NASER ORIĆ SUMMARY OF JUDGEMENT International Please find below the summary of the judgement today read out by Judge Agius: Criminal Tribunal for the former Introduction Yugoslavia Tribunal Pénal Trial Chamber II of the International Criminal Tribunal for the Former Yugoslavia is sitting today to International pour deliver its Judgement in the trial of Naser Orić. l’ex-Yougoslavie This case deals with crimes of murder and cruel treatment of prisoners and of wanton destruction of cities, towns or villages alleged to have happened in Srebrenica in 1992 and 1993 for which the Accused was indicted on 13 March 2003. The Accused stood trial for the following charges: first, under COUNT 1, he is charged with individual criminal responsibility under Article 7(3) of the Statute of the Tribunal (“Statute”) for murder as a violation of the laws or customs of war pursuant to Article 3 of the Statute. Under COUNT 2, the Accused is charged with individual criminal responsibility under Article 7(3) of the Statute for cruel treatment as a violation of the laws or customs of war pursuant to Article 3 of the Statute. The Prosecution never alleged that these crimes of murder and cruel treatment were committed by the Accused, but only accused him pursuant to Article 7(3) of the Statute as being responsible for these crimes committed by his subordinates whilst he was holding a position of superior authority.

    ZAKON O NACIONALNOM PARKU „DRINA“ Član 1. Ovim zakonom uređuju se granice, zone i režimi zaštite, pitanja upravljanja, zaštite i razvoja Nacionalnog parka „Drina“ (u daljem tekstu: Nacionalni park). Član 2. Nacionalni park je područje izuzetnih prirodnih vrijednosti, koje čini klisurasto- kanjonska dolina rijeke Drine kao jedna od najznačajnijih riječnih dolina Republike Srpske, sa brojnim staništima endemičnih i reliktnih biljnih vrsta, te izuzetnim diverzitetom flore i faune, koje je namijenjeno očuvanju postojećih prirodnih vrijednosti i resursa, ukupne pejzažne, geološke i biološke raznovrsnosti, kao i zadovoljenju naučnih, obrazovnih, duhovnih, estetskih, kulturnih, turističkih, zdravstveno-rekreativnih potreba i ostalih aktivnosti u skladu sa načelima zaštite prirode i održivog razvoja. Član 3. Na pitanja od značaja za zaštitu, razvoj, unapređivanje, upravljanje, finansiranje, kaznene odredbe i održivo korišćenje Nacionalnog parka koja nisu uređena ovim zakonom primjenjuju se posebni propisi kojim se uređuju pitanja nacionalnih parkova, zaštite prirode i drugi zakoni i podzakonski akti kojima se reguliše ova oblast. Član 4. (1) Nacionalni park prostire se na području opštine Srebrenica u ukupnoj površini od 6.315,32 hektara. (2) Opis spoljne granice Nacionalnog parka: Početna tačka opisa granice obuhvata Nacionalnog parka je u tromeđi opština Srebrenica, Višegrad i Rogatica (tačka A). Granica ide ka sjeveroistoku do tromeđe opština Srebrenica, Višegrad i Bajine Bašte u Srbiji (tačka B). Od tačke A do tačke B, granica ide jezerom Perućac, odnosno granicom između opština Srebrenica i Višegrad. Od tromeđe opština Srebrenica, Višegrad i Bajine Bašte u Srbiji (tačka B), granica ide do krune brane Perućac (tačka V). Od tačke B do tačke V, granica ide jezerom Perućac, odnosno granicom između Bosne i Hercegovine i Srbije.

The accused was transferred to the Detention Unit of the International Criminal Tribunal Pénal Tribunal for the former Yugoslavia the following day. International pour l’ex-Yougoslavie The Indictment against Naser Ori} was confirmed on 28 March 2003. According to the Indictment, Naser Ori} (born on 3 March 1967 in Poto~ari, municipality of Srebrenica, Bosnia and Herzegovina) was the Commander of the forces of the Army of Bosnia and Herzegovina (ABiH) in the Srebrenica area in Eastern Bosnia and Herzegovina. The Indictment states that, “by virtue of his position and authority as Commander, Naser Ori} commanded all units that were operating within his area of his responsibility. This includes all units involved in combat activities in the municipality of Srebrenica and Bratunac, in particular the combat activities in Rupovo Brdo on 10 June 1992, Ratkovi}i on 21 and 27 June 1992, Je`estica on 8 August 1992, Fakovi}i on 5 October 1992, Bjelovac between 14 and 19 December 1992 and Kravica on 7 and 8 January 1993 and all units including the Military Police involved in the detention and custody of Serb individuals in Srebrenica ”. The Indictment alleges that, between 24 September 1992 and 20 March 1993, members of the Military Police under the command and control of Naser Ori} detained several Serb individuals in the Srebrenica Police Station and in the building behind the Srebrenica Municipal Building.

SERBIAN VILLAGES OF THE SREBRENICA REGION REDUCED TO ASHES This presentation of the crimes committed by the Muslims against the Serbian people of Central Podrinje is just a fraction of the entire pogrom of the Serbian population in that region throughout the war. The destruction of Serb settlements and their cultural and religious institutions in that region bear wounds, which have evidently not yet been healed. According to one of the several hundred important documents of the BiH Army in our possession, the following has been stated: “ At the end of January or beginning of February in 1993, within the Zone of Responsibility of the 8th OG (Operating Group, author’s remark), a vast, linked, free territory had been formed, with its centre in Srebrenica, covering 95% of the Srebrenica municipality, 90% of the Bratunac municipality, 60% of the Vlasenica municipality, and 50 % of the territory of the Zvornik municipality. Furthermore, a direct physical link with the liberated villages of the Zepa region was established.” 1 By that time (at the end of January or the beginning of February in 1993), according to the same document, in the above listed municipalities, the Muslims had occupied an area of more than 850 km2 of the entire territory. Their undisputed military success had nearly resulted in the complete extermination of the many Serb settlements in the aforementioned municipalities and had also produced much tribulation amongst the inhabitants of Serb nationality.

Geografski položaj i opšti podaci Opština se nalazi na sjeveroistoku Republike Srpske-BiH. Locirana je u središnjem dijelu toka rijeke Drine na koju se prislanja u dužini od 45 km, od čega je oko 23km Perućačko jezero, HE Bajina Bašta. Graniči sa opštinama Bratunac, Milići, Rogatica i Višegrad u BiH, i opštinom Bajina Bašta u Republici Srbiji. Prije rata u okviru regionalno-teritorijalnog uređenja u Republici Bosni i Hercegovini, Srebrenica je pripadala Tuzlanskom okrugu. Tabela 1. Saobraćajna povezanost Opština se ne nalazi na glavnim regionalnim saobraćajnim koridorima. Pojedini djelovi opštine su bolje povezani sa Republikom Srbijom i sa drugim područjima Bosne i Hercegovine, nego sa urbanim centrom. Do opštine postoje samo putne komunikacije. Prema tome opština Srebrenica spada u saobraćajno slabo povezanu opštinu. Srebrenica je pored regionalnih putnih pravaca (Bratunac-Skelani, Bratunac-Srebrenica-Skelani i Zeleni Jadar-Milići) prije rata imala izrazito razvijenu putno-komunikacionu mrežu makadamskih lokalnih - opštinskih seoskih puteva, koji su se koristili za potrebe stanovništva, turizma, lovnog turizma i privrede.
