The genealogy of this norm goes back to the lost concept of “cultural genocide,” or the destruction of a group’s unique characteristics. This latter concept was originally stillborn while drafting the 1948 Genocide Convention because a majority of countries assumed that assimilation, or the absorption of outsiders into dominant structures, was something normal and desirable in the construction of modern nation- states. Yet this old assumption fell out of date by the 1970s, as evidenced by the shift in the International Labor Organization from the 1957 Indigenous and Tribal Populations Convention (No. 107) to the 1989 Indigenous and Tribal Peoples Convention (No. 169). The abandoned norm of “cultural genocide” (also perplexingly referred to as “ethnocide”) was revived in this broader intellectual context. These two keywords were actually used in the original draft of what became Article 8 of the 2007 Declaration, but they were explicitly redacted from the final text due once again to more powerful interests. This hidden history exposes a paradox in international norm dynamics between competing currents of continuity and change. On the one hand, the 2007 Declaration is the outcome of what I describe as settler colonial globalism, or the logics of sovereignty ii and capitalism in the contemporary era of neoliberalism. Such an ideological filter was responsible for the carefully scripted wording of this international legal instrument. On the other hand, even with its textual redactions, Article 8 remains rooted in a spirit of Indigenous survival and resistance, not to mention the productive capacity of non-state actors to affect change in global affairs. The articulation of cultural integrity as a human right symbolizes a definitive break with the historical patterns that I identify as the normalcy of assimilation. In order to problematize the apparent “progress” of international norms in relation to certain continuities of power in global governance, however, I employ a theory of co-optation, defined as the incorporation of resistant elements into a dominant structure. iii ACKNOWLEDGEMENTS I would like to begin by acknowledging, first and foremost, that this dissertation was completed in Lenapehoking, which is the ancestral homeland of the Lenape people, and which is, moreover, an occupied territory upon which I have made my home.1 It is further necessary for me to admit my own biased standpoint in this geographical and political context. I am a settler American who has been scholarly trained by a land-grant institution of higher education. The land-grant system dates back to a federal statute passed by the Thirty-seventh Congress (1861-1863) as part of a number of bills that transferred massive amounts Indigenous territories to the settler colonial public domain.2 As such, my experience is implicated in a larger structure of domination, for in no uncertain terms, I am personally benefitting from the legacies of settler colonialism. My school, Rutgers, the State University of New Jersey, is a land-grant institution in Lenapehoking that was founded in 1766, although my campus (Newark) was incorporated in 1946. Not that this late arrival makes it any better.     Concept note and agenda REGIONAL MEETING ON ETHNICITY AND HEALTH IN THE AMERICAS 7-8 December 2015 Introduction Available data indicates that indigenous and afrodescent peoples are amongst the most marginalized populations of the region, encountering considerable challenges with regards to social and health conditions and with higher levels of rurality or urban marginality, unemployment, poverty, and illiteracy. They have less access to, and lower utilization of, health services, particularly quality health services, as compared to the rest of the population. Therefore, their health outcomes are poorer, presenting greater morbidity and mortality both from communicable and chronic diseases as well as external causes. Since 1993, the Pan-American Health Organization (PAHO) approved significant Resolutions to address these challenges and to advance the work on ethnicity and health in the region. In 1993, Member States reached consensus in recognizing the deficits in both living conditions and health among the indigenous peoples of the Americas. The Resolution 1 aimed to implement the SAPIA initiative (Health of the Indigenous Peoples Initiative of the Americas) and was reinforced by other two Resolutions on indigenous peoples approved in 1997 and 2006 2. The Strategy for Universal Access to Health and Universal Health Coverage, approved in 2014, specifically refers to indigenous and afro-descendant as some of the most affected groups facing problems of exclusion and lack of access to appropriate quality services. In addition, at global levels, there has been increasing attention to indigenous and afrodescent issues: the World Conference on Indigenous Peoples (WCIP) was held at the United Nations General Assembly in September 2014.

From a very early age I found myself standing in an undefinable awe before the natural world. An attitude of gratitude, wonder, and a sense of protection especially as I began to see the hills being bulldozed down for roads, and the forests of the Pacific Nothwest magically float away on logging trucks. I grew up in a rural family in the state of Washington. My grandfather was a homesteader in the Pacific Northwest. The economic base of the whole region was logging. In trying to grasp the dynamics of what was happening, rural state of Washington, 1930's, depression, white boy out in the country, German on one side, Scotch- Irish on the other side, radical, that is to say, sort of grass roots Union, I.W.W., and socialist-radical parents, I found nothing in their orientation, (critical as it was of American politics and economics), that could give me an access to understanding what was happening.

The resulting well-written, nuanced examination of a unique German national identity, that of colonial Germans, integrates the German colonial experience into Weimar and Nazi history in new and substantive ways.

    10 1. THE HARMLESS DRUDGE : DEFINING ETHNOMUSICOLOGY DEFINITIONS. For years, people have been asking me the question: "You're an ethnomusicologist?" Shortly after 1950 it was likely to be accompanied by expressions of wonder and of the belief that I was somehow involved with "folk" music, with "primitive music," and particularly with "ancient music," and also that I must have a great deal of companionship with a tape recorder. By 1960 the questioner would likely bring up participation in an Indonesian gamelan, or perhaps an ability to "play" many of the world's odd instruments. In the 1970s, the conversation might well include the term "ethnic" music or even the etymologically outrageous "ethnomusic," and in the eighties and nineties, free association might lead to “diversity” and “world music.” I have always found it difficult to come to a precise, concise, and readily intelligible definition. Dictionaries differ considerably but espouse limited views. In the 120 years in which modern ethnomusicology can be said to have existed, since pioneer works such as those of Ellis (1885), Baker (1882), and Stumpf (1886), attitudes and orientations have changed greatly, and so has the name, from something very briefly called “Musikologie” (in the 1880s), to “comparative musicology” (through about 1950), then to “ethno- musicology” (1950–ca. 1956), quickly to “ethnomusicology” (removing the hyphen actually was an ideological move trying to signal disciplinary independence), with suggestions such as “cultural musicology” (Kerman 1985) and “socio-musicology” (Feld 1984) occasionally thrown in. The changes in name paralleled changes in intellectual orientation and emphasis. It is difficult to find a single, simple definition, to which most people in this field would subscribe, and thus ethnomusicologists have been perhaps excessively concerned with defining themselves.

The findings also indicated that the deep rooted perceptions of differences have caused each clan to perceive itself as an independent tribe and not clan of the same Kuria ethnic group. Additionally, categorization has lead clan groups to share the available resources based on the existing groups. This evokes prejudices and inter-clan competition over resources which consequently lead to inter- clan conflict. It was concluded that strategies such as seminars, use of media and integrated education can be used to reduce the perceived inter clan differences, cultivate inclusive identity and increase inter clan social cohesion. As human beings began to navigate the surface of the earth thousands of years ago they learned the nuances of the land and the creatures that inhabited it, and they began to relate this knowledge to their fellow man. At the beginning this knowledge may have been transmitted as a simple sound or gesture: a cry of warning or an eager nod of the head. But as time went on, humans began to string together these sounds and bits of knowledge into words, and then into story, and sometimes into song.
