LASH* ALICIA HARRSON** In 1799, the Federalist minority of the Virginia House of Delegates produced an extended defense of the Alien and Sedition Acts. This Minority Report responded to Madison's famous Virginia Resolutions and efforts by Virginia Republicans to tar the Adams Administration with having exceeded its powers under the federal Constitution. Originally attributed to John Marshall by biographerAlbert Beveridge, recent biographies of Marshall have omitted the episode or rejected Beveridge's claim and the current editors of the Papers of John Marshall omitted the Minority Report from their multi-volume collection of Marshall's work. What was once an assumed (if controversial) episode in Marshall's career has disappeared from otherwise exhaustive accounts of his life and work. As in Philip K. Dick's story, Minority Report, an alternate view of events has been unceremoniously erasedfrom the official record. The authors of this Article challenge the decision to remove Marshall's name from the Minority Report. Marshall was the only person named at the time as the probable author, and Marshallhad both reason and opportunity to draft the Address. While it is customary to tender one’s resignation at the time a change of administration takes place, officers remain formally at the head of their department until a successor is appointed. Subordinates acting temporarily as heads of departments are not con- sidered Cabinet officers, and in the earlier period of the Nation’s history not all Cabinet officers were heads of executive departments. The names of all those exercising the duties and bearing the respon- sibilities of the executive departments, together with the period of service, are incorporated in the lists that follow. The dates immediately following the names of executive officers are those upon which commis- sions were issued, unless otherwise specifically noted. Where periods of time are indicated by dates as, for instance, March 4, 1793, to March 3, 1797, both such dates are included as portions of the time period. On occasions when there was a vacancy in the Vice Presidency, the President pro tem- pore is listed as the presiding officer of the Senate. The Twentieth Amendment to the Constitution (effective Oct. 15, 1933) changed the terms of the President and Vice President to end at noon on the 20th day of January and the terms of Senators and Representatives to end at noon on the 3d day of January when the terms of their successors shall begin. Recess Appointments: A Legal Overview Summary The U.S. Constitution explicitly provides the President with two methods of appointing officers of the United States. First, the Appointments Clause provides the President with the authority to make appointments with the advice and consent of the Senate. Specifically, Article II, Section 2, clause 2 states that the President “shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by law.” Second, the Recess Appointments Clause authorizes the President to make temporary appointments unilaterally during periods when the Senate is not in session. Article II, Section 2, clause 3 provides: “The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.” While the Recess Appointments Clause enables the continuity of government operations, Presidents, on occasion, have exercised authority under the Clause for political purposes, appointing officials who might otherwise have difficulty securing Senate confirmation. This constitutional provision is not without its ambiguities, and the President’s use of his recess appointment power in light of these ambiguities has given rise to significant political and legal controversy since the beginning of the republic.

Mar- shall was born on the 24th of September 1755, in what is now Fau- quier County, Virginia. He died in Philadelphia, while still holding the office of Chief Justice of the United States, a few weeks less than eighty years later. One hundred and twenty years have thus elapsed since John Marshall com- pleted the judicial labors for which he is so greatly celebrated. In that long interval, ten other Americans have held the office that Marshall held, and three preceded him in it. Our Chief Justices have included some very distin- guished and able men; but, by universal consent, Marshall is recognized to stand pre-eminent-indeed, unrivalled-among them. The appellation, "the great Chief Justice," is still today, as it long has been, a completely unam- biguous reference to John Marshall, and to no one else. Now, I mean not to dissent from this universal view of Marshall's great- ness; yet I do think that the true nature of his judicial career, particularly in the field of constitutional interpretation, has long been very generally mis- understood. According to the usual view, Marshall is conceived to have dom- inated his associates on the Supreme Court so completely that he was able to make the constitutional decisions of that tribunal express his own ideas and nothing else.
