In doing so Morhof set an example for a whole series of writers about English institutions and people up to the present day: one of the most recent authors to use Arnold as an informant is Christopher Hill in his Milton and the English Revol­ ution (1977). With reference to Milton the point can be made that in the major biographies of this writer, those by Masson and Parker, mention is made of Milton's signature in Christoph Arnold's album amicorum, and certain passages from Arnold's letters to his corre­ spondent Georg Richter are cited again and again. Nevertheless so far no attempt has been made to extend our knowledge of Arnold beyond the basic information that he was "a German traveller from Nuremberg". Who was this Christoph Arnold? An examination of his album amicorum, his correspondence and publications, and of the sale cata­ logue of the library that he built up together with his son, reveal that Arnold's importance is certainly not limited to a brief meeting with Milton and the much quoted letter to Richter. His album amicorum and his letters show that he was in touch with many promi­ nent English as well as other European scholars and that he took a lively interest in the world around him and in the scholarly achieve­ ments of his day. From the sale catalogue of his library it is apparent that he was an avid book-collector whose library contained a considerable number of English works. Christoph was not the only member of the Arnold family to have English contacts. His son Andreas (1656-1694) visited England thirty years later, stayed there for more than a year and moved in circles of the Royal Society. Like his father he maintained contacts with many members of the contemporary world of learning and he, too, collected English books which found their way to the library of the Arnolds. The literary relations between England and Germany in the seven­ teenth century have figured in a number of studies, notably the one by Waterhouse (1914). However, till now this subject has always been approached along very general lines. This monograph endeavours to examine in detail what the concrete impact of these relations was in the specific cases of two Nuremberg scholars. Thus, ample attention will be paid to the lives of the Arnolds and especially to their travels to England and a survey will be given of their albums amicorum. Like many Tseventeenth-century scholars they were great letter-writers and their letters, in particular the correspondence 1 between father and son during the latter's travels, will be dealt with extensively. Of particular interest is Christoph's letter to Richter mentioned above and a translation of the complete letter will be given in an appendix. A survey of the library of the Arnolds with the emphasis on the books related to England will conclude this study of "two German travellers from Nuremberg". 2 CHAPTER I THE LIVES OF CHRISTOPH AND ANDREAS ARNOLD The present study will discuss some aspects of the literary rela­ tions between England and Germany in the second half of the seven­ teenth century and in particular the parts played in this respect by the Nurembergers Christoph and Andreas Arnold, father and son. In order to provide the right perspective and to fill in the necessary background, it is useful first of all to give a brief survey of the lives of the Arnolds, the more so since, apart from a few entries in biographical lexica, this has not been done before . Since the his­ tory of the Arnold family is bound up with Nuremberg a brief account of this city is prefixed to the actual biographies of Christoph and Andreas Arnold. Nuremberg possessed the status of a free imperial town, a "Reichsstadt", with its own city government, only dependent (and that mainly nominally) on the Emperor of the German Empire, or the Holy Roman Empire of the German Nation as it was officially called, and its own territory. In the late Middle Ages and especially in the sixteenth century it had been the richest and most influential of the imperial towns and, although this was no longer the case by the middle of the seventeenth century, it was still a city of consider­ able importance. The main source of Nuremberg's wealth had been the eastern and mediterranean trade but with the recession in this trade due to the development of new sea-routes and increasing national protectionism, and also as a result of the devastating Thirty Years' War, a gradual decline set in which was to continue throughout the seventeenth and eighteenth centuries and eventually ended in the annexation by Bavaria in 1806. Nuremberg was a Protestant town in the middle of the mainly Protestant area of Middle Franconia but otherwise surrounded, es­ pecially on the south and west, by Catholic territory, a fact of considerable importance in seventeenth-century Germany.

Die Last wird mit einsetzendem Regen die zulässigen Traglasten vermutlich deutlich überschreiten.

Advisory Opinions and the Problem of Legal Authority Christian R. Burset* The prohibition against advisory opinions is fundamental to our understanding of federal judicial power, but we have misunderstood its origins. Discussions of the doctrine begin not with a constitutional text or even a court case, but a letter in which the Jay Court rejected President Washington’s request for legal advice. Courts and scholars have offered a variety of explanations for the Jay Court’s behavior. But they all depict the earliest Justices as responding to uniquely American concerns about advisory opinions. This Article offers a different explanation. Drawing on previously untapped archival sources, it shows that judges throughout the anglophone world—not only in the United States but also in England and British India— became opposed to advisory opinions in the second half of the eighteenth century. The death of advisory opinions was a global phenomenon, rooted in a period of anxiety about common-law authority.

And, during the following two to three weeks, all of the various high offices in the government and the royal household were filled. Most of the politically powerful posts went either to tories or to moderates. The tory Earl of Danby was made Lord President of the Council and another tory, the Earl of Nottingham was made Secretary of State for the Southern Department. The office of Lord Privy Seal was given to the Atrimming@ Marquess of Halifax, whom dedicated whigs had still not forgiven for his part in bringing about the disastrous defeat of the exclusion bill in the Lords= house eight years earlier. Charles Talbot, Earl of Shrewsbury, who was named Principal Secretary of State, can really only be described as tilting towards the whigs at this time. But, at the Admiralty and the Treasury, both of which were put into commission, in each case a whig stalwart was named as the first commissioner--Lord Mordaunt and Arthur Herbert respectivelyBand also in each case a number of other leading whigs were named to the commission as well.i Whig lawyers, on the whole, did rather better than their lay fellow-partisans. Devonshire lawyer and Inner Temple Bencher Henry Pollexfen was immediately appointed Attorney- General, and his cousin, Middle Templar George Treby, Solicitor General.

    J.A. B A KKER Megalithic Research in the Netherlands The impressive megalithic tombs in the northeastern Netherlands are called ‘hunebedden’, meaning ‘Giants’ graves’. These enigmatic Neolithic structures date to around 3000 BC and were built by the Funnelbeaker, or TRB, people. The current interpretation of these monuments, however, is the result of over 400 years of megalithic research, the history of which is recorded in this book. The medieval idea that only giants could have put the huge boulders of which they were made into position was still defended in 1660. Others did not venture to MEG explain how hunebeds could have been constructed, but ascribed them to the most I ancient, normally sized inhabitants. 16th-century writings speculated that Tacitus was N THE NETHE referring to hunebeds when he wrote about the ‘Pillars of Hercules’ in Germania. A Titia Brongersma is the first person recorded to do excavations in a hunebed, in LITHIC RESE 1685. The human bones she excavated were from normally sized men and suggested that such men, not giants, had constructed the hunebeds. Other haphazard diggings followed, but much worse was the invention of stone covered dikes which required large amounts of stone. This launched a widespread collection of erratic boulders, which included the hunebeds. Boundary stones were stolen and several hunebeds R were seriously damaged or they vanished completely. He appeared at Cologne in 1581, where he apparently studied the writings of Aristotle. At some point prior to obtain- ing his doctorate, Althusius also studied law at Geneva with Denis Godefroy (1549–1622), the renowned legal scholar who published the first complete edi- tion of Roman Civil Law in 1583.2 He received his doctorate in both civil and canon law at Basel in 1586. Astonishingly, he published his first book Jurisprudentiae Romanae, which was a systematic treatise on Roman law based on the Godefroy edition, during the same year. While at Basel, he lived for a time in the home of Johannes Grynaeus (1540–1617), with whom he studied Reformed theology and thereafter maintained a lifelong correspon- dence. In 1586, he accepted a call to teach in the newly founded law faculty in the Reformed Academy at Herborn.
