BIOMETRICS TAKES OFF—FIGHT BETWEEN PRIVACY AND AVIATION SECURITY WAGES ON ALEXA N. ACQUISTA* ABSTRACT In the last two decades, the Department of Homeland Secur- ity (DHS) has implemented a variety of new screening and iden- tity verification methods in U.S. airports through its various agencies such as the Transportation Security Administration (TSA) and Customs and Border Protection (CBP). In particular, biometric technology has become a focal point of aviation secur- ity advances. TSA, CBP, and even private companies have started using fingerprint, iris, and facial scans to verify travelers’ identi- ties, not only to enhance security but also to improve the travel experience. This Comment examines how DHS, its agencies, and private companies are using biometric technology for aviation security. It then considers the most common privacy concerns raised by the expanded use of biometric technology: data breaches, func- tion creep, and data sharing.

  • Placing the Militia Occupation of the Malheur National Wildlife Refuge in Harney County, Oregon
Placing the Militia Occupation of the Malheur National Wildlife Refuge in Harney County, Oregon Carolyn Gallaher School of International Service American University [email protected] Abstract This intervention examines the recent militia occupation of the Malheur National Wildlife Refuge in Oregon. There is no consensus on how to place the group. Some commentators suggest the group was white supremacist. Others argue that it was animated by religious fanaticism. Still others emphasize the group’s grievances with the Bureau of Land Management. I argue here that the Malheur occupiers’ politics cannot be understood with reference to a single identity position. Rather, we need to focus on the group’s anti-government rhetoric because it funnels and shapes multiple interests at once. Here I examine how the group’s anti-government rhetoric frames race and class interests. In terms of race, I argue that anti-government rhetoric obscures the white interests behind the occupation. This concealment is based on a selective reading of history that emphasizes the end of settlement, when the government took ownership of land not claimed during the settlement period, instead of the stage leading up to it, when the government seized Indigenous land for white settlement. So construed, the occupiers could claim they were taking the ‘people’s’ land back from the government rather than engaging in a second round of white theft of Indigenous land. In terms of class, I argue that because the occupiers framed their fight as against government tyranny instead of as for privatization, the occupiers did not have to confront the inequities that come with privatization.

  • The Malheur Occupations and the Hyper-Masculine Drive for Control
The Patriarch and the Sovereign: The Malheur Occupations and the Hyper-Masculine Drive for Control COURTNEY IRONS* On January 2, 2016, a group of armed protestors seized control of the Malheur National Wildlife Refuge. The occupation followed a long tradition of resistance in western states of federal land management policy, but the members took a stricter approach to federalism than most. The group fully rejected federal sovereignty over the land, and in doing so demonstrated a particularly gendered approach to power and government. The purpose of this Note is to explore how the occupier‟s understanding of federalism relates to theories on masculinity. Drawing on statements made during the course of the occupation, news reports, and testimony during the subsequent legal proceedings, this Note will argue the occupiers‟ patriarchal beliefs about masculinity influenced and informed their understanding of federalism with the belief that doing so may help us understand the growing nationalist and extremist views in conservative movements today. * Executive Notes Editor, Colum. CONCLUSION 25. 1EXECUTIVE SUMMARY The 2016 armed standoff at the Malheur National Wildlife Refuge in Oregon provided the American public with a ringside seat to a disturbing trend on U.S. public lands: extremist and militia groups using America’s national forests, parks, monuments, and wildlife refuges to advance their anti-government beliefs. But these far right-wing organizations are not operating in a vacuum. To the contrary, the armed insurrection in Oregon and Nevada before—led by Ammon Bundy and the Bundy family—share the same foundations as land transfer schemes promoted by some elected leaders in states throughout the West. Both rely upon a philosophy based in vehement anti-government ideologies, both have connections to organizations that espouse armed resistance, both employ pseudo-legal theories to justify their actions, and both use scholarly support from conspiracy theorists and discredited academics. Our nation’s parks and network of public lands are one of our finest democratic achievements.

  • The Airport Security Shortcut That Isn't Precheck
The Airport Security Shortcut That Isn’t PreCheck Clear, a private trusted-traveler program, is expanding thanks to longer TSA lines and a Delta linkup A look at Clear, a company offering a path to jump TSA lines and get through airport security with no delays. Is it worth it? WSJ's Scott McCartney joins Lunch Break with Tanya Rivero to discuss. Photo: Clear By SCOTT MCCARTNEY June 22, 2016 1:25 p.m. ET 135 COMMENTS Would you pay $10 to $15 a month for a guaranteed cut to the front of some crowded airport security lines, even ahead of PreCheck members and first-class passengers? Clear is a private trusted-traveler program sanctioned by the Transportation Security Administration. It has lanes at only 13 airports—San Francisco, Denver and Orlando, Fla., among them. Once enrolled, members go to Clear’s faster lane instead of TSA and have their identity verified by fingerprint or iris scan. Then they go straight to the X-ray machine. The speedy service is finding new life because airport security screening lines have disrupted so many passengers this year. Enrollment this year through June tripled, compared with the same period a year earlier, and now 500,000 people are enrolled. Delta Air Linesbought 5% of the company in April. It will be giving Clear memberships to its top-level frequent fliers and helping Clear open up at more airports, including Delta hubs, by the end of this year. Airports like Seattle-Tacoma International, which has had big problems with long lines, have invited in Clear, with service to start in July.

PARKS AND PRIORITIES | FRACTURING NATIVE FAMILIES | THE UNSPOKEN LANGUAGE OF ACEQUIAS High Country ForN people whoews care about the West Celebrity Scofflaw How the feds helped make Cliven Bundy a hero By Tay Wiles April 30, 2018 | $5 | Vol. 50 No. 7 | www.hcn.org 50 No. | $5 Vol. April 30, 2018 CONTENTS Editor’s note Wild country For anyone with an appetite for the West’s ongoing culture clashes, the new Netflix series Wild Wild Country is an unexpected feast. It describes how the followers of Indian guru Bhagwan Shree Rajneesh bought a ranch outside of rural Antelope, Oregon, in the early 1980s and attempted to build a utopian community. The series hits themes familiar to High Country News readers: a persecuted minority seeking a remote place to practice their beliefs without interference; conservative white locals with little tolerance for outsiders; fabulous wealth (the Bhagwan reportedly had 90 Rolls Royces and wore million- dollar diamond watches) contrasted with wretched poverty (the Rajneesh community bused in thousands of homeless people from cities in an attempt to sway local elections); and, of course, guns and violence. There’s even an environmental angle — Oregon’s first counterattack focused on the community’s violation of progressive land-use regulations designed to protect agricultural lands from development. Cliven Bundy walks out of federal court in Las Vegas with his wife, Carol, and attorney Bret Whipple in January, I couldn’t find anything about this tumultuous after a judge dismissed criminal charges against him and his sons over the 2014 standoff in Bunkerville, Nevada.
