    Law 10/2008, of 10 July, of the fourth book of the Civil Code of Catalonia, regarding successions Section 200-00017/08 PREAMBLE I. PRINCIPLES AND PROCEDURE In line with the Catalan civil law coding scheme as set out by Law 29/2002, of 30 December, the first law of the Civil Code of Catalonia, this law gives approval to the fourth book of the Civil Code relating to inheritances. Notwithstanding the provisions of article 6 of the aforementioned law, it does not do so by introducing amendments that add to, remove or newly draft current regulations; rather, it entails a complete alternative text, thereby avoiding the difficulties brought about by subsequent consolidation. It is known that Catalan law had already set out provisions in this sphere with a calling to achieve completeness by means of Law 40/1991, of 30 December, on the Code of Succession mortis causa in civil law in Catalonia. The law that is currently being passed follows in the footsteps of its predecessor and preserves its foundations, its basic institutional structure and even the drafting in the case of many articles. Nonetheless, the opportunity afforded by the incorporation of its content into the fourth book of the Civil Code has been taken in order to update a large number of its institutions and rules and, in certain areas, to conduct major reforms. In this regard, it is important to not overlook the fact that, although the Code of Succession was a somewhat recent text that had been in force for sixteen years, a major proportion of its articles stemmed from the 1960 Compilation or the 1955 Draft Compilation, legal bodies that have become rusty on account of the historical circumstances in which they were drafted.

During this period, given the great opportunity that has been the parallel process of coding Catalan Civil Law, many efforts have been made to regulate Land Stewardship Agreements to the point of getting specific provisions in the Civil Code of Catalonia. In this article, I analyse the current civil regulation of the Land Stewardship Agreements in the Civil Code of Catalonia based on their essential elements and providing a critical view of the resulting legal framework. The objective is to disseminate the key learning and suggestions of the Catalan case for the professionals of the Land Stewardship around the world. RESUM: Durant les primeres dècades del segle XXI, Catalunya ha acollit amb èxit la custòdia del territori com a estratègia per a la conservació de la natura. The use of an estate has effects on the one next to it. A doctor may be bothered by the noise coming from a confectioner’s business.1 The more heterogeneous the uses of the pieces of property are, the more likely conflicts are to arise. While individuals have always had the capacity to affect the enjoyment of their neighbors, the situations became more complex with the advent of industrialization, which put residential and industrial users in close proximity. Historically, the law of nuisance has been used to solve these conflicts. In veterinary malpractice litigation, standards of care expressed in guideline statements could influence the civil and penal courts in the decision-making process. Based on these considerations, the authors examine the importance of clinical practice guidelines (CPGs) in veterinary malpractice litigation involving quality of care and explore how the law may treat CPGs in the future. Abstract: The strengthening of the bond between humans and animals has changed the landscape of the veterinary profession. This has, in turn, led the legal system to assess damages in veterinary malpractice and liability cases more carefully, paying attention to the possibility of using clinical practice guidelines (CPGs) to prove whether the defendant veterinarian contravened or not the standard of care. In this era of evidence-based veterinary medicine, CPGs are becoming an integral part of many aspects of veterinary practice, even if CPGs do not have the force of law and are situated halfway between ethical rules and legal requirements.

The Constitution restored the possi- bility of creating regional autonomies, which were abolished earlier during the Franco dictatorship. However, the basic law was adopted before the foundations of regional structures were fully developed, so norms concerning the issues of autonomy were dictated in a general way. Only later legal acts regulated the situation in detail, but often their content depended on the politi- cal situation and was not always homogeneous. The creators of the Constitution did not foresee the subsequent forming of autonomous communities in the entire state territory. For over four decades of validity of the Spanish constitution, differences in the way the individual autonomous communities were established and differences in the competences of different regions have emerged. Some autonomous governments have also begun to expand their rights at the expense of the central authorities. The above factors caused a lively discussion among lawyers and politicians over the necessity of constitutional reform in the scope of the territorial system of Spain.
