EUROPEAN COMMISSION

Initiation of proceedings (Case M.8306 — Qualcomm/NXP Semiconductors) (Text with EEA relevance) (2017/C 197/01)

On 9 June 2017, the Commission decided to initiate proceedings in the above-mentioned case after finding that the notified concentration raises serious doubts as to its compatibility with the internal market. The initiation of proceedings opens a second phase investigation with regard to the notified concentration, and is without prejudice to the final decision on the case. The decision is based on Article 6(1)(c) of Council Regulation (EC) No 139/2004 (1). The Commission invites interested third parties to submit their observations on the proposed concentration to the Commission. In order to be fully taken into account in the procedure, observations should reach the Commission not later than 15 days following the date of this publication. Non-opposition to a notified concentration (Case M.8489 — Cinven/Eurovita) (Text with EEA relevance) (2017/C 197/02)

On 15 June 2017, the Commission decided not to oppose the above notified concentration and to declare it compatible with the internal market. This decision is based on Article 6(1)(b) of Council Regulation (EC) No 139/2004 (1). COMMISSION IMPLEMENTING DECISION of 16 June 2017 on the publication in the Official Journal of the European Union of a request for amendment of a specification for a name in the wine sector referred to in Article 105 of Regulation (EU) No 1308/2013 of the European Parliament and of the Council (Dealurile Zarandului (PGI)) (2017/C 197/04)

THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1), and in particular Article 97(3) thereof, Whereas: (1) has sent an application for amendment of the specification for the name ‘Dealurile Zarandului’ in accordance with Article 105 of Regulation (EU) No 1308/2013. (2) The Commission has examined the application and concluded that the conditions laid down in Articles 93 to 96, Article 97(1), and Articles 100, 101 and 102 of Regulation (EU) No 1308/2013 have been met. (3) In order to allow for the presentation of statements of opposition in accordance with Article 98 of Regulation (EU) No 1308/2013, the application for amendment of the specification for the name ‘Dealurile Zarandului’ should be published in the Official Journal of the European Union,

HAS DECIDED AS FOLLOWS: Sole Article The application for amendment of the specification for the name ‘Dealurile Zarandului’ (PGI), in accordance with Article 105 of Regulation (EU) No 1308/2013, is contained in the Annex to this Decision. In accordance with Article 98 of Regulation (EU) No 1308/2013, the publication of this Decision confers the right to oppose the amendment of the specification referred to in the first paragraph of this Article within two months of the date of its publication in the Official Journal of the European Union.

2. Description and reasons for the amendment 2.1. Amendment to the demarcated area The area demarcated for the production of wines with the geographical indication ‘Dealurile Zarandului’, which stretches across Arad County, is to be extended to include the localities Zăbrani, Neudorf, Frumuşeni, Cruceni, Fiscut, Firiteaz, Hunedoara Timişană, Dud and Agrişu Mare. The configuration of the final geographical area for which protection of wines with the geographical indication is requested will therefore be as follows:

The white wines obtained around Lipova, Zăbrani and Neudorf have the typical minerality and flavour of wines from the southern part of the Miniș-Măderat vineyard area. Due to the abundance of the harvests, they have rela­ tively high acidity, which is slightly lower at first contact, and well-shaped primary aromas. In contrast, the red wines maintain the special depth of colour characteristic of the entire Miniș-Măderat vineyard area: a purplish hint against a dark but brilliant ruby-red background. The wines are extractive. According to ONVPV statistics for 2012, 2013 and 2014, the dry extract content of white wines may reach levels of up to 19-20 g/l (Sauvignon), while for red wines it can go up to 27,55 g/l (Cabernet Sauvignon). Wines produced in the northern part of the region (Dud, Agrișu Mare, Luguzău) are finer and have a more pronounced acidity, due to the same marked extractivity: 19,44 g/l for white wines (Pinot gris and Sauvignon) and 27,63 g/l for red wines (Merlot). 21.6.2017 EN Official Journal of the European Union C 197/5

A description of the wines produced in the localities extending the area provides an explanation for their analytical and organoleptic specificities. A comparative analysis of wines produced from several varieties cultivated in both the old area and in the recently included localities over the last four harvest years shows that: the natural alcoholic strength of the Mustoasă de Măderat variety ranges from 11,76-12,30 % alcohol, total acidity 6,0 g/l tartaric acid, total dry extract 18,15-19,85 g /l; the natural alcoholic strength of the Riesling Italian variety ranges from 10,60-12,35 % alcohol, total acidity 5,20-6,30 g/l tartaric acid, total dry extract 17,20-21,10 g /l; the natural alco­ holic strength of the Merlot variety ranges from 12,50-13,00 % alcohol, total acidity 6,10-6,50 g /l tartaric acid, total dry extract 24,65-27,55 g/l; and the natural alcoholic strength of the Cabernet Sauvignon variety ranges from 12,20-12,60 % alcohol, total acidity 4,70-6,69 g/l tartaric acid, total dry extract 20,63-24,75 g /l. Significant simi­ larities in terms of freshness and fruitiness were found in white varieties cultivated in the Lipova, Radna, Zăbrani, Neudorf, Păuliş and Baraţca localities. Strikingly similar secondary flavours are observed in white varieties of wine from plantations in the Şagu, Cruceni, Fiscut, Firiteaz, Hunedoara Timişană and Frumuşeni localities. The brown chernozem soil yields wines which are extractive, full bodied and full of taste in the Şilindia, Satu Mic, Luguzău, Dud and Agrişu Mare localities. It is no coincidence that vines have been cultivated on these lands since ancient times.

A combination of a poor understanding of European policy on the protection of areas demarcated by a geographi­ cal indication and a lack of wine producers' associations at the time Romania joined the European Union resulted in some localities with ancient traditions of producing specific quality wines being omitted from the Dealurile Zarandului area.

8. Description of the link(s) Link with the demarcated area The specific natural factor is provided by the Zarand foothills, which are characterised by skeletal soils rich in iron and microelements. These recesses between hills provide a variety of topoclimatic conditions, specific to individual vineyards in this area, in conditions that are similar in terms of geoclimatic position and variety cultivated.

The vine plantations have a predominantly southern exposure, with some exceptional south-western and south- eastern exposures. As a result, different individual vineyards, located at the same latitude and longitude and culti­ vating the same variety of grape, are distinguished from one another by a variety of topoclimatic characteristics. The steep terraced slopes used for the cultivation of vines break up and limit the force of winds and cold air currents. During calm weather, the heating of the slopes ensures a gentle circulation of air, which is favourable to the plants' physiological processes and to bringing out the qualities of the grape berries. The slopes prevent stagna­ tion of excess water, aiding the heating of the soil and preventing grey mould colonisation.

The microclimate, with its Mediterranean influences, results in early, wet springs and long, warm, dry autumns. Ecoclimatic data: annual average temperature: 11,2 °C, total annual precipitation: 644 m m, total active tempera­ tures: 3 291 °C, total sunshine hours: 1 490, total active precipitation: 365 mm. The ten-year average for relative humidity is around 75 %. The wines obtained from skeletal, ferruginous soils have a b right red colour with deep ruby highlights and are very generous and expressive.

An organoleptic assessment of the wines produced on the Zarand foothills reveals a high colouring intensity in the red varieties, with strong bluish highlights in young wines that turn to brick-red as the wines mature. From an astringent tannic taste when young, the wine becomes balanced, firm, pleasant, full-bodied and velvety as it ages. 21.6.2017 EN Official Journal of the European Union C 197/11

A comparative analysis of wines produced from several varieties cultivated in both the old area and in the recently included localities over the last four harvest years shows that: the natural alcoholic strength of the Mustoasă de Măderat variety ranges from 11,76-12,30 % alcohol, total acidity 6,0 g /l tartaric acid, total dry extract 18,15-19,85 g /l; the natural alcoholic strength of the Riesling Italian variety ranges from 10,60-12,35 % alcohol, total acidity 5,20-6,30 g/l tartaric acid, total dry extract 17,20-21,10 g/l; the natural alco­ holic strength of the Merlot variety ranges from 12,50-13,00 % alcohol, total acidity 6,10-6,50 g /l tartaric acid, total dry extract 24,65-27,55 g/l; and the natural alcoholic strength of the Cabernet Sauvignon variety ranges from 12,20-12,60 % alcohol, total acidity 4,70-6,69 g /l tartaric acid, total dry extract 20,63-24,75 g/l. Significant simi­ larities in terms of freshness and fruitiness were found in white varieties cultivated in the Lipova, Radna, Zăbrani, Neudorf, Păuliş and Baraţca localities. Strikingly similar secondary flavours are observed in white varieties of wine from plantations in the Şagu, Cruceni, Fiscut, Firiteaz, Hunedoara Timişană and Frumuşeni localities. The brown chernozem soil produces wines which are extractive, full bodied and full of taste in the Şilindia, Satu Mic, Luguzău, Dud and Agrişu Mare localities. It is no coincidence that vines have been cultivated on these lands since ancient times.

APPLICATION FOR A NEW AMENDMENT TO THE PRODUCT SPECIFICATION ‘DEALURILE CRIŞANEI’ PGI-RO-A0106-AM01 Date of submission: 3.6.2015 1. Rules applicable to the amendment Article 105 of Regulation (EU) No 1308/2013 — Non-minor amendment

2. Description and reasons for the amendment 2.1. Amendment to the demarcated area The Association of Wine Producers of the traditional vineyards of Satu Mare has submitted an application to mod­ ify the specifications for the Dealurile Sătmarului GI, to extend the demarcated production area to include localities which have the specific characteristics of the Satu Mare area. These localities were incorrectly included in the demarcated area of the specifications for the Dealurile Crișanei GI, given that there is a series of arguments regard­ ing the location and the eco-pedoclimatic factors in those localities, which are specific to the area of the indication Dealurile Sătmarului and not Dealurile Crișanei. The above is supported by information regarding the wines from the wine-growing region of Dealurile Sătmarului, i.e. from Rătești, which have long been produced and known under the designation ‘Dealurile Răteștilor’ or ‘Vinul de Halmeu’.

The inclusion of the localities in question in the Satu Maru area and therefore within the indication Dealurile Sătmarului and not in Dealurile Crișanei, is supported by data regarding the relief and climate of hills such as Ardud-Beltiug-Hurez, Hododului, Tășnad-Săuca-Pir, Săcășeni-Supur, Tășnad-Cehal, which have steeper slopes with terraces mitigating their inclines, Pleistocene soils of red clays and north-facing slopes with gentler inclines covered with more podzolic soils. Mediterranean influences permit the development and production of wines with floral or fruity aromas (forest berries of Pinot noir, Merlot, Burgund mare), as well as peppery or grassy wines with pleasant primary notes (Fetească albă, Furmint). The flavours are typical of the variety: round, tannic, velvety and with mod­ erate astringency, full-bodied, fresh (white wines).

The localities which are being removed from the area of the geographical indication Dealurile Crişanei are located in the county of Satu Mare. They are:

Description of the link(s) Link with the demarcated area The specific natural feature of the environment is the Crișul Repede river area, bounded on the north by the Șes mountain, gentle hills close to the plain and the influence of the Central European climate, causing a certain reduc­ tion in temperatures and increased rainfall variability. Winters in this area are milder, and wine-growing areas enjoy a significant amount of sunshine while being sheltered from winds and cold currents.

In the wine-growing areas of Diosig and Valea lui Mihai, the area of Silvania and the wine-growing centres of Biharia and Tileagd there are vineyards distributed over a large area, to the north and north-east of the . The wine-growing centres of the wine areas (Diosig, Săcuieni and Sâniob) have a tradition dating back to 1569-1578. The white wines produced here are rich, with an expressive taste and a strong acidic and fruity character. The varieties with particular potential in this wine-growing area include Fetească albă, Fetească regală, Riesling Italian and the aromatic Muscat Ottonel. The wines of this area have a well-balanced structure. The oenoclimatic potential of the wine-growing region has a score of 4 287 on the hydro-helio-thermal index. This means that the region is particularly suitable for white wines, which have expressive aromas of acacia flowers, green apples and cut grass (Fetească regală), with a l ong finish (Tămâioasă românească), ripe pears, notes of vanilla when matured in oak barrels, with prominent exotic notes of pineapple (Chardonnay), balanced and with good acidity. Red wines are full-bodied, velvety, round, with aromas of cherries to ripe sour-cherries with ageing in the case of Pinot noir, peppery notes in the case of Syrah, and typical forest fruits — fresh raspberries in the case of Merlot.

1. Notice for the attention of Fared Saal whose name was added to the list referred to in Articles 2, 3 and 7 of Council Regulation (EC) No 881/2002 imposing certain specific restrictive measures directed against certain persons and entities associated with the ISIL (Da'esh) and Al-Qaeda organisations, by virtue of Commission Regulation (EU) 2017/1094 (2017/C 197/11)

1. Council Decision (CFSP) 2016/1693 (1) calls upon the Union to freeze the funds and economic resources of the members of the ISIL (Da'esh) and Al-Qaeda organisation and other individuals, groups, undertakings and entities associated with them, as referred to in the list drawn up pursuant to UNSCR 1267(1999) and 1333(2000) to be updated regularly by the UN Committee established pursuant to UNSCR 1267(1999).

The list drawn up by this UN Committee comprises:

— ISIL (Da'esh) and Al-Qaeda;

— natural or legal persons, entities, bodies and groups associated with ISIL (Da'esh) and Al-Qaeda; and

— legal persons, entities and bodies owned or controlled by, or otherwise supporting, any of these associated persons, entities, bodies and groups.

Acts or activities indicating that an individual, group, undertaking, or entity is ‘associated with’ ISIL (Da'esh) and Al-Qaeda include:

(a) participating in the financing, planning, facilitating, preparing, or perpetrating of acts or activities by, in conjunction with, under the name of, on behalf of, or in support of ISIL (Da'esh) and Al-Qaeda, or any cell, affiliate, splinter group or derivative thereof;

(b) supplying, selling or transferring arms and related materiel to any of them;

(c) recruiting for any of them; or

(d) otherwise supporting acts or activities of any of them.

2. The UN Security Council Committee approved on 16 June 2017 the addition of the entry of Fared Saal to the ISIL (Da'esh) and Al-Qaeda Sanctions Committee's list.

Fared Saal may submit at any time a request to the UN Ombudsperson, together with any supporting documentation, for the decision to include them in the UN list referred to above, to be reconsidered. Such request should be sent to the following address:

Further to the UN decision referred to in paragraph 2, the Commission has adopted Regulation (EU) 2017/1094 (1), which amends Annex I to Council Regulation (EC) No 881/2002 of 27 May 2002 imposing certain specific restrictive measures directed against certain persons and entities associated with the ISIL (Da'esh) and Al-Qaeda organisations (2). The amendment, made pursuant to Article 7(1)(a) and 7a(1) of Regulation (EC) No 881/2002, adds the name of Fared Saal to the list in Annex I of that Regulation (‘Annex I’).

The following measures of Regulation (EC) No 881/2002 apply to the individuals and entities included in Annex I:

(1) the freezing of all funds and economic resources belonging to the individuals and entities concerned, or owned or held by them, and the prohibition (on everyone) on making funds and economic resources available to any of the individuals and entities concerned or for their benefit, whether directly or indirectly (Articles 2 and 2a); and

(2) the prohibition on granting, selling, supplying or transferring technical advice, assistance or training related to military activities to any of the individuals and entities concerned, whether directly or indirectly (Article 3).

4. Article 7a of Regulation (EC) No 881/2002 provides for a review process where observations on the grounds for listing are submitted by those listed. Individuals and entities added to Annex I by Regulation (EU) 2017/1094 may make a request for the grounds for their listing to the Commission. This request should be sent to:

5. The attention of the individuals and entities concerned is also drawn to the possibility of challenging Regulation (EU) 2017/1094 before the General Court of the European Union, in accordance with the conditions laid down in the fourth and sixth paragraphs of Article 263 of the Treaty on the Functioning of the European Union.

6. For good order, the attention of the individuals and entities included in Annex I is drawn to the possibility of making an application to the competent authorities in the relevant Member State(s), as listed in Annex II to Regulation (EC) No 881/2002, in order to obtain an authorisation to use frozen funds and economic resources for essential needs or specific payments in accordance with Article 2a of that Regulation.
