RE: GRIEVANCES REGARDING NON ISSUANCE OF TENDERS & SHEER VIOLATIONS OF PUBLIC PROCUREMENT RULES, 2004 (PPRA). Dear Sirs,

Attention is invited to the Classified Advertisement "INVITATION OF BIDS" for procurement of various development works under Community Development Programme for (SDG's) Sustainable Development Goals (2017-18) by the Executive Engineer, Karachi Central Civil Division No.IU, Pakistan Public Works Department, Karachi, through his No.EE.KCCD-IIIINITnso dated 14th December 2017 (Copy of press clipping attached for ready reference).

The concerned Executive Engineer is reluctant to issue tender documents despite written request and several personal visits to his office on the pretext to get eligibility certificate issued from the "Procurement Committee". The condition is unique in nature and never ever experienced earlier.

Principally, issuing of tenders to the intending contractors should have been ensured as per Rule-23(1) of Public Procurement Rules, 2004 immediately after the publication of the invitation to bid for open competitive bidding but persistent denial in issuing tenders by the concerned Executive Engineer in absence of eligibility certificate from the "Procurement Committee" is a question mark besides his integrity to manipulate, award of works to his 'blue-eyed' contractors is unwarranted & in sheer breach of the laid down rules making the whole process as mis­ procurement under Rule-SO ofPPRA, 2004.

According to the rules; a Procurement Committee is required to be constituted by the procuring agency for evaluation and acceptance of bids or to redressat of the grievances and settlement of disputes but the term has been misconstrued by the Executive Engineer in his Invitation of bid for manipulation & a deliberate attempt in ousting the potential contractors from the open and competitive bidding process.

Being aggrieved with the above unlawful delaying tactics; we have left no option except to approach your good offices to intervene into the matter by issuing clear directives to the Executive Engineer concerned to issue tender documents immediately and refrain from indulging in mal­ practices.
