that arise before the various commissions, agencies, and programs that are staffed and directly supported by the Planning Department. Legal support and compensation for claims against Planning Department employees shall be in accordance with the adopted policies and procedures of the respective jurisdiction regarding defense of employees and payment of claims. The City shall be liable for judgments rendered against the City and the County shall be liable for judgments against the County. When both the City and the County are named in any action against the Planning Department and/or an employee or neither jurisdiction is named but the Planning Department itself is named, the jurisdiction on whose behalf the contested action was taken shall be responsible for defense of the claim, consistent with the policies identified above, and, where necessary, shall cooperate in allowing dismissal of the other jurisdiction. In any action, the offices of the City and County Attorney shall only be responsible for representing their respective jurisdictions, and for Department employees acting on behalf of their jurisdictions, as detailed above, and shall not be responsible for representation of the other jurisdiction.

SECTION III. JOINT UNIFIED DEVELOPMENT ORDINANCE

A. The City and County agree to the creation and establishment of a Joint Unified Development Ordinance (UDO) to update existing ordinances, and oversee and coordinate development throughout the County and City. Beginning with the FY13-14 budget cycle, the City and County agree to each fund half of the costs associated with the new Joint UDO. The Planning Director will oversee the UDO process, and provide updates to and seek input from both Boards as necessary. Once the new UDO is completed it will replace the existing Zoning document for each entity.

SECTION IV. GENERAL TERMS OF AGREEMENT

A. This Agreement may be amended from time to time upon mutual consent of the Governing Bodies expressed in writing. The Governing Bodies shall review this Agreement at least once every three (3) years.

4 78 B. It is the intent of the City and County under this Agreement for the City to exercise no planning or zoning authority within an Extraterritorial Area (ETA). C. Either the City or County may terminate this Agreement for any reason as follows: 1. Termination: This Agreement can only be terminated as of the beginning of any fiscal year, except as provided under paragraph 2, below. Notice to terminate must be given in writing to the other party on or before January 1 immediately preceding the proposed July 1 termination date. 2. This Agreement may also be terminated by either party upon thirty (30) days prior written notice to the other party in the event the City and County are unable to agree upon an Annual Budget. 3. The agreement shall have an effective date of July 1, 2013.

Summary of Information: The Person County Animal Control Advisory Board has been working on a comprehensive revision to the Animal Control Ordinance over the last two years. The first revised version of the Ordinance was presented to the Board of Commissioners in early 2011. Since that time, the Animal Control Advisory Board has been updating their Ordinance to incorporate best practices for enforcement and animal welfare. The Animal Services Director is presenting this updated draft ordinance to the Board for consideration of adoption. Attached please find the proposed revised ordinance and attachments as well as the current ordinance.

PERSON COUNTY ANIMAL SERVICES ORDINANCE

The Person County Board of Commissioners is authorized under the provisions of G.S. 153A-121, 153A-153 and 153A-442 to adopt ordinances.

SECTION 1: DEFINITIONS

As used in this ordinance the following terms mean:

A. Animal Services Officer: A county employee designated as Person County Animal Services Officer, Person County Animal Services official or other designations that may be used whose responsibility includes Person County Animal Services.

B. Owner: Any person, group of persons, firm, partnership or corporation owning, keeping, having charge of, sheltering, feeding, harboring or taking care of any animal. The owner is responsible for the care, actions, and behavior of his animals.

C. Kennel, Dealer, Breeder, or Pet Shop: Any person, group of persons, partnership, or corporation engaged in buying, selling, breeding or boarding pet animals.

D. At Large: Any animal shall be deemed to be at large when he is off the property of his owner and not under control of a competent person.

E. Restraint: An animal is under restraint within the meaning of this ordinance if he is controlled by means of a chain, leash or other like devise; or, is secured within a vehicle being driven or parked; or, is within a secure enclosure.

F. Spayed Female: Any female which has been operated upon to prevent conception.

G. Neutered Male: Any male which has been operated upon to prevent reproduction.

H. Animal Shelter: Any premises designated by the County for the purpose of impounding and caring for animals found running at large or otherwise subject to impoundment in accordance with the provisions of this ordinance.

I. Exposed to Rabies: An animal has been exposed to rabies within the meaning of this ordinance, if it has been bitten by, or been exposed to any animal known or suspected to have been infected with rabies.

J. Potentially Dangerous Dog: A dog that:

1. Inflicted a bite on a person either upon public or private real property

2. Killed or inflicted severe injury upon a domestic animal when not on the owner’s real property.

3. Approached a person when not on the owner’s property in a vicious or terrorizing manner, or an apparent attitude of attack.

K. Dangerous Dog: A dog that:

1. Without provocation has killed or inflicted severe injury on a person; or animal.

2. Is declared vicious by the Director of Person County Animal Services pursuant to N.C.G.S. 130A-200.

3. Is determined by the Director of Person County Animal Services to be dangerous and, after this determination, engages in one or more of the behaviors listed in subsection J of this section.

L. Stray Dog or Cat: Any dog or cat, within the County wandering at large or lost and does not have an owner, or any dog or cat, within the County, whose owner fails to list animal for license purposes, or fails to have said dog or cat vaccinated against rabies by a veterinarian, or any dog or cat not wearing a collar and current rabies tag.

M. Acts Deemed Public Nuisance: An act of public nuisance is defined as any animal that repeatedly chases snaps at, or attacks pedestrians, bicyclists or vehicles and also includes animals that turn over garbage pails, damages gardens flowers or vegetables. Public nuisance includes the owner permitting a female animal to run at large during the estrous stage of reproduction.

N. Rabies Vaccination: the administration of rabies vaccine by a licensed veterinarian or by a certified rabies vaccinator. Rabies vaccines given by a certified rabies vaccinator are only valid for one year. Rabies vaccines given by a veterinarian are valid for one year to three years as determined by State Law.

O. Animal: refers primarily to domestic cats and dogs unless provided for by state law. Domestic livestock is part of the jurisdiction of Person County Animal Services as set out by state law. Ferrets are included for the purpose of rabies vaccines.

P. Proof of Ownership: Can include but is not limited to veterinary records, photos, registration papers, bill of sale, microchip or adoption contract.

SECTION 2: DUTIES OF PERSON COUNTY ANIMAL SERVICES DEPARTMENT:

The State laws regarding the care of animals will be enforced by the Person County Animal Services Department of Person County.

The Person County Animal Services Department shall be further charged with the responsibility of:

A. Enforcing all State or County laws, ordinances and resolutions relating to dogs and cats,

2 82 and the care, custody and control of animals.

B. Aiding the Health Director to insure public safety and assisting in the enforcement of the laws of the State of North Carolina with regard to animals and especially with regard to vaccination of animals against rabies and the confinement or leashing of dangerous and potentially dangerous animals.

C. Investigating animal cruelty, neglect or abuse.

D. Making such canvasses of the county, including the homes in the county, as it deems necessary for the purpose of ascertaining that all dogs, cats and ferrets are vaccinated against rabies.

E. Operating, pursuant to policies of the Board of County Commissioners;

F. Maintaining a reference file of rabies vaccination all in accordance with the provisions of this ordinance and the policies of the Board of County Commissioners.

SECTION 3: DOGS, CATS AND FERRETS MUST WEAR COLLAR AND RABIES TAG

A. It shall be unlawful for any dog, cat or ferret owner to fail to comply with the State laws relating to the control of rabies. It shall be unlawful for any dog, cat or ferret owner to fail to provide any dog, cat or ferret he or she owns with a suitable collar or harness for the wearing of the rabies tag to be issued upon vaccination.

B. The rabies tag is to be worn by said dog or cat at all times except as otherwise provided by State Law. Exceptions include but are not limited to performing at shows, obedience trials, tracking tests, field trials, training schools or other events sanctioned and supervised by a recognized organization. Proof of rabies must be presented upon request of the Person County Animal Services Officer as required by the NC G.S. 130A-192.

C. Unless proof of rabies vaccination is available, it shall be the duty of the Person County Animal Services staff to insure that any redeemed animal over the age of four months is vaccinated against rabies at the owner’s expense before release and that a record be maintained of the vaccination.

D. A dog, cat or ferret is subject to impoundment in accordance with the provisions of this ordinance if it is not wearing a current rabies tag or if the owner cannot furnish evidence of vaccination.

E. It shall be unlawful for any person to use for any animal a rabies vaccination tag not issued for that animal.

F. It is recommended that animals be micro-chipped in the event that the collar and tags are lost for identification purposes.

3 83 G. It is the purpose of this ordinance to supplement the State law by providing a procedure for the enforcement of State laws relating to rabies control.

SECTION 4: POSSESSION OF DOGS OR CATS

It shall be unlawful for any person knowingly to harbor, feed, or keep in his possession, by confinement or otherwise, any dog or cat that does not belong to him unless he has:

A. The consent of the owner or custodian of the dog or cat.

B. If a dog or cat is not wearing tags, or other mode of identification indicating its owner, and is delivered to an animal shelter by;

1. A person who has found and captured the dog or cat.

2. By an approved rescue organization that received the dog or cat from a person who found and captured the dog or cat.

3. The Person County Animal Services’ shelter may, in writing, appoint the finder or approved rescue organization to be the agent of the Person County Person County Animal Services’ shelter.

4. For purposes of this subsection, the term “approved rescue organization” means a nonprofit corporation or association that cares for stray animals that has been favorably assessed by the Director of Person County Animal Services through the application of written standards.

a. The finder or approved rescue organization shall hold the dog or cat for the 72-hour holding period.

b. After the expiration of the applicable holding period, the shelter may:

1) Transfer the dog or cat to the person or organization that has held it as agent. 2) Extend the period of time the finder or rescue organization holds the dog or cat as agent of the shelter.

c. The privilege to act as an agent for the shelter may be revoked during the holding period at any time by directing the finder or rescue organization to deliver the animal to the shelter.

d. The city, county, or organization operating the animal shelter, as principal in the agency relationship, shall not be liable to reimburse the agent for the costs of care of the animal and shall not be liable to the owner of the animal for harm to the animal caused by the agent.

4 84 e. During the 72-hour or longer holding period established an animal shelter may place an animal it is holding in foster care.

f. If the Person County Animal Services’ shelter transfers physical possession of an animal under subsections of this section a photograph which depicts the head and face of the animal shall be displayed at the shelter in a conspicuous location that is available to the general public during hours of operation. This will remain posted for the 72-hour or longer holding period.

Comments: Humane traps may be obtained from Person County Person County Animal Services on a first come first serve basis for domestic dogs or cats only. There will be a deposit fee. See Appendix A.

SECTION 5: POSSESSION OF LIVESTOCK

The Person County Animal Services Department shall enforce the applicable State Laws in reference to the care and possession of livestock.

SECTION 6: RABIES VACCINATION AND CONTROL

It shall be unlawful for an owner to fail to provide current vaccination against rabies for his dogs, cats and ferrets over the age of four months as required by State law.

Should it be deemed necessary by the County Health Director or Board of County Commissioners that it is necessary for other animals to be vaccinated for rabies, the owner must insure they are vaccinated in order to prevent a threatened epidemic, or to control an existing epidemic. It shall be unlawful for an owner to fail to provide current rabies vaccination against rabies for those animals, provided that rabies vaccination is available for those species.

A. Bite Cases:

1. Every animal which has bitten a human or domestic animal shall be confined immediately and shall be promptly reported to the Person County Animal Services Department.

2. The animal shall be securely quarantined under the direction of the Person County Animal Services Department for a period of 10 days, and shall not be released from such quarantine except by written permission from the Person County Animal Services Department.

3. The biting animal and its records of rabies vaccination shall be inspected by the Person County Animal Services Officer. The following policy will then be observed:

a. A properly rabies vaccinated dog, cat or ferret may be confined on the owner’s premise provided that an Person County Animal Services Officer determines that the owner has an adequate means of confinement upon his own premises.

5 85 The animal must be available for observation by the officer at any time during the 10 day period.

b. A dog, cat or ferret not properly vaccinated against rabies, belonging to an owner, shall immediately be confined in a veterinary hospital or the county Animal Shelter at the expense of the owner for the 10 day confinement. The dog, cat or ferret shall not be vaccinated during confinement.

c. At the end of 10 days, the animal must be vaccinated at the owners’ expense by a certified rabies vaccinator before release in addition to the other fees.

d. A biting stray dog, cat or ferret shall immediately be confined in the County Animal Shelter for a 10 day period.

Comments: Rabies vaccinations are available for some other animals through a licensed veterinarian.

B. Surrender for Quarantine Required on Demand:

It shall be unlawful for any person to refuse to allow an investigation by the Person County Animal Services Department upon demand, of any animal which has bitten a human, domestic animal or has been in an encounter with a suspected rabid animal.

It shall be unlawful for any person to fail or refuse to surrender any animal for quarantine or destruction as required, when demand is made by the Person County Animal Services Department or the County Health Director.

C. Rabies Diagnosed:

If an animal dies or appears ill while under observation for rabies, then the head of such animal must be submitted to the State Public Health Lab to test for rabies. This method is the only approved way to diagnosis rabies. The body cannot be reclaimed. It must be disposed of by Person County Animal Services to protect public health. It shall be unlawful for any person to kill or release any animal under observation for rabies, any animal suspected of having been exposed to rabies, any animal which has bitten a human, or to remove such animal from the County without written permission from the Person County Animal Services Department and the County Director of Public Health.

D. Emergency Quarantine and Procedure:

When reports indicate a positive diagnosis of rabies, the local health director or the appointed acting agent may order an area wide quarantine within Person County for a period as he/she deems necessary. Each member of the Person County Animal Services Department, Police and Sheriff’s Department is authorized during such quarantine, to impound or after reasonable effort has been made to apprehend the animals to destroy the uncontrolled dogs and cats and properly dispose of their bodies. During the quarantine period, the Person County Animal Services Department or the local health authorities shall be empowered to provide a program of mass immunization by the establishment of

6 86 temporary emergency rabies vaccination clinics strategically located throughout the County. When a township is under rabies quarantine, animals are not allowed to be adopted from Person County Animal Services during the period of rabies quarantine for six months if the animals have been impounded by reason of being a stray, unclaimed by the owner or surrendered without a current rabies vaccination. In the event there are additional positive cases of rabies occurring, the period of quarantine may be extended at the discretion of the local health director or an agent acting on his or her behalf. (NCGS130A-195)

Comment: In the event of activities requiring rabies Quarantine of all or a portion of the County, the County Health Director may require greater enforcement activities to protect the public and to control an outbreak.

E. Current Rabies Vaccination:

Animals that are brought into this State unvaccinated shall immediately be securely confined and shall be vaccinated within one week. The animal then shall remain confined for two weeks after vaccination. An animal brought into this State accompanied by a certificate issued by a licensed veterinarian showing that the animal is currently vaccinated against rabies is not required to get a booster. See NC G.S.130a-193.

Comment: North Carolina State rabies vaccination requirements are for cats, dogs and ferrets to have a one year rabies vaccine at four months of age. A booster vaccine is given one year later. Later booster vaccines are administered every three years thereafter if given by a licensed veterinarian. Vaccines given by a certified rabies vaccinator are only good for one year. The animal must be revaccinated at intervals as required by law throughout their lifetime.

F. Exposed animals

If an animal is bitten or exposed to a proven rabid animal or animal suspected of having rabies that is not available for laboratory diagnosis, it shall be destroyed immediately by its owner, the County Person County Animal Services Officer, a law officer or licensed veterinarian unless the animal has been vaccinated against rabies in accordance with this Ordinance, the rules and regulations of the Person County Health Department and NC State Law more than 28 days prior to being bitten or exposed, and is given a booster of rabies vaccine within three days of the bite or exposure. It shall be unlawful for any person to fail to surrender said unvaccinated animal to the Person County Animal Services Department on demand for compliance with any protocol established by the Person County Health Director for handling of rabies exposure incidents.

The carcass of any dead animal suspected of dying with rabies shall be reported to the Person County Health Department. If the Health Department deems it necessary, the animal’s carcass shall be surrendered to the Person County Animal Services Department. The head of such animal shall be submitted to the Person County Health Department for shipment to the State Public Health Lab for testing.

7 87 SECTION 7: POTENTIALLY DANGEROUS OR DANGEROUS ANIMALS

The behaviors that can result in a dog being considered potentially dangerous or dangerous are listed in the definitions.

A. The provisions of this Section do not apply to a dog being used by a law enforcement officer to carry out the law enforcement officer’s official duties. A working dog will be handled in accordance with state law. A dog shall not be considered a dangerous dog under this Article if the injury inflicted by the dog was sustained by a person who, at the time of the injury, was committing a willful trespass or other tort, was tormenting, abusing, or assaulting the dog, had been observed or reported to have tormented, abused, or assaulted the dog, or was committing or attempting to commit a crime.

B. The Director of Person County Animal Services must notify the owner of a potentially dangerous dog in writing giving the reasons for his determination that the animal is dangerous under this Section. The owner may appeal the determination of the Person County Animal Services Director by giving written notice of the appeal within 5 days of receiving this notification. Written notice of appeal should be sent to the Director of Person County Animal Services. The dog will be considered potentially dangerous pending the appeal. The appeal will be reviewed by the Person County Animal Services Advisory Committee within 2 weeks. The owner will be notified of the Committee’s decision within 10 days. The committee’s decision can be appealed to Superior Court within 10 days pursuant to NC G.S. 67-4.1 Chapter 10.

C. It is unlawful for an owner to:

1. Leave a dangerous dog unattended on the owner’s real property unless the dog is confined indoors, in a securely enclosed and locked pen, or in another structure designed to restrain the dog.

2. Permit a dangerous dog to go beyond the owner’s real property unless the dog is leashed and muzzled or is otherwise securely restrained and muzzled.

D. If the owner of a dangerous dog or a potentially dangerous dog transfers ownership or possession of the dog to another person, the owner shall provide written notice to the Director of Person County Animal Services, stating the name and address of the new owner of the dog and to the person taking possession of the dog; specifying the dog’s dangerous behavior and the Director of Person County Animal Services’ determination.

E. A dog that has been determined to be dangerous or potentially dangerous may be humanely destroyed in the following instances:

1. If the Director of Person County Animal Services determines that a dog that was previously determined to be dangerous or potentially dangerous either bit a person so as to cause a break in the skin or was at large on two or more separate occasions after such determination, the Director of Person County Animal Services may seek a court order that the dog to be humanely destroyed.

2. If the Director of Person County Animal Services in determining that a dog is dangerous or potentially dangerous also determines that the dog, without provocation, has killed or inflicted severe injury on a person, the Director of Person County Animal Services may seek a Court Order that the dog be humanely destroyed.

F. A dog that has been determined to be dangerous or potentially dangerous may not be released from the animal shelter except to original owner.

G. The owner or custodian of any dog that has been determined to be dangerous or potentially dangerous, shall report immediately to the Person County Animal Services Officer if the dog gets loose or is otherwise unconfined or it attacks a person or another animal.

H. An Person County Animal Services Officer shall inspect the premises where a dog determined to be dangerous is kept to insure it conforms to the requirements of this ordinance.

I. If an animal is observed engaged in any of the acts identified as a public nuisance as defined in the definition section of this ordinance, and an official complaint is filed and the owner, if known, is notified the owner is required to keep said animal contained. Each day said animal is not contained, constitutes a separate violation of this ordinance and the owner shall be so charged with violation of this ordinance.

SECTION 8: NOISY DOGS

It shall be unlawful for the owner or custodian of any dog to allow it to bark, whine, howl, or make any other noise for a protracted period so as to result in a serious annoyance or interference with the reasonable use and enjoyment of neighboring premises.

SECTION 9: PUBLIC NUISANCE

It shall be unlawful for the owner or custodian of any domestic animal to repeatedly chase, snap at, or attack pedestrians or vehicles or to turn over garbage pails, damage garden flowers or vegetables. It shall also be unlawful for the owner or custodian to permit a female animal to run at large during the estrous stage of reproduction.

SECTION 10: INJURING ANIMALS, NOTICE REQUIRED

It shall be unlawful for any person to injure a domestic animal by running over, into, or coming into contact with animal, by automobile, motorcycle, bicycle, or other vehicle and fail to notify immediately, the owner of the animal or Emergency Communications for the appropriate response.

SECTION 11: CRUEL TREATMENT

It shall be unlawful for any person to tease, bait, molest, torture, deprive of necessary sustenance, or cruelly beat, mutilate or kill, wound, injury, poison, abandon or subject to conditions detrimental to its

9 89 health or general welfare any animal or to cause or procure such action. The words “torture, or cruelly” shall be held to include every act omission or neglect whereby unjustifiable physical pain, suffering or death is caused or permitted; but such terms shall not be construed to prohibit lawful shooting of birds, deer and other game for human food nor to prohibit the lawful trapping of game pursuant to the provisions of the NC General Statues and the regulations of the Wildlife Resources Commission; nor to prohibit the Person County Animal Services Department or their agents or veterinarians from destroying dangerous, unwanted or injured animals in a humane manner.

SECTION 12: MANNER OF KEEPING AND TREATING ANIMALS GENERALLY

In accordance with State Laws any person must provide domesticated animals with adequate shelter, proper food, adequate water and space in accordance with the standards set out in subsections A-C below. In addition, the provisions of subsections D and E shall apply to dogs and cats and sick or injured animals.

A. Adequate shelter means provision of and access to shelter that is suitable for the species, age, condition, size, and type of each animal; provides adequate space for each animal; is safe and protects each animal from injury, rain, sleet, snow, hail, direct sunlight, the adverse effects of heat or cold, physical suffering, and impairment of health; is properly lighted; is properly cleaned; enables each animal to be clean and dry, except when detrimental to the species; and for dogs and cats, provides a solid surface, resting platform, pad, floor mat, or similar device that is large enough for the animal to lie on in a normal manner and can be maintained in a sanitary manner. Under this chapter, shelters whose wire, grid, or slat floors: (i) permit the animals feet to pass through the openings; (ii) sag under the animals’ weight; or (iii) otherwise do not protect the animals’ feet or toes from injury are not adequate shelter.

B. Provide proper food and adequate water means provision of and access to clean, fresh potable water of a drinkable temperature that is provided in a suitable manner, in sufficient volume, and at suitable intervals appropriate for the weather and temperature, to maintain normal hydration for the age, species, condition, size and type of each animal, except as prescribed by a veterinarian or as dictated by naturally occurring states of hibernation or fasting normal for the species; and is provided in clean, durable receptacles that are accessible to each animal are placed so as to minimize contamination of the water by excrement and pests or an alternative source of hydration consistent with generally accepted husbandry practices.

C. Adequate space means sufficient space to allow each animal to: (i) easily stand, sit, lie, turn about, and make all other animal body movements in a comfortable, normal position for the animal; and (ii) interact safely with other animals in the enclosure. When an animal is tethered “adequate space” means a tether that permits the above actions and is appropriate to the age and size of the animal; is attached to the animal by a properly applied collar, halter, or harness configured so as to protect the animal from injury and prevent the animal or tether from becoming entangled with other objects or animals, or from extending over an object or edge that could result in the strangulation or injury of the animal; and is at least three times the length of the animal, as measured from the tip of its nose to the base of its tail, except when the animal is being walked on a leash or is attached by a tether to a lead

10 90 line. When freedom of movement would endanger the animal, temporarily and appropriately restricting movement of the animal according to professionally accepted standards for the species is considered provision of adequate space.

D. Dogs and cats must not be in extended contact with wet surroundings.

E. Sick or injured animals:

1. Where an illness has affected the quality of life or is life threatening shall be taken to a licensed veterinarian and treatment administered or humanely euthanized within a 24 hour period. 2. Diseased animals that are contagious to other animals or humans should be quarantined in an area that can be properly disinfected. They shall be treated until determined to no longer be contagious or humanely euthanized. 3. Diseased animals that are contagious to humans shall be reported to the state veterinarian and treated as directed by the state and local veterinarians. 4. Animals infested with parasites shall be treated along with the environment as to avoid re-infestation. 5. Injured animal with an open wound that exposes deeper tissue, fractured , or persistent pain caused by soft tissue damage, should be treated by a veterinarian, or humanely euthanized.

The provisions above are in accordance with State Laws for each type of animal under the jurisdiction of Person County Animal Services. It is recommended that animals have adequate vaccination against disease, according to the species of the animal. See Appendix A. Animals are required to be on the owner’s property and under control at all times. The City of Roxboro requires animals to be on a leash or physically restrained.

SECTION 13: IMPOUNDING ANIMALS

Any animal which appears to be lost, stray or unwanted, or which is found not wearing a current valid rabies vaccination tag as required by State law, shall be confined in the Animal Shelter in a humane manner for a minimum of (3) business days, for redemption by the owner and a maximum of 15 business days for adoption. Animals may be redeemed once it is established to the satisfaction of the Person County Animal Services Director that it has been vaccinated against rabies. If the animal has not been vaccinated against rabies, the animal will be vaccinated before release at the owner’s expense. The owner will be given a date by which the vaccine must be given to any animal under 4 months. (Refer to section on Rabies control)

A. Sale or Destruction: If an impounded animal is not redeemed by the owner within three (3) business days, it becomes the property of the county. As such it may be offered for adoption, placed with a rescue group or humanely euthanized by the Person County Animal Services Department. Animals that are sick injured, from a quarantine area, being held for legal reasons or a danger to the public will not be available unless provided for elsewhere in this ordinance. Animals may be humanely euthanized in order to comply with regulations governing space requirements when there is insufficient space and that situation will be noted on the records.

11 91 B. Adoption: The animal can be adopted by any responsible adult who is willing to comply with the Person County Animal Services ordinances and the conditions of the adoption contract. Identification will be required. The adoption fees and spay/neuter deposit must be paid at the time of adoption. (See Appendix A)

C. Notifying Owner: Immediately upon impounding an animal, the Person County Animal Services Department will make reasonable efforts to notify the owner, and inform such owner of the conditions under which the animal may be reclaimed.

D. Animal Rescue Organizations: It is the county’s policy to make animals available to organizations in order to attempt to find homes for as many animals as possible, reduce euthanasia rates and for all organizations that care for homeless animals to work together to provide the greatest opportunity for adoption without prejudice towards organizations that are forced to euthanize animals. It is further the County’s policy to foster a community cooperative approach to reducing pet overpopulation with all shelters and rescue groups working together to place all healthy, adoptable animals with families in their community. Animal protection and rescue organizations that possess an IRS Code section 501 designation and meet the requirements of Appendix B shall have the right to obtain possession of any animal in the possession of the County set out in this ordinance except for animals which are rabid or suspected to be so, necessary for criminal or civil judicial purposes, necessary for the disposition of law enforcement investigations, required to be held or disposed of to protect the public health or safety of the citizens of the county or ordered to be held or disposed of by a court of competent jurisdiction. In making animals available to organization as provided for in this subsection, the County does not warrant the physical condition or disposition of any animal. The organization obtaining animals hereunder shall be responsible for any and all damages and injuries sustained by any person or animal on account of such animals and shall hold the County harmless for any claims of damages and injuries sustained by any person or animal on account of such animals. (Refer to Appendix B for guidelines and information for animal rescue organizations who want to take possession of an animal at the shelter.)

E. Intact Dogs and Cats: The Person County Animal Services Department shall require that at the appropriate age all dogs and cats adopted from the Animal Shelter be spayed or neutered. The owner must provide proof from the vetererian that surgery has been completed.

F. Suspected Rabies: Animals impounded which have been bitten by a rabid animal or which the Person County Animal Services Officer has reasonable grounds to suspect has been exposed to a suspect rabid animal, or appear to be suffering from rabies shall not be redeemed or adopted, but shall be dealt with as provided in Section 6 entitled “Rabies Vaccination and Control” of these Ordinances. Unvaccinated animals from a rabies quarantine area cannot be released.

Comments: When quarantine for County has been activated, no animals will be released from the shelter, unless it has a current rabies vaccination.

G. Unwanted Animals: If an animal is officially surrendered by the owner to the Person County Animal Services Department, it may be offered for adoption, placed with a rescue or humanely euthanized without waiting three (3) days if the owner provides proof of ownership. If animal is sick or injured, the animal will be euthanized humanely without a waiting period.

12 92 H. Diseased or Injured Animals: Any animal impounded which is badly wounded or diseased (not a rabies suspect) and has no identification shall be humanely euthanized immediately. If the animal has identification, the Person County Animal Services Department will attempt to notify the owner before the animal is euthanized, but if the owner cannot be reached, and the animal is suffering, the Person County Animal Services Department may euthanize the animal at its discretion, in a humane manner.

I. Feral Animals: The Person County Animal Services Director is primarily responsible for public health including the employees of the Person County Animal Services Department. If it is determined that there is a danger to people to hold an animal for three days, the animal may be humanely euthanized without a waiting period.

SECTION 14: RECLAIM AND ADOPTION PROCEDURE FOR IMPOUNDED ANIMALS

Every person must provide proof of rabies vaccination at the time of reclaim or the animal will be vaccinated by a certified rabies vaccinator at the owner’s expense. If not four months of age at the time of reclaim, owner must provide proof of rabies vaccination when animal reaches four months of age.

A. Reclaim Procedure

1. The owner shall be entitled to reclaim his animal, except as provided for in this ordinance, upon compliance with the provisions of this ordinance and the payment of shelter fees incurred. In addition to the reclaim fee, a holding fee per day must be paid before animals may be reclaimed. A rabies vaccine shall be administered at the shelter before the animal can be reclaimed unless the owner provides proof of a current rabies vaccine. Owner will be charged for this rabies vaccine. A list of fees is found in Appendix A.

2. If the dog or cat is under four months, the owner will be given a proof of rabies vaccination card at the time of the reclaim. This will include the date stating the time limit allowed to have the dog or cat vaccinated for rabies. The owner must provide proof of the rabies vaccine and submit a copy to Person County Animal Services. If this is not returned to Person County Animal Services within the time limit, a Person County Animal Services’ officer will be dispatched to retrieve the dog or cat and the owner can be cited for violation of state law.

B. Adoption Procedure

1. All animals will be vaccinated against rabies before leaving the shelter unless they are under four months of age. Rabies vaccines that are given by a certified rabies vaccinator are for one year only.

2. Adoption fee covers age appropriate vaccinations and will be paid at the time of adoption.

13 93 3. There will be a spay/neuter deposit for all animals adopted from the shelter unless already spayed/neutered. This deposit will be returned once the proof of sterilization has been returned unless have opted for voucher. The sterilization must be completed within 30 days if the animal is 6 months of age or older. If the animal is under six months, a date will be set and listed on the adoption papers. In order to receive a refund of the deposit, surgery must be done by the date set unless there is a documented medical reason to delay surgery. (See Appendix C)

4. Documentation from a veterinarian will be required for any spay/neuter deposits to be returned.

Comments: For a list of these fees, see Appendix A.

SECTION 15: EXEMPTIONS

Hospitals, clinics and other premises operated by licensed veterinarians for the care and treatment of animals are exempt from the provisions of this ordinance except for the sections on cruel treatment and the manner of keeping animals as per state law.

SECTION 16: INTERFERENCE

It shall be unlawful for any person to interfere with a member of the Person County Animal Services Department or Person County Animal Services Officers or Veterinarians in the performance of any duty authorized by this ordinance, or to seek to release any animal in the custody of said agents.

SECTION 17: RECORDS

It shall be the duty of the Person County Animal Services Department to keep accurate and detailed records of:

A. Impoundment and disposition of all animals coming into the Person County Animal Services;

B. Bite cases, violations, and complaint investigations;

C. All monies belonging to County which were derived from impoundment fees, penalties and adoption of animals;

D. All other records deemed necessary by the County Manager and/or State law.

SECTION 18: FEES

Fees shall be charged in accordance with schedule of fees adopted from time to time by the Person County Board of Commissioners. (See Appendix A).

14 94 SECTION 19: PENALTIES

A. Under authority of NC G.S. 153A. 123 (b) violation of this ordinance is a misdemeanor punishable by a fine and/or imprisonment for not more than thirty days.

B. The Person County Animal Services Officer may institute an action for injunctive relief and an order of abatement as provided for in NC G.S. 153 A-123 (e) for any condition found unlawful in this ordinance.

C. The Person County Animal Services Officer may also enforce this Ordinance by issuing a Notice of Civil Penalty.

D. Each day of continued violation of this ordinance is a separate and distinct offense as provided for in NC G.S.153A-123(g).

SECTION 20: PERSON COUNTY ANIMAL SERVICES DEPARTMENT

The Person County Animal Services Department of Person County, as created the 21st day of April, 1981, shall be composed of such positions as shall be determined by the Board of County Commissioners. The said employees shall be hired and compensated in accordance with the Person County Personnel Policy.

SECTION 21: ADVISORY COMMITTEE

An Advisory Committee shall advise the Board of County Commissioners and the County Manager with respect to Person County Animal Services matters. The Advisory Committee is composed of members appointed by the Board of County Commissioners to serve at the pleasure of said Board.

SECTION 22: SEVERABILITY

If any section or part of this ordinance should be held invalid for any reason, such determination shall not affect the remaining sections or parts, and to that end the provisions of this ordinance are severable.

SECTION 23: EFFECTIVE DATE

This ordinance shall become effective on the ____ day of______, 2013 and supersedes any previous versions of the ordinance.

96 Appendix B Rescue Group Procedures

The purpose of this policy is to establish standard operating procedures for Person County Animal Services and all rescue groups that wish to pull animals from Person County Animal Shelter. In making animals available to organizations, the Person County Animal Service’s goal is to improve the lives of animals in our county. In order to attempt to find homes for as many animals as possible and reduce euthanasia rates, all organizations that care for homeless animals must work together to provide the greatest opportunity for adoption without prejudice towards organizations that are forced to euthanize animals. A community cooperative approach to reducing pet overpopulation is the goal with all shelters and rescue groups working together to place all healthy, adoptable animals with families in their community. Animal protection and rescue organizations that possess an IRS Code section 501 designation and meet the requirements of Appendix B shall have the right to obtain possession of any animal in the possession of the County set out in this ordinance except for animals which are rabid or suspected to be so, necessary for criminal or civil judicial purposes, necessary for the disposition of law enforcement investigations, required to be held or disposed of to protect the public health or safety of the citizens of the county, or ordered to be held or disposed of by a court of competent jurisdiction. As provided for in this subsection, the County does not warrant the physical condition or disposition of any animal. The organization obtaining animals hereunder shall be responsible for any and all damages and injuries sustained by any person or animal on account of such animals and shall hold the County harmless for any claims of damages and injuries sustained by any person on account of such animals.

1. Rescue groups wishing to rescue animals must be a non-profit organization with 501 paperwork. Each rescue group must submit a copy of its 501 papers and a list of agents authorized to pick up animals from the Person County Animal Shelter.

2. All rescue groups must have an application approved by the Person County Animal Services Director (hereinafter “Director”). A rescue application may be denied by the Director, in which case he/she will send an explanation for the denial in writing.

3. Person County Animal Services will notify an applying rescue group of the approval or denial of its application and will do so within 10 business days of the receipt of the application.

4. In the event a rescue group’s application is denied, the group may appeal the decision to the Animal Services Advisory Committee. The Committee will meet within 2 weeks and notify the group of its decision within 10 days after that meeting. If the Committee overturns the denial, the application will be forwarded to the Director, and will be signed by the Chairperson of the Committee signifying approval of the application.

5. A rescue group may have its privileges to pull animals from Person County Animal Shelter suspended by the Director. The Director will notify the Animal Advisory Committee. The Committee will meet within 2 weeks review the suspension. The Animal Services Advisory Committee will notify the suspended rescue group within 10 days after that meeting of its decision.

The guidelines for rescue groups are as follows:

1. Adherence to animal pull procedures which include date and time limits.

2. Cordial interaction between all parties.

3. Not violating any of the other rules or provisions provided herein.

4. All rescue groups are to make arrangements to pull all animals they intend to rescue prior to the day the animals is scheduled for euthanasia.

5. All rescues are to be coordinated through the Rescue Coordinator.

6. All animals will be held at the Person County Animal Shelter for the mandatory 72 hours impoundment period after arriving at the shelter, and no animal is to be released prior to the expiration of this time. (Except as outlined in Section 4 of the Person County Animal Services Ordinance.)

7. The adoption agent will have 1st choice of animals that are in holding. If an animal is placed in adoption and does not get adopted, the rescue group will be notified that they may pull the animal.

8. Animals can be tentatively reserved while they are in the holding. The following information needs to be directed to the Rescue Coordinator:

Intake number, cage number, brief description and sent to the Rescue Coordinator by email or by a written notice. Rescue Coordinator must be notified by 4:00 p.m. on day before animal is due to be released from holding. Example: Hold Until Date 7/2/10 Notify Rescue Coordinator no later than 4:00 p.m. on 7/1/10

9. You will be notified if the animal you reserved is put up for adoption, has been adopted, reclaimed or has become ill. If it is in the best interest of the animal due to unforeseen issues, the animal will be humanely euthanized before you are notified. If a qualified potential adopter and a rescue group are interested in the same animal, the adopter will be given preference according to NC G.S.130A- 192(a1).

98 10. If a rescue group reserves an animal, Person County Animal Shelter will place the animal in the rescue holding cages and will place a card on its cage stating the name of the group and the date by which the animal will be pulled by the rescue group.

11. Age appropriate vaccinations will be given upon request to animals when they are moved to Rescue Holding. Rescue Groups will be responsible for the cost of the vaccinations which will be billed on a monthly basis. See Appendix A for cost.

12. A rescue group’s request to reserve an animal may be denied at the discretion of the Director.

13. Rescue group members are not allowed to euthanize or medicate animals at the Person County Animal Shelter.

14. Before leaving the Person County Animal Shelter with any animal, a rescue group member must notify a shelter employee.

15. Animals that have been reserved can be picked up during normal business hours.

16. Rescue groups must have procedures for sterilization of the animals that they adopt out.

17. Any questions regarding the animals will be directed to the Rescue Coordinator. If the coordinator is not available, the questions should be submitted in writing.

Person County Animal Services has partnered with three local veterinarians to offer you an opportunity for low cost spaying or neutering for your adopted animal(s).

The adopter will schedule an appointment with one of the veterinarians before the deadline date listed on this voucher. Please be sure to tell the veterinarian’s office that you will be using your spay or neuter voucher on an adopted animal from the Animal Shelter. This voucher will be presented for payment to the veterinarian’s office.

This voucher will NOT cover any complication costs associated with the spaying or neutering surgery (i.e. pregnancy or retained testicles) or will not cover any additional medical services. Additional costs will be the animal owner’s responsibility.

This voucher only applies to the three veterinarians listed below. If you choose a different veterinarian, you will be responsible to pay for the spaying or neutering. You will still need to have the surgery performed by the deadline stated in your contract. Please submit a copy of the invoice from the veterinarian to Person County Animal Shelter to receive your $75 deposit refund. Agenda Title: Request for additional funding for Sheriff’s Office and Detention Center

Summary of Information: The Sheriff’s Office requests additional funding for the Vehicle Maintenance and Repairs line in the amount of $20,000. For FY12-13 we requested and were appropriated $50,000 for Vehicle Maintenance; we currently have transferred from other line items an additional $19,450 ($14,450 was from the insurance claims received on hail-damaged vehicles) totaling $69,450 spent. Our estimate needed to complete this year’s budget is another $20,000. Factors that we believe have affected this increase are 1) higher than normal projected maintenance costs 2) We are currently operating seven vehicles with over 100,000 miles and eight vehicles with over 90,000 miles which is higher than Person County maximum Vehicle Replacement Policy. These two factors are the main influence of high cost, because as vehicles get older, high mileage maintenance costs are more expensive such as drive train problems, things other general maintenance.

The Detention Center requests an increase in the Contracted food service/supplies budget line of $144,000. In preparing the 2012-2013 budget, we estimated the cost of housing an inmate for one year at $4,938, We based this estimate on housing 88 inmates by averaging years 2009-2011. This was a conservative number, based information of changes in housing for State and Federal inmates. There was a spike 2012, in population because of a successful drug operation which raised the average for that year to 105. This year we have had another spike in population and for several months we were at the maximum housing population of 136. For this reason we requesting additional funds and we have made adjustments for budget request for 2013-2014 to increase to $550,171.

Recommended Action: Increase the Sheriff’s Vehicle Maintenance and Repair Line by $20,000 and the Contracted Food Service/Supplies Line by $144,000

Summary of Information: At the Board of Commissioners January 7, 2013 meeting, the Board voted 3-2 to no longer require a second to a motion. Staff was directed to bring this item back for evaluation at the first meeting in May. An excerpt of the Board’s minutes follows:

A motion was made by Commissioner Puryear, seconded by Commissioner Blalock to not require a second to a motion on a trial basis for a period of three months.

An amended motion was made by Commissioner Puryear, seconded by Commissioner Blalock and carried 3-2 to not require a second to a motion on a trial basis until the first meeting in May 2013 at which time, the process will be reevaluated. Commissioners Puryear, Blalock and Newell voted in favor of the amended motion. Chairman Clayton and Vice Chairman Jeffers cast the dissenting votes.

Recommended Action: Evaluate the Board’s decision to not require a second to a motion. Amend the Rules of Procedure to reflect this change if appropriate.
