NOTE: Trade marks marked with an asterisk (*) or an IR number are international applications designating Australia AUSTRALIAN OFFICIAL JOURNAL OF TRADE MARKS 17 December 2009 OFFICIAL NOTICES Close-down periods for the Patent, Trade Marks, Designs Offices and the sub-offices The close-down provisions in the Patents, Trade Marks and Designs legislation provide for the effect of the Patent Office, the Trade Marks Office and the Designs Office in Canberra or any of their sub-offices in the State capitals not being open for business. On 23 October 2009, IP Australia’s Director General declared under the close-down provisions the days when the Patent, Trade Marks and Designs Offices and their sub-offices would not be open for business. This covers the period from 6 November 2009 to 1 January 2011. Authorised Australia Post outlets, “IP Lodgement Points”, in Hobart, Perth, Adelaide, Sydney, Darwin and Melbourne are sub-offices for the purposes of the Patents, Trade Marks and Designs legislation. These Australia Post outlets may be physically open to the general public for other services provided by Australia Post during the close-down period. However, as declared by the Director General, they are taken not to be open for business for the purposes of lodging IP documents and/or making IP-related payments from Friday 25 December 2009 until Friday 1 January 2010. If the last day for doing an act is a day when a sub-office is not open for business, section 222A(1) of the Patents Act, section 223A(1) of the Trade Marks Act and section 136A(1) of the Designs Act allow for the act to be done on the next day when the sub-office is open for business. This means that customers will not be disadvantaged by the closure of the sub-offices for the period between Christmas Day and the New Year’s Day holiday. Revision of Part 29 – Section 43 – Trade Marks Likely to Deceive or Cause Confusion Part 29.4.2 of the Trade Marks Manual has been amended for consistency with amended Part 32A.3.2, with section 43 in relation to plant variety names articulated with reference to "connotation”. Revision of Part 32A – Examination of Trade Marks for Plants (in Class 31) Part 32A of the Trade Marks Manual has undergone major revision including a new introduction, additional information in relation to the interaction between the Plant Breeder's Rights Act and the Trade Marks Act, added reference to section 39 of the Trade Marks Act in relation to certain prescribed signs in Class 31 applications, and clarification of practice in relation to sections 41, 42 and 43 of the Trade Marks Act. Revision of Part 32B – Examination of Trade Marks for Wine (in Class 33) Part 32B of the Trade Marks Manual has been revised to clarify overlaps between beer and wine following change of practice, and to clarify practice regarding protected terms in specifications of goods. Revision of Part 50 – Disputed Extension of Time in Opposition Matters Part 50 of the Trade Marks Manual has been revised to clarify the meaning of ‘disputed extensions of time’. Revision of Part 51 – General Opposition Proceedings Part 51 of the Trade Marks Manual has been revised to clarify the length of time after which applications for extensions of time to serve evidence will require an indication of when the process is intended to be completed. Removal of Part 53 – Hearings, Decisions and Appeals Procedure Part 53 of the Trade Marks Manual has been removed because the part deals mainly with internal procedures and information relevant to external customers which are already covered in Part 52. Revision of Part 54 Subpoenas, Summonses and Production of Documents Part 54 of the Trade Marks Manual has been revised to indicate that court documents or subpoenas may not be left at a sub office for the purpose of delivery to IP Australia to effect service to the Registrar or Deputy Registrar of Trade Marks.
