Ordinance Supplementing Chapter 122 (Public Assemblies) of the Jersey City Municipal Code Implementing Specific Permit Requirements for Special Improvement Districts City Clerk File No. Ord. 19-001 Agenda No.^ 3.B J st Reading Agenda No., ____ T-n. 2nd Reading & Final Passage COUNCIL AS A WHOLE offered and moved adoption of the following ordinance: C\JY ORDINANCE 19-001 TITLE: ORDINANCE SUPPLEMENTING CHAPTER 122 (PUBLIC ASSEMBLIES) OF THE JERSEY CITY MUNICIPAL CODE IMPLEMENTING SPECIFIC PERMIT REQUIREMENTS FOR SPECIAL IMPROVEMENT DISTRICTS. WHEREAS, the City of Jersey City (the "City") has designated seven (7) Special Improvement Districts ("SIDs") throughout the City; and WHEREAS, SIDs host many public events each year that requu-e pemiits issued pursuant to Chapter 122 of the City Code; and WHEREAS, an applicant seeking a permit pursuant to Chapter 122 is currently required to secure a refundable $1,000.00 bond for each permit application; and WHEREAS, thousands of dollars offhe SIDs' budget are tied up in refundable bonds causing a hardship for the SIDs and discouraging future events; and WHEREAS, the SID-hosted events are commumty-building and it is in the best interest of the City to ensure that these events contmue. THE MUNICIPAL COUNCIL OF JERSEY CITY DOES ORDAIN: 1. The following supplements to Chapter 122 (Public Assemblies) of the Jersey City Code are hereby adopted. Chapter 122 - PUBLIC ASSEMBLIES § 122-1.-Definitions. As used in this Chapter, the followmg terms shall have the meanings indicated; SPECIAL MPROVEMENT DISTRICT shall mean the Management Corporation for a Special Improvement District designated by Chapter 69 of this Title § 122-4. - Application for pennits; insurance requirements; fees; temporary structures; bond requirements. E. Bonds. [The a] Applicants shall provide a cash bond in the sum of $1,000.00 conditioned upon holding the City harmless from any and all liabilities or causes of action which might arise by virtue of the granting of a permit to the applicant and conditioned further that no damage shall be done to the streets, sewers, trees or adjoining property and that no dirt, paper, litter or other debris shall be permitted to remain upon the streets or upon any private property by such applicant. Such cash bond shall be returned to the applicant upon certification by the license issuing authority that all conditions of this Chapter have been complied with. The City Clerk and the Corporation Counsel are hereby authorized and directed to change any chapter numbers, article numbers, and section numbers in the event that the codification of this ordinance reveals a conflict between those numbers and the existing code, in order to avoid confusion and possible repeals of existing provisions.     AMENDMENT TO THE ENTIRE HISTORIC PRESERVATION PLAN ELEMENT (ARTICLE IX) AMENDMENT APPROVED BY THE JERSEY CITY PLANNING BOARD ON MARCH 10,2015 IX. HISTORIC PRESERVATION PLAN ELEMENT INTRODUCTION Jersey City has both a long history of development and a long history of historic preservation. Jersey City’s first historic preservation ordinance was enacted in 1974, at which time the Historic Preservation Commission and the Historic Preservation Officer position were created and the first local historic districts (Van Vorst Park, Paulus Hook and Hamilton Park) were designated. Those districts were later added to the State and National Registers of Historic Places. Since 1974, several other local districts and individual landmarks have been added to the Historic Preservation Commission’s jurisdiction based on works like the 1987 Historic Preservation Element of the Jersey City Master Plan and the Cultural Resource Inventories (Phase I and Phase II) performed by Dr. Joseph Brooks and Mary Dierick, respectively, in the 1980s and, since 2000, Designation Reports of the Warehouse District and West Bergen-East Lincoln Park District. Though many of the recommendations of the 1987 Historic Preservation Element are on-going and still relevant and were carried-over into the Master Plan in 2000, a new City-wide Historic Preservation Survey should be untaken. HISTORY1 Jersey City was originally settled in the seventeenth century by Dutch traders and colonists. The City was part of Bergen Township from 1660 to 1869. Bergen Township was divided into several municipalities between 1855 and 1863. Between 1869 and 1870, Hudson City, Bergen City and Jersey City were consolidated and in 1873 Greenville was added, creating the modern Jersey City.

INTRODUCTION The Bright Street Redevelopment Area (hereinafter the Redevelopment Area or the Area) was determined to be “an area in need of redevelopment”, pursuant to the New Jersey Local Housing and Redevelopment Law (N.J.S.A. 40A:12A-1 et seq.) by resolution of the Jersey City Municipal Council following a recommendation by the Jersey City Planning Board. The Bright Street Redevelopment Area consists of 19 tax lots along Bright and Grand Streets in downtown Jersey City. To the south of the Redevelopment Area is the Liberty Harbor North Redevelopment area, a plan which seeks to redevelop 86 acres south of Grand Street into a new mixed use neighborhood by extending the street grid of the Van Vorst Park Historic District into formerly industrial and vacant properties along the old Morris Canal route. The Van Vorst Park Historic District to the north of the Redevelopment Area consists mostly of mid and late nineteenth century townhouses and tenements with occasional corner storefronts and other mixed uses. For much of Jersey City’s history, the area that is now the Bright Street Redevelopment Area was the residential edge of the Van Vorst neighborhood as it transitioned into industrial sites along and south of Grand Street. This edge condition is now characterized by vacant land, dilapidated buildings, over crowded lots, and properties in generally poor and blighted conditions lacking historic integrity and context (with one notable exception of the Passaic Hose Building at 14 Bright Street), and marginal land-uses which are not in keeping with those uses permitted in the zone plan for the Area nor recommended in the Master Plan.
