Equality as a Human Right: The Development of Anti-Discrimination Law in Hong Kong CAROLE J. PETERSEN* The women's movement in Hong Kong has significantly benefited from the political and legal changes that oc- curred during the transition to 1997. Citizens of Hong Kong developed a greater awareness of human rights issues, and women have successfully identified equality as a "human right" deserving legalprotection. The women's movement has also allied itself with the increasingly democratic and assertiveLegislative Council. As a result, the legalprohibition offemale inheritance of land in Hong Kong was repealed in 1994 and the first law prohibiting sex discrimination was enacted in 1995. Additionally, Hong Kong's first Equal Opportunities Commission is being established. Ironically, the very developments that strengthened the women's movement in recent years-its association with the broaderhuman rights movement and with assertive legislators--may threaten it when China regains sovereignty. * Lecturer in Law, School of Professional and Continuing Education, University of Hong Kong. In its early years as a Crown Colony, it suffered from corruption and racial segregation but grew rapidly as a free port that supported trade with China. It took about two decades before Hong Kong established a genuinely independent judiciary and introduced the Cadet Scheme to select and train senior officials, which dramatically improved the quality of governance. Until the Pacific War (1941–1945), the colonial government focused its attention and resources on the small expatriate community and largely left the overwhelming majority of the population, the Chinese community, to manage themselves, through voluntary organizations such as the Tung Wah Group of Hospitals. The 1940s was a watershed decade in Hong Kong’s history. The fall of Hong Kong and other European colonies to the Japanese at the start of the Pacific War shattered the myth of the superiority of white men and the invincibility of the British Empire. When the war ended the British realized that they could not restore the status quo ante. They thus put an end to racial segregation, removed the glass ceiling that prevented a Chinese person from becoming a Cadet or Administrative Officer or rising to become the Senior Member of the Legislative or the Executive Council, and looked into the possibility of introducing municipal self-government. -

HONG KONG'S ENDGAME AND THE RULE OF LAW (II): THE BATTLE OVER "THE PEOPLE" AND THE BUSINESS COMMUNITY IN THE TRANSITION TO CHINESE RULE JACQUES DELISLE* & KEVIN P. LANE- 1. INTRODUCTION Transitional Hong Kong's endgame formally came to a close with the territory's reversion to Chinese rule on July 1, 1997. How- ever, a legal and institutional order and a "rule of law" for Chi- nese-ruled Hong Kong remain works in progress. They will surely bear the mark of the conflicts that dominated the final years pre- ceding Hong Kong's legal transition from British colony to Chinese Special Administrative Region ("S.A.R."). Those endgame conflicts reflected a struggle among adherents to rival conceptions of a rule of law and a set of laws and institutions that would be adequate and acceptable for Hong Kong. They unfolded in large part through battles over the attitudes and allegiance of "the Hong Kong people" and Hong Kong's business community. "APRES MoI LE DELUGE"? JUDICIAL REvIEw IN HONG KONG SINCE BRITAIN RELINQUISHED SOVEREIGNTY Tahirih V. Lee* INTRODUCTION One of the burning questions stemming from China's promise that the Hong Kong Special Administrative Region (HKSAR) would enjoy a "high degree of autonomy" is whether the HKSAR's courts would have the authority to review issues of constitutional magnitude and, if so, whether their decisions on these issues would stand free of interference by the People's Republic of China (PRC). The Sino-British Joint Declaration of 1984 promulgated in PRC law and international law a guaranty that implied a positive answer to this question: "the judicial system previously practised in Hong Kong shall be maintained except for those changes consequent upon the vesting in the courts of the Hong Kong Special Administrative Region of the power of final adjudication."' The PRC further promised in the Joint Declaration that the "Uludicial power" that was to "be vested in the courts" of the SAR was to be exercised "independently and free from any interference."2 The only limit upon the discretion of judicial decisions mentioned in the Joint Declaration was "the laws of the Hong Kong Special Administrative Region and [to a lesser extent] precedents in other common law jurisdictions."3 Despite these promises, however, most of the academic and popular discussion about Hong Kong's judiciary in the United States, and much of it in Hong Kong, during the several years leading up to the reversion to Chinese sovereignty, revolved around a fear about its decline after the reversion.4 The * Associate Professor of Law, Florida State University College of Law. -

2016-2017 INTRODUCTION The Chiang Ching-kuo Foundation for International Scholarly Exchange (the Foundation) was established in 1989 in memory of the outstanding achievements of the late President of the Republic of China, Chiang Ching- kuo (1910-1988). The Foundation’s mission is to promote the study of Chinese culture and society, as well as enhance international scholarly exchange. Its principal work is to award grants and fellowships to institutions and individuals conducting Sinological and Taiwan-related research, thereby adding new life to Chinese cultural traditions while also assuming responsibility for the further development of human civilization. Operational funds supporting the Foundation’s activities derive from interest generated from an endowment donated by both the public and private sectors. As of June 1, 2017, the size of this endowment totaled NT$3.62 billion. The Foundation is governed by its Board of Directors (consisting of between 15 and 21 Board Members), as well as 3 Supervisors. Our central headquarters is located in Taipei, Taiwan, with a regional office near Washington D.C. in McLean, Virginia. In addition, the Foundation currently maintains four overseas centers: the Chiang Ching-kuo International Sinological Center at Charles University in Prague (CCK-ISC); the Chiang Ching-kuo Foundation Inter-University Center for Sinology at Harvard University (CCK-IUC); the Chinese University of Hong Kong – Chiang Ching-kuo Foundation Asia-Pacific Centre for Chinese Studies (CCK-APC); and the European Research Center on Contemporary Taiwan – A CCK Foundation Overseas Center at Eberhard Karls Universität Tübingen (CCKF-ERCCT). There are also review committees for the five regions covering the geographic scope of the Foundation’s operations: Domestic, American, European, Asia-Pacific and Developing. -

People's Republic of China Briefing on EU concerns regarding human rights in China Prepared for EU-China Summit 5 September 2005 In May of this year, representatives of the European Union decided to delay a move to lift the arms embargo against China, citing human rights concerns. They referred specifically to four areas of concern that would affect future consideration in lifting the embargo: the need for Chinese authorities to release citizens imprisoned in connection with the suppression of the 1989 pro-democracy movement; the need for reform of China’s “Re-education through Labour” (RTL) system; the need for the PRC to ratify the International Covenant on Civil and Political Rights (ICCPR); and the need to ease media censorship. Amnesty International welcomes the fact that the EU has made the lifting of its embargo contingent on human rights reform and has detailed specific areas for improvement. In this briefing Amnesty International presents an update on developments in these four areas in the lead-up to the EU-China Summit in September, 2005. Amnesty International urges the EU to take these factors and other human rights concerns into consideration in its ongoing analysis of the human rights situation in China. Release of those imprisoned in connection with 1989 pro-democracy protests A core issue raised by EU representatives as an area of human rights concern is the continued detention of individuals imprisoned for their connection to the 1989 pro-democracy movement. The EU arms embargo was imposed on 27 June 1989 as a direct response to the armed suppression by the Chinese military of the peaceful protests calling for democracy and political reforms in and around Tiananmen Square in Beijing on 3-4 June.
