4 1. Monitoring and Assessment Task and Implementation

Progress

After signing the external resettlement monitoring and assessment contracts for 16 non-core sub-projects including Lengshuijiang City,

Lianyuan City, Shuangfeng County, Shaoyang City, Shaodong County,

Longhui County, Jiangyong County, Xintian County, Jianghua County,

Qiyang County, Ningyuan County, Chenzhou City, Zhuzhou City,

Liling City, Zhuzhou County and Youxian County, the Hunan Water

& Electricity Consulting Corporation (HWECC) has prepared and delivered No. 1~4 external resettlement monitoring and assessment

(M&A) reports to the Asian Development Bank (ADB) in Sept. of 2008, in Apr. and in Dec. of 2009, and in Jul. of 2010 respectively. This time, external resettlement monitoring and assessment (M&A) have been carried out by HWECC for above 16 sub-projects and the main tasks are as followings: (1). Progress of the main project. (2). Progress of land acquisition and resettlement. (3). Establishment and operation of resettlement institutions. (4). Raising and payment of the resettlement funds.

HWECC’s staffs have made site investigation, collected data, held talks and visited families for above 16 projects since late December, 2011, and prepared the External Resettlement Monitoring & Assessment Report (No.

5 1 in 2011 and No. 5 in total) after comprehensive analysis. According to the M & A results, Zhuzhou County Urban Flood Control Project has not been included in the Report as it is the only project which has not started construction among the 16 sub-projects. As the Ningyuan County sub-project has implemented land acquisition and resettlement while the

RP (Resettlement Plan) has not got ADB’s approval, HWECC has delivered due diligence report of the resettlement to ADB in accordance with the request of ADB. Since ADB did not approve the RP of the

Ningyuan County up to now, it has not been included in the Report. It has been found that because of food control combining urban construction, the land acquisition and resettlement of subprojects including

Lengshuijiang, Youxian, etc., have been enlarged, making land acquisition and resettlement and domestic match fund more difficult. On

Jan. 12, 2011, the State Council issued the Regulation on Acquisition and

Compensation of Houses on the State-owned Land (No.590), land acquisition and resettlement became more difficult. For instance, the southern protection zone in Qiyang County Town has not started because of land acquisition and resettlement difficulties. In addition, the Jianghua

Subproject could not start because of Centianhe Dam Expansion Project.

In Oct. of 2011 the Centianhe Dam Project started construction, review design of the Jianghua Subproject in accordance with the construction of the Centianhe Dam Project has been carried out and got approval of

6 Hunan Water Resources Department, and the Jianghua subproject started construction on Oct. 8, 2011. Above contents will be stated in detail in each subproject. According to the progresses of various subprojects, the key to speed up the project implementation is to strengthen domestic fund raising and work well land acquisition and resettlement according to the laws and regulations. Both project units and departments in charge should pay attention to land acquisition and resettlement.

2. Project Description and Implementation Progress

2.1 Project Description.

The description of 16 subprojects is given in Table 2.1-1.

14 3. Establishment and Operation of Resettlement Institutions

3.1 Establishment of Resettlement Institutions

Both local governments and owners have attached great importance to land acquisition and resettlement of the Project, have established sound project management institutions and affiliate resettlement institutions, and allocated experienced staffs from departments including government, land resources, water resources, finance, real estates, agriculture, etc., and from the grassroots to be in charge of the resettlement work in order to carry out the work smoothly. All leaders of the resettlement institutions have been trained by Provincial PMO. The arrangement of various resettlement institutions is given in Table 3.1.

1-2 leaders in every affected township (town) and village have been assigned to be responsible for their resettlement work.

3.2. Operation of the Resettlement Organizations

After establishment, the resettlement institutions of all subprojects have carried out resettlement work in accordance with the leadership of both Provincial PMO and local headquarters and according to the requirements and procedures of ADB and their main work contents are as followings:

(1). Advertise the importance of the flood control project and resettlement policy and issue Resettlement Information Manuals to the resettled people and local residents in the resettlement arrangement areas.

(2). Check and determine physical indexes in accordance with Resettlement Plan and real situation of the project.

16 (3). Implement land acquisition and resettlement, sign compensation agreements, pay compensation capital and make settlement.

(4). Organize support to vulnerable group.

(5). Handle complaints and claims of the resettled people.

(6). Report land acquisition and resettlement progress to related higher departments.

4. Description of Various Subprojects

4.1 Jiangyong County

4.1.1 Progress of Resettlement Implementation

According to the Resettlement Plan of the Urban Flood Control Project of the Jiangyong County approved by the Chinese Government and agreed by the Asian Bank, the targets of the resettlement schedule are as followings: the resettlement preparation started in Mar. of 2006 and ended in Jun. of 2007 with total period of 16 months. The resettlement implementation began in Sept. of 2007, the resettlement acceptance was made in Mar. of 2009 and the post evaluation of the resettlement was made in Apr. of 2009. Up to now, land acquisition has completed 45.51 mu (accounting for 86.7%), house removal has finished 2937.89 m2 (including 437.89 m2 auxiliary houses and accounting for 129%). The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

17 4.1.2 Existed Problems and Suggestions

(1). The resettlement progress is behind the planned schedule. According to the resettlement plan, the resettlement implementation should finish in the Mar. of 2009. Therefore, the original schedule has lost control function. It is suggested that relevant units should make comprehensive consideration and adjust the plan properly.

(2). The main part of the Project has been completed. Since the issue of No. 3 External Resettlement Monitoring and Assessment Report, the main project and resettlement have no progress. According to local information, the reason is mainly constraint of the capital. It is suggested to pay attention to funding and to speed up project construction.

(3). The progress of resettlement house construction is slow, no house has been begun in addition to house land. It is suggested that local PMO and governments attach importance to resettlement arrangement, to accelerate house construction so that the resettled people can move to new house earlier.

4.1.3 Assessment Conclusion

It is considered by the monitoring and assessment that the Project is basically in accordance with the RP requirements except lagged implementation progress, especially house construction, and higher land acquisition compensation comparing the RP and the planned standards.

18 4.2 Chenzhou City

4.2.1 Progress of Resettlement Implementation

According to the Resettlement Plan of the Urban Flood Control Project of the Chenzhou City approved by the Chinese Government and agreed by the Asian Bank, the targets of the resettlement schedule are as followings: the resettlement preparation started in Mar. of 2006 and ended in Jun. of 2007 with total period of 15 months. The resettlement implementation began in Sept. of 2007, the resettlement acceptance was made in Mar. of 2009. Up to now, land acquisition has completed 237.64 mu (accounting for 48.18%), house removal has finished 3508.6 m2 (accounting for 6.3% of the planned, including 1986 m2 urban houses and 1522.6 m2 rural houses). The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

4.2.2 Existed Problems and Suggestions

(1). The resettlement progress is behind the planned schedule. According to the resettlement plan, the resettlement implementation should finish in the Mar. of 2009. Therefore, the original schedule has lost control function. It is suggested that relevant units should accelerate resettlement implementation, make comprehensive consideration and adjust the plan properly.

(2). Accelerate construction of the resettlement place and reduce the transition period of the resettled people.

(3). Occupation of farmland should be controlled strictly.

19 4.2.3 Assessment Conclusion

It is considered by the monitoring and assessment that the Project is basically in accordance with the RP requirements except lagged implementation progress and higher land acquisition compensation comparing with the RP and the planned standards.

4.3 Shaoyang City

4.3.1 Progress of Resettlement Implementation

According to the Resettlement Plan of the Urban Flood Control Project of the Shaoyang City approved by the Chinese Government and agreed by the Asian Bank, the targets of the resettlement schedule are as followings: the resettlement preparation started in Mar. of 2006 and ended in Jun. of 2007 with total period of 15 months. The resettlement implementation began in Sept. of 2007 and finished in Mar. of 2009 with total period of 21 months. Up to now, land acquisition has completed 27 mu (accounting for 3.5%), no house has been removed. The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

4.3.2 Existed Problems and Suggestions

(1). Since beginning of the construction in Mar. of 2009, the Project’s progress is quite slow and only 0.36 km (accounting for 3%) of the total 12.07 km dike has been finished. The main reasons include inadequate domestic counterpart fund and difficult removal as it is hard to sign resettlement agreements. Up to now no removal has been made. Fund and resettlement have become constraints of the Project. It is suggested that

20 both local PMO and governments raise funds by various channels and speed up resettlement under the conditions of guaranteeing the legal rights of the resettled people.

(2). The PMO should strengthen coordination and management of the Project.

4.3.3 Assessment Conclusion

The implementation is quite slow and both local governments and related departments in charge of the Project should speed up the progress by solving counterpart funds and land acquisition problems.

4.4 Qiyang County

4.4.1 Progress of Resettlement Implementation

According to the Resettlement Plan of the Urban Flood Control Project of the Qiyang County approved by the Chinese Government and agreed by the Asian Bank, the targets of the resettlement schedule are as followings: the resettlement preparation started in Mar. of 2006 and ended in Jun. of 2007 with total period of 15 months. The resettlement implementation began from Jul. of 2007 and ended in Jan. of 2009 with total period of 19 months. Up to now, land acquisition has completed 372 mu (accounting for 40.32%), and house removal has finished 9247.98 m2 (accounting for 52.55%). The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

22 4.4.2 Existed Problems and Suggestions

Flood control dike of 13.635 km is planned to build and only 4.5 km of it has been finished (Chengbei (northern) and Chengdong (eastern) zones, accounting for 33%). The Cengnan (southern) Protection Zone has not started because of land acquisition and resettlement difficulties. It is suggested to speed up construction progress of the main project.

4.4.3 Assessment Conclusion

People are satisfied with the finished resettlement arrangement area as it is in proper location and with completed infrastructure. The dike construction should be accelerated as only 33% of it has been constructed.

4.5 Longhui County

4.5.1 Progress of Resettlement Implementation

According to the Resettlement Plan of the Urban Flood Control Project of the Longhui County approved by the Chinese Government and agreed by the Asian Bank, the targets of the resettlement schedule are as followings: the resettlement preparation started in Mar. of 2006 and ended in Jun. of 2007 with total period of 15 months. The resettlement implementation began in Sept. of 2007 and finished in Mar. of 2009 with total period of 19 months. Up to now, land acquisition has completed 137.7 mu (accounting for 81.4%), 15480.76 m2 houses have been removed (all being auxiliary houses with monetary compensation, accounting for 98% of the planned). The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

23 4.5.2 Existed Problems and Suggestions

Most of the land acquisition and resettlement of the Project have been completed with land acquisition, house removal and resettled people finishing 81.4%, 98% and 97% respectively. It is suggested to do the rounding-off work of the resettlement well and the finishing of various resettlement files (physical indexes, land acquisition agreements, payment of compensation funds, pictures, photos and videos) for acceptance and post-evaluation of the resettlement.

4.5.3 Assessment Conclusion

The resettlement work in Longhui County has been done quite well. The arrangement area is suitable, the infrastructure conditions including water, electricity, road, etc., are completed and the houses of the resettled people are big with good quality. Through site visits, the resettled people are satisfied and the whole resettlement work is in accordance with the RP requirements.

4.6 Jianghua County

4.6.1 Progress of Resettlement Implementation

Being affected by the Centianhe Dam Expansion Project which is 12km in the upstream, the Hunan Nanfang Hydro & Power Design Institute has re-checked the design of the subproject considering the Centianhe Dam factor. Hunan Water Resources Department approved the design (Xiangshuizhong [2011] No.1) on Apr. 8, 2011. Comparing with the original design, the dike top elevation lowered 0.213~2.065m, the Liyujing Middle School was included in the protection zone. The revised

24 design combining with urban development, not only satisfies the flood control requirements, but also meets fewer difficulties in land acquisition, construction conditions, project financing, operation and maintenance. The Subproject was started construction in Oct. of 2011. During implementation, as Jianghua County belongs to minority area and it is difficult to carry out land acquisition and resettlement, the dike sector which needs land acquisition and resettlement in accordance with Xiangshuizhong [2011] No.1 was changed to stone masonry wall, turf revetment in accordance with top width 3.5m, slope ratio 1:2.0 was cancelled. The land acquisition and resettlement will be carried out when implementing the integration of urban and rural areas in future. At the moment land acquisition and resettlement become easy. 2 households 8 persons, 267 m2 were involved and 1 household 3 persons has been finished. The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

The original RP of Jianghua Urban Flood Control Project has become useless.

4.6.2 Existed Problems and Suggestions

After completion of the Centianhe Dam Expansion Project located 12km upstream of the Jianghua County Town, combining with planned urban dike project, the flood control standard of the Jianghua County Town will raised to 1-in-50-years. In Aug. of 2009, the Jianghua County Government delivered the Request to Lower the Dike Top Elevation of the Jianghua County Urban Flood Control Project to Hunan Water Resources Department (Jiangzhengfu [2009] No.17), the Hunan Nanfang Hydro & Power Design Institute has re-checked the design of the subproject. Comparing with the original design, the dike top elevations

25 have lowered 0.213~2.065m. During implementation, as Jianghua County belongs to minority area and it is difficult to carry out land acquisition and resettlement, the dike sector which needs land acquisition and resettlement was changed to stone masonry wall, the land acquisition and resettlement will be carried out when implementing the integration of urban and rural areas in future. As above changes belong to the change of the scheme, it has been suggested to report them to related higher department for review and approve. How to combine land acquisition and resettlement with the integration of the urban and rural areas, it should have concrete plan and should approved by related departments.

4.6.3 Assessment Conclusion

Affected by the Centianhe Dam Expansion Project which is located in the upstream (started construction on Oct. 28, 2011), the Jianghua County Urban Flood Control Project has been officially begun in Oct. of 2011, measures should be taken to accelerate the progress. During implementation, because of land acquisition difficulties, the approved design by Xiangshuizhong [2011] No1 has been changed and it should report to department in charge for approval.

4.7 Zhouzhu City

4.7.1 Progress of Resettlement Implementation

According to the Resettlement Plan of the Urban Flood Control Project of the Zhuzhou City, the targets of the resettlement schedule are as followings: the resettlement preparation ended in Jul. of 2007. The resettlement agreements and implementation began in Aug. of 2007, the resettlement production and living arrangements were finished by the end

26 of Feb., 2009, the resettlement acceptance was made in May of 2009 and post-evaluation began in Jun. of 2009. Up to now, 48.15 mu land has been acquired (3.87 mu collective land and 44.28 mu State-owned land) (accounting for 4.2%). In implementation, land acquisition is reduced to min. extent and the dike without removal has been construction firstly, there is no house removal at the moment. The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

4.7.2 Existed Problems and Suggestions

As there is no specialized resettlement organization for the Zhuzhou flood control sub-project presently, it is suggested to establish the resettlement organization and arrange personnel to carry out the corresponding work.

4.7.3 Assessment Conclusion

The major content of the Zhuzhou Sub-project is to thicken and heighten the dikes. The Heming Protection Zone implemented in the 1st stage includes dike consolidation of 11.64 km, up to now 7 km have been finished (accounting for 60.14%). Sector without house removal has been implemented firstly. Up to now no house has been removed and 48.15 mu land has been acquired (accounting for 11.59%).

4.8 Lengshuijiang City

4.8.1 Progress of Resettlement Implementation

The Lengshuijiang Subproject includes 8.27km flood control dike, 11 culverts and gates, 2 drainage stations. The Buxi Protection Zone, started in Apr. of 2009, has finished 1.5km dike (accounting for 18.1%) and 6

27 culverts and gates. It is planned to resettle 160 households 1738 persons, 25 households 81 persons have been moved and 2114.53 square m houses have been removed (accounting for 7.2%). It is planned to acquire 687.57 mu, including permanent occupation of 325.76 mu, 120 mu land have been finished (accounting for 17.4%). Resettlement capital has finished 7 million RMB, accounting for 30% of the plan (23.34 million RMB). The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

29 4.8.2 Existed Problems and Suggestions

Since beginning construction in Apr. of 2009, the Lengshuijiang Subproject has finished only 1.5 km dike at the moment. The main reason for slow progress is the combination of flood control project with urban road development and BT construction mode is applied, leading to more difficult to resettlement and self-raising fund. In particular, in Jan. of 2011, the State Council issued the Regulation on Acquisition and Compensation of Houses on the State-owned Land (No.590), land acquisition and resettlement became more difficult and the construction speed was affected. It is suggested that related departments should strengthen coordination and cooperation to raise fund and speed up construction.

4.8.3 Assessment Conclusion

Raise match fund actively to solve capital bottleneck, and control the scale of land acquisition and resettlement strictly to reduce the difficulty.

4.9 Lianyaun City

4.9.1 Progress of Resettlement Implementation

The Lianyuan City Urban Flood Control Project includes 15.895 km flood control dike, 11.869 km dike have been finished since Apr. 15, 2009 (accounting for 74.7%). In addition, 2.5 km river channel needs dredging to lower the flood level. Project investment of 34.65 million RMB has been completed. Permanent land acquisition has finished 220 mu (145 mu collective land and 75 mu other land), 8700 square meter rural houses have been removed, 51 households 138 persons have been arranged with finished resettlement investment of 11.51 million RMB (accounting for

30 69.6% of the total resettlement investment of 16.5444 million RMB). The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

4.9.2 Existed Problems and Suggestions

Since beginning construction in Apr. of 2009, the progress of the Lianyuan Subproject is quite fast and acceptance has been carried out to finished dike project. In respect to Minzhu Street in , because of dense houses along both river banks, the scheme of dredging river channel to lower flood level to replace flood control dike has been used to reduce house removal. According to the PMO, flood control dike will not be built along 2.5km dredging sector. It is suggested to report the revised scheme and implementation result to related higher department for keeping on record

31 4.9.3 Assessment Conclusion

The subproject has a rapid progress and all finished parts have past acceptance. Other match projects and round-off works should be carried out in order to finish the project at an earlier time.

4.10 Shuangfeng County

4.10.1 Progress of Resettlement Implementation

The Shuangfeng Urban Flood Control Project includes 9.8 km flood control dike (4.97 km eastern dike and 4.83 km western dike), 12 culverts and gates, 2 drainage stations, 1 flood discharge channel with length of 1.605 km, 2 underground culverts (1.13 km). The eastern dike was started in Dec. of 2010 and has finished 700 m earth dike. The western dike was started in Jul. of 2011. In total 3.5 km dike has been constructed, accounting for 35.7%. According to RP, 16014 m2 houses are removed. Because of optimization of the design, there is no house removal with the constructed dike area. It is planned to acquire land 455.3 mu (362.3 mu permanent land), at the moment 180 mu land has been acquired and all compensation capital have paid. The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

4.10.2 Existed Problems and Suggestions

35.7% of the project has been finished in Shuangfeng County. According to the PMO, the land acquisition and resettlement in unfinished area are very difficult, and the construction has been stopped by local people. It is suggested that related departments should strengthen coordination in land acquisition and resettlement to accelerate the progress of the subproject. In addition, the loan of ADB is based on US dollar, the real loan amount has been reduced because of the appreciation of RMB.

4.10.3 Assessment Conclusion

The eastern dike has finished only 700 m (accounting for 17% of the plan) since beginning in 2010. According to PMO, the main reason of slow progress is difficult land acquisition. Land acquisition and resettlement should be worked well in accordance with the laws and regulations.

4.11 Shaodong County

4.11.1 Progress of Resettlement Implementation

The Shaodong County Urban Flood Control Project was started on Jun. 2, 2011, 5.13 km earth dike have been finished (accounting for 43.9% of 11.686km dike). The dike line has been adjusted in order to reduce land acquisition during construction, there is no land acquisition in finished dike area. 558 mu land, including 458 mu permanent land (454 mu collective owned and 4 mu state owned) and 100 mu temporary land, have finished formality approval and signed compensation agreements. The compensation is 36745 RMB/mu for paddy field (22517 RMB/mu

34 according to the plan) and 10230 RMB/mu for dry land (15495RMB/mu according to the plan). 20.5 million RMB has been finished in land acquisition. The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

4.11.2 Existed Problems and Suggestions

The 5.13 km constructed dike has no land acquisition owing to adjustment of the dike line. Located in the old urban area with dense enterprises and residents, the remaining dike needs to acquire 871 mu permanent land and 444 mu temporary land, and to remove 13666 m2 houses (9151 m2 residential houses). On Jan. 12, 2011, the State Council issued the Regulation on Acquisition and Compensation of Houses on the State-owned Land (No.590), land acquisition and resettlement became more difficult. The PMO suggests to optimize the dike line to reduce land acquisition and to speed up the project.

36 4.11.3 Assessment Conclusion

According to the site investigation, the unfinished dike area has a dense houses and buildings. According to local PMO, the cost for two buildings of the Shaodong County People’s Hospital is about 5 million RMB and there is no suitable place for constructing new building. In order to reduce land acquisition and speed up implementation, the local PMO should make further investigation and report to related higher departments to solve the problem properly.

4.12 Xintian County

4.12.1 Progress of Resettlement Implementation

Consisted of 5 flood control zones, the Xintian County Urban Flood Control Project includes construction of 9.789 km earth dike and 2.032 km stone masonry wall, consolidation and heightening of 6.514 km stone masonry flood control wall, 0.61 km stone masonry slope protection, and construction of 2 electric drainage stations (4 units, 664 KW) and 2 culverts and gates. Started on Jun. 5, 2009, 2.5 km dike have been finished with investment of 22.814 million RMB (accounting for 43.5% of the total investment of 52.42 million RMB, including main project of 16.484 million RMB, land acquisition and resettlement of 5.23 million, other investment of 1.1 million RMB). According to the RP, 124 mu permanent land (88mu collective land and 36 mu state-owned land) and 57.45 temporary land will be acquired. 193.5 mu land have been finished, including 124 mu permanent land (88mu collective land and 36 mu state-owned land). It is planned to remove 11400 m2 houses, including 11400 m2 permanent houses (4094 m2 urban houses and 7306 m2 rural houses) and to resettle 70 households and 285 persons. 15210 m2 houses

37 have been removed, which exceeded the planned removal. The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

4.12.2 Existed Problems and Suggestions

The Subproject has finished only 2.5 km dike (accounting for 25.5%) and investment of 22.814 million RMB (accounting for 43.5%) and it is suggested to take effective measures to control the total investment. In addition, as part dike is located in the old town area with many historic buildings, it is very difficult to acquire land and to resettle, the County PMO suggests to optimize the dike line to avoid removing the dense houses of the enterprises and residents in the old town area.

4.12.3 Assessment Conclusion

Since starting construction in 2009, the Subproject has finished only 2.5 km dike (accounting for 25.5%) and investment of 43.5%, the whole schedule would be affected if no effective measures and optimized design are taken to reduce the removal scale and control the capital gap.

4.13 Liling City

4.13.1 Progress of Resettlement Implementation

The Liling City Urban Flood Control Project includes construction of 3.39 km stone masonry flood control wall, consolidation and heightening of 3.86 km existed flood control dike, and construction of 5.195 km flood control dike. Started on Nov. 19, 2010, 1200 m flood control dike have been finished till Dec. 31,2011. According to the RP, 46776 m2 houses are removed, including residential houses of 43647 m2 and resettlement of

38 544 households and 1994 persons, 788.3 mu land is acquired permanently, including 735.3 mu collective land (including 39.6 mu farmland) and 53 mu state-owned land, and 120 mu land is acquired temporarily. Up to now 469 mu land have been acquired (all belonging to collective land, accounting for 54.9% of the plan), 4030 m2 houses have been removed (all belonging to urban houses and accounting for 8.6%). The task of land acquisition and resettlement is heavy in future, especially in house removal (finishing less than 10%). The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

4.13.2 Existed Problems and Suggestions

According to our site investigation and reports from the County PMO, the tasks of land acquisition and resettlement for unfinished project will be very heavy and the costs will be high, especially after the issuing of the Regulation on Acquisition and Compensation of Houses on the State-owned Land, the work becomes more difficult with the increase of compensation standards. It is suggested that the project unit should implement land acquisition and resettlement in accordance with the laws and regulations in order to accelerate the progress of the project. According to the County PMO, the loan of ADB is based on US dollar, the real loan amount has been reduced because of the appreciation of RMB, making domestic match funding more difficult. This problem has been reported by many project owners and should get the attention of related departments.

4.13.3 Assessment Conclusion

Implement land acquisition and resettlement in accordance with the laws

39 and regulations to solve the bottleneck of the project progress.

4.14 Youxian County

4.14.1 Progress of Resettlement Implementation

Started early, the Chenbei (northern) Flood Control Dike of the Youxian County Urban Flood Control Project began on Nov. 28, 2007 and has finished basically, the Chennan (southern) Flood Control Dike began on Aug. 28, 2010 and has finished 2.7 km earth dike, land acquisition of the project and the resettlement arrangement area.

(1). Progress of land acquisition

331.2 mu land has been finished (accounting for 64.3% of the plan), including 324.8 mu permanent land (292.8 mu collective land and 32 mu state-owned land) and 6.4 mu temporary land. Because of combining with urban construction, the permanent land acquisition exceeded the plan, while the temporary land reduced.

(2).Progress of resettlement & removal

22848 m2 houses have been removed, including 8848 m2 urban houses and 14000 m2 rural houses. 85 households and 384 persons have been arranged. The Chenbei resettlement arrangement area has been finished and the Chennan arrangement area has finished land acquisition and leveling.

The accomplishments of land acquisition, resettlement and capital payment are given in attached Table 1, Table 2 and Table 3.

41 4.14.2 Existed Problems and Suggestions

Started early, the Chenbei (northern) Flood Control Dike of the subproject has been finished substantially, while the Chennan (southern) Flood Control Dike and some matching projects have not been finished yet and should be speeded up. In addition, both the amount of houses removal and land acquisition exceeded the RP owing to combining with urban construction, it may affect project progress if handled improperly.

4.14.3 Assessment Conclusion

On Jan. 12, 2011, the State Council issued the Regulation on Acquisition and Compensation of Houses on the State-owned Land (No.590), land acquisition and resettlement became more difficult. Both land acquisition and resettlement scales should be controlled strictly.
