Federal Dr. Urbana, IL 61801 www.sagamorepublishing.com Dedication “To produce a mighty book, you must choose a mighty theme. No great and enduring volume can ever be written on the flea, though many there be that have tried it.” Herman Melville, my ancestor and author of the classic novel Moby Dick, has passed this advice forward to myself and the world in this quote. The dynamics of the sports environment have proven to be a very worthy topic and have provided a rich amount of material that investigates the actions, thoughts, and behaviors of people as they navigate their way through a social environment that we have come to know as sport. By avoiding the study of fleas, I have instead had to navigate the deep blue waters of research into finding the causes, roots, and solutions to a social problem that has become figuratively as large as the mythical Moby Dick that my great-great uncle was in search of. -
Re-Writing the Script : Representations of Transgender Creativity In
Kate Norbury Re-writing the Script: Representations of Transgender Creativity in Contemporary Young Adult Fiction and Television Abstract: The transgender, gender-atypical or intersex protagonist challeng- es normative assumptions and expectations about gender, identity and sexu- ality. This article argues that contemporary transgender-themed young adult fiction and television uses the theme of creativity or the creative achievement script to override previously negative representations of adolescent transgender subjectivities. I consider three English-language novels and one television series for young adults and use script theory to analyse these four texts. Cris Beam’s I Am J (2011) and Kirstin Cronn-Mills’ Beautiful Music for Ugly Children (2012), both originally published in the United States, depict female to male transitions. Alyssa Brugman’s Alex As Well (2013), originally published in Australia, foregrounds the experience of an inter- sex teenager, Alex, raised as a boy, but who, at the age of fourteen, decides she is female. Glee introduced the transgender character Unique in 2012, and in 2014 she continued to be a central member of the New Directions choir. The Swedish graphic novel, Elias Ericson’s Åror (Oars, 2013), includes two transgender characters who enact the creative achievement script and fall in love with each other. Ericson’s graphic novel goes further than the English-language texts to date. Collectively, these transgender, gender-atypical or intersex protagonists and central characters assert their creativity and individual agency. The transgender character’s particular cre- ativity ultimately secures a positive sense of self. This more recent selection of texts which date from 2011 validate young adult transgender experience and model diversity and acceptance. -

THE CONSTITUTIONAL IRRELEVANCE of ART, Brian Soucek
99 N.C. L. REV. 685 (2021) THE CONSTITUTIONAL IRRELEVANCE OF ART* BRIAN SOUCEK** In Masterpiece Cakeshop, the baker’s lead argument to the Supreme Court was that his cakes were artworks, so antidiscrimination laws could not apply. Across the country, vendors who refuse to provide services for same-sex weddings continue making similar arguments on behalf of their floral arrangements, videos, calligraphy, and graphic design, and the Supreme Court will again be asked to consider their claims. But arguments like these—what we might call “artistic exemption claims,” akin to the religious exemptions so much more widely discussed—are actually made throughout the law, not just in public accommodations cases like Masterpiece Cakeshop. In areas ranging from tax and tort, employment and contracting discrimination, to trademark, land use, and criminal law, litigants argue that otherwise generally applicable laws simply do not apply to artists or their artworks. This Article collects these artistic exemption claims together for the first time in order to examine what determines their occasional success—and to ask when and whether they should succeed. The surprising answer is that claims of the form “x is protected because it is art” should never succeed. The category “art” is constitutionally irrelevant. Contrary to widespread assertion among scholars and advocates, a work’s status as art has never done any work in the Supreme Court’s First Amendment case law. * © 2021 Brian Soucek. ** Professor of Law and Chancellor’s Fellow, University of California, Davis School of Law. As television must always create its spaces and places on the screen, what, then, is the significance of the varying emphases as well as the commonalities constructed in televisual high school settings in UK, US, and Japanese television shows? This master’s thesis considers how fictional televisual high schools both contest and construct national identity. In order to do this, it posits the existence of the televisual school story, a descendant of the literary school story. It then compares the formal and narrative ways in which Glee (2009-2015), Hex (2004-2005), and Ouran koukou hosutobu (2006) deploy space and place to create identity on the screen. In particular, it examines how heteronormativity and gender roles affect the abilities of characters to move through spaces, across boundaries, and gain secure places of their own. ii TABLE OF CONTENTS Abstract ii Table of Contents iii Acknowledgement v Introduction Orientation 1 Space and Place in Schools 5 Schools on TV 11 Schools on TV from Japan, 12 the U.S., and the U.K. -
