1. Declarations of Interest

In terms of Standing Order 16 and Section 5 of the Code of Conduct for Councillors, Councillor Reid, as a member of the group, declared a non-pecuniary interest in Urgent Agenda Item 10.1 (Community Development Grants Scheme and Local Youth Action Fund: Application for Financial Assistance) and took no part in the determination of the application from Promoting Kilwinning.

2. Minutes

The accuracy of the Minutes of (i) the ordinary meeting of the Committee held on 12 September 2013; and (ii) the special meeting held on 25 September 2013 was confirmed and the Minutes signed in accordance with paragraph 7(1) of Schedule 7 of the Local Government (Scotland) Act 1973.

3. Presentation: Transport Scotland/TranServ: Whitehirst Park Wetland Area

The Committee received a verbal update by Phil Hinchliff, Area Manager South (Transport Scotland) and Andy Smart, Area Manager (TranServ) in relation to the wetland area at Whitehirst Park.

Page 1 5 TranServ have carried out an investigation into the drainage and gullies around the Whitehirst Park area. Most of the gullies run into a manhole in the wetland area while one gully feeds into a carrier pipe that travels to a manhole which is the property of North Ayrshire Council. The carrier pipe appears to be blocked approximately 25m into the wetland area and the manhole cover appears to require some work carried out before the pipe can be accessed by TranServ to assess the blockage.

An on-site meeting is scheduled to take place next week involving North Ayrshire Council Roads Section and TranServ to attempt to access the blockage and identify the best way forward from that point.

Members asked questions, and received clarification, in relation to the following:-

 the timescales, following the on-site meeting, for any works to be carried out; and  the overall effect clearing the blockage in the carrier pipe should have on the wetland area.

The Committee (a) noted and welcomed the recent progress made in relation to this matter; and (b) agreed (i) that any update information following the site visit next week be provided to the Clerk to forward to Members of the Committee; and (ii) that a follow-up report by the Corporate Director (Development and Environment) be submitted to a future meeting of the Committee.

4. Community Planning

4.1 North Ayrshire Community Planning Partnership (CPP) Board: Minutes of Meeting held on 12 September 2013

Submitted report by the Chief Executive on the meeting of the North Ayrshire Community Planning Partnership (CPP) held on 12 September 2013.

Councillor Steel, as a representative of the Community Planning Partnership Board, advised on the relaunch of the SOA for 2013-2017.

Noted.

4.2 Police Scotland

Inspector Conway provided statistical information on crimes reported and detected in the Committee's area during the period 1 August to 31 September 2013, including comparative information from the same period in 2012, highlighted a number of crimes of note that had taken place in the Committee's area and a range of forthcoming events that will involve local officers. Information was also provided on the policing priorities taking place within the Committee area.

Page 2 6 Members asked questions, and discussed the following:-

 the online petition in relation to policing in the Kilwinning area; and  the 2 serious incidents in Kilwinning in relation to flood damage and a major gas leak and the community appreciation of the support provided by the emergency services and Council officers.

4.3 Scottish Fire and Rescue Service

Submitted report by Scottish Fire and Rescue Service on activity within the Kilwinning area from 1 September to 21 October 2013.

Information was provided on:-

 refuse fires in the bins in the Main Street area; and  the Autumn Strategy in relation to Bonfire night and the work being put in place through the schools liaison officers to encourage attendance at organised displays throughout North Ayrshire.

Members discussed the sale of over-the-counter fireworks and the likelihood of any future changes to legislation in this regard.

5. Abbey Primary School: Education Scotland Report

Submitted report by the Corporate Director (Education and Skills) on the Education Scotland Report in respect of Abbey Primary School.

The inspection, undertaken in June 2013, covered key aspects of the work of the school at all stages, the quality of children's experience in learning, pupils' achievements, the effectiveness of the school, the environment for learning, and the school's processes for self-evaluation.

The HM Inspectors' report was published on 27 August 2013 and identified the key strengths detailed within the report. Two areas for improvement have been agreed between Education Scotland, the school and the Education Authority and were detailed in the report. In consultation with the designated Senior Manager and staff, the headteacher has put plans in place to incorporate the recommendations of the Education Scotland report into the School Improvement Plan. The school and the authority will build on the strengths identified in the inspection report and work together to address the key recommendations identified. In terms of follow-through, HMIE will maintain contact with the school to ensure the necessary improvements are made.

Page 3 7 The Committee (a) asked that the Head Teacher pass on its congratulations to the staff at the school; (b) noted (i) the steps taken to address the key point for action; and (ii) that in terms of follow-through, HMIE will make no further visits but will maintain contact with the school and local authority to monitor progress.

6. Eglinton Country Park

Submitted report by the Corporate Director (Education and Skills) giving an update on recent initiatives at Eglinton Country Park

Information was provided on:-

 the position in relation to the housing development located within Eglinton Country Park;  the provision of new car parking facilities;  plans for the design layout for the zones around the visitor centre in relation to the Breaking Ground Project;  the pilot project in relation to the organic soil area; and  the woodland management training project.

Members asked questions, and received clarification, on the following:-

 possible plans to upgrade the heritage section within the Park;  the recent traffic junction improvements resulting in safer access to the Park;  possible improvements to the security measures to combat unauthorised vehicular access within Eglinton Country Park;  the number of break-ins over the summer period;  the envisaged plan for the Friends of Eglinton project; and  the cancellation of the October Bat Walk event due to severe weather.

7. North Ayrshire Council (Kilwinning) Charitable Trust

Submitted report by the Chief Executive on the new charitable trust fund established for Kilwinning and on the administration of this fund by the Area Committee.

In January 2012, the Council approved a reorganisation scheme whereby the existing trust funds held for the relief of poverty and assistance to those in need would be amalgamated to ensure more effective use of the assets available for disbursement and to simplify the administration of these trust funds. As part of this process, a new Trust Fund has been established for the town of Kilwinning known as the North Ayrshire Council (Kilwinning) Charitable Trust (the 'Kilwinning Trust').

Page 4 8 The Kilwinning Trust has the following 3 trust purposes:-

A the prevention of relief or poverty; B the provision of recreational facilities, or the organisation or recreational activities, with the object of improving the conditions of life for the persons for whom the facilities or activities are primarily intended; and C the relief of those in need by reason of age, ill-health, disability, financial hardship or other disadvantage.

The Committee was further advised of a grant of £5 which has been historically paid annually from the Kilwinning Trust funds to assist a person considered to be poor. It is proposed that the recipient of this grant payment is, in the future, asked to submit an application form for assistance from the Kilwinning Trust but that the payment continue to be made from the Kilwinning Trust until such time as any new application arrangements are finalised.

Members asked questions, and received clarification, on the following:-

 whether it would be in order for the Committee to make a payment in relation to trust purpose B if no applications were received for trust purposes A and C by the end of the financial year; and  the general management of the fund.

The Committee agreed (a) to approve the procedure for considering applications for grants from the North Ayrshire Council (Kilwinning) Charitable Trust; and (b) that the current arrangements in relation to the payment of a grant in the sum of £5 to a Kilwinning resident continue until the new application arrangements are finalised.

8. Community Development Grants Scheme and Local Youth Action Fund: Application for Financial Assistance

Submitted report by the Corporate Director (Education and Skills) on applications for financial assistance received in respect of the Community Development Grants Scheme and the Local Youth Action Fund.

The Committee agreed to make the following awards:-

10. Urgent Items

The Chair agreed that the undernoted items be considered as a matter of urgency to allow the grant request to be processed timeously and for Members to receive up-to-date information.

10.1 Community Development Grant Scheme and Local Youth Action Fund: Application for Financial Assistance

The Committee agreed to make an award of £750 to Promoting Kilwinning from the Community Development Grants Scheme.

10.2 Flooding in Kilwinning

There was discussion on the recent flooding which took place in parts of the Corsehill area of Kilwinning, including Fergushill Road.

The Committee agreed that the Corporate Director (Development and Environment) submit a report to the meeting on 12 December 2013 on the short-term and longer-term arrangements put in place to tackle flooding in this area.

Kilwinning Area Committee

Subject: Traffic Regulation Order for School Keep Clear zig zag markings

Purpose: To advise the Committee that a Traffic Regulation Order will be promoted to make School Keep Clear zig zag markings legally enforceable within North Ayrshire.

Recommendation: That the Committee notes the content of the report.

1. Introduction

1.1 Traffic congestion at school opening and closing times is often caused by parents parking inappropriately as near to the school entrance as possible. Often these cars cause a danger to pedestrians and cyclists as they block the footpath or reduce visibility when children are crossing the road.

2. Current Position

2.1 The Traffic Signs Regulations and General Directions 2002 (as amended) permits local roads authorities to provide School Keep Clear zig zag road markings outside schools in order to control short term parking at entry/exit times. This marking can either be provided on an advisory basis or can be made legally enforceable when used in conjunction with an appropriate traffic sign and backed by a Traffic Regulation Order (TRO).

2.2 Historically many schools within North Ayrshire have advisory School Keep Clear zig zag road markings in place, which rely on voluntary compliance by parents.

2.3 Many schools are very concerned about the increased level of traffic management problems on the roads surrounding the school campus and following discussions with Police Scotland, it is considered appropriate to introduce this TRO to assist Police Scotland in carrying out their enforcement duties.

19 2.4 In North Ayrshire, the School Travel Plan Officer is responsible for the development and promotion of active travel initiatives within schools. A key element of this role is to encourage and support families to find healthy and sustainable travel modes on the school journey which could reduce the number of vehicles parking at schools. Some of the initiatives that are being promoted include School Travel Plans, Park and Stride, Walk to School Week and Cycle to School Day.

3. Proposals

3.1 It is proposed to introduce a TRO that will allow Police Scotland to enforce, under the Road Traffic Regulation Act 1984, the prohibition of stopping or parking on existing School Keep Clear markings between the hours of 8.00 am and 5.00 pm, Monday to Friday. This TRO only relates to existing School Keep Clear markings and does not propose to introduce any new markings at this time.

3.2 School Keep Clear markings are currently in place on public roads at all schools within the Kilwinning Area with the exception of Kilwinning Academy and Pennyburn Primary School.

3.3 It is proposed that the Committee notes the above.

4. Implications

Financial Implications

4.1 The cost of promoting/advertising the TRO, making amendments to some of the existing road markings and erecting a pole and traffic sign at each location, will be sourced from the existing revenue budget within Development Planning Services (Roads) and a programme of works would be undertaken over a number of years.

5.1 Consultation has taken place with Police Scotland and NAC Education Services who support this proposal.

6. Conclusion

6.1 The safety of children immediately outside many schools within North Ayrshire is frequently raised as a significant concern by many parents, due to the large volume of cars either dropping off or collecting children at schools.

6.2 While many schools have School Keep Clear markings already in place, these are advisory and are unable to be enforced by Police Scotland. In order to assist Police Scotland in managing inconsiderate parking outside schools, the Council will promote a TRO to introduce a restriction on stopping or parking on School Keep Clear zig zag markings between the hours of 8 am and 5 pm, Monday-Friday.

11. In which way does this application address Council priorities?

Safe and Secure:  Increase levels of public reassurance about community safety.

Children's Health and wellbeing is improved through breaking the cycle of poverty, inequality and poor outcomes:  Child and young people are safe, healthy, active, aspiring and achieving.  The life chances of vulnerable children and young people are improved.

North Ayrshire residents feel safer and communities are empowered:  Fear of crime and antisocial behaviour has reduced.  More residents engage in community activities and volunteering.

12. How will the expenditure develop the group/organisation and benefit the local community?

By replacing damaged/unsafe existing furniture, it will provide a more comfortable meeting place for the local community and groups who meet within the Centre.

13. How does the application show innovation or development?

I see no real evidence that the application shows innovation or development as it is merely an application to replace equipment.

14. Overall assessment?

I agree with the ethos behind the application to provide a more comfortable setting for people to meet, but I am sure the group could source furniture a bit cheaper than from IKEA that would serve the purpose just as well.
