The Siloviki in Russian Politics
The Siloviki in Russian Politics Andrei Soldatov and Michael Rochlitz Who holds power and makes political decisions in contemporary Russia? A brief survey of available literature in any well-stocked bookshop in the US or Europe will quickly lead one to the answer: Putin and the “siloviki” (see e.g. LeVine 2009; Soldatov and Borogan 2010; Harding 2011; Felshtinsky and Pribylovsky 2012; Lucas 2012, 2014 or Dawisha 2014). Sila in Russian means force, and the siloviki are the members of Russia’s so called “force ministries”—those state agencies that are authorized to use violence to respond to threats to national security. These armed agents are often portrayed—by journalists and scholars alike—as Russia’s true rulers. A conventional wisdom has emerged about their rise to dominance, which goes roughly as follows. After taking office in 2000, Putin reconsolidated the security services and then gradually placed his former associates from the KGB and FSB in key positions across the country (Petrov 2002; Kryshtanovskaya and White 2003, 2009). Over the years, this group managed to disable almost all competing sources of power and control. United by a common identity, a shared worldview, and a deep personal loyalty to Putin, the siloviki constitute a cohesive corporation, which has entrenched itself at the heart of Russian politics. Accountable to no one but the president himself, they are the driving force behind increasingly authoritarian policies at home (Illarionov 2009; Roxburgh 2013; Kasparov 2015), an aggressive foreign policy (Lucas 2014), and high levels of state predation and corruption (Dawisha 2014). While this interpretation contains elements of truth, we argue that it provides only a partial and sometimes misleading and exaggerated picture of the siloviki’s actual role. -

ARTICLE An International Legal Framework for Surveillance ASHLEY DEEKS* Edward Snowden’s leaks laid bare the scope and breadth of the electronic surveillance that the U.S. National Security Agency and its foreign counterparts conduct. Suddenly, foreign surveillance is understood as personal and pervasive, capturing the communications not only of foreign leaders but also of private citizens. Yet to the chagrin of many state leaders, academics, and foreign citizens, international law has had little to say about foreign surveillance. Until recently, no court, treaty body, or government had suggested that international law, including basic privacy protections in human rights treaties, applied to purely foreign intelligence collection. This is now changing: Several UN bodies, judicial tribunals, U.S. corporations, and individuals subject to foreign surveillance are pressuring states to bring that surveillance under tighter legal control. This Article tackles three key, interrelated puzzles associated with this sudden transformation. First, it explores why international law has had so little to say about how, when, and where governments may spy on other states’ nationals. Second, it draws on international relations theory to argue that the development of new international norms regarding surveillance is both likely and essential. Third, it identifies six process-driven norms that states can and should adopt to ensure meaningful privacy restrictions on international surveillance without unduly harming their legitimate national security interests. These norms, which include limits on the use of collected data, periodic reviews of surveillance authorizations, and active oversight by neutral bodies, will increase the transparency, accountability, and legitimacy of foreign surveillance. This procedural approach challenges the limited emerging scholarship on surveillance, which urges states to apply existing — but vague and contested — substantive human rights norms to complicated, clandestine practices. -

Commercial and Industrial Cyber Espionage in Israel Shahar Argaman and Gabi Siboni Cyberspace is especially suited to the theft of business information and to espionage. The accessibility of information, along with the ability to remain anonymous and cover one’s tracks, allows various entities to engage in the theft of valuable information, an act that can cause major damage. Israel, rich in advanced technology and a leader in innovation-based industries that rely on unique intellectual property, is a prime target for cyber theft and commercial cyber attacks. This article examines the scope of cyber theft and cyber industrial espionage globally, and attempts to estimate how much !nancial damage they cause in countries around the world and in Israel. It seeks to raise awareness of the extent of the phenomena among the relevant authorities in Israel and provide recommendations on how to grapple with it. Thank you for the opportunity to testify on behalf of the Department of Justice (Department) concerning China’s economic aggression, its efforts to threaten our national security on several, non-traditional fronts, and our efforts to combat them. The Department views this threat as a priority, and last month the former Attorney General announced an initiative to marshal our resources to better address it. This initiative continues, and I am privileged to lead this effort on behalf of the Department. I especially appreciate the Committee’s interest in this area of growing concern. I will begin by framing China’s strategic goals, including its stated goal of achieving superiority in certain industries, which, not coincidentally, corresponds to thefts of technology from U.S. companies in those industries. I will then describe some of the unacceptable methods by which China is pursuing (or could pursue) those goals at our expense. Finally, I will explain what the Department is doing about it, including through our China Initiative. I. Malcolm Chalmers of Royal United Services Institute said Russian security services were going well beyond normal spying practice: “By launching disruptive operations that threaten life in target societies, they blur the line between war and peace”. The main domestic service, the FSB, is a successor to the Communist-era KGB. It is responsible for counter-terrorism and counter espionage and Russian information security. Critics say that it continues the KGB’s work of persecution of ‘dissidents’ and is guilty of torture and other human rights violations, and of extortion and corruption. One estimate put its staff complement at 200,000, and it has grown in power, particularly since the election of Vladimir Putin as President of Russia. -
