2.38(f)(1) CRITICAL MISCELLANEOUS. ***On November 20, 2016 a non- died at the facility inside a shipping enclosure awaiting transfer to another facility. The shipping enclosure was used to recover the animal from sedation which made it difficult to adequately monitor the animal’s condition. Immediately following the incident the facility conducted an evaluation of the procedures used to sedate and monitor non-human . Procedures must be reviewed and amended to ensure proper handling of all during transport. Correct within 30 days.

This inspection and exit interview were conducted with the ARC Director.

Based on checklists provided by the facility for review, the facility completed a review of their program for humane care and use of animals and the facility's animal facilities on 6/18/13 and 11/18/13. There were no reports of these evaluations prepared and submitted to the Institutional Official. Both reports contained multiple issues, including some of which were checked as significant, many of which were checked as problems on both reports. There were no action plans for correction or dates for correcting each deficiency. The IACUC must prepare a report of their semiannual evaluations to ensure that deficiencies are corrected in an appropriate and timely manner. The IACUC shall prepare a report based on its semi-annual evaluations for the Institutional Official that identifies all deficiences found, designates them as minor or significant and that contains a reasonable and specific plan and schedule with dates for correcting each deficiency. Correct with the next semi- annual evaluation.

2.31 (d)(1)(xi) INSTITUTIONAL ANIMAL CARE AND USE COMMITTEE (IACUC). Two protocols (0607TJG-02 and 0607TJG-03) approved by the IACUC contain a method of euthanasia that is not considered acceptable by the AVMA. Any method of euthanasia used should be AVMA approved in assurance of being a humane and safe method of euthanasia or there must be scientific justification approved by the IACUC as to why the method must be used. Methods of euthanasia must be AVMA approved and accomplish the humane destruction of an animal. Correct by June 10, 2014.

2.31 (e)(2) INSTITUTIONAL ANIMAL CARE AND USE COMMITTEE (IACUC). Protocols 0607TJG-03 and 0607TJG-02 list the numbers of animals of multiple species to be used but does not give a rationale for the appropriateness of the species and numbers of animals to be used in the teaching protocols. A protocol must contain a justification for the species and the numbers of animals to be used to allow the IACUC to appropriately review the protocol and assure that there will not be duplication and to assure minimalization of pain and distress. 2.33 (a)(1) ATTENDING VETERINARIAN AND ADEQUATE VETERINARY CARE. The facility currently has an arrangement with a consulting veterinarian to be their attending veterinarian. The formal arrangement does not currently include a written program of veterinary care with regularly scheduled visits to the research facility. A formal arrangement documented in writing is necessary to assure veterinary oversight over the care and use of the animals at the facility. The formal arrangement between the facility and the part-time consulting veterinarian shall include a written program of veterinary care and regularly scheduled visits to the research facility. Correct by April 30, 2014.

2.35 (a)(1) RECORDKEEPING REQUIREMENTS. The meeting minutes available for review included those dated 6/18/13, 9/15/13 and 2/18/14. Two of these minutes consisted simply of names of those who attended and protocol review results. The minutes did not include any activities or deliberations of the Committee. No votes on full protocol review were noted. The minutes need to reflect accurately all that occurs at the IACUC meetings to act as record for future reference. The minutes of IACUC meetings shall include records of attendance, activities of the Committee and Committee deliberations. Correct starting with the next IACUC meeting.

2.31(e)(3) INSTITUTIONAL ANIMAL CARE AND USE COMMITTEE (IACUC). The following reviewed protocols do not contain a complete description of the proposed use of the animals: *Review of records and conversations with lab personnel for protocol M/07/258 show that a refraction procedure involving the use of contact lenses and the routine post operative administration of Cerenia and Vitamin B-12 injections are not included in the IACUC approved version of the protocol. *Review of pig anesthesia records for protocol M/14/154 show that general anesthesia is being performed in some instances with isoflurane and others with sevoflurane. The IACUC approved version of the protocol includes only isoflurane. Protocols must include a complete description of the proposed use of animals to allow the IACUC and veterinary reviewers to do a thorough review of the protocol. All proposals to conduct an activity involving animals must contain a complete description of the proposed use of the animals. Correct by Nov. 30, 2016.

2.33(b)(3) CRITICAL ATTENDING VETERINARIAN AND ADEQUATE VETERINARY CARE. Two incidences involving a lack of timely communication between individuals making observations about animal health and well-being issues and the attending veterinarian were identified during this inspection. Both incidences were reviewed and addressed by the iACUC immediately after they occurred. *A rabbit kicked its hind legs and vocalized loudly during anesthetic induction with injectable drugs at 7:55 am. The researchers proceeded with the surgery and post operative records at 12:30 and 13:30 state that the "legs are paralyzed". The postoperative analgesic was noted given at 18:30. A veterinarian was not contacted until the following morning at which time the veterinarian recommended euthanasia. *A galago recovered from a craniotomy surgery and study procedure (over 12 hour duration total) conducted under general anesthesia sooner than anticipated and prior to the administration of the postoperative analgesic. The researchers did not give the analgesic injection as the animal became agitated and aggressive after another post operative medication injection. The researchers did not call a veterinarian for guidance. The following morning (8 hrs later) the vet tech gave an analgesic injection and contacted the veterinarian. The veterinarian evaluated the

Observations regarding problems of animal health, behavior and well-being may be accomplished by someone other than the attending veterinarian but all such issues must be conveyed to the attending veterinarian in a timely manner to ensure that all animals receive appropriate veterinary care. The facility shall maintain a program of adequate veterinary care that includes a mechanism of direct and timely communication on problems of animal health, behavior and well being to the attending veterinarian. Correct from this day forward.

2.33(b)(4) ATTENDING VETERINARIAN AND ADEQUATE VETERINARY CARE. Protocol M/07/258 includes the use of multiple anesthetics and a neuromuscular blocking drug (NMB). Review of the protocol shows that the intra-operative monitoring includes heart rate, respiratory rate and CO2 done every 10 minutes. During the use of the NMBs a ventilator is used. One record, for galago 7-14-1, shows that the NMB and anesthetic were discontinued within the same 10 minute time block on the monitoring chart. There is no record of specifically when the NMB was discontinued, the method used to confirm that the NMB was no longer effective prior to reducing the anesthesia, when the animal returned to spontaneous breathing and when the anesthetic was discontinued. Lab personnel stated that the discontinuation of the NMB and the waking of the animal occurred almost simultaneously. They stated this happened so quickly that the personnel were not able to give the required post-operative analgesic. Further conversation elicited the information that the research personnel were monitoring anesthesia depth during NMB use with "heart rate and withdrawal reflex". The appropriate use of NMB under anesthesia is critical to ensure that the animals do not feel any pain during the procedure. The facility must ensure that investigators and other personnel involved in handling, immobilization, anesthesia, and analgesia are given appropriate guidance to ensure these procedures are done appropriately. Correct by Nov. 30, 2016.

2.31(b)(3)(ii) INSTITUTIONAL ANIMAL CARE AND USE COMMITTEE (IACUC). Between March 2016 and February 2017 the IACUC held six meetings. The unaffiliated member was not present for four of those meetings. In addition, the unaffiliated member was not involved in either of the two semi-annual facility inspections and program reviews conducted by IACUC members during those 12 months. The lack of participation of an unaffiliated IACUC member in IACUC meetings and semi-annuals means that there is a lack of general community interest being represented on the committee regarding proper care and treatment of animals at the facility. The IACUC, when conducting business required under the Animal Welfare Act, shall include at least one member unaffiliated with the facility. Correct by April 2017.

2.31(c)(3) INSTITUTIONAL ANIMAL CARE AND USE COMMITTEE (IACUC). The IACUC meeting minutes state that a semi-annual facility inspection and program review were conducted in September 2016. However, there is no written evaluation report of the findings submitted to the Institutional Official as required. The evaluation report must contain all required information about the inspection and review findings, include any minority views and be signed by a majority of the IACUC members. The semi-annual evaluation report functions as method for the IACUC to notify the Institutional Official of the status of the animal care and use program at the facility. The facility shall ensure that the IACUC completes an evaluation report to the Institutional Official upon completion of the required semiannual evaluations. Correct from this day forward.

2.31(c)(3) REPEAT INSTITUTIONAL ANIMAL CARE AND USE COMMITTEE (IACUC). The semi-annual report to the Institutional Official dated June 9, 2016 is not complete. The checklist for the program review shows one minor deficiency that is not described and there is no correction plan or date. The semi-annual facility inspection checklist shows several minor deficiencies none of which are described or have a correction plan/date. The semi-annual report to the IO dated 12/13/16 does include a description, correction plan and correction date for all minor deficiences. However, the facility inspection review evaluation has only been signed by four of eight IACUC members. The semi-annual evaluation report to the IO is an important document that updates the IO on the status of the facility's animal care and use program and allows the IO to know when to intervene to ensure that the facility meets the federal guidelines. The IACUC's semi-annual reports of evaluations of the program of animal care and use and facility inspection must identify specifically any departures from the Animal Welfare Act Standards and Regulations, must state reasons for each departure, must distinguish significant from minor deficiencies and must contain a reasonable and specific plan and schedule with dates for correcting each deficiency. The evaluations must be reviewed and signed by a majority of the IACUC members.

2.31(d)(2) INSTITUTIONAL ANIMAL CARE AND USE COMMITTEE (IACUC). *Review of protocols shows that two protocols (1608-CVM-13 and 1602-CVM-05) were approved by an electronic polling method. Emails reviewed showed that IACUC members made motions to vote and voted via emails sent back and forth between the IACUC chair and the IACUC members. Voting by such an electronic method does not meet the requirements of either the Designated Member Review or the Full Committee Review process. *Review of IACUC meeting minutes shows that protocol 1605-VMT-09 was "approved with revisions" at a full committee meeting. Some of the members requested that the PI make revisions. The protocol was approved with this condition.

To ensure a proper and robust review, the IACUC shall ensure that all protocols are approved only by after review at a convened meeting of a quorum of the IACUC and with an approval vote of the majority present or by a designated member designated by the chairman to review the protocol after all members have had a chance to call the protocol to full committee review. If revisions are requested by the IACUC the protocol should be returned to the PI for modifications and then sent back to the IACUC to secure approval. Correct from this day forward.

2.31(d)(5) INSTITUTIONAL ANIMAL CARE AND USE COMMITTEE (IACUC). Protocol 150729-01-05-03D was approved on 7/29/15. Protocol 151207-01-05-03D was approved on 12/7/15. Animals are currently being used on this protocol. There was no record of an annual review of these protocols having been conducted. In order to ensure full oversight of all animal use activities being conducted at the facility, the IACUC shall conduct continuing reviews of all animal use activities/protocols at least annually. Correct by 2/15/17.

2.33(b)(2) ATTENDING VETERINARIAN AND ADEQUATE VETERINARY CARE. During the inspection one thin white female mixed breed dog #1106 was identified. Her ribs and lumbar vertebrae are easily seen with no to minimal fat cover. Her pelvic bones protrude and are obvious. She exhibits a marked concave abdominal tuck and a marked hourglass shape to her waist. Records show that when she arrived on 1/4/17 from a shelter she weighed 17.4 kg and was given a 2/5 body condition score by the examining veterinarian. Routine intake fecals and bloodwork were performed but there were no clinical notes regarding her thin body condition or any plan for addressing it. The next weight recorded was on 1/24/17 at which time she weighed 17.6 kg. Review of her food logs shows that she is being fed 1 1/4 cup of Purina EN twice daily and that she is eating. Review of Purina EN feeding recommendations show that the amount she is being fed is the recommended maintenance amount for a dog her current weight. It does not appear from the records that she has been receiving any supplemental calories while at the facility. Thin shelter/rescue dogs are common but their underweight body condition should be noted and addressed to ensure that the dogs gain weight and health. Animal records should reflect all medical conditions including body weight conditions/concerns to ensure that a proper diagnosis has been made and any necessary treatment/husbandry changes instituted. PRIMARY CONVEYANCES (MOTOR VEHICLE, RAIL, AIR, AND MARINE). Inspection of the van used by the Vet Tech program to transport dogs and cats shows the van has a leak around a roof top vent in the cargo area. The empty crates stored underneath the vent during the inspection both have accumulated water on top of them and the floor between the crates was also wet. Inspection of the inside of vent showed a loose rubber gasket type material. The leaking vent is allowing water to enter which may cause discomfort to the animals transported in the van. Correct prior to use of the van.

2.38(f)(1) CRITICAL MISCELLANEOUS. ***On November 20, 2016 a non-human primate died at the facility inside a shipping enclosure awaiting transfer to another facility. The shipping enclosure was used to recover the animal from sedation which made it difficult to adequately monitor the animal’s condition. Immediately following the incident the facility conducted an evaluation of the procedures used to sedate and monitor non-human primates. Procedures must be reviewed and amended to ensure proper handling of all animals during transport. Correct within 30 days.

2.31(c)(6) INSTITUTIONAL ANIMAL CARE AND USE COMMITTEE (IACUC). During the Dec. 2016 IACUC meeting a noncompliance that occurred on protocol 2455 was discussed. The meeting minutes state that "the PI and all other protocol personnel will be informed about the halting of the protocol and corrective actions as soon as possible after today's meeting". There was no notation in the minutes that a vote to suspend the protocol was conducted. This was confirmed by talking to individuals present at the IACUC meeting. The IACUC may suspend an activity that it had previously approved if it determines that the activity is not being conducted in accordance with the description provided by the PI and approved by the committee only with a suspension vote of a majority of the quorum present at the meeting. Correct from this day forward.

2.31(c)(7) INSTITUTIONAL ANIMAL CARE AND USE COMMITTEE (IACUC). Review of the Dec. 2016 IACUC meeting minutes showed that an amendment to protocol 2455 was brought before the committee for full committee review. The IACUC voted to approve a "revised amendment contingent on" two items being completed/revised. The IACUC, as the representative body for the facility, is responsible for approving all animal use protocols and significant changes prior to the animals being used. During a review the committee can approve, require modifications to secure approval or withhold approval of the proposed significant changes. A protocol should not be approved 'with contingencies' in order to avoid confusion between the IACUC and researchers. The IACUC shall ensure that all amendments to protocols, including to protocol 2455, are approved via an appropriate review. Correct from this day forward.

2.31(e)(3) INSTITUTIONAL ANIMAL CARE AND USE COMMITTEE (IACUC). During a review of an amendment submitted to the IACUC for protocol 2455 the IACUC determined that the researchers were performing an unapproved procedure during a terminal surgery study on pigs that involved restricting oxygen to the pigs. co-investigator reviewed the protocol and realized that the procedure was not in the approved protocol. This particular co-investigator had been initially told incorrectly by the surgeon researchers that the procedure was approved. A protocol must contain a complete description of the proposed use of the animals in order for all researchers to understand what procedures can be performed and to allow the IACUC to ensure that all research is conducted in a manner in accordance with the regulations. All proposals to conduct an activity involving animals shall include a complete description of the proposed use of animals including protocol 2455. Correct prior to the use of any additional pigs.

2.38(f) MISCELLANEOUS. The IACUC meeting minutes and an adverse event report documented an event in which a horse broke its femur during a transport between the horse's housing area and a teaching area. Seven horses were loaded into a trailer at their housing site with no complications. Upon arrival at the first teaching venue where six horses were to be unloaded for the day the arena was locked and no one was present to let the handlers remove the horses from the trailer and lead them into the arena. While the handlers were waiting in the truck for someone to let them in they felt a bump and movement in the trailer. They checked on the horses and one of the horses was on the floor of the trailer and unable to stand up. They were able to get her up and unload her from the trailer but she then laid down again once outside the trailer. A veterinarian was called immediately and decided to euthanize the horse as it was suspected that the femur was fractured. This was confirmed by necropsy. After action interviews were conducted and it was determined that this particular horse was known to be a dominant, high strung horse. Miscommunication issues between the employees bringing the horses to the arena and the employees at the arena resulted in a delay unloading the horses which was felt to be the cause of the incident. Appropriate handling of horses during trailering should include the evaluation of the horses' personality and herd interactions along with proper planning to ensure a safe transport of the animals. Handling of all animals shall be done as expeditiously and carefully as possible in a manner that does not cause trauma, behavioral stress, physical harm or unnecessary discomfort. Correct from this day forward.
