SHRI RODMAL NAGAR: SHRIMATI KESHARI DEVI PATEL: Will the Minister of Electronics and Information Technology be pleased to state: - (a) the total number and the names of Chinese Mobile Companies which have failed safety norms of the country and are selling their products in the Indian market; (b) the steps taken/being taken by the Government to check the same; (c) whether the Government has formulated any scheme to ban such Chinese mobile phones and electronic items which emit maximum radiations thereby causing many diseases and if so, the details thereof; (d) the number of electronic items imported from China which were tested by the Bureau of Indian Standards (BIS) along with the details thereof; and (e) the details of imported Chinese electronic items, samples of which failed the BIS tests along with the details thereof? ANSWER MINISTER OF STATE FOR ELECTRONICS AND INFORMATION TECHNOLOGY (SHRI SANJAY DHOTRE) (a) For the product categories notified under the Compulsory Registration Scheme, BIS grants registrations to the manufacturers only for those models which pass the requirements of the notified Indian Standard(s). For seven number of registrations granted to Chinese Mobile companies, the model picked up during surveillance have failed to comply to the safety norms of India since Feb 2015. The non-compliant products are not allowed to be sold in the Indian market. The details are enclosed at Annexure-I. (b) The Ministry of Electronics and Information Technology (MeitY), has notified “Electronics and IT Goods (Requirement of Compulsory Registration) Order, 2012 (CRO)” in the Gazette of India vide S.O. No. 2357(E) dated 03.10.2012, S.O. No. 2905(E) dated 13.11.2014, S.O. No. 3509(E) dated 24.10.2016, S.O. No. 2742 (E) dated 17.08.2017 and S.O. No. 1236(E) dated 01.04.2020 under the provision of Compulsory Registration Scheme notified by BIS under the ambit of the BIS Act, 1986. The Order mandates Indian Safety Standards for the notified product categories. The product categories are covered under CRO in phased manner and till date 56 product categories have been included in the Schedule of the Order and the Order has come into effect for 44 notified product categories. For the remaining 12 product categories, the Order is scheduled to come into effect from 01.04.2021. The mobile phones were notified under ambit of the schedule of the Order in Second Phase of CRO on 13.11.2014 and for this product category, the Order has already come into effect from 13.09.2015.As per the provisions of the “Compulsory Registration Scheme”, for the notified product categories BIS grants registrations based on testing of the products at the BIS recognized laboratories and MeitY executes surveillance of the notified goods. Since BIS is the authority for granting/renewal/cancellation of registrations, all the cases where non-compliance is observed are forwarded to BIS for taking necessary action as per the provisions of BIS Act and Rules. (c) The Department of Telecommunications (DoT) has taken measures to ensure safety from the radiations emitted by the mobile handsets. The mobile hand-sets should comply to the Specific Absorption Rate (SAR) value as prescribed by DoT. Further, MeitY has notified the “Electronics and IT Goods (Requirement of Compulsory Registration) Order, 2012” mandating Indian safety standards for the notified products for the safety of the consumers. The products are tested for safety hazards like electric shock, fire hazard, temperature rise, radiations etc. If the product does not meet the requirements of the notified standard, the product is not allowed to be sold in the Indian market. (d) Since inception, BIS has granted 13,752 registrations to the Chinese manufacturers based on the testing at test laboratories recognized by BIS. The detail is available in public domain at http://electronicstds.gov.in. (e) Amongst the product categories notified under the “Electronics and IT Goods (Requirement of Compulsory Registration) Order, 2012”, 123 numbers of registrations of Chinese products have failed to comply to the notified Indian standard since Feb 2015.
