1. Background information and objectives The services to be provided as a result of this tender shall develop the overall language skills of the Europol staff members in accordance with the Common European Framework of Reference for Languages, hereinafter CEFRL. Languages services aim to support staff members (and, if applicable, other categories of people working at Europol): 1. meet the required level of knowledge of a third language which equals to the level B2 of the CEFRL1. For staff members this is necessary in order to pass an exam in all four competencies (reading, listening, writing speaking) and receive an equivalent certificate (see Appendix 1 for an indicative list of equivalent certificates). 2. learn languages in the context of multilingualism (e.g. professional and individual development); 3. learn languages for integration purposes; 4. support specific operational language needs. The contract confers no exclusive rights to the Contractor for the provision of language training to Europol staff2. Europol reserves the right to support the staff members in receiving language training also by reimbursing to staff members the tuition fees for the courses (which may be provided by third parties) that the staff members complete in line with Europol internal policy and Staff Regulation.

4.2 Europol Europol hosts around 1200 staff. Due to the specific nature of the organisation, the target groups are divided as follows: • All Europol’s staff members (Temporary Agents and Contract Agents); • Members of the Liaison Bureaux (e.g. Europol Liaison Officers etc.); • Seconded National Experts who are experts in their field of expertise and are appointed by their home authorities; • Interns/Trainees.

Europol staff have diverse educational backgrounds, have a wide range of mother tongues and all staff members speak at least two languages. The working language in Europol is English. In the past, Europol did not offer a structured language training service for its staff, but individual training applications were addressed by various external providers.

2. Scope (brief description of the services) Europol seeks to contract a provider who will assist it by delivering in-class3 language training services to Europol staff upon request. Europol aims to provide in-class language training services for at least the following five official EU languages: - Dutch - French - German - Italian - Spanish The training must be provided on the Europol Premises or at the Contractor’s training location (which must be in the proximity4 of Europol Premises) as requested by Europol during contract implementation. Europol’s needs evolve, so Europol may be interested in the future in additional languages and language training for specific business purpose if the tenderer offers these specific services in its tender.

3. Volume of the contract

The estimated expenditure is provided in the Invitation to Tender & Tender Specifications. A contract volume (total and / or per language) cannot be provided as Europol’s needs depend on the linguistic needs of Europol staff and the available resources. Based on recent statistics about Europol staff, in 2018, about 78 persons were learning French; 78 persons were learning Dutch; 50 persons were learning Spanish; 25 persons were learning German and 9 persons were learning Italian. However, those persons were at various levels of language proficiency. The linguistic needs of Europol staff may change in the future.

4. Requirements

3 The purpose of this procurement procedure is acquire in-class language training (not e-learning). Europol has already another framework contract for e-learning language courses resulted from an inter-agency procurement procedure ( http://ted.europa.eu/udl?uri=TED:NOTICE:456728-2016:TEXT:EN:HTML). The current framework contract for e-learning covers the following languages: Dutch, English, French, German, Italian, Portuguese, Spanish. 4 See the Section 2.7.3 of the Invitation to Tender and Tender Specifications where the concept of “proximity to Europol Premises” is explained. 4.1 Places of performance

Europol may request courses to be provided either at Europol Premises5 (including the future Europol Satellite Building6, which will be in close vicinity of the main Europol Premises) or at the training location of the Contractor. Please refer to section 4.2 for the general requirements applicable irrespective of the place of performance and to sections 4.3 and 4.4 for the specific requirements for each place of performance.

4.2 General requirements (applicable irrespective of the place of performance)

4.2.1 Mandatory Language Training Services The tenderer applying shall offer the following types of language courses in French, Spanish, German, Italian and Dutch: - General language courses for small groups (3-9 participants) and large groups (10- 16 participants) at Europol premises; - General language courses for small groups (3-9 participants) and large groups (10- 16 participants) at the Contractor’s training location; - General language courses one-to-one (one participant) and two-to-one (two participants) at Europol premises; - General language courses one-to-one (one participant) and two-to-one (two participants) at the Contractor’s training location; - Intensive language courses for small groups (3-9 participants) and large groups (10-16 participants) at Europol premises; - Intensive language courses for small groups (3-9 participants) and large groups (10-16 participants) at the Contractor’s training location; - Intensive language courses one-to-one (one participant) and two-to-one (two participants) at Europol premises; - Intensive language courses one-to-one (one participant) and two-to-one (two participants) at the Contractor’s training location; In this context, a “general language course” shall be understood as a course covering less than 4 hours of in-class training7 per week and leading to the achievement of a language level8. In this context, an “intensive language course” shall be understood as a course covering 4 hours or more of in-class training9 per week10 and leading to the achievement of a language level11. The language courses shall take place in-class with a trainer. The courses may contain occasionally online components (e.g. online tests, online exercises) during the in-class

training, but those online components should be only complementary to the in-class teaching methodology. If the Contractor offers online components as part of the in-class course (e.g. access to the Contractor’s web-based training platform), the cost of those online components shall be included in the price of the training. In addition, the Contractor may offer the additional language training services specified in section 4.5.

4.2.2 Course design, methodology and content The tenderer shall be responsible for designing, developing, adapting and delivering all the language courses of the CEFRL (level A1-C1) continuously and throughout the year. Each level as described in the CEFRL may consist of one or several levels. In order to be able to compare several offers, Europol requests the tenderers to prepare their price offers for the mandatory language training based on the following levels: - From A0 to A1 - From A1 to A2 - From A2 to B1 - From B1 to B2 - From B2 to C1 The tenderers shall specify in their tenders how many in-class hours are included in the offered courses for each of the above levels. The total number of in-class hours for the levels A0 to C1 aggregated shall not be less than 480h12. The tenderers shall offer all-inclusive prices per in-class hour for each of the above- mentioned five levels. If the tenderers use sub-levels (e.g. from A2.1 to A2.2) as part of their training methodology, the tenderer shall explain in their technical tenders how the number of in- class hours per each level is distributed over the sub-levels. If during contract implementation, Europol orders a course for a sub-level, then the price of the course for a sub-level shall be: the number of in-class hours for the sub-level multiplied by the price/ in-class hour applicable to the level in question. The courses that continue from one level/ sub-level to another must be consistent and linked, in the sense that there should be a sound continuation of the learning objectives and of the topics to be taught in the next level.

4.2.3 Placement tests, assessment tests, certificates and diplomas 4.2.3.1 Placement tests The Contractor must design, develop and run placement tests to determine the current language level of the Europol staff. The language ability shall be measured in accordance with the CEFRL and the assessment shall cover all four linguistic competencies (listening, reading, speaking and writing). At the end of the placement test, the Contractor shall place the Europol staff in the relevant course and shall provide Europol with a report of the participants indicating:

• the current language level of each participant; • identifying the level each participant should be placed in; • personal language needs of each participant regarding the four language competencies and • if applicable, a compiled report of the groups to be formed. The placement tests shall be free of charge and there shall be no obligation for Europol staff to enrol in a course following the placement tests. The placement tests shall take place before the Purchase Order/ Specific Contract is placed. They are necessary in order to specify the groups and the language levels.

4.2.3.2 Assessment Tests The Contractor must design, develop and run a final assessment test at the end of the given course. The final assessment test shall measure the language ability of the participants according to the CEFRL levels or the objectives of the training and the standards set. It must cover all language competencies: listening, reading, speaking and writing. The cost of the assessment test shall be included in the price of the training.

4.2.3.3 Certificates After successful completion of a course, the Contractor shall provide to the participants a certificate of completion (or equivalent name), specifying the obtained level in line with the CEFRL, the start and end dates of the course, the duration of the course in hours and the percentage of attendance. In case the participant does not pass the final assessment test , the Contractor shall provide to the participants a certificate of attendance (or equivalent name), specifying the start and end dates of the course, the duration of the course in hours and the percentage of attendance. The Contractor must submit scanned copies of the certificates to Europol. The cost of the certificate shall be included in the price of the training.

4.2.4 Educational material The Contractor must use relevant and generally accepted educational material in the courses. The Contractor must distribute the principal educational and supporting material (e.g., books, electronic material, handouts etc) to the participants before or on the day on which the language course starts. Ad hoc educational materials are to be given out at the appropriate time. The Contractor shall facilitate and coordinate the assignment and distribution of the textbooks as needed and shall take full responsibility for the content and quality of the material. The costs of all educational materials shall be included in the price of the training. When the materials are prepared specifically for Europol, it is the responsibility of the Contractor to fulfil all legal obligations relating to the reproduction of documents and copyright legislation. Europol is not liable in such regard. Europol Public Information

4.2.5 Contract management For the smooth organisation of the language service provision, the Contractor shall identify an administrative coordinator and a training coordinator13. Similarly, Europol will designate contact persons. Europol will establish regular contact with the Contractor in order to ensure the smooth operation of the language services.

4.2.5.1 Administrative coordinator The Contractor shall identify an administrative coordinator within its organisation who will represent the single point of contact for all administrative and operational communication with Europol. The administrative coordinator shall:  Be responsible for and ensure consistency in the planning, calendar and schedules, trainers’ assignments, as well as participants’ level assignment in coordination with the trainers, provision of training materials, issuance of end-of-course certificates;  Ensure that for each language service there is a back–up trainer to enable continuity of the services in case of: absence of the main trainer (planned or unforeseen) or replacement requested due to reported unsatisfactory performance;  Promptly respond to any queries related to the administration/implementation of the services schedule, teachers’ availability, attendance list, etc.  Keep Europol informed of any change concerning the execution of the services requested and promptly respond over the phone or e-mail, should Europol require urgent assistance related to the services;  Manage in a timely and consistent way all administrative and financial tasks pertaining to the contract implementation (responding to requests for services, signature of purchase orders, follow-up of invoices, reporting, handling any teaching-related complaints, etc.);  Inform and make sure that trainers providing services at Europol Premises respect all relevant Europol specific procedures related to safety and security and any others rules applicable in Europol Premises (i.e. access to Europol buildings, certificates of good conduct of the trainers, evacuation, etc.);  If necessary, communicate directly with the Europol training participants and keep the Europol contact person informed of any issue related to the Europol training participants (such as low level of attendance etc);  Ensure the compliance of the schedules (for courses held at Europol Premises) with the Europol public holidays (see Appendix 2 for the Europol Public Holidays applicable for 2019). All communications and exchange of information between Europol and the Contractor during the contract period shall be held in writing14 (mainly by email), in English and be addressed to the Contractor’s administrative coordinator and to the contact person in Europol respectively. The tenderer shall during contract implementation present to

Europol the CV of the administrative coordinator if Europol so requests. The administrative coordinator shall be fluent in English.

4.2.5.2 Training coordinator The Contractor shall provide a training coordinator to supervise the training implementation from a pedagogical point of view to ensure adaptation of adult teaching methods and language methodology. In addition, he/she shall safeguard that the requirements as described in this tender are being kept. More specifically, the training coordinator shall:  Supervise and ensure that all requested language services are offered in compliance with the CEFR, that Europol needs are met and that all services are delivered according to the highest standards in all teaching/didactical aspects (content, methodology, learning material, style);  Promote excellent relations trainers-participants;  Be responsible for the provision of a consistent and detailed course curricula (content, teaching methods, objectives) for all languages and levels, as well as for the thematic courses and assessment testing;  Evaluate language learning courses and oversee trainer’s performance; The coordinator will need to collaborate closely with Europol ensuring that the quality of the language training meets the standards set. The tenderer shall during contract implementation present to Europol the CV of the training coordinator if Europol so requests. The training coordinator shall: - have proven experience in designing language training courses; - have proven experience in applying adult learning principles; - have relevant educational background and qualifications; - is aware of language assessment methods; - have a level of proficiency in English language of minimum B2.

4.2.6 Requirements related to teachers/ trainers

The Contractor must provide suitable and professional trainers. All trainers and their replacements must fulfil the following minimum criteria:  have at least 3 (three) years proven experience in delivering language training courses;  have at least 3 (three) years proven experience of teaching language to adults and have knowledge of adult learning principles;  are specialists in teaching the language taught and preferably native speakers;  have educational background and qualifications relevant for delivering language training;  are aware of language assessment methods; Europol Public Information

 have experience in teaching and working in multicultural environments;  have the ability in using multimedia resources, where applicable;  have a level of proficiency in English language of minimum level B2;  In case the tenderer offers specialised courses (see Section 5 below) the trainers must have a minimum experience of 3 (three) years on the subject taught.

The tenderer shall during contract implementation present to Europol the CV of the trainer if so requested by Europol. If during the contract a trainer does not meet the above-mentioned criteria, the tenderer must propose a substitute within minimum five (5) working days. The tenderer shall ensure that there is a back-up trainer per language course available. Should a trainer become unavailable for any reason for more than one (1) week, the back- up trainer has to be provided at short notice. The back-up trainer must be familiar with the curriculum that has been taught and shall continue the language teaching at the required standards. Each proposed trainer must comply with the security requirements as referred to in section 4.2.9 (Security Aspects). No travel or subsistence allowance will be paid under this contract. Europol reserves the right to reject a language trainer if the trainer’s performance is not satisfactory to Europol. In this case, the Contractor must provide a substitute within five (5) working days.

4.2.7 Reporting and invoicing In the course of the performance of the contract, the Contractor shall provide a report to Europol contact points at the end of the course. The report shall contain: • Europol participants' attendance and progress (indicating level reached); • Duration, dates and times of the courses taught; • Statistics e.g. Europol participation rates, percentage of successful Europol participants; • If needed, recommendations and proposals for corrective measures that may concern the system, content and methodologies implemented • Any other issues to be raised/ determined by the Contractor. Invoicing and payment conditions are stipulated in the Draft Contract. Invoices shall be accompanied by progress reports specifying: - Reference number of the Framework Contract and the applicable Specific Contract or Purchase Order; - Detailes of the training performed; - Number of in-class hours delivered during the reference period of the invoice; - Number of enrolled Europol participants; - Presence of the enrolled Europol participants.

4.2.8 Quality requirements, monitoring and evaluation The quality performance review will be conducted along the implementation of the contract. The deliverables will be primarily assessed by - Europol course participants via the course surveys applied and processed by Europol and - via direct ad-hoc feedback from participants and Europol contract manager. Europol will communicate to the Contractor whenever the delivered services do not meet its quality expectations or the contractual requirements, upon which the Contractor shall apply immediate corrective actions. The outcome of the corrective actions will be assessed within a reasonable time agreed between the contractual parties. The recurrent non-compliance of the Contractor documented in the context of the quality monitoring review may lead to termination of the purchase order/ specific contract or the termination of the framework contract.

4.2.9 Security aspects Each member of the Contractor’s personnel providing services to Europol shall undertake to treat in the strictest confidence and not make use of or divulge or disclose to third parties any information and/or documents which are linked to performance of the contract, without prior written permission from Europol. The members of the successful tenderer’s personnel shall continue to be bound by this obligation for an unlimited period even after the expiry or termination of the resultant contract. Each member of the Contractor’s personnel providing services at Europol will be required to sign and submit to Europol a declaration of confidentiality (see Art II-15 of the Draft Contract for details). Each member of the Contractor’s personnel providing services to Europol Premises must present a valid certificate of good conduct (see Art II-15 of the Draft Contract for details) prior to the start of the services. Europol reserves the right not to request a certificate of good conduct for the Contractor’s personnel providing services outside Europol Premises. Europol reserves the right to request full security clearance (minimum level EU RESTRICTED), or adjust entry/clearance requirements for a services provided at Europol Premises if deemed necessary. This will be communicated to the Contractor in advance of the order confirmation. Any costs related to the provision of a certificate of good conduct or the security clearance shall be borne by the Contractor.

4.2.10 Payment The Contractor shall submit invoices to Europol upon completion of the services delivered or according to a pre-defined payment schedule agreed with Contractor during the ordering process. As a minimum, invoices shall be submitted with the following supporting documents: - At the end of each course: the reports specified in Section 4.2.7. - Unless specifically agreed in the Order Form/Specific Contract, the invoices shall identify all elements and be accompanied by the relevant supporting documents (see Section 4.2.7 above and Draft Contract). 4.2.11 Handling of Personal Data

Europol is obliged to use only data processors providing sufficient guarantees to appropriate technical and organisational measures in such a manner that the processing of personal data will meet the requirements of the applicable legislation and ensure the protection of the rights of the data subjects. This obligation on Europol stems from Europol’s legal base, which provides for the direct applicability to Europol of Regulation (EC) No 2018/172515 for all administrative personal data held by Europol. As the Contractor will be the “‘processor” of personal data on behalf of Europol, Europol must ensure that the Contractor processes the personal data in a manner compliant with the requirements of Regulation (EC) No 2018/172516. The Contractor commits to provide to Europol on request information and evidence of the implemented technical and organisational measures taken to ensure that the processing of personal data by the Contractor is performed in accordance with the national applicable data protection legislation.

4.3 Specific requirements for Europol Premises 4.3.1 Organisation of courses held at Europol Premises Europol may request the Contractor to provide courses for Europol staff at Europol Premises17 (which in this context include the future Europol Satellite Building18, which will be in close vicinity of the main Europol Premises). All language courses organised at Europol Premises must finish by 19:00pm. Unless otherwise authorised by Europol, the courses must take place outside the core working hours. The time intervals which are available for the provision of the training outside the core working hours are: - Monday/ Tuesday/ Thursday: 12:00 – 15:00 or 16:30 – 19:00 - Wednesday/ Friday: 12:00 – 15:00 or 16:00 – 19:00 Europol reserves the right to modify these intervals during the lifetime of the contract. The Contractor must consider Europol official public holidays (see Appendix 2 for the list of holidays of 2019) in their planning. Europol will communicate to the Contractor every year the official list of holidays for the year, as soon as the list becomes available. Subject to prior agreement, Europol will arrange a training room equipped with basic training equipment for the execution of the courses such as flipchart and screen. The course schedule will be agreed between Europol and the Contractor taking into accounts Europol’s constraints.

The size of the group of participants in a course shall be specified in the Specific Contract/ Purcahse Order and shall be considered constant for the whole duration of the course, irrespective of the attendance rate of the participants.

4.3.2 Rescheduling of lessons organised at Europol Premises Europol reserves the right to reschedule lessons as referred to in the Purchase Order/ Specific Contract which take place at Europol Premises for whatever reasons such as: logistical problems, low attendance rate etc. Europol reserves the right to reschedule free of charge a group lesson scheduled at Europol Premises by sending a written notice (via e-mail) to the Contractor up to one (1) working day before the date of the lesson. The Contractor may be entitled to a rescheduling fee equal to 2% of the value of the course as specified in the Specific Contract / Purchase Order, if such rescheduling is made less than one (1) working day in advance. Europol reserves the right to re-schedule free of charge an individual (one-to-one and two- to-one) lesson scheduled at Europol Premises by sending a written notice (via e- mail) to the Contractor up to one (1) working day before the date of the lesson. The Contractor may be entitled to a rescheduling fee equal to 2% of the value of the course as specified in the Specific Contract / Purchase Order, if such rescheduling is made less than one (1) working day in advance. The lesson shall be rescheduled via written mutual agreement between the Contractor and Europol.

4.3.3 Cancellation policy (courses held at Europol Premises) Cancellation by Europol For the flexibility in the management and delivery of the language services, and notwithstanding the cancellation policy proposed by the tenderer, Europol reserves the right to cancel a course/ the remaining lessons of a course as referred to in the Purchase Order/ Specific Contract The cancellation shall be in writing (by email), subject to fourteen (14) calendar days' notice before (if Europol wishes to cancel a full course) or after the beginning of the course (if Europol wishes to cancel the remaining lessons of a course). The following conditions shall apply: - Courses not started: o if the cancellation is notified at least 14 calendar days prior to the planned start date, no payment for the cancelled course/ compensation by Europol is due to the Contractor. o If the cancellation is notified less than 14 calendar days prior to the planned start date, only 10% of the price of the course as specified in the Purchase Order/ Specific Contract is due to the Contractor. - Courses already started: o If the combined number of lessons already performed and lessons scheduled to be performed within the cancellation period (i.e. the next 14 calendar days after the cancellation notice is sent), is equal to or less than the half of the total number of lessons of the course, 50% of the price of the Europol Public Information

course as specified in the Purchase Order/ Specific Contract is due to the Contractor. o If the combined number of lessons already performed and lessons scheduled to be performed within the cancellation period (i.e. the next 14 calendar days after the cancellation notice is sent), is more than the half of the total number of lessons of course, 100% of the price of the course as specified in the Purchase Order/ Specific Contract is due to the Contractor. o If agreed by both parties classes that did not take place can be rescheduled and assigned to another level/language. No other payment/ compensation is due to the Contractor in addition to the amounts specified above in the event of cancellation by Europol. As an example, Europol shall be allowed to cancel a language course or activity whenever the attendance rate is not satisfactory, logistical problems prevent the smooth running of the course or any other situation where the conditions underlying the ordering of services are no longer met.

Cancellation by the Contractor In the event of a cancellation of a training course, due to the unavailability of a Contractor’s Personnel or to another impediment of the Contractor, the Contractor shall be entitled to the amount due corresponding to the services provided (up to the date when the cancellation takes effect). Cancellation must be specified in writing (via e-mail). In addition, Europol will be entitled to impose a financial penalty as follows: - Courses not started: o if the cancellation is notified to Europol at least 14 calendar days prior to the planned start date specified in the Purchase Order or Specific Contract, no penalty will be applied.. o If the cancellation is notified to Europol less than 14 calendar days prior to the planned start date specified in the Purchase Order or Specific Contract, the penalty is maximum 10% of the price of the course as specified in the Specific Contract / Purchase Order. o Courses already started: If the Contractor cancels the course at any time after the start of the course, the penalty is maximum 50% of the price of the course as specified in the Purchase Order/ Specific Contract to Europol.

The cancellation policy described in this section 4.3.3 is a minimum requirement. Tenderers may offer a cancellation policy more advantageous for Europol. The overall quality of the offered cancellation policy will be assessed within the tenderer’s technical tender. The resulting Framework Contract will specify (or make reference) to the applicable cancellation policy.

Europol Public Information

4.4 Specific requirements for Contractor’s training location

4.4.1 Organisation of courses held at Contractor’s training location The tenderer must offer language courses in its own training location in the proximity of Europol Premises19. Those lessons shall only be offered during weekdays (Monday- Friday), outside Europol core working hours and allowing for sufficient travel time for the participants. The time intervals which are available for the provision of the training at the Contractor’s training location are: - Monday/ Tuesday/ Thursday: 12:30 – 14:30 or after 17:00 - Wednesday/ Friday: 12:30 – 14:30 or after 16:30 Europol reserves the right to modify these intervals during the lifetime of the contract. On its own training location, the Contractor shall provide all necessary equipment for the execution of the courses and logistic arrangement at no extra cost. As the language and level of proficiency may be different per Europol staff member, it is not always possible to create a group (3-16 participants) only for Europol participants. For cost efficiency, Europol authorises the Contractor to create groups (3-16 participants) which include Europol participants and other third party clients of the Contractor. For example, if one Europol participant is included in a group containing 11 third party participants (other clients of the Contractor), the fee applicable to Europol participant shall be the fee for language courses “for large groups (10-16 participants) at the Contractor’s location”20.

4.4.2 Rescheduling of lessons held at Contractor’s training location In case the Contractor cancels a lessons scheduled to take place at the Contractor’s training location, the Contractor must inform the participants and Europol immediately. The Contractor shall re-schedule the cancelled lesson, free of charge, at a later suitable date and notify the Europol participants. In case of last minute unavailability of the trainer (for example, the trainer falls ill just before the course starts) the Contractor shall have measures in place to replace the trainer. If no such replacement is available the lesson shall be rescheduled under the same conditions and the Contractor must notify the Europol participants. Europol reserves the right to re-schedule free of charge an one-to-one (one participant) or two-to-one (two participants) lesson scheduled at the Contractor’s training location by sending a written notice (via e-mail) to the Contractor up to 24h before the time of the lesson. The lesson shall be rescheduled via writen mutual agreement between the Contractor and Europol.

4.4.3 Cancellation policy (courses held at the Contractor’s training location) Europol may cancel a course as referred to in the Purchase Order/ Specific Contract which takes place at the Contractor’s training location (e.g. due to low attendance rate or any other situation where the conditions underlying the ordering of services are no longer met). In case of group courses with participants from both Europol and third parties, the cancellation shall concern only Europol participants. Tenderers shall propose in their technical tender a cancellation policy favourable to Europol complying with the requirements specified in these Technical Specifications. The cancellation policy must cover both cancellation by Europol and cancellation by the Contractor. The overall quality of the offered cancellation policy for language courses planned to take place at the Contractor’s training location will be assessed within the tenderer’s technical proposal.

4.5 Optional services: additional linguistic services

Within the scope of multilingualism and in performance of its duties, Europol may request additional linguistic services such as (not exhaustive list): • Language training in other EU official languages21; • Language training in non-EU languages (e.g. Russian, Chinese, Arabic) for Europol’s operational needs; • Language training from level C1 to level C2 in the five mandatory languages and other EU/ non-EU languages ; • Tailor-made language courses; • Language courses designed for a specific business purpose (such as: legal language training; financial language training; courses aimed at improving performance in any work-related task (taking part in meetings, presentations and speeches, telephone calls, writing skills, etc.)). It is optional (not a mandatory requirement) for the tenderers to offer such additional linguistic services in their tenders. However, such additional linguistic services will be considered during the evaluation against quality award criteria. If the tenderers offer to Europol additional linguistic services, the tenderers are required to describe those services in their technical tenders and to include prices for the offered services in the in financial tenders. Only complete offers (containing technical description and price) for additional linguistic services will be considered during evaluation. If the tenderer has a ‘Public List of Prices’22 directly accessible to the public (on the tenderer’s website) for any of above-mentioned optional services, the tenderer is invited to indicate in the offer the website address where the ‘Public List of Prices’ is available. During the contract implementation, Europol may also request optional services falling within the scope of the contract, but for which a price is not specified in the contract or in the Contractor’s Public List of Prices. Work will resume as normal on Friday 3 January 2020.

Without prejudice to the entire final schedule of public holidays for 2020, Wednesday 1 and Thursday 2 January 2020 will be holidays.

The Executive Director of Europol may modify these provisions, should the needs of the service so require.

During the lifetime of the framework contract, Europol will communicate to the Contractor every year the official list of holidays for the year, as soon as the list becomes available.
