EXTRAORDINARY PUBLISHED by AUTHORITY No. 1675, CUTTACK EXTRAORDINARY PUBLISHED BY AUTHORITY No. 1675, CUTTACK, FRIDAY, SEPTEMBER 12, 2008/ BHADRA 21, 1930 HOUSING & URBAN DEVELOPMENT DEPARTMENT NOTIFICATION The 12th September 2008 S.R.O. No.442/2008ʊWhereas, the notification of the Government of Orissa in Housing & Urban Development Department No.5874, dated the 18th February 2008 relating to division of the area of Cuttack Municipal Corporation into wards and reservation of seats thereof were challenged before the Hon’ble High Court of Orissa in W.P. (C) No.4159 of 2008 and also in similar other writ petitions and Hon’ble High Court by Judgment and order dated the 15th May 2008 quashed the said notification and directed the State Government to proceed in the matter afresh in accordance with the mandate of sections 7 and 60 as well as sub-rule (3) of rule 4 of the rules and take a fresh decision on the objection of the petitioner in consonance with the aforesaid statutory provisions and keeping in view the principles of consultation as laid down by the apex Court as well as the Madras High Court referred to in the said order of the Hon’ble High Court ; Whereas, pursuant to the said judgment of the Hon’ble High Court, the process relating to division of area of the Cuttack Municipal Corporation into wards and reservation of seats thereof is to commence afresh; Now, therefore, in exercise of the powers conferred by sub-sections (1) and (3) of section 60 of the Orissa Municipal Corporation Act, 2003 (Orissa Act 11 of 2003) read with sub-rule (1) of rule 3 of the Orissa Municipal Corporation (Division of City into Wards, Reservation of Seats and Conduct of Election) Rules, 2003, notice is hereby given that Cuttack Municipal Corporation in the District of Cuttack shall be divided into 54 wards as specified in Column (2) of the Statement-I below with the description and boundaries of the said wards against each in Columns (3) and (4) respectively thereof for the purpose of ensuing election of Corporators to the same and the wards specified in Column (2) of the Statement-II below in which the seats reserved under section 7 of the said Act, shall be set assigned against each in Column(3) thereof. Any objection or suggestion which may be received from any person interested in respect of the said draft notification on or before the date of expiry of the period of ten days from the date of publication of this notification will be considered. Objections or suggestions received after the said period shall not be taken into consideration. 2 STATEMENT-I Sl.
