Jahr des Bestehens der Femina Politica hat sich die Redaktion nun zu einem wichtigen Schritt entschlossen: einen international besetzten, wissenschaftlichen Beirat einzuberufen. Der Beirat, der sich im Oktober 2012 zum ersten Mal kon- stituiert, wird der Redaktion beratend zur Seite stehen bei der Identifizierung von innovativen Themen für die Schwerpunkte der Femina Politica, bei den Kontakten zu AutorInnen sowie bei der weiteren Professionalisierung der Redaktionsarbeit. Wir sind begeistert, dass die angefragten Mitglieder für den Beirat allesamt mit Freude zugesagt haben und künftig der Redaktion als kompetente Ansprechpart- nerinnen zur Seite stehen. Bei der Auswahl der Mitglieder des Beirats war uns zweierlei wichtig: als Gruppe soll der Beirat die Breite der politikwissenschaft- lichen Geschlechterforschung abdecken und die einzelnen Mitglieder sollen in ih- rem The mengebiet angesehene Wissenschaftlerinnen sein. Als Mitglieder unseres wissenschaftlichen Beirats begrüßen wir herzlich: Sabine Berghahn (Berlin), Nikita Dhawan (Frankfurt/M.), Antke Engel (Hamburg/Berlin), Nancy Fraser (New York, USA), Cilja Harders (Berlin), Annette Henninger (Marburg), Brigitte Kerchner (Berlin), Sabine Lang (Seattle, USA), Andrea Maihofer (Basel, Schweiz), Joyce M. Mushaben (St. Louis, USA), Birgit Sauer (Wien, Österreich), Angelika von Wahl (Eaton, USA), Ingrid Wehr (Freiburg). Der umfangreiche „Schwerpunkt“ dieses Heft befasst sich dem Thema „Recht als feministische Politikstrategie“. Das Rechtssystem ist für die Politik das zentrale Steuerungsmedium. Der Stellenwert und Charakter des Rechts für das feministische Projekt einer gleichberechtigten Gesellschaft ist in der feministischen Rechtstheo- rie rechtswissenschaftlicher ebenso wie politikwissenschaftlicher Provenienz seit jeher umstritten. Denn Rechtsetzung ist immer ein Prozess, der Ausdruck von ge- sellschaftlichen Machtverhältnissen ist und in dem Konflikte ausgehandelt werden. Emanzipatorische Kämpfe sind auch immer Kämpfe ums Recht – auf Anerkennung, auf politische Teilhabe sowie auf Kodifizierung oder Umsetzung von Rechten und Ansprüchen. In der Politikwissenschaft wird seit vielen Jahren eine „Judizialisie- rung von Politik“ konstatiert, die sich im politischen Einfluss der Judikative (auf allen Ebenen) sowie in der Verrechtlichung politischer Diskurse und von Teilhabe- ansprüchen niederschlägt. Kann – gerade auch vor diesem sich wandelnden Hinter- grund – der Rechte-Diskurs und die Nutzung des Rechtssystems eine Strategie für erfolgreiche feministische Politik sein? Können über das Medium Recht und seine gesellschaftliche Implementierung geschlechtergerechtere soziale Verhältnisse ge- schaffen

    Keynote Speakers CVs H.E. Professor Dr. Dr. h.c. LL.M. Susanne Baer, Justice of the Federal Con- stitutional Court, Germany Professor Baer serves as Justice of the Federal Constitutional Court in Germany, elected by the Bundestag in 2011 to the First Senate, for a 12 years term. She is the Professor of Public Law and Gender Studies at Humboldt University Berlin and a James W. Cook Global Law Professor at the University of Michigan Law School, where she received an honorary doctorate in 2014, as she did from the University of Hasselt (2017) and from the University of Lucerne (2018). She is a Corresponding Fellow at the British Academy of Arts and Sciences, where she gave the Maccabean Lecture in 2019. She has taught at CEU Budapest, in Austria, Switzerland and Canada. Prof. Baer studied law and political science and was active in movements against dis- crimination, including pornography, sexual harassment and domestic violence; from 2003 until 2010, she directed the Gender Competence Centre to advise the German federal government on gender mainstreaming. At Humboldt University, she served as Vice-President for International and Student Affairs, as Director of Gender Studies and Vice Dean of the Faculty of Law, and she founded the Law and Society Institute Berlin and a Law Clinic in Human Rights. PCAP Donates Art to Federal Court Justices by Ashley Lucas On January 30, 2017 the University of Michigan hosted a joint conversation between United States Supreme Court Justice Sonia Sotomayor and Justice Susanne Baer of the Federal Constitutional Court of Germany—that country’s highest court. Justice Sotomayor was presented with an honorary doctorate of law degree, an honor which Justice Baer had also received in 2014. After Justice Sotomayor was officially given her ceremonial degree, she unexpectedly took over the microphone and said, “Now I can officially say, ‘Go, Blue!’” Sonia Sotomayor was born in New York City in 1954, the child of working class Puerto Rican parents. Sotomayor became one of the first minority students to gain admittance to Princeton University, where she graduated summa cum laude in 1976. She earned her law degree from Yale University in 1979. President Barack Obama nominated her for the U.S. Supreme Court, where she has been an Associate Justice since 2009. She is the first Latina and third woman to hold the post of U.S. Supreme Court Justice. Her rulings in U.S. Supreme Court cases have provided greater legal rights for juveniles at the time of their arrests, undocumented immigrants, and people Justice Sotomayor with “The Lifer” by Martin Vargas serving life sentences that were given to them as juveniles.

    Susanne Baer* DIGNITY, LIBERTY, EQUALITY: A FUNDAMENTAL RIGHTS TRIANGLE OF CONSTITUTIONALISM† What is the relationship among fundamental rights to equality, to liberty, and to dignity? In several political and legal contexts, developments in equality law tend to be stalled by reference to dignity and have traditionally been limited based on an understanding that equality collides with liberty – as in the ideological opposition between socialism and capitalist liberalism, as in most balancing theories, and as in philosophical concepts of rights that trump one another. In addition, all three fun- damental rights have been conceptualized in rather ambivalent ways, with some domi- nant as well as some relatively silenced philosophical (including religious) interpretations. Equality, liberty, and, particularly ambivalent, dignity carry burdens that serve as entry points for rather problematic ways of interpreting these notions. Dignity is either defined as an abstract principle or narrowed down to a right against extreme abuse, and it has been charged with moralistic ideology. Liberty and equality have mostly been set on a collision course, balanced against each other, with ideological baggage of their own. Observations in comparative consti- tutionalism reveal that, in some jurisdictions, dignity tends to become a black box, while equality tends to be limited by using dignity and liberty tends to trump the other two. Such studies, however, also provide inspiration for a new approach to all three fundamental rights. I propose here that we rethink their histories as well as current developments. I suggest a triangle of fundamental rights as a more appropri- ate metaphor to understand the complexity of cases that arise in the area and to better decide them.

    A closer look at law: human rights as multi-level sites of struggles over multi-dimensional equality Susanne Baer* In many societies, deep conflicts arise around religious matters, and around equality. Often, religious collectives demand the right to self-determination of issues considered – by them – to be their own, and these demands collide with individual rights to, again, religious freedom. These are thus conflicts of religion v. religion. Then, collective religious freedom tends to become an obligation for all those who are defined as belonging to the collective, which carries the problem that mostly elites define its meaning and they silence dissent. Usually, such obligations are also unequal relating to gender, with different regimes for women and for men, and transgender identities fail to be recognized entirely. Examples include not only the Muslim headscarf, Jewish yarmulke or Sikh turban cases, but also the cases around swimming lessons or litigation for prayer time at school which I use as focal points in this paper. And, at present, such conflicts surface in surprising numbers. Therefore, I will place them in discussions of constitutionalism, secularism, multi-level regulation, and, of course, religious freedom and equality. With this multi-layered analysis, I propose to seek a deeper understanding of these struggles, beyond a portrayal of them as mere clashes of rights. Such an understanding needs the tools of discourse analysis, in that it should uncover which rights are claimed by whom with which effect on whom. We need to acknowledge that rights are often an issue, since human rights are a point of reference both for moral claims as well as for political suppositions, used as illustrations in many academic fields way beyond legal studies.
