Abstract

In the last decade, the study of social norms has become a major focus of and research in law a nd economics. Surprisingly, this "new norms" literature has almost completelyignoreddecadesofsystematictheory,experimentation,andfieldresearchon normative processes by social . We demonstrate that there are multiple mechanisms by which normative influence operates, each with its own principles and consequences. We also identify a host of situational and dispositional (individual - difference)moderatorsthateitherattenuateoramplifytheeffectsofnormativeinfluence sources. Finally,weshowthattheinternalizationprocessismuchlessmysteriousthan some have suggested; it can occur through any of several well -studied processes. By taking these theoretical distinctions and moderators into account, the new norms literature wil l necessarily become more , but not necessarily chaotic or incoherent. Becausethesecomplexitiesarefactsofsociallife,acknowledgingthemwill allow the new norms theorist to improve their predictions and hence their norm - managementimplicatio ns.

I. Introduction

FollowingElickson’sbook,OrderWithoutLaw,1lawandeconomicscholarshave taken the leading role in the legal scholarship of social norms. Dozens of papers have beenwrittenonvarietyoftopics,showingtheimportanceoftakingnormsintoaccount when studying the effect of legislation on people’s behavior. 2 Given the amount of review papers and symposiums, which have analyzed the current and potential contribution of the new norm -scholarship on legal scholarship, we will not attem pt to conduct a full review of the various ideas developed by scholars working in this scholarship.

Scholarsofthelawandeconomicsofnorms(henceforth,“LENscholars”)have proposed various theoretical mechanisms. Ellickson has relied on the concept of reciprocity and reputation,3 citing it as the main reason that people engage in norms, hence arguing that norms could govern efficiently in close -knit groups or when reputations could be monitored. Following the reputation rationale, Posner 4 has argued thatnormsserveasameansofsignalingtoothersone’slowdiscountrateandthatthey could, therefore, serve as good business parties. Moving to a less instrumental and materialistic account of norms, McAdams argues that people’s primary for following norms stems from their need for others’ approval to maintain their self - esteem. 5 Cooter goes even further, arguing that, ultimately, self -enforcing mechanisms areonlyensuredwhenpeopleinternalizethenorm. 6

The motivation for writing this p aper thus sprang from the fact that, in many cases,thisemergingliteratureistacklingquestionsverysimilartothosethathavebeen discussedbysocialpsychologistsforthepastseventyyears. 7MostLENscholarsappear torecognizethatsocialnormsh avebeenanalyzedbyothersocialscientists(especiallyby sociologists),butsuchanalysesarerarelyexaminedexplicitly,andearliernon-economic effortsareoftendismissedinpassingasprimitiveoratleastpre -scientific.Asaresult, this new lit erature has almost completely ignored decades 8 of systematic theory, experimentation,andfieldresearchonnormativeprocessesbysocialpsychologists. 9We find this omission to be especially puzzling when considering the great visibility of cognitivepsy chologyintheeconomicanalysisoflaw,anareaknownasbehaviorallaw andeconomics. 10

Of course, historical precedence does not give one discipline sufficient justification to criticizeorpatronizemodelsdevelopedbyotherdisciplines.Wedonot contendthateconomicpsychologicalmodelsshouldreplaceeconomicmodels –indeed, existing psychological accounts have important limitations -- but that recent law and economics accounts of social norms would benefit from taking into account relevant princi ples and findings from social psychology. We will show that psychologists have alreadydevelopedelaborateandempiricallybasedanswersformanyofthequestionsthat lawandeconomicscholarsaredealingwithtoday.

Our discussion of relevant findings wi ll be organized around three questions. First, how do norms operate? Some LEN scholars have recognized that a few basic normative influence processes, but we will show that social psychology has detailed numerousnormativemechanismsindetail.Second,when donormsoperate?Wewill identifyanumberofrobustgeneralizationsaboutclassesofsituationalanddispositional (individual -difference) factors that moderate 11 the norm -behavior relationship. Third, howdoesinternalizationoccur?LENscholars havetreatedthisquestionasacomplete enigma, but we will identify several well -understood processes by which actors internalizenormativemessages.

Of course, we acknowledge at the outset that LEN scholars are concerned with importantquestionsthats ocialpsychologistshavelargelyignored.Forexample,cana rational choice model of human behavior explain why would people follow social norms? 12 Under what circumstances could norms govern efficiently, and when would stateinterventionberequired?To whatextentdonormsmediatetheeffectoflegislation

The general theme of the papers in this volume is the law and economics of irrationalbehavior.Manynormsdoappearirrational,butmanydonot,andofcoursethe mere fact that people often follow social norms is not irrational. Norms can provide a powerful coordination mechanism, and adherence to norms is often dictated by simple cost -benefitcalculat ions.Ourinterestislessintheirrationalityofnormativecontentthan inthefrequent arationality ofthenormativeinfluenceprocess –thewaysinwhichnorms can shape behavior absent any explicit deliberative calculation by the actor. 14 We see little valueinfurtherdebatesaboutwhethernormcomplianceisinstrumentalornot,or whether people are egoist or altruistic; 15 such debates often boil down to semantics. Insteadwewillsimplyassertthatitisoftenclarifyingandparsimonioustolabelcert ain behavior as normatively influenced, and we will identify a number of robust generalizations about such influence. Our hope is to improve the predictive and explanatory power of current LEN models by drawing attention to well -understood phenomenatheyoversimplifyorobscure.

Economistssometimescriticizepsychologyfortreatingallsocialphenomenaas context -dependent, producing a chaotic, falsifiable, and non-applicable view of . Scott 16 argues that: “a preference -shaping analysis provides a r icher explanation for commonly observed interactions among legal rules, norms, and values, but at a considerable price. The introduction of nonfalsifiable hypotheses produces an analysis

Feldman&MacCoun - 1/16 /03 - 6 that is rich in content but also speculative and context -dependent.” While we acknowledgethatthepictureweportrayisconsiderablymorecomplexthanthepithyand stylized models of the LEN literature, a wealth of evidence from both controlled experiments and field studies shows that the complexity is a property of real ity rather than a shortcoming of psychological analysis. The moderators and theoretical distinctionswewillfocusonarewellestablished,testable,andfairlyeasytorecognize ex -ante, 17 evenfromalegal -policyperspective.Wefailtoseehowtheseco nceptsare any less falsifiable than the key factors in LEN accounts, and it is clear that social psychologists have gone far further than the LEN community in actually devising and conductingrigoroustests.

A. Recentcriticismofsocialnorms

Our argume nt for the failure of law and economics to recognize the important contribution that social psychology could make, becomes even clearer and more appealing when one considers the criticism this new literature has received. We will showthat,atleasttoso meextent,theproposedmodificationsinthemodelsweadvocate forcouldreducesomeofthecriticismofthisnewliterature.

Mitchellarguesthatthenewnormsmodelsofferanoversimplifiedaccountofthe functioningofnorms. 18 Elster 19 stipulatesthatitissimplyimpossibletoexplainnorms only on grounds of rationality. Other scholars, who discuss these trends in law and economics, argue that current models of law and economics are either not backed by empirical research,20 or cannot be backed by fu ture research because they are just not

More specifically, she recognizesthatthereisalmostnofieldresearchbackingthegeneralizationmadebygame theoristsregardingfairnessandsocialnorms.

Thecriticismofthecurrentinterestsoflawandeconomicsinsocialnormsisnot limitedonlytosocialscientists,however.Legalscholarswhoarethemselvesidentified withthenewapproachestolawandeconomicsarguethatsomeofth emodelsusedinthis literaturesuffersfromsignificantlimitations.

Kahan,25 discussingrationalchoicemodelsofsocialnorms,says:

“A theory can be said to be over determined when it furnishes a menu of opposingbehavioralmechanismsthataresuff icientlyabundanttoaccountforessentially anyphenomenaaswellasitsnegation.Inthatcircumstance,thetheorydoesnotgenerate ’explanations’ at all; it merely supplies a convenient of story -telling templates that allow the theorist to rational ize ex post whatever existing facts she encounters and to

McAdams, himself a leading scholar in this tradition, focusing on models developed by Posner 26 argues that the signaling model is non-falsifiable and gives no predictionastowhengivennormswillsucceedandwhentheyarelikelytofail.

AverysimilarcritiqueissuggestedbyRachlinski: 27 “…thelawandsocialnorms scholar shipismerelyaposthocefforttoaccommodatesomeanomalousphenomena… [that]mightnotgeneralizetonewsituations,makingthemuselesstopolicy -makers.”

And even Elickson, the founding father of the LEN approach, admits in his evaluationofthearea thatheco -created:“Butintheend,thiscanonaccountsforonlya handfulofthesnapshotsinthethickphotoalbumofthelegalcathedral.”

B. Evaluationofthecriticism

ItisevidentfromtheshortreviewthatwehaveconductedthattheLENapproac h hasdrawnalotoffirefromcriticsfromdifferentandsometimeevenopposingdirections. Inourviewthecriticismsaren’tunwarranted,butwetheintegrationofinformalsocial controlsintolawandeconomicsscholarshipisanimportantadvancethats houldnotbe dismissed prematurely. Moreover, recent changes in law and economics have enabled the use of psychological literature in legal areas that were traditionally off -limits for psychology.Traditionally,psychologywasemployedbothinlegalpract iceandinlegal theory to areas such as insanity defense, child custody and jury research. Prior to the interest of law and economics scholars in psychology, there were limited interactions betweenpsychologicaltheoriesandsubstantivelegalquestionsin suchareasascontracts, property,andcorporatelaw.Inthelasttenyearshowever,coincidingwiththeincreasing interest in social norms and in behavioral decision-making, reference to psychological theoriesisacommonpracticeinmoreandmoreareas oflegalresearch.Hence,thenew law and economics scholarship has created a “portal” for psychology to access legal

Wethinkthatitisimportantforscholarsfromotherdisciplinestorecognizethe benefitsofaneconomictreatmentofsocialnorms.Relativetopsychology,weseethree importantadvantages:

First, economics has a meta -theory about the conditions under which the norm willbeefficient. 28 Alegalpolicymakerthatfocusesonnormsmusttakeintoaccountnot onlyhownormsoperate,butwhatthelikelycontentofthenormswillbe,aswellashow thecontentofthenormsmightbeaffectedbythelegalregulation.

Second,theeconomicanalysishasanexplicitaccountofsocialequilibriumand stability 29 inthedevelopmentofnorms.Thefocusonequilibriumisespeciallyimportant for legal policymaking, which is naturally interested in understanding not only how normsaffectbehaviorinagivensituationbutalsointhedynamicsofchangeandstability asexpressedinsocialforcesovertime.

Third, there is a clear connection between positive and normative economics. While lessimportantfromtheperspectiveofpuresocialscience,whentheinterestisin usingsocialsciencetoenhancesocialwelfare,thenormativeorientationofeconomicsas wellastheexistenceofameta -theoryofefficiencyenablesittoadvocatemore forcefully for a legal policymaking that will be sensitive to the functioning of social norms. Psychology, in contrast, largely lacks an explicit normative framework that is clearly linkedtoitsdescriptivetheoryandresearch.

We should also acknowledge two impediments to the incorporation of psychological theories into law and economic models: the fact that most theories in psychologyarenotformalized,andtheproliferationofjargon.

Because theories in psychology aren’t always formalized 30 it can be hard for economists to take advantage of those theories. Some argue, 31 for example, that the relativesuccessofthetheoriesofKahnemanandTversky 32 inthecontextofdecision- makingamongeconomistsisduetothefactthattheirtheoriesareformaliz edinaway, whichmakestheincorporationoftheirtheoriesintoeconomicsrelativelypainless.

Social psychology is also plagued by a proliferation of jargon, which makes it difficulttounderstandwhatthe“bottomline”iswithinpsychologicaltheorie sregarding policy questions. This fact is especially problematic given the general lack of mathematical formalization that could otherwise be used to avoid redundancy. Hence, sometimes -identicalphenomenareceiveddifferentnamesbydifferentscholars,cr eating needless complexities and uncertainties about the existence of bottom lines. Also frustratingfortheLENscholaristhefactthattheterm“norm”israrelyused.Instead, there is a bewildering array of related concepts – pressure, group identification, public self, etc. We will attempt to clear much of this conceptual underbrushinthesectionsthatfollow.

II. HowDoNormsOperate?

Social psychology offers several overlapping taxonomies of social influence. Whileasinglecomprehensiveta xonomymightbepreferred,attemptstointegratethem into a grand scheme have been more cumbersome than useful, losing much of their heuristicfocusforexplanationandprediction.33 Table1presentsaroughdepictionofthe overlappingcategoriesofthes etaxonomies.

A. Compliance,identification,andinternalization

B. Sourcesofsocialpower

FrenchandRaven 35 suggestadifferentclassificationthanKelmanthatconsistsof fivebasesofsocialpower.Ino therwordstheirfocuswasnotondifferentprocessesof social influence but instead on the factors that gives the influencing source its social power. The first two bases - reward and coercive power - seem to be central the deterrence/compliancemodel.T henextbaseofsocialpower -referencepower -seemsto beessentialtotheidentificationmodel.Thelasttwobases -expertpowerandlegitimate power 1 -seemtobemostimportantintheinternalizationmodel.

Thepotentialvaluethatcouldemergefro macomparisonofthepsychologicaland theeconomicmodelsisclearwhenweconsiderthefunctionsoftheidentificationversus theexpressivemodel.AccordingtoMcAdams’expressivemodelofattitudinalchange, 36 localgovernment-enactedlawmightbebet terequippedfromanexpressiveperspective duetothefactthatlocalgovernmentscanbetterrevealthepreferencesofpeopleinthe relevant community. The identification model 37 , focusing on the importance of the relationship between the source and its r eference power, might suggest that the local government could do better from the expressive perspective because people’s group identitymaybestrongerandmoresalientonthelocallevelthanonthestateorfederal levels.

C. Normscanbedescriptiveorinjunctive

Another very important distinction is Cialdini’s distinction between descriptive normsandinjunctivenorms. 38 Aninjunctivenormismyperceptionofwhatotherpeople thinkIshouldbedoing, 39 whileadescriptivenormismyperceptionofwhatoth erpeople arethemselvesdoing.AccordingtoCialdini’sfocustheory,thesaliencyofthenormative source (descriptive/injunctive) will determine the influence of norms on behavior, a predictionhehassupportedinnumerousfieldexperimentsinvolvinglit teringofpublic spaces. Cialdini argues that injunctive norms tend to have a more robust and enduring effect,andtendtobemoreeasilygeneralizedtodifferentsituations. 40

LENscholarsarenaturallyawareofthisdistinction,andyetitdoesnotreall yget any treatment by them. As Robert Cooter puts it,“I use ’social norm‘ … to mean an effectiveconsensusofobligation.Bythisdefinition,normexistswhenalmosteveryone in a community agrees that they ought to behave in a particular way in specif ic circumstances,andthisagreementaffectswhatpeopleactually do.”Inotherwords,while Cooterrecognizesthedifferencebetween“ought”(injunctive)and“do”(descriptive),he assumesthatthesetwoconceptsaregoingtofollowthesamepathandthat ,therefore,a distinctionbetweenthemisnotrequired.41

This distinction is not maintained with regard to the expressive function of the laweither.AccordingtoCooter, 42 enactinglawincreasestheperceivednumberofpeople

Wewouldarguethat greaternoticeshouldbegivent othisdistinction,as norm managementcouldbackfireifitisneglected.Forexample,Cialdiniargues 47 thatanti - littering ads have an injunctive message (“don’t litter”) that is undermined by a covert descriptivemessage(“lookatallthislitteringher e”).

Another example comes from Dishion, McCord, and Poulin, who argue that interventions for juvenile delinquency inadvertently reinforce problem behavior. 48 Severallong-termstudiesshownegativeeffectswhenhigh -riskkidsarebroughttomeet with counselors about their problems. The leading hypothesis is that peer influence is strongerthananyothermessagethattheyreceivefromthosecounselors.Thus,whilethe kids who were invited to the intervention group were exposed to injunctive norms disappro vingcriminalactivity,theyengagedinaprocessof“deviancytraining”.

Another final example of this sort of backfiring is described in the work of Kahan 49 .WhileKahan’sanalysisofthedecreaseintheamountoftrustinthetax -system

E. Strengthinargumentsvs.strengthinnumbers

Latane’sworkonsocialimpacttheory,likethatofCialdinionnorms,hasdrawn heavily on data from information perceivers glean from casual interaction with others, mereofothers,orobservationofthetracesofothers’behaviors.Thesocial decision scheme literature 60 has systematically examined faction size effects in the contextofdel iberatingexperimentalgroups,wherefactionsize,discussioncontent,and task factors can be disentangled using experimental manipulation. This literature has testedtherelativefitofawidevarietyof“socialdecisionschemes” –roughly,transition probability matrices mapping the relationship between the distribution of initial individual opinions and either post -discussion individual opinions or post -discussion groupdecisions.Acrossdozensofexperiments,twoclassesofdecisionschemesappear todescribethebulkofgroupprocesses.

One class involves “strength in numbers” schemes in which majority factions havedrawingpowerdisproportionatelylargerthanwouldbeexpectedfromtheirrelative size alone. When such schemes are operative, groups appear to be operating under a “majorityrule”schemeevenwhentheyareassignedaunanimityrule(atoneextreme)or givennoexplicitinstructionstoreachconsensus(attheother).

A second class of schemes are asymmetrical, such that certain opinio ns or positions hold disproportionate drawing power even when initially endorsed by only a

Asimple majorityschemeorslightvariantshavebeenshowntodoagoodjobof summarizinggroupjudgmentsunderaverybroadarrayofdecisiontasks,settings,and populations,particularlyinjudgmentalsituationswherethereisnonormativealgorithm fordefiningorderivingacorrectanswer(e.g.,poetry,art,facultyhires).Butwhenthere is a shared scheme for identifying correct option (e.g., math, fastest runner), small factions with strong arguments are much more likely to prevail. 61 But even here, the extreme“truthwins”modeldoesapoorjobofdescribingactualgroupbehavior.Atbest, "truth -supportedwins" -- i.e.,thememberfindingthesolutionneedsatleastsomeinitial socialsupportorthegroupwilloftenfailtoadoptthecorrectsolution.62 M acCounand Kerrhavedemonstratedthatthereasonabledoubtstandardpromotessuchanasymmetric influence function in criminal juries; when mock criminal juries are assigned a preponderance of evidence instruction, influence becomes symmetrical. 63 Kerr, Ma cCoun, and their colleagues have shown that because of such influence processes, group deliberation can either attenuate or amplify biases in individual judgment, dependingonwhetherthereisasharedconceptualschemebywhichaminoritycancall attentiontothebias. 64

1.1 Normsarebiasedsamples

Achallengefortheapplicationofanormsanalysisisthatnormsareformedfrom samples of social information, and those samples arise through processes that are statisticallybiased.Exceptperhapsinthe(incr easinglycommon)influenceofpublicized polling results, actors usually encounter normative information in a piecemeal fashion. Thegeographicfeaturesofsocialspace,notedabove,makeitlikelythatphysicallyand temporally proximate information will have an disproportionate weight in normative judgment. 65

Ceterisparibus,theanalystmightcopewiththisfactthroughasimpleschemeof distanceweighting,asinLatane’shypothesisthatimpactfallsoffviaaninversesquare rule. 66 But this adjustment will often be inadequate because normative information sampling is an active, selective perceptual process. Sociologists have long recognized thatactorsaredisproportionatelyinfluencedby“referencegroups” –loosely,groupsof specialsalienceorinter esttotheperceiver.Socialpsychologistshaveidentifiedvarious formsofselection.

Onedimensionis horizontal –wecanmakecomparisonsacrossindividuals(me vs. her) or across groups (us vs. them). For example, actors tend to experience greater anger, and are more likely to engage in political action, when they perceive that their groupistreatedunjustlythanwhentheyperceivepersonalinjustice. 67 Andasdiscussed below, people apply different evaluative standards to the outcomes and actions of “ingroup”vs.“outgroup”members. 68

People tend to look upward when their goal is to improve their own abilitiesortoverifythecorrectnessoftheirbeliefs.Peopletendtocomparethemselves withsimilarindividualswhentheirgoalistoappraisetheirownabilities,preferencesand outcomes.Evidenceismixe dforthepropositionthatpeoplelookdownward–tothose lessableorlessfortunate –whentheirgoalispromotetheirownself -esteem. 70

Most law and economic scholars that discuss norms focus on the concept of consensus.Infact,inmanybusinessconte xts,differentgroupsmightholddifferentviews aboutthenatureofthenorm. 71 Whenthoseviewsareinconflictitisveryimportanttobe abletopredictwhichthechosenreferencegroupwillbeineverysituation.Byknowing which the likely reference g roup is, one could both predict better the behavior of the individual and target any policy effort on this specific target group. Along those lines Feldman has demonstrated, using experimental techniques, that employees were giving the approval of their previous employer different weight in different contexts, when decidingwhetherornottoshareinformation.Inmostcasesemployeesgavelessweight72 to the likelihood of approval by their previous employer while giving much greater weight to their current employer’s approval. However, in some cases (when they were toldthattheconfidentialinformationwasdownloadedwhileworkingfortheirprevious employer),theapprovaloftheirpreviousemployerwassignificant,whiletheapprovalof their current emplo yer was not. Given the differing interests of the previous and the current employer with regard to the use of confidential know-how sharing, the importance of the choice of reference group carries policy implications for the

F. Trueandpseudo“falseconsensus”

Inmanyareasoflawandeconomicsscholarshipithasbecomealmostmainstream to draw on the psychological literature on heuristics and biases in discussions of risk assessment and the evaluation of economi c goods. Curiously, the new norms literature haslargelyignoredsuchwork;peopleareexpectedtoaccuratelyestimatepublicviews andtobeassensitivetochangesinconsensusastheywouldtochangesinthepriceofan economic good.73 But it is likely that a variety of cognitive and motivational factors producesystematicdistortionsinconsensusjudgments.

Forexample,Ross,Greene,andHouseproposedthatperceiversaresusceptibleto a“falseconsensusbias” 74 suchthatpeoplewhofavorpositionAest imatemoresupport forthatpositionthanpeoplewhodon’tfavor A.

That such a bias might produce a normative failure follows from economic models of the expressive function of the law (e.g., Cooter, McAdams). According to these models, one of the basic m echanisms that leads people to follow the law is a perceived -consensus in one’s relevant community. Nonetheless, according to the false consensuseffect,sometimesthecasualrelationshipwillgotheotherwayaround.Thus, peoplewhoareunabletoreally knowwhatmostpeopleintheircommunitythinkabouta certainlawmightinferwhatmostpeopledofromwhattheythemselveswoulddoina similarsituation.Accordingtothisbias,theabilityofthelawtouseconsensusasatool

Theexistenceofmultiple equilibria,(whenone’sowndominantstrategyiscontingentuponthebehaviorofothers), mightsuggestthatsuchbiasescouldbehardtofixrelyingsolelyonmarketevolution.

It is important to recognize that the false consensus effect has received considerablecriticism.ThemostvocalopponentofthisviewisDawes, 79 whoarguesthat theeffectmaybearationalBayesiancalculationbasedonone’sownknowledge(i.e.,a sampleofn=1).

Onthenormativelevel,itmaynotma tterwhetherthefalseconsensuseffectisa rationalheuristicsorabias.Fromapolicyperspective,therecanbeanormativefailureif people’s ability to update their beliefs about the consensus is not independent of the views of the individual.EvenifweacceptDawes’arguments,peoplewithundesirable

ThesecondobjectiontoDawes’critiqueismorepositive, focusingontheworkof Krugerandhiscolleaguesregardingthe“trulyfalseconsensuseffect.”82 Theyshowthat the consensus bias is actually much larger than assumed in a Bayesian calculation in whichinformationisreceivedaboutthefirstchip.Moreover,DunningandCohen 83 found no difference in the consensus judgments of people who did or did not receive true consensus information.84 (This, even though they were specifically told that the target student was in the 50th percentile). This shows strong eg ocentric bias even when informationabouttheconsensuswasavailable.

G. Pluralisticignorance

A related – and seemingly contradictory – perceptual principle is pluralistic ignorance, 85 a concept at least one L&E scholar has recently deployed.86 According t o

The importance of relationship is not unanticipated for LEN scholars studying socialnorms.Oneofthebasicdistinctionsinthefunctioningofnormsingameth eory literatureaboutnormsisrelatedtothedifferencebetweenrepeatedplayersandone-shot players 89 anditsimplicationsforreputation,reciprocityetc. 90 LeadingLENscholarsas Ellickson91 and Berenstein 92 cite reciprocity and tit -for-tat as key factors in the maintenanceofsocialnormsamongrepeatedplayersinaspecificcommunity.

However, psychologists have offered a richer and more nuanced account of the influence of relationships. In the early 1970s, Foa93 showed that the implicit rules of social exchangevarieddependingonthenatureofthesocialresourcebeingexchanged– e.g., money vs. love vs. esteem or prestige. Later, Clark and Mills 94 distinguished exchangerelationshipsfromcommunalrelationships.Inessence,exchangerelationships are thoseinwhichparticipants“keepscore,”atendencythatiscorrosivetothelong-term stability of more communal, nurturance -basedrelationships.Clark,PowellandMills 95 have shown that the tendency to reciprocate significantly varied with the nature o f the relationship.96 When the participants were manipulated to think that the other partner

Fiske’s theorycontendsthatsocialrelationsinallsocietiesaregovernedbyvariouscombinatio ns offourfundamentalpsychologicaltemplates:Wesometimescategorizeindividualsand treatcategorymembersidentically(communalsharing),wesometimestreatindividuals bytheirrankwithinagroup(authorityranking),wesometimeskeepscoreofoutco mes andstrivetoequalizethem(equalitymatching),andwesometimesvalueoutcomesonan absolutemetricandmaketradeoffsamongthem(marketpricing).Eachtemplatehasits own rules of appropriate conduct, its own norms of distributive fairness, and most crucially, its own consensually agreed upon domains of operation in a community’s life. 100 Fiske’s model fits a considerable body of sociological and anthropological evidence, and it has fared well in more exacting psychometric analyses and social - cognitivelaboratoryexperiments. 101

The activation of different schemas is posited to have numerous effects with regardtodecision-making,moraljudgment,andtheexchangeofgoodsandservices. 102 Butofspecialrelevancetothepresentdiscussionistheargume ntthatthefourschemas areassociatedwithdistinctsocialinfluenceprocesses. 103 Communalsharinginvolvesa desire to promote similarity and maintain unanimity; thus the individual will change attitudes to maintain a certain harmony in the group. In a uthority ranking, there is obediencetoauthorityorprestigiousleaders,irrespectiveofthecontentofthenorm.In equalitymatching,thefocusisonreciprocityandturntaking.Finally,inmarketpricing, influenceflowsfromincentivesandaweighin gofthecostsandbenefitsofcompliance witharequestordemand.

The fact that different processes of social influence are more dominant in one thananotherindicatesthatasingleaccountoftheinteractionbetweenlawsand normsmightfail tocaptureimportantdifferencesacrossdomainsoflaw,suchas law, employment law, or administrative law. So for example, a model of social norms that is likely to predict the function of social norms in a family context could not be applied, as is, to the social norms of corporate directors. Because people are likely to comply with the social norms through different behavioral mechanisms across these differentschemas,factorssuchasreciprocity,monetaryincentives,abilityformonitoring and t he like, will carry differing weights with regards to the efficiency of legal decentralization and the policymaker’s ability to rely on social norms in each legal doctrine.

III. WhenDoNormsOperate?

A. Normsvs.attitudes

Psychologiststendtomeasureattitudesfairlyrigorously,buttodefinethemfairly loosely. Most definitions involve a relatively stableevaluativejudgmentreflectingthe desirabilityofvariousoutcomesassociatedwithanobjectorbehavior,weightedbythe

Inthe1960sand1970s,therewasgrowingskepticismaboutthepredictivepower ofpublicopinionpollsandotherattitudinalmeasures.Inrecentdecades,therehavebeen considerableadvancesinunderstandingtheconditionsunderw hichattitudesdoordonot predictandinfluencebehavior. 104 Muchofthisworkhasbeenorganizedundertherubric ofAjzenandFishbein’s“theoryofreasonedaction”anditssuccessor,Ajzen’s“theoryof planned behavior.”105 Three principles from these th eories are relevant to the present discussion.

First, to be predictive, attitudes and behaviors need to be matched at the same level of specificity. Because most behaviors are specific (e.g., voting for a particular balletproposition),abstractattitudes (“Iabhorguns”)arefarlesspredictivethanhighly specific attitudes (“this gun control proposition is a hopeless and meaningless compromise”). These more specific attitudes are less intriguing than the lofty abstractions at issue in many sociolegal a nalyses, but they are often more relevant in particularsettings.

Second, attitudes are only one determinant of the intention to engage in a behavior.Aseconddeterminantistheactor’sperceivedcapabilityofperformingtheact – what Bandura 106 calls “ self -efficacy beliefs” and Ajzen calls “control beliefs.” Two

Morerele vantforthepresentessay,AjzenandFishbeinidentifysubjectivenorms as a third major determinant ofbehavioralintentions. 107 Acrossdozensoffieldstudies involving many different classes of behavior (diet, drug use, exercise, voting, energy conservat ion, military enlistment), investigators have assessed both attitudes and perceived injunctive norms, allowing a comparison of their relative associations with behavior. In an examination of 30 different types of behavior, Trafimow and Finlay 108 found that o verall, behavioral intentions were better predicted by attitudes than by subjective norms (median correlations = .68 vs. .40). As might be expected from our earlierdiscussionsofconsensusandsocialclustering,attitudesandnormswerereliably correlat ed (median correlation = .37). But for most behaviors, perceived norms significantly increased the predictability of intentions above and beyond attitudes. 109 Behaviorsvariedinthedegreetowhichtheywereunderattitudinalvs.normativecontrol. Trafimow and Fin lay also found strong individual differences in the relative weightgiventoattitudesvs.normsacrossbehaviors. 110 Thebehaviorofafifthofthe peopleintheirstudywasmainlyundernormativecontrol,whiletheremainingfour-fifths were mainly under attitudinal control. Later, we identify some empirical correlates of theseindividualdifferences.

B. Habitandautomaticity

An acknowledged boundary condition on the “planned behavior” framework describedaboveisthatbehavioritselfisonlypartlyintentio nal,atleastinthesenseof consciously formed plans. The notion of intentional choice is becoming increasingly problematic as psychologists discover the considerable extent to which behavior is mediated by factors outside conscious awareness. 111 But that question is probably orthogonaltodebatesaboutrationality;itisquitepossibleforthebraintomakecoherent, incentive-basedchoiceswithoutconsciousdeliberation.

Though behaviors cannot be neatly parsed into “conscious” and “unconscious” categorie s,itisbothmeaningfulandusefultodistinguishrelativelyhabitualor“scripted” behaviorsfrommorenovelbehaviorsandchoices.Thus,ameta -analyticpathanalysisof 64 separate studies by Oullette and Wood found that past behavior was a stronger predictorofpresentbehaviorforactionsthattendtooccurroutinely(e.g.,onceormorea week; weighted path coefficient = .45) than for actions occuring less frequently or in varying contexts (weighted path coefficient =.12). Conversely, self -reported intentions wereaweakerpredictorofbehaviorforroutineactions(weightedpathcoefficient=.27) than for actions performed less frequent or in highly variable settings (weighted path coefficient = .62). Of special interest to the present discussion, p erceived norms were stronger predictors of behavior for fairly novel actions than for routine actions. 112 We suspect the latter finding is more general; because highly routinized behaviors become increasingly automaticized and “mindless,” any external source of information seems morelikelytoinfluencenovelchoicesthanroutinechoices. 113

C. Ambiguityofsituationalcues

Norms are particularly likely to influence behavior in highly ambiguous situations.Inanearlydemonstration,Sherif 114 showedthatstrangersq uicklyformedan arbitrary consensus about the “size” of an illusory movement of light produced by an opticalillusion.Festingerlaterarguedthatpeopleengageinsocialcomparisoninorderto reduce uncertainty by learning about the behavior of others. 115 Feldman has found suggestive evidence 116 that the perceived clarity of trade-secret law 117 moderates the relationship between Silicon Valley employees’ of local norms and their judgmentsofthemoralityandfairnessofcomplyingwiththelaw. 118

Am biguitymaybesufficienttopromoterelianceonnorms,butitisnotnecessary. In the famous conformity created by Solomon Asch,119 a large fraction of participants were willing to endorse patently false beliefs if enough experimental confederat esfirstendorsedthem.Thisisaclear -cutcaseofKelman’scompliancefactor; no identification or internalization was involved. What is interesting isthatnoexplicit socialsanctionswereinvolvedotherthanthevaguepossibilityofpeerdisapproval; the partieswerestrangerswithnothingatstakeandnoexpectationoffutureinteraction.

D. Publicandprivateselves

Contemporary psychology tends to view “the self” not as a unitary agent but rather as a complex of currently activated memories and goal st ates, emergingthrough processes of spreading activation and competition for limited cognitive resources. It is convenient to classify these various complexes in terms of multiple selves, though no implicationofdiscretecognitiveorneurologicalmodules isintended.

The fundamental distinction is that private self -awareness focuses on matching one’s conduct to personal goals and standards, while public self -awareness strives to match one’s conduct to the perceived goals and standards of other people. Extremely subtle situationalfactorscanpromoteincreasedprivatevs.publicselffocus.Forexample,the presence of a mirror significantly increases private self focus (as me asured in various ways),andrelativetoacontrolcondition,thisprivatefocusinturnleadstogreaterself - comparisontopersonalstandards,andbehaviorthatismoreconsistentwithpriorattitude surveyresponses.Ontheotherhand,thepresenceofa patentlynon-operationalcamera stimulatesattentiontobroadersocialstandardsandgreaterconformitytothebehaviorsof others. 121

Private and public self focus vary dispositionally as well as situationally; i.e., therearestableindividualdifferences inchronicattentiontoprivatestandardsvs.public standads, as assessed by Snyder’s self -monitoring inventory, 122 which identifies the extenttowhichindividualsstrategicallycultivatepublicappearances.Highself -monitors engageinexpressivecontrol,basedonsensitivitytosocialcuesandthetendencytobe influencedbytheexpectationsofothers.Lowself -monitorsputmoreweightontheirown attitudes. Self -monitoring has been shown to moderate or qualify many bivariate relationshipsintheperso nalityandsocialpsychologyliteratures.Ofparticularrelevance

E. Individualdifferencesinmoralreasoning

Another individual -differences moderator of normat ive influence is moral reasoning style. Kohlberg’s well -known theory of moral development128 proposes a developmental sequence of six stages, divided into three levels: pre -conventional,

TappandKohlberg 130 haveappliedthisframeworktolegalcomplianceinmanner that closely parallelsparallelthethree -tierapproachesofKelmanandCooter,although fromanindividual -differenceperspectiveratherthanamulti -processesapproach.131 They distinguishrule -obeying,rule -maintaining,andr ule -makingorientations.Thefirsttype is most sensitive to the magnitude of risk, and obeys the law mainly out of fear of punishment without any respect for the rules. This type seems to be best described by deterrence models. 132 The second type is most s ensitive to the legality of the act, and tendstoobeythelawmainlyoutofalawandorderperspective:“ifthelawmakersaysI should do it is probably good”. This type seems to be the most aligned with the expressivemodelsincetheyaremostlikelyto careabouttheannouncementofthelaw, disregardingitssanctionsoritsalignmentwithmorality. 133 Thelasttypeisexemplified

IV. HowandWhenDoWeInternalizeNorms?

A basic question in the new norms literature is whether the effect ofanormis external/exogenousorinternal/endogenous.Inprevioussectionsofthispaper,wehave discussedthemixofattitudesandnormsasifthesefactorsareindependent.Nonetheless, inmanycases,thisindependencewillcea setoexistandtheattitudesandnormsofthe individualwillmerge. 134 Inneo -classiceconomictheory,preferencechangewaslongoff - limits as an area of research. Despite the fact that the internalization of social norms capturesmuchattentionfromlaw andeconomicsscholars, 135 thebehavioralmechanism underlying this “internalization” is still far from clear. 136 While a full analysis of the endogenous/exogenousnatureofpreferencesisbeyondthescopeofthispaper,wewould liketoclarifytheconceptofinternalization,totheextentthatthisprocessisbeingtreated byLENscholarsofsocialnormsasbeingrelevanttopsychology.

Some LEN scholars have suggested that psychology cannot explain the mechanism of internalization. Scott, for example, main tains that “The fact is that behavioral science does not yet understand the mechanism of internalization.”137 A

Wefindsuchargumentspuzzling,itistruethatpsychologistslackacompleteand comprehensive “final theory” of internalization, but the gap is far from cavernous. Psychologistsactuallyknowagreatdealaboutinternalization,butthetopicissolarge thatite ncompassesmanyrubrics.Therearevastliteraturesontheprinciplesofinductive learning, 139 vicarious social learning, 140 and moral by parents, 141 each of whichinvolvesrobustempiricalgeneralizationsbasedonliterallythousandsoflaborato ry andfieldstudies.Ratherthanattemptingtodojusticetosuchvastliteratures,wewill simply focus on two explanatory that seem readily applicable to internalizationbyfollowinganexposuretonewnorms.

A. Centralvs.peripheralrou testopersuasion

Applied work by psychologists for the military in World War II launched an enormouspost -warefforttoidentifythesystematicprinciplesofpersuasion.Bythemid - 1970s, there was an enormous and unwieldy catalog of findings involving sp ecific source, audience, and message factors, alone or in combination. In the late 1970s and early1980s,itwasdiscoveredthatmostofthisliteraturecouldbeintegratedusingafew straightforwardorganizingprinciplesthatyieldclear,testableaprio ripredictions. 142

Thecentralrouteinvolvesactive,consciousdeliberation;anassessment ofargumentsand theattempttogenerateplausiblecounterarguments.Thecentralrouteisonlyactivated whentwoconditionsaremet:theindividualismotivatedtothinkaboutamessage,and theindividualisabletocognitivelyprocessinformation.Whenthosetwoconditionsare met, the primary determinant of persuasion is the perceived strength of the presented arguments. Argument change generated by the central route tends to be durable and resistancetoallbutthestrongestcounterinfluenceattempts.

Whenindividualsaredisinterestedinthetopic(lowmotivation),distracted(low ability), or unable to comprehend the message (low ability), at best they will be influencedbyaquickandsuperficialrelianceoncurrentlysalient“cuestopersuasion” – e.g., “themajorityfavorsthis,”“therearealotofargumentsheresoitmustberight,” “she’s the expert so I’ll take her word for it,” “he’s the NBA’s leading scorer, and he buysNikes.”PettyandCacioppocallthisthe“peripheral”routetopers uasion.Attitudes and beliefsformedviaperipheralpersuasionarefragileandtransitory,easily“knocked out”whenalternativeperipheralcuesbecomemoresalient.

ThisframeworkhasobviousrelevancefortheinfluencetaxonomiesofKelman, FrenchandR aven,andCooter(seeTable1above).Forexample,inthePetty -Cacioppo framework, French and Raven’s “expert power” may be correlated with strong arguments,butonlyiftheaudienceismotivatedandabletoreflectonthosearguments.If not, expertise serves as a mere, and transitory, peripheral cue. The central route – persuasionbasedonthoughtfuldeliberation-- isakeypathtowardinternalization,butit isonlyonesuchpath.Peripheralpersuasion,ontheotherhand,canproduceeithermere publiccompliance,identification,or(asweshallsee)eveninternalization.

B. Self -reinforcingperipheralbeliefs

Thecentralrouteisnottheonlypathtointernalization.Peripherallyformedbeliefs areephemeralwhentheyfailtoproduceaction,butundert herightconditions,positions adopted expediently or superficially via the peripheral route to persuasion can become self -reinforcingandstable.

This can occur through the sort of path dependency that has long interested economists. 144 Actionsbasedontr ansitoryviews(“whims”)canexposetheactortonew settingsandanewmixofsocialcontacts,whichcaninturnplacetheindividualunder newcompliancepressures,butalsoundernewcognitivepressures.

Festinger’sworkoncognitivedissonance, 145 andBe m’s 146 workonself -perception suggesttwosimilar,butstilldistinctive,mechanismsbywhichachangeinbehaviorcan produce a change in attitudes, they differ in their view of which mechanism is being employed.AccordingtoFestinger,thegapbetweenone’sattitudesandbehaviorcreatea mentaldissonanceassociatedwithanunpleasantfeelingthatcouldpotentiallybereduced byachangeinone’sattitudes.AccordingtoBem,theprocessesaremorestraightforward. The individual simply infers from her beh avior what her attitudes are. Empirically, Festinger’s theory is most applicable to attitudes that the actor cares about; Bem’s accountmostlyappliestomoretrivialorcasuallyconsideredviews. 147

A related process is parallel constraint satisfaction, as represented using connectionist models. 148 Constraint satisfaction algorithms are used to model the cognitive processes by which actors integrate numerous interrelated elements (e.g.,

We recognize that that these theories both clarify and complicate the LEN analysis.Theyclarifyitinthesensethattheymakeinternalizationlessmysterious,but theyalsoidentifyconditionsforinternalization–strongarguments,motivatedandable perceivers, pressures towar d self -consistency -- that are difficult to incorporate into stylized formal analyses. These accounts also make internalization somewhat less of a legal panacea. The law’s normative messages aren’t the only norms that can get internalized; processes of persuasion, dissonance reduction, and constraint satisfaction can solidify all sorts of views that the government would wish to discourage. Nor can economistscannotassumethatalltypesofinternalizationarepermanentandirreversible. Thelaw’smessages willhavetocompeteinamarketplaceofideas –bothgoodandbad, seriousandtrivial.

V. Conclusion

Inthispaperwehavereviewedandorganizedsomeofthemaintheoriesinthe psychologicalliteratureofsocialnormsinthreemainthemes.Thechoiceoft heorieswas conducted not according to their importance within psychology, but according to their relevancytothenewnormsliteratureinlawandeconomics.Thefirstthemethatwehave discussedisthemultiplicityofnormativeprocesses.Wehaveargued thattakingthese distinctionsintoaccountcouldrefineandimprovethecurrentvaguedefinitionofnorm usedbyLENscholars.Oursecondthemeisthemultiplicityofnormativemoderators – factorsthatstrengthenorattenuatetheinfluenceofnormsrel ativetoattitudes,prices,and otherfactors.Wehavearguedthatawarenessoffactorsthatmitigatetheeffectofnorms on behavior is required of any policymaker who is interested in decentralizing legal enforcement, since the widespread existence of a norm is insufficient to guarantee its

Inall,werealizethatthetheoriesthatwehavereviewedandtheirimplicationto the current L&E models of social norms create considerable complexity and heterogeneity. We don’t contend that theorists need to construct a grand theory that accounts for the full depth and breadth of the social psychology li terature – if psychologists haven’t, why should economists? Rather, we think the challenge is for LENtheoriststodrawuponsocialpsychologyselectivelyinamannerthatincreasesthe validityandrealismofthemodelswhilestrivingtomaintaintheirf ormaltractabilityand heuristicvalue.Takingthischallengeintoaccountinourreview,wehavefocusedmainly onthetypesoftheoriesthat,onceincorporatedintothecurrentmodels,seemtoworththe cost.Webelievethatbytakingthesemoderatorsan dtheoreticaldistinctionsintoaccount, LEN scholars will be able to analyze when norms are likely to govern efficiently and what the nature of interaction between norms and law is in much greater clarity and predictability.Atthesametime,weareaware ofthefactthatnotalltheoriesreviewed here will have equally practical implications for the “norm management” project. Nonetheless, we think that even in these cases a theoretical value emerges from the comparison of newer economic models with older psychological models that aim to answertheexactsamequestionsfromdifferent,andsometimericherperspectives.
