Legal Fiction and Forfeiture: An Historical Analysis of The Civil Asset Forfeiture Reform Act Todd Barnet* INTRODUCTION In The Palmyra, in 1827, the United States Supreme Court endorsed the judicially-created in rem personification fiction of the "guilty object."' Writing for the Court, Justice Joseph Story held that a Spanish pirate ship could be put on trial for a crime, stating that the personification fiction was a settled principle in the law of admiralty.2 The pirate vessel itself was put on trial as a respondent "person" in the action in admiralty. Since that time, the legal fiction of personificatiorl has become an important part of the law of both civil and criminal forfeiture, accepted by the United States Supreme 3 Court as a legal reality. How did we get to this seemingly irrational, fanciful conclusion? And what has been the effect on United States forfeiture law - particularly on the civil side of the court? This article surveys the influence of legal fictions in the law of civil and criminal forfeiture.

    Legal Fictions as Strategic Instruments Daniel Klerman1 USC Law School Preliminary Draft August 14, 2009 Abstract Legal Fictions were one of the most distinctive and reviled features of the common law. Until the mid-nineteenth century, nearly every civil case required the plaintiff to make a multitude of false allegations which judges would not allow the defendant to contest. Why did the common law resort to fictions so often? Prior scholarship attributes legal fictions to a "superstitious disrelish for change" (Maine) or to a deceitful attempt to steal legislative power (Bentham). This paper provides a new explanation. Legal fictions were developed strategically by litigants and judges in order to evade appellate review. Before 1800, judicial compensation came, in part, from fees paid by litigants. Because plaintiffs chose the forum, judges had an incentive to expand their jurisdictions and create new causes of action. Judicial innovations, however, could be thwarted by appellate review. Nevertheless, appellate review was ordinarily restricted to the official legal record, which consisted primarily of the plaintiff's allegations and the jury's findings. Legal fictions effectively insulated innovation from appellate review, because the legal record concealed the change. Wilson All Rights Reserved ii BLOOD MONEY IN SUDAN AND BEYOND: RESTORATIVE JUSTICE OR FACE-SAVING MEASURE? Jacqueline H. Wilson, M.S. Mentor/Chair John O. Voll, Ph.D. ABSTRACT This thesis assesses the restorative justice aspects of blood money processes used around the world but focuses primarily on Sudan and South Sudan. It examines sulha, judiya (Darfur), galad (eastern Sudan) and other processes using a mixed methods approach and a multi-site ethnography methodology. The paper scrutinizes these processes from foundational agreements, information gathering and truth-telling, through selecting a third party, and examines truces, exile, women’s roles, compensation agreements, closing rituals, and implementation measures. The paper documents contemporary challenges facing these blood money processes such as collective responsibility, global trends like urbanization, widespread killing and retaliation that rises to a feud, situations where killer and killed are unknown to each other, and situations where blood money is paid by outsiders. I identify shortcomings within these processes relative to international legal norms and human values, as well as areas where they are consistent. Using a restorative justice analytical framework, I determine whether blood money processes are restorative and constitute justice, and ask whether these iii traditional mechanisms are sufficiently robust to stop the cycle of violence.

    Review Essay Legal Fictiont LAW'S EMPIRE. By Ronald Dworkin.* CAMBRIDGE, MASS.: HARVARD UNIVERSITY PRESS, 1986. Pp. 416. $20.00. By JAMES D.A. BOYLE** Ronald Dworkin occupies a role midway between jurisprudential sa- vant and liberal legal guru. (Nice work if you can get it.) His latest book, Law's Empire is long, heavy (about three pounds, I would guess) and well written. It has a blue cover which reminds me of the linoleum in innumerable Glasgow slum bathrooms. Having said that much I am at a bit of a loss how to continue. It is not that I suffered the fate of which all reviewers are terrified-agreeing with the author-though I came much closer than I had expected. Rather, the problem is that I could no more give an abstract explanation of what this book means, than I could give an abstract explanation of the irony in the fact that one of the less suc- cessful men in the Ford family was called Edsel. If there was ever a book which positively cried out "I am a cultural artifact, bring on the visiting anthropologists," this is that book. Law's Empire tells us something about the liberal reaction to Meese and "origi- nal intent," it says something about the changing consciousness of that small subgroup of the legal elite who produce Jurisprudential Theories, and it has a place in the intellectual history of "the turn to interpreta- tion," for those who are interested in such things. Along the way the book develops a sophisticated jurisprudential argument which combines literary criticism, the high theory of the equal protection clause, and an imaginary superhuman judge called Hercules.

    ABSTRACT “The Good Angel of Practical Fraternity:” The Ku Klux Klan in McLennan County, 1915-1924. Richard H. Fair, M.A. Mentor: T. Michael Parrish, Ph.D. This thesis examines the culture of McLennan County surrounding the rise of the Ku Klux Klan in the 1920s and its influence in central Texas. The pervasive violent nature of the area, specifically cases of lynching, allowed the Klan to return. Championing the ideals of the Reconstruction era Klan and the “Lost Cause” mentality of the Confederacy, the 1920s Klan incorporated a Protestant religious fundamentalism into their principles, along with nationalism and white supremacy. After gaining influence in McLennan County, Klansmen began participating in politics to further advance their interests. The disastrous 1922 Waco Agreement, concerning the election of a Texas Senator, and Felix D. Robertson’s gubernatorial campaign in 1924 represent the Klan’s first and last attempts to manipulate politics.     FEDERAL CONVICTIONS REVERSED The following is a publication of the Office of the Federal Public Defender for the Northern District of New York. The cases are from United States Courts of Appeal and the United States Supreme Court. The opinions contain at least one point favorable to criminal defendants. The purpose is to give CJA Panel Attorneys a shortcut to case law favoring their clients. All cases should be researched to see if they are still viable. A precedent in one jurisdiction is not necessarily the law elsewhere. None of the cases should be cited without first reviewing the entire opinion. This warning is especially for prisoners and defendants who wish to rely on the cases herein. A one-line summary cannot possibly be sufficient to cite these cases without first reading each. These materials may be duplicated for any lawyer providing legal services to indigent defendants. Duplication is encouraged. These materials may be reprinted by other free publications or free on-line providers serving the criminal defense bar. Attribution to this office is requested. This collection has previously existed as Reversible Errors and Errores Juris. The new name reflects that coverage is now limited to errors overturning federal criminal convictions, not sentences, nor are other aspects of the criminal justice system addressed. There are two reasons. First, it has been difficult to update so many areas of law on a regular basis. Second, federal sentencing law has changed drastically in recent years and it will take time to determine the common bases for reversal among federal jurisdictions.
