96-790 F Updated June 16, 1998 CRS Report for Congress Received through the CRS Web Kosovo and U.S. Policy Steven Woehrel Specialist in European Affairs Foreign Affairs and National Defense Division Summary Kosovo, a region in southern Serbia, has been the focal point of bitter struggles between Serbs and Albanians for centuries. Leaders of the ethnic Albanian majority in Kosovo say their people will settle for nothing less than complete independence for their region, while almost all Serb political leaders have been adamantly opposed to Kosovo’s independence or even a substantial grant of autonomy to Kosovo. Conflict between ethnic Albanian rebels and Serb police has resulted in over 300 deaths since late February 1998. The United States has spoken out repeatedly against human rights abuses in Kosovo, but does not support Kosovar demands for independence, only an "enhanced status" within the Serbia-Montenegro (the Federal Republic of Yugoslavia) that would include meaningful self-administration. The United States and its allies in the international Contact Group (the United States, Russia, Germany, France, Britain and Italy) have used a "carrot-and-stick" approach of sanctions and inducements to stop Serb attacks against civilians and get the two sides to the negotiating table. NATO is reportedly examining options to use force against Serbia-Montenegro if diplomacy and sanctions fail. This report will be updated as events warrant. Background Kosovo, a region in southern Serbia, has a population of 2 million and is one of the poorest regions of the former Yugoslavia.1 It has been the focal point of bitter struggles between Serbs and Albanians for centuries. -

THE DRAFTING PROCESS FOR THE 1998 ALBANIAN CONSTITUTION Scott N. Carlson INTRODUCTION With its adoption of a new constitution in 1998, the Republic of Albania joined the ranks of other Central and East European nations who have now adopted democratic constitutions. For Albania, the new constitution provides a historic foundation upon which to forge an independent, democratic future. Throughout recent history, Albania has endured domination and rigid control at the hands of regional powers, and even when independent, the country has suffered under autocracy. The most egregious example of the latter, the Stalinist dictator, Enver Hoxha, led post-World War II Albania into 45 years of exile from the international community. With its adoption of a democratic constitution, Albania took a significant step towards solidifying its democracy and joining the community of nations who rely on constitutions to structure and safeguard their democratic systems of government. While the history of domination and isolation does not fully explain Albania’s delay in the adoption of a new constitution, it does shape the context in which constitutional reform developed. In particular, it helps to explain the lack of constitutional materials in the Albanian language, the lack of familiarity and experience with modern democratic institutions and human rights, and both international and local agreement on the necessity for extensive foreign input. The introduction of a new constitutional system or structure necessarily entails challenges. Even a completely tried and tested system or structure may fail when introduced into a new environment. The process of legal transplantation is a delicate one, and the host state can reject the introduction of foreign legal concepts for a variety of reasons. -

Adem Demaçi Sakharov Prize 1991 Standing up to the harsh repression of the Serbian regime, the ‘Mandela of the Balkans’ devoted himself to the promotion of tolerance and ethnic reconciliation in Kosovo. Las Madres de Plaza de Mayo Sakharov Prize 1992 The ‘Mothers of the Plaza de Mayo’ led a peaceful resistance movement against the military dictatorship and repression in Argentina in response to the forced disappearance and torture of political opponents. Oslobođenje Sakharov Prize 1993 The journalists of Sarajevo’s Oslobođenje newspaper risked their lives fighting to maintain the unity and ethnic diversity of their country during the war in the former Yugoslavia. Taslima Nasreen Sakharov Prize 1994 Exiled from Bangladesh and Bengal for her secular views, the writer Taslima Nasreen fights against the oppression of women and opposes all forms of religious extremism. Leyla Zana Sakharov Prize 1995 The first Kurdish woman to be elected to the Turkish Parliament, Leyla Zana’s fight for democracy symbolises her people’s struggle for dignity and human rights. -
Youth Policy in Albania Council of Europe in 1997
ID 9540 Albania is the seventeenth country to have undergone an international review of its national youth policy, a series which was started by the Youth policy in Albania Council of Europe in 1997. The review was performed in 2009 during two one-week visits by a team of international experts working on the basis of the Albanian National Youth Strategy, published in 2007. The report focuses on three issues identified by the Albanian government: the law, delivery mechanisms and youth participation, and three issues identified as important by the review team itself: youth information, leisure-time activities and youth crime and justice. While reviewing the youth policy in Albania with special attention to theses issues, the international team came across a number of specific or cross-sectoral subjects (education, health, minorities, etc.) which helped depict a broad picture of the situation of young people in the country. Recommendations made by the international team, cover not only government action, but address steps to be taken by those who take part, at all levels, in the shaping of youth policy in Albania. Youth policy in Albania The Council of Europe has 47 member states, covering virtually the entire continent of Europe. It seeks to develop common democratic and legal principles based on the European Convention on Human Rights and other reference texts on the protection of individuals. Ever since it was founded in 1949, in the aftermath of the Second World War, the Council of Europe has symbolised reconciliation. Bartkowski boulder london 15 Kosovo: Civil Resistance in Defense of the Nation, 1990s Howard Clark Each year on March 5–7, Kosovo celebrates the Epopee of the Kosova Liberation Army (KLA)—the anniversary of the 1998 gun battle in the village of Donji Prekaz where Adem Jashari, a founder of the KLA, and more than fifty of his family members were killed. The Jashari home is now a shrine. The Epopee includes the Night of Flames when fifty fires are lit and a gathering in Prekaz of Kosovo’s leading dignitaries and the uniformed suc - cessors of the KLA (at one time the Kosovo Protection Corps, now the Kosovo Security Force). The main speeches in 2010 were made by the prime minister and president—at that time Hashim Thaçi, a founder of the KLA, and Fatmir Sejdiu, a founder and leader of the Democratic League of Kosova (LDK), the party most associated with the nonviolent struggle. Sejdiu began, On March 5, 1998 . the legendary Commander of the Kosovo Libera - tion Army, Adem Jashari, and his father Shaban and his brother Hamëz, fell on the altar of freedom. That day, besides these three martyrs, many other children and members of Jashari family were deprived of their lives. But, by virtue of their matchless sacrifice, they were decorated with the most precious and gilded crown in the history of our long-lasting war for freedom and independence and turned into an incomparable symbol of sublime self-sacrifice for the homeland. -

PER CURIAM: Xhevat Gashi, a native and citizen of Kosovo, through counsel, petitions for review of the Board of Immigration Appeals’ (“BIA”) decision denying his motion to reopen his proceedings regarding his application for asylum, filed pursuant to 8 U.S.C. §§ 1158, 1231. Gashi argues that the BIA should have granted his motion to reopen because he presented new and material evidence of changed country conditions in Kosovo that supported his application for asylum. For the reasons set forth more fully below, we deny Gashi’s petition for review. Gashi arrived in the United States under the visa waiver program and was referred to the Immigration Judge (“IJ”) for asylum-only proceedings. Gashi filed an application for asylum, alleging that he was persecuted in Kosovo on account of his nationality as an ethnic Albanian and his status as a member of the Democratic League of Kosovo (“LDK”). The IJ denied Gashi’s applications for relief, finding that Gashi had not met his burden of establishing that he suffered past persecution in Kosovo or had a well-founded fear of persecution there on account of one of the protected grounds. -

National Myths in Interdependence: The Narratives of the Ancient Past among Macedonians and Albanians in the Republic of Macedonia after 1991 By Matvey Lomonosov Submitted to Central European University Nationalism Studies Program In partial fulfillment of the requirements for the degree of Master of Arts CEU eTD Collection Advisor: Professor Maria Kovács Budapest, Hungary 2012 Abstract The scholarship on national mythology primarily focuses on the construction of historical narratives within separate “nations,” and oftentimes presents the particular national ist elites as single authors and undisputable controllers of mythological versions of the past. However, the authorship and authority of the dominant national ist elites in designing particular narratives of the communal history is limited. The national past, at least in non- totalitarian societies, is widely negotiated, and its interpretation is always heteroglot . The particular narratives that come out of the dominant elites’ “think-tanks” get into a polyphonic discursive milieu discussing the past. Thus they become addressed to alternative narratives, agree with them, deny them or reinterpret them. The existence of those “other” narratives as well as the others’ authorship constitutes a specific factor in shaping mythopoeic activities of dominant political and intellectual national elites. Then, achieving personal or “national” goals by nationalists usually means doing so at the expense or in relations to the others. If in this confrontation the rivals use historical myths, the evolution of the later will depend on mutual responses. Thus national historical myths are constructed in dialogue, contain voices of the others, and have “other” “authors” from within and from without the nation in addition to “own” dominant national ist elite. -

(Signature) ……………………………………………………………………………… Page 1 of 181 Abstract This thesis aims to determine how and why Rome undertook a series of interventions in Illyria during the period of 230 – 167 BC. The thesis is based on a detailed examination and consideration of the ancient written sources and the subsequent historiography on the subject. The Roman interventions in Illyria during this period have traditionally been treated as a component of wider studies of Roman expansion, although Rome’s involvement in Illyria has recently been examined by Dzino in his 2010 work Illyricum in Roman Politics 229BC-AD68. This work examined the development and integration of Illyricum in Roman political discourse, in which the Roman interventions were a smaller component in the broader study. A study of the Roman interventions in Illyria during the period of 230 – 167 BC has never previously been treated on this scale, nor effectively with a synthesis of the various approaches and pieces of evidence that are now available.
