I have been misquoted on more than one occasion. I’ll be happy to talk to you about what I think about the transition but I don’t want my name attached to any of it. MK: Okay. So we’ll come back to you for any quotes. We’re going to look at both aspects: the transition itself and then the operations of the office. Working on the theory that one of the things that would be important for people is to understand how an effective operation works, what should they be aiming toward? For example, what is a smooth-running counsel’s office? What are the kinds of relationships that should be established and that sort of thing? So, in addition to looking at the transition, we’re just hoping they’re looking toward effective governance. In your time in Washington, observing many administrations from various distances, you have a good sense of transitions, what works and what doesn’t work. One of the things we want to do is isolate what are the elements of success—just take a number, six elements, five elements—that you think are common to successful transitions. What makes them work? LC: Well, the most important thing to grasp first is how much a White House itself, especially as it starts off after a change in the party occupying the White House, resembles a city hall. -

Testimony of Joan Claybrook, President, Public Citizen, Former Administrator, National Highway Traffic Safety Administration before the Senate Committee on Competition, Foreign Commerce and Infrastructure June 3, 2004 Thank you, Mr. Chairman and members of the Senate Competition, Foreign Commerce and Infrastructure Committee, for the opportunity to offer this written testimony on the importance of improvements in vehicle safety. My name is Joan Claybrook and I am President of Public Citizen, a national non-profit public interest organization with over 150,000 members nationwide. We represent consumer interests through lobbying, litigation, regulatory oversight, research and public education. I am testifying before you with shocking news that has, over time, sadly become hum-drum fact. Vehicle crashes are the leading cause of death for Americans from 4 to 34 – killing 118 people every day of the year – the same as a major airline flight crashing each and every day. The National Highway Traffic Safety Administration (NHTSA) estimates the direct cost in economic losses from vehicle crashes is $230 billion each year (in 2000 dollars), or $820 for every man, woman and child in the U.S.1 Dr. Jeffrey Runge, Administrator of NHTSA, predicted last year that the total dead could reach 50,000 annually in 2008. “This is a Vietnam War every year,” he said. “That’s just not tolerable.” Mr. Chairman, I agree. The Transportation, Recall Enhancement, Accountability and Documentation Act, called the TREAD Act, was passed by Congress in November 2000 after a reporter in Houston, Texas, grabbed the attention of the nation with her story that Ford Explorers with Firestone tires were experiencing sudden tire blowouts, rolling over and killing the people inside. -

Ultimately the material goes into a presidential library; it will go into the [Jimmy] Carter Library. We’re working with the National Archives on it. The full interviews don’t come out publicly until 2001, when a new President comes in, and also you’ve had a chance to go over the transcript. GR: Okay. MK: It’s going to be used in various ways. It’s a group of presidency scholars and we’re doing profiles of seven offices. We’ve selected seven offices. And we’ll go back over time to the [Richard] Nixon administration, and profile what the functions have been, the responsibilities, different ways in which they’ve been organized. I’m writing the one by myself on communications. I’m doing press and communications by myself. The pieces themselves are going to be short, although they’ll be on a pass-coded website for people coming in so they can then⎯in addition to reading the fifteen pages about some of the general things about the office⎯they’ll be able to select items within it as well. We’ll have links in to longer pieces. And then we’re doing what we call “Standards of a Successful Start” in the spring, which are isolating maybe eight elements that are common to successful transitions. GR: Interesting. There will never be another superlawyer on the scale of Lloyd Cutler, who died on May 8 at age 87. This is not to deny the possibility that someone, somewhere may replicate the dazzling array of talents that made Cutler the pre-eminent lawyer-statesman of his generation: intellectual brilliance, wisdom, public-spiritedness, eloquence, genius for grasping the interests of everyone around the table, and passion for forging consensus solutions to hard problems. But even if more such people walk among us, the political and legal environments that enabled Cutler to be Cutler no longer exist. This is a man who served every Democratic president since LBJ and every Republican president since Ronald Reagan; who won the trust and friendship of the best and brightest leaders in both major parties; who represented corporate titans and civil-rights groups; who moved effortlessly between private and public sectors; who tackled national problems as diverse as the race riots of the 1960s, the Iranian hostage crisis, the vast, unsecured nuclear stockpiles in Russia, and faulty intelligence on weapons in Iraq. The snarling partisanship, pervasive mistrust, intellectual shallowness, and TV-driven demagogy that permeate today's Washington would make it all but impossible for a Lloyd Cutler to work his magic now. He was in his element when steering small groups of serious, moderate-spirited leaders who wanted to make the system work, and who were moved not by flash or fiery rhetoric or poll numbers, but by intellectual rigor. -

The study assesses and compares increased automobile fuel efficiency and synthetic fuels production with respect to their potential to reduce conventional oil consumption, and their costs and impacts. News Release For Immediate Release: Contact: Tim Parsons October 9, 2012 410-955-7619 or [email protected] Safety Pioneer Joan Claybrook Receives 2012 Community Hero Award Joan Claybrook, President Emeritus of Public Citizen and former administrator of the National Highway Traffic Safety Administration (NHTSA), has received the 2012 Community Hero award from the Johns Hopkins Center for Injury Research and Policy, part of the Johns Hopkins Bloomberg School of Public Health. The Community Hero Award was created by the Johns Hopkins Center for Injury Research and Policy to recognize distinguished injury prevention leaders and exemplary programs that contribute to improving safety in our communities. In 1966, Claybrook teamed up with Public Citizen founder Ralph Nader to successfully lobby for passage of the nation’s first auto safety laws. As administrator of NHTSA under President Jimmy Carter, she issued the first standards requiring air bags in all passenger vehicles and the first fuel-economy laws. These acts empowered government to establish safety standards for new vehicles and issue recalls for defective vehicles and parts. She went on to serve as president of Public Citizen from 1982 until 2009. “Motor vehicle safety is recognized by the CDC as one of the top ten public health success stories of the last century, and much of this success is attributable to the work of Joan Claybrook,” said Andrea Gielen, ScD, ScM, director of the Johns Hopkins Center for Injury Research and Policy. “We in the field of injury prevention are indebted to Joan’s tireless service, advocacy and leadership.” While at the Bloomberg School to accept her award, Claybrook spoke on “The Politics of Safety” at the annual Daniel J. -

UNITED STATES DISTRICT COURT FOR THE DISTRICT OF COLUMBIA CENTER FOR AUTO SAFETY, et al., ) ) Case No. 04-0392 (ESH) Plaintiffs, ) ) v. ) ) NATIONAL HIGHWAY TRAFFIC ) SAFETY ADMINISTRATION, ) ) Defendant. ) ____________________________________) MEMORANDUM IN OPPOSITION TO DEFENDANT’S MOTION TO DISMISS This case challenges a de facto legislative rule, promulgated in a 1998 letter to auto manufacturers from the National Highway Traffic Safety Administration (“NHTSA”), that permits vehicle manufacturers to conduct “regional recalls.” Regional recalls exclude vehicle owners residing in large parts of the country from the warning and free remedy that is guaranteed by the National Traffic and Motor Vehicle Safety Act (“Safety Act”) to all owners of motor vehicles containing safety-related defects. In its motion to dismiss, NHTSA suggests that plaintiffs Public Citizen and the Center for Auto Safety want to substitute their judgment for that of the agency. To the contrary, through this lawsuit, plaintiffs hope to force NHTSA to comply with Congress’s judgment that safety recalls should protect all motorists, not just those living in select states. NHTSA’s motion falters from the start by mischaracterizing the complaint. Contrary to NHTSA’s repeated statements, plaintiffs are not challenging individual past or future regional recalls. Rather, plaintiffs challenge NHTSA’s across-the-board rule authorizing and setting the standards for regional recalls. The agency’s 1998 letters to auto manufacturers contain specific directives and requirements controlling the conduct of regional recalls, which both bind manufacturers and limit NHTSA’s discretion to take certain actions. Furthermore, plaintiffs have standing to bring this action, as amply illustrated by the complaint, declarations ignored by NHTSA, and additional declarations submitted with this opposition. -

Hounshell Throughout the 20th century, the automobile became the great American machine, a technological object that became inseparable from every level of American life and culture from the cycles of the national economy to the passions of teen dating, from the travails of labor struggles to the travels of “soccer moms.” Yet, the automobile brought with it multiple dimensions of risk: crashes mangled bodies, tailpipes spewed toxic exhausts, and engines “guzzled” increasingly limited fuel resources. During the 1960s and 1970s, the United States Federal government created institutions—primarily the National Highway Traffic Safety Administration within the Department of Transportation and the Office of Mobile Source Pollution Control in the Environmental Protection Agency—to regulate the automobile industry around three concerns, namely crash safety, fuel efficiency, and control of emissions. This dissertation examines the growth of state institutions to regulate these three concerns during the 1960s and 1970s through the 1980s when iv the state came under fire from new political forces and governmental bureaucracies experienced large cutbacks in budgets and staff. -
