    Resolution of Territorial Disputes in East Asia: The Case of Dokdo Laurent Mayali & John Yoo* This Article seeks to contribute to solving of the Korea-Japan territorial dispute over Dokdo island (Korea)/Takeshima (Japanese). The Republic of Korea argues that Dokdo has formed a part of Korea since as early as 512 C.E.; as Korea currently exercises control over the island, its claim to discovery would appear to fulfill the legal test for possession of territory. Conversely, the Japanese government claims that Korea never exercised sufficient sovereignty over Dokdo. Japan claims that the island remained terra nullius—in other words, territory not possessed by any nation and so could be claimed—until it annexed Dokdo in 1905. Japan also claims that in the 1951 peace treaty ending World War II, the Allies did not include Dokdo in the list of islands taken from Japan, which implies that Japan retained the island in the postwar settlement. This article makes three contributions. First, it brings forward evidence from the maps held at various archives in the United States and Western Europe to determine the historical opinions of experts and governments about the possession of Dokdo. Second, it clarifies the factors that have guided international tribunals in their resolution of earlier disputes involving islands and maritime territory. Note on the Present Position of the Munich Agreement of 29 September 1938 THE Munich Agreement, concluded between Germany, the United Kingdom, France and Italy for the cession of the Sudeten German territory by Czecho­ slovakia, although officially dated 29 September 1938, was in reality signed in the small hours of the morning of 30 September. l To it was annexed a declaration by the British and French Governments guaranteeing the new boundaries of the Czechoslovak state against unprovoked aggression. Germany and Italy also agreed to give a similar guarantee to Czechoslovakia 'when the question of the Polish and Hungarian minorities in Czechoslovakia had been settled'. It was further declared that the problems of these minorities in Czechoslovakia, if not settled within three months by agreement between the respective Governments, 'shall form the subject of another meeting of the Heads of the Governments of the four Powers here present'. Because of its nature, the Munich Agreement was not subject to the usual forms of ratification, and no provision for such procedure was included in its text. Parliamentary approval was accorded to Mr Chamberlain and to M. Daladier, on 6 and 5 October respectively, by means of votes of confidence but by the time these had been given in the House of Commons and the Chamber of Deputies the terms of the Munich Agreement were already a fait accompli. On 2 November 1938 the German and Italian Foreign Ministers, Ribben­ trop and Ciano, handed down the First Vienna Award, which, without consultation with, or reference to, the British and French Governments, adjudicated the fate of the Polish and Hungarian minorities in Czechoslovakia, in violation of the annexe to the Munich Agreement.2 The structure set up by the Munich Agreement was destroyed on 15 March 1939 when Hitler proclaimed that 'Czechoslovakia has ceased to exist'.

INTRODUCTION: SHIFTING WINDS IN THE EAST In late 2012 when the Diaoyu/Senkaku Islands first became prominent in the news, the conflict over the uninhabited islands seemed melodramatic.1 However, the dispute over the islands quickly became a metaphor for the longstanding rivalry between two of Asia’s greatest powers: China and Japan.2 This was also the first instance in which a belligerent China seemed willing to go to war over a few uninhabited rocks, whose mere existence in the world had no political importance until just a few years ago.3 While the islands themselves are of relatively little use, large energy deposits reside a little off their coast. This process remains incomplete for the two Koreas. This article focuses on bridging the divide between the current armistice agreement and a future peace treaty by utilizing just war theory. Specifically, a prong of just war theory that has more recently emerged, jus post bellum (justice after war), provides a beneficial lens by which to achieve a better peace by focusing on both addressing past issues as well as accounting for prospective opportunities for future engagement. This paper argues that a peace treaty influenced by elements of jus post bellum informs the framework necessary for meaningful rapprochement on the Korean Peninsula and a much needed denouement to the Korean War.
