MEETING MINUTES OF THE ITALIAN UIA NATIONAL COMMITTEE, MAY 21ST, 2018 On May 21st, 2018, 11,00 a.m. in Florence, at the Courthouse - Bar Association, hall Adone Zoli, an extraordinary session of the Italian UIA National Committee is held. The following lawyers are present: Aldo Bulgarelli, Lilia Lucia Petrachi, Carlo Mastellone, Guido Lachi, Mario Napoli, Bruno Micolano, Manfredi Burgio, Claudio Coggiatti, Stefano Dindo, Paolo Rosini, Walter De Agostino, Laura Pibiri, Elena Borsacchi, Daniele De Benedetti, Simone Lazzerini an Silvia Lenzetti. By means of proxy: the Florence Bar and Gianluca Pojaghi (proxy to Carlo Mastellone); the Turin Bar (proxy to Mario Napoli); Maria Cristina Creti, Alessandro Colavolpe, Caterina Coggiatti and Raffaele Rizzi (proxy to Claudio Coggiatti); Corrado De Martini, Pietro Bellante and the Bar of Verona (proxy to Daniele De Benedetti); Francesca Conte and Nicola Putignano (proxy to Lilia Lucia Petrachi). President Bulgarelli declares the Italian National Committee meeting duly constituted, introducing the agenda after the ritual gratitude: 1) Approval of the proposed amendments to the Statute; 2) Setting up of Local Operational Headquarters/ Regional Representatives; 3) Organisational aspects of the UIA Higher Education School; 4) Conventions with Italian Universities; 5) Italian website. _________________ Pt. 1 of the agenda) Approval of the proposed amendments to the Statute: those present examine the modifications, suggested by adv. Corrado De Martini1, to the Statute of the Italian UIA National Committee: after a thorough discussion, the Committee unanimously approves the adoption of the amendments, with the following variations: a) Terminology (“Regulations” vs “Statute”): the UIA centre in Paris will be requested for clarifications; b) the Italian Committee will be defined as a “locally based body”; c) the Headquarters of the Italian UIA Committee are established in 50127 Florence, Viale Alessandro Guidoni n. 61, at the Bar Association (New Courthouse, Block G, second floor). The full text of the new Statute is attached hereunder, sub “B”. Pt. 2 of the agenda) Setting up of Local Operational Headquarters/ Regional Representatives: the Committee aknowledges the following Regional Operational Headquarters (Sezioni Regionali del 1 Attached sub “A”. Comitato Italiano), related to the Court of Appeal Districts listed below (together with the names of the respective Presidents and Secretaries, appointed by the Italian Committee): 1. Pt. 3 of the agenda) Organisational aspects of the UIA Higher Education School; Pt. 4 of the agenda) Conventions with Italian Universities. Pt 3 and 4 are dealt together, because of their close connection. Adv. Carlo Mastellone sheds light on the project for the creation of the UIA Higher Education School, inclusive of EU Law, International Law and Human Rights courses. Adv. Stefano Dindo mentions the already existent Convention with the University of Verona, highlighting the importance of ad hoc Conventions: the issue of involving the Universities is complex and delicate, and demands the best practice. Adv. Mastellone believes that is necessary to establish “Framework Conventions” with the Universities, with specific Conventions included inside (following the pattern provided by the University of Cassino). The creation of a Commission, to be involved with the works for the Conventions with the Universities is also necessary. The application form for specialist associations must be submitted before June 30th, 2018 (and also the Universities have urgent necessities for the 2019 budget, to cover the costs of the events already organised – financing the young people who can thus participate in the activities abroad). The idea is involving three Universities for the “International Business and Trade Law” Area and three Universities for the “European and International Protection of Human Rights” Area. In order to stipulate the Convention with the National State Bar, said Universities need to cover as much national territory as possible. The bodies at the moment identified are the following: Milano, Verona (Venezia?), Bologna, Roma III, Salento. Carlo Mastellone continues: from January 1st, 2019, 200 h/year of specialised training must be guaranteed. 50h/year will be offered through the training events organised overseas by the UIA Centre, i.e. the annual Congress, seminars and training courses (1 seminar = 12 h); the other 50h/year will be covered through the sessions held at the Universities. Adv. Claudio Coggiatti considers preferable to organise two different seminaries of 6h+6h, rather than a single one of 12h so that it is possible for the participants not to stay overnight and cut the costs accordingly; the annual Congress is worth 20h. Thanks to the high training offered, the title of Specialist Lawyer may be provided. Stefano Dindo urges a reflection on the world of the Universities. A number of participants between 25 and 50 units would mean a reduced presence for individual events. Therefore, one must consider whether it is right to involve six Universities right away, not knowing where the participants may come from. Aldo Bulgarelli suggests to limit, for the time being, the Universities involved to those with which there are already existing relationships: Firenze, Roma, Milano, Salento. Adv. Bruno Micolano wonders about the nature of the courses: closed and reserved, or open? Aldo Bulgarelli asks the following question: what to do in case the UIA Headquarters demands the participation of people enrolled with the UIA, exclusively? Should it be considered to register such participants in the association? Adv. Lilia Lucia Petrachi disagrees, and Carlo Mastellone also raises concerns: after all, the UIA needs to be promoted and the enrolment cannot be mandatory. Hopefully, if the offer was valid and well organised, the participants will decide to join the association at the end of the courses. Organising open courses will bring in both participants to the school and external subjects. The school does not have to be a mere summation of seminars. It is confirmed that the Higher Education Courses in Human Rights organised by Lilia Lucia Petrachi (always with the UIA patronage) can be used as lesson hours. It takes an organisational effort to achieve a balance (“Human Rights” on the one hand, “Business” on the other), as well as an administrative endeavour (to organise and manage school enrollments). At this point, the Italian UIA National Committee unanimously approves to apply for the registration of the UIA in the list of the most representative specialised forensic associations, held at the National Bar. Such certification is a pre-condition for realising a specialised training courses oriented to the exercise of the profession in the dedicated areas of European Union Law and International Law, to be organised under the Conversions eventually signed with the National Bar Association under art. 7 Ministerial Decree of August 12, 2015, n. 144; the Committee also expressly delegates the President to apply for inclusion in the list of the most representative specialistic forensic associations referred to in art. 35, par. 1, letter s) of the law December 31, 2012, n. 247, and to stipulate appropriate agreements with the National Bar and the Italian Universities. Those present also deliberate the appointment of at least one reference person for each “affiliated” University, members of the (internal) Management Committee “UIA School of Advanced Specialisation Training in European Union Law, International Law and Human Rights”. Mario Napoli asks whether having such a large Management Committee is the right choice: the answer is that, for each University, there is a need of at least one person on the territory; the additional members will, in any case, be active for field reports.
