Treaty of San Francisco - Wikipedia, the free encyclopedia Page 1 sur 5 Treaty of San Francisco From Wikipedia, the free encyclopedia Treaty of San Francisco The Treaty of San Francisco or San Francisco Peace (San Francisco Peace Treaty) Treaty between the Allied Powers and Japan, was Treaty of Peace with Japan officially signed by 49 nations on September 8, 1951 in San Francisco, California. It came into force on April 28, English Treaty of Peace with Japan 1952. It is a popularly known name, but its formal French Traité de paix avec le Japon English name is Treaty of Peace with Japan. Spanish Tratado de Paz con Japón This treaty served officially to end World War II, to end Japanese 日本国との 平和条約 formally Japan's position as an imperial power and to ( Nihon-koku tono Heiwa- allocate compensation to Allied civilians and former Jōyaku? ) prisoners of war who had suffered Japanese war crimes. This treaty made extensive use of the UN Charter and the Universal Declaration of Human Rights to enunciate the Allies' goals. The objects examined include one such handscroll painting, several illustrated books from the Sakamaki-Hawley Collection, University of Hawaiʻi at Mānoa Library, and Hokusai Ryūkyū Hakkei, an 1832 series of eight landscape prints depicting sites in Okinawa. Drawing upon previous scholarship on the role of popular publishing in forming conceptions of “Japan” or of “national identity” at this time, a media discourse approach is employed to argue that such publications can serve as reliable indicators of understandings -

McMahon Ying Zhang Copyright by Chad Michael Berry 2014 Abstract In March 1879, Japan announced the end of the Ryukyu (Liuqiu) Kingdom and the establishment of Okinawa Prefecture in its place. For the previous 250 years, Ryukyu had been a quasi-independent tribute-sending state to Japan and China. Following the arrival of Western imperialism to East Asia in the 19th century, Japan reacted to the changing international situation by adopting Western legal standards and clarifying its borders in frontier areas such as the Ryukyu Islands. China protested Japanese actions in Ryukyu, though Qing Dynasty (1644-1912) leaders were not willing to go to war over the islands. Instead, Qing leaders such as Li Hongzhang (1823-1901) and Prince Gong (1833-1898) sought to resolve the dispute through diplomatic means, including appeals to international law, rousing global public opinion against Japan, and, most significantly, requesting the mediation of the United States and former U.S. President Ulysses S. Grant (1822-1885). Initially, China hoped Grant’s mediation would lead to a restoration of the previous arrangement of Ryukyu being a dually subordinate kingdom to China and Japan. In later negotiations, China sought a three-way division of the islands among China, Japan, and Ryukyu. -

The Case of Dokdo
Resolution of Territorial Disputes in East Asia: The Case of Dokdo Laurent Mayali & John Yoo* This Article seeks to contribute to solving of the Korea-Japan territorial dispute over Dokdo island (Korea)/Takeshima (Japanese). The Republic of Korea argues that Dokdo has formed a part of Korea since as early as 512 C.E.; as Korea currently exercises control over the island, its claim to discovery would appear to fulfill the legal test for possession of territory. Conversely, the Japanese government claims that Korea never exercised sufficient sovereignty over Dokdo. Japan claims that the island remained terra nullius—in other words, territory not possessed by any nation and so could be claimed—until it annexed Dokdo in 1905. Japan also claims that in the 1951 peace treaty ending World War II, the Allies did not include Dokdo in the list of islands taken from Japan, which implies that Japan retained the island in the postwar settlement. This article makes three contributions. First, it brings forward evidence from the maps held at various archives in the United States and Western Europe to determine the historical opinions of experts and governments about the possession of Dokdo. Second, it clarifies the factors that have guided international tribunals in their resolution of earlier disputes involving islands and maritime territory. Third, it shows how the claim of terra nullius has little legitimate authority when applied to East Asia, an area where empires, kingdoms, and nation-states had long exercised control over territory. * Laurent Mayali is the Lloyd M. INTRODUCTION The People's Republic of China (PRC) has the opportunity to fashion a novel relationship with the capitalistic city-state of Hong Kong. This opportunity has arisen out of the September 26, 1984 Joint Declaration of the Government of the United Kingdom of Great Britain and Northern Ireland (UK) and the Government of the People's Republic of China on the Question of Hong Kong.1 This Joint Declaration, issued with three integrated annexes, and an Ex change of Memoranda, comprises the text of the "agreement" be tween the UK and the PRC on the future of the current British Colony.2 The UK-PRC agreement, which was signed in Peking on December 19, 1984,3 is an unprecedented solution to the PRC's * Associate Professor of Law, Syracuse University College of Law; A.B. Watts IV n May 15, 1972, the United States returned Okinawa and the other islands in the Ryukyu chain to Japan, culminating years of negotiations that some have 1 Ohailed as “an example of diplomacy at its very best�” As a result, Japan regained territories it had lost at the end of World War II, while the United States both retained access to bases on Okinawa and reaffirmed strategic ties with Japan� One detail, however, complicates this win-win assessment� At the same time, Japan also regained administrative control over the Senkaku, or Diaoyu, Islands, a group of uninhabited—and uninhabitable—rocky outcroppings in the East China Sea�2 By 1972, both the People’s Republic of China (PRC) and the Republic of China (ROC) on Taiwan also had claimed these islands�3 Despite passing con- trol of the Senkakus to Japan, the United States expressed no position on any of the competing claims to the islands, including Japan’s� This choice—not to weigh in on the Senkakus’ sovereignty—perpetuated Commander Robert C. -

APPENDIX .A. Note on the Present Position of the Munich Agreement of 29 September 1938 THE Munich Agreement, concluded between Germany, the United Kingdom, France and Italy for the cession of the Sudeten German territory by Czecho slovakia, although officially dated 29 September 1938, was in reality signed in the small hours of the morning of 30 September. l To it was annexed a declaration by the British and French Governments guaranteeing the new boundaries of the Czechoslovak state against unprovoked aggression. Germany and Italy also agreed to give a similar guarantee to Czechoslovakia 'when the question of the Polish and Hungarian minorities in Czechoslovakia had been settled'. It was further declared that the problems of these minorities in Czechoslovakia, if not settled within three months by agreement between the respective Governments, 'shall form the subject of another meeting of the Heads of the Governments of the four Powers here present'. Because of its nature, the Munich Agreement was not subject to the usual forms of ratification, and no provision for such procedure was included in its text. Parliamentary approval was accorded to Mr Chamberlain and to M. Daladier, on 6 and 5 October respectively, by means of votes of confidence but by the time these had been given in the House of Commons and the Chamber of Deputies the terms of the Munich Agreement were already a fait accompli. On 2 November 1938 the German and Italian Foreign Ministers, Ribben trop and Ciano, handed down the First Vienna Award, which, without consultation with, or reference to, the British and French Governments, adjudicated the fate of the Polish and Hungarian minorities in Czechoslovakia, in violation of the annexe to the Munich Agreement.2 The structure set up by the Munich Agreement was destroyed on 15 March 1939 when Hitler proclaimed that 'Czechoslovakia has ceased to exist'.
