EXECUTIVE SUMMARY The Committee met for two days in Casper. The Committee received testimony and considered the establishment of a Wyoming Energy Authority, bill drafts regarding limited mining operations, the state's nuclear regulatory agreement, the cease-and-transfer priority list, the Environmental Quality Council, economic diversification, and bill drafts referred from the Blockchain Task Force. The Committee also received reports and updates regarding the energy industry in Wyoming, the Wyoming energy strategy, an oil and gas taxation burden study, the University of Wyoming Institute of Innovation and Entrepreneurship and the Tier-1 Initiative of the College of Engineering and Applied Science, and the gender wage disparity study that was completed. The Committee voted to sponsor legislation regarding the Wyoming Energy Authority, limited mining operations, the nuclear regulatory agreement, the cease-and-transfer priority list, the Environmental Quality Council, and banking bills related to blockchain technology.

CALL TO ORDER (NOVEMBER 29, 2018) Chairman Greear called the meeting to order at 8:06 a.m. The following sections summarize the Committee proceedings by topic. Please refer to Appendix 1-01 to review the Committee Meeting Agenda.

APPROVAL OF MINUTES The Committee approved the minutes from the August 27-28 meeting without change.

WYOMING ENERGY AUTHORITY

Dr. Laura Nelson, State Energy Director, Utah Office of Energy Development, gave an overview of the development and work of the Utah Governor's Office of Energy Development (Appendix 2-03). Dr. Nelson described the development of a multi-year action plan to spur development of the energy industry in Utah and discussed the focus on rural counties, grants for energy development, and goals for job creation for the energy industry. Dr. Nelson outlined Utah's energy development board and advisory council and the bonding authority Office of Energy Development had under statute.

Brian Fuller, Staff Attorney, gave an overview of 19LSO-0056 (Appendix 2-01), which would establish the Wyoming Energy Authority by merging together the Wyoming Pipeline Authority and the Wyoming Infrastructure Authority.

Brian Jeffries, Executive Director, Wyoming Pipeline Authority, provided the Committee with suggested amendments to the bill draft (Appendix 2-02). Mr. Jeffries noted the need for the Energy Authority to have the ability to respond quickly to issues related to the Federal Energy Regulatory Commission.

Jason Begger, Executive Director, Wyoming Infrastructure Authority, discussed the effective date for the Energy Authority and noted that the Integrated Test Center could be moved into the Energy Authority.

Chairman Von Flatern noted that the working group established at the Committee's August meeting had proposed several changes, including those that Mr. Begger suggested at the August meeting.

Public Comment

Mark Doelger, Barlow and Haun, outlined the recent activity of the Oil and Gas Conservation Commission and noted that the Pipeline Authority is effective because it has the flexibility to act quickly. Mr. Doelger

Mike Easley, Board Member, Wyoming Infrastructure Authority, encouraged the Committee to make sure that any new entity had a clear mission and vision for success with adequate resources to accomplish its goals and sufficient authority to take all necessary actions.

Shawn Taylor, Executive Director, Wyoming Rural Electric Association, gave information on the work that the Wyoming Energy Commission and noted that any new authority could be built from the existing structure of the current authorities.

Chairman Von Flatern moved the Committee sponsor the bill. The motion passed by roll call vote with Representative Clausen voting no. The Committee adopted several amendments, which are found in Appendix 2-04.

WYOMING INFRASTRUCTURE AUTHORITY REPORTS

Energy Strategy

Mr. Begger gave an overview of the Wyoming Energy Strategy (Appendix 3-08) and discussed the need to develop a comprehensive strategic plan for energy in the state and what neighboring states have completed for developing an energy strategy. Mr. Begger noted that the next legislative session could bring opportunities for further development of a plan and outlined a timeline for developing and implementing an energy strategy. Mr. Begger provided the Committee with the Interim Report (Appendix 3-01) and several other materials related to the interim report (Appendix 3-02), (Appendix 3-03), (Appendix 3-04), and (Appendix 3-05).

In response to a question, Mr. Begger discussed the status of a lawsuit involving a coal export terminal on the West Coast.

Oil and Gas Taxation Study

Mr. Begger and Daniel Johnston, Consultant, gave an overview of a study completed on the taxation burdens to the oil and gas industry in Wyoming (Appendix 3-06). They noted that Wyoming's tax burden may be slightly higher than peer states but is not a major outlier in comparison. Mr. Johnston discussed possible changes to Wyoming's revenue statutes and described the amount of risk taken in comparison to a taxation scheme.

Craig Grenvik, Mineral Tax Division Administrator, Department of Revenue, gave an overview of mineral taxation in Wyoming and discussed the conclusions from the study (Appendix 3-07). He noted the need for sharing more data for further analysis.

Dean Michael Pishko, University of Wyoming College of Engineering and Applied Science, updated the Committee on the College of Engineering's Tier 1 Initiative, including work on the engineering building at the University of Wyoming and new degree and certificate programs in the College. Dean Pishko noted that one consistent challenge is having the ability to hire more faculty and to continue to improve recruiting.

UNIVERSITY OF WYOMING INSTITUTE OF INNOVATION AND ENTREPRENEURSHIP

Dean Pishko, Dean David Sprott, University of Wyoming College of Business, and Jack Mason, Chief Operating Officer of the Institute, gave an overview of the Institute of Innovation and Entrepreneurship (Appendix 5-01). They noted that the Institute is a "front-door" for innovation and entrepreneurship at the University and discussed seed funding for new business ventures, the development of an entrepreneurship minor, and the creation of WyoVentures as a one-stop shop for business aspects of the Institute.

DEPARTMENT OF ENVIRONMENTAL QUALITY

Todd Parfitt, Director; Kyle Wendtland, Land Quality Division Administrator; and Luke Esch, Solid and Hazardous Waste Division Administrator; Department of Environmental Quality, discussed several bill drafts related to the Department.

Director Parfitt gave an overview of limited mining operations in Wyoming, including the need for permission from landowners, notice, and a bond.

Mr. Wendtland gave an overview of 19LSO-0170 (Appendix 6-01), which amends provisions related to limited mining operations. Mr. Wendtland made several suggestions for amendments to the bill and noted that the changes would help alleviate administrative burdens on the Department.

Mr. Fuller provided an overview of 19LSO-0172 (Appendix 6-02), which also amends provisions for limited mining operations and includes provisions for adjacent surface owners to object to proposed limited mining operations.

Public Comment

Kyle Frisinger, Croell Redi-Mix, gave his perspective on limited mining operations, expressed his support for 19LSO-0170, and expressed opposition to 19LSO-0172.

Shannon Anderson, Powder River Basin Resource Council, expressed her support for 19LSO-0172 and affording landowners more say in limited mining operations.

Joe Spiering, Wyoming Contractors Association, and Chris Fare, Melgaard Construction, expressed their support for 19LSO-0170 and noted that the bill draft would address backlogs in the Department of Environmental Quality.

Senator Perkins moved the Committee table 19LSO-0172. The motion passed by voice vote.

Representative Loucks moved the Committee sponsor 19LSO-0170. The motion passed unanimously by roll call vote. The Committee adopted the following amendments:

Director Parfitt and Mr. Wendtland gave an overview of 19LSO-0156 (Appendix 6-03), which makes a change to conform with the nuclear regulatory agreement with the federal government.

Public Comment

Travis Deti, Wyoming Mining Association, thanked the Committee for its work and noted the benefits of having a nuclear regulatory agreement in Wyoming.

Senator Perkins moved the Committee sponsor 19LSO-0156. The motion passed unanimously by roll call vote. No amendments were offered.

Mr. Esch gave an overview of 19LSO-0250, which establishes an updated cease and transfer priority list (Appendix 6-04). Mr. Esch also provided the Committee with the updated cease and transfer annual report (Appendix 6-05).

Public Comment

Steve Moldt and Cindie Langston, Wyoming Solid Waste and Recycling Association, gave an overview of the history of funding for cease and transfer and landfill remediation projects and asked for the Committee's support in recommending additional funding for projects.

Ms. Langston made additional comments on behalf of the City of Casper, noting that there was a question on landfill credits and using credits for remediation projects.

Representative Byrd moved the Committee sponsor 19LSO-0250. The motion passed unanimously by roll call vote. No amendments were offered.

ENVIRONMENTAL QUALITY COUNCIL

Director Parfitt and Meghan Lally, Chair, Environmental Quality Council, gave an overview of the report of the working group (Appendix 7-01) and outlined recommendations for changes for the Environmental Quality Council.

Director Parfitt and Ms. Lally gave an overview of 19LSO-0283 (Appendix 7-03), which amends provisions related to the Environmental Quality Council, including staffing and the role of the Department of Environmental Quality in submitting proposed orders to the Council.

Public Comment

Ms. Anderson appreciated the work of the Council and the working group and expressed her support for the bill draft.

Mr. Deti expressed his support for the bill draft and suggested an immediate effective date.

Senator Coe moved the Committee sponsor 19LSO-0283. The motion passed unanimously by roll call vote. The Committee adopted an amendment based on the proposed language in the staff comment on page 5 of the bill draft.

Chairman Greear gave an overview of 19LSO-0173 (Appendix 7-02), which amends provisions related to constituting a quorum and voting for the Environmental Quality Council.

Ms. Lally noted that she would prefer to require a majority of the council agree on issues coming to vote. She noted that meetings were held over the phone and there was only one situation where only four of the seven council members were present at a meeting.

Representative Lindholm moved the Committee sponsor 19LSO-0173. The motion failed by an equally divided vote, with Senators Anderson, Coe, and Rothfuss and Representatives Byrd, Clausen, Crank, and Henderson voting no.

ENERGY INDUSTRY UPDATES

Energy Policy Network Update

Randy Eminger, Executive Director, Energy Policy Network, gave an update on the work of the Energy Policy Network (Appendix 8-09) and the group's work on avoiding early closure of coal-fueled power plants that use Wyoming coal. Mr. Eminger provided several materials for the Committee: (Appendix 8- 01), (Appendix 8-02), (Appendix 8-03), (Appendix 8-04), and (Appendix 8-05). Mr. Eminger noted that only private donations were used to fund litigation and attorneys for efforts to keep plants open.

Advanced Coal Technology/Research Center

Ken Woodring, Director of Operations, Ramaco Carbon, gave a presentation on the development of a coal- innovation campus that would integrate research and the use of coal in manufacturing (Appendix 8-06). In response to a Committee question, Mr. Woodring noted that Ramaco had resubmitted its permit application that was currently in review.

Don Collins, Chief Executive Officer, Western Research Institute, gave an overview of the Institute and discussed a research and development center near Laramie focused on clean-coal projects and other downstream projects made from coal (Appendix 8-07).

Flaring Technology

Mark Rizzi, George Chedsey, David Moneyhun, and Vernon Clayton gave a presentation on beneficial uses of flare gas that would reduce emissions, increase royalties and tax revenues as well as an overview of technology developed for flare gas (Appendix 8-08).

CALL TO ORDER Chairman Von Flatern called the meeting to order at 8:00 a.m.

ENDOW

Jerimiah Rieman, Director of Economic Diversification Strategy and Initiatives, Governor's Office, updated the Committee on ENDOW activities and air service in Wyoming, including a new terminal that opened in Cheyenne. Mr. Rieman discussed broadband in the state and computer science in Wyoming schools. Mr. Rieman also updated the Committee on the work of Startup:Wyoming and the establishment of a trade office in Taiwan. Mr. Rieman recognized ENDOW council members Jerad Stack and Wally Wolski, who were present.

Mr. Rieman gave an overview of 19LSO-0159 (Appendix 11-01), which would create a chief economic diversification officer and establish a governor's cabinet to help coordinate economic-diversification efforts across state agencies.

Public Comment

Shawn Reese, Chief Executive Officer, Wyoming Business Council, noted that economic diversification is a topic that concerns many agencies and that the bill draft would bring everyone together in a more uniform and accountable system.

Phil Christofferson, Chief Executive Officer, Energy Capital Economic Development, noted that the bill draft would help put economic diversification and recommendations into action.

R.C. Johnson, Wyoming AAUW, gave an overview of small businesses in Wyoming and noted that the federal Small Business Administration could offer resources for economic diversification.

Wally Wolski, ENDOW Member and Goshen County Commissioner, noted that the bill draft would help implement ENDOW's strategic vision and noted the importance of education in economic diversification.

WAGE DISPARITY STUDY

Representative Cathy Connolly gave an overview of the gender wage disparity study and its development. Representative Connolly noted that the study was presented to the Joint Labor, Health and Social Services Interim Committee, which will sponsor bills related to the gender wage issue.

Tony Glover, Research and Planning Section Manager; and Michael Moore, Research and Planning Section Editor; Department of Workforce Services, gave an overview of the study (Appendix 12-01) and also provided the Committee with the study's appendix (Appendix 12-02) and a presentation (Appendix 12- 03).

Mr. Glover gave an overview of the project and the collection of data. Mr. Moore outlined the key findings in the study, including an overview of the gender wage gap and possible reasons for the gap, including a portion of the gap that cannot be explained with data.

Public Comment

Ms. Johnson discussed the study and discussed the importance of training women to negotiate salaries. She noted that there was a long history of lower wages for women and the importance of the freedom of speech in discussing salaries with co-workers.

BLOCKCHAIN TASK FORCE/BILL DRAFTS

Representative Lindholm, Senator Rothfuss, and Senator Ogden Driskill, members of the Blockchain Task Force, outlined the Task Force's work throughout the 2018 Interim and the bill drafts that the Task Force referred to the Committee (Appendix 13-04).

Representative Lindholm gave an overview of 19LSO-0045 (Appendix 13-01), which would revise banking technology and stock provisions related to capital stock and shareholder records.

Mike Geesey, Executive Director, Wyoming Bankers Association, expressed support for the bill draft.

Representative Byrd moved the Committee sponsor the bill draft. The motion passed unanimously by roll call vote. No amendments were offered.

Representative Lindholm gave an overview of 19LSO-0048 (Appendix 13-02), which would establish a financial technology sandbox that would allow companies to test and offer products to consumers under limited waivers of certain statutory and regulatory requirements related to the Division of Banking and the Secretary of State's Office.

Albert Forkner, State Banking Commissioner, Department of Audit-Division of Banking, noted that most waivers would come from the Banking Division and that one other state currently had a sandbox. He noted that there may be several thousand companies that could be attracted to a sandbox.

Representative Lindholm and Senator Rothfuss provided an overview of 19LSO-0055 (Appendix 13-04), which would authorize special purpose depository banks in Wyoming. The new bank would be a non- lending institution and would be required to hold 100% of reserves on hand.

Mr. Forkner raised concerns with the bill draft and noted the need for the state to have a well-defined contingency to address situations where a special purpose depository bank fails.

Mr. Geesey expressed concerns about the bill draft and encouraged further study before sponsoring a bill.

Faron Ferguson, President, Wyoming Bankers Association, expressed concern with the bill draft and issues with the special purpose depository banks' level of risk and ability to generate profit without lending as well as concerns with addressing the failure of a special purpose depository bank.

John Coyne, Past President, Wyoming Bankers Association, expressed his opposition to the bill draft and noted that current banks could offer similar services.

Pamela Day, Chief Executive Officer, Paladin Trust, outlined her experience with blockchain technology and expressed support for the bill draft. She noted that timing was important to attract businesses to Wyoming.

Mike Williams, Jonah Bank, expressed concern with the bill draft and concerns with special purpose depository banks maintaining adequate capital and complying with reporting requirements.

Mr. Geesey noted that the bill created nothing additional to what banks can currently offer.

Caitlin Long, Wyoming Blockchain Coalition, expressed her support for the bill draft and noted that the banking industry is not providing banking services for the blockchain industry. She also noted that businesses would be likely to come to Wyoming if the bill passed.

Joseph Pitlock, Martin Kleystul, Steve Lubien, and Bob Cornish expressed their support for the bill draft and noted that establishing this type of bank would attract businesses to Wyoming.

Representative Byrd moved the Committee sponsor the bill draft. The motion passed by roll call vote, with Representative Henderson voting no. House Bill. The Committee adopted the following amendments:

COMMITTEE DISCUSSION ON OIL AND GAS ISSUES

Chairman Von Flatern gave an overview of oil and gas issues throughout the state and noted that the Committee received an e-mail from a constituent, Terry Sandberg, raising issues with the issuance of drilling permits in Wyoming (Appendix 14-01).

MEETING ADJOURNMENT

The Committee recognized Representative Byrd for his service on the Committee and in the Legislature.

There being no further business, Chairman Von Flatern adjourned the meeting at 4:51 p.m.
