INTRODUCTION Public Consultation plays a crucial role in improving the quality of rules and regulations and in improving compliance and reducing enforcement costs for both governments and the private sector. Public consultation gathers information to facilitate governments in formulating sound policy decisions. The application of tools to formulate and review policy, such as Regulatory Impact Assessment (RIA) and Reducing Unnecessary Regulatory Burdens (RURB), has resulted in consultation increasingly being used to collect empirical and qualitative information for analytical purposes.

APEC Peer Review on Public Consultation Initiatives (this project) sets a platform for volunteer economies to undertake a peer-review on public consultation. Through this peer review mechanism, volunteer economies will have the opportunity to identify gaps in how they conduct public consultation. Addressing these gaps will assist APEC economies in applying Good Regulatory Practices and improving indicators measured by the World Bank, APEC, OECD and other relevant international organisations. It will also support public consultation reforms which will improve the formulation of business regulations.

To initiate this project in March 2018, Malaysia has engaged Ms. Sue Elaine Holmes, an APEC expert from Australia to assess Malaysia’s public consultation practices through a series of interviews on peer-review public consultation initiatives with key stakeholders from business, government agencies, academicians and NGOs.

In April 2018, APEC Survey on Public Consultation Initiatives has also been circulated to all APEC economies to capture government wide practices on how governments engage with stakeholders about public consultation affecting regulatory policy and also identify best practices in public consultation. The results gathered from the responses received through the above surveys will be shared during the APEC workshop scheduled on 17-18 July 2018 at Kuala Lumpur, Malaysia.

OBJECTIVES The main objectives of the workshop are: • To increase participants’ knowledge on implementing more effective and efficient public consultation initiative for formulating regulatory policy; • To share experiences among the participants on the implementation of good public consultation practices; • To share the results of Malaysia’s peer review assessment; • To take stock of the APEC economies’ public consultation practices; and • To discuss and explore the way forward on governance, strategies and techniques in implementing effective and efficient public consultation for APEC economies.

SPEAKERS’ PROFILES SESSION 2 : IMPORTANCE OF PUBLIC CONSULTATION IN GOOD REGULATORY PRACTICES (GRP) Paul Davidson

Paul Davidson commenced as a Policy Analyst in the Measuring Regulatory Performance Programme, as part of the Regulatory Policy Division at the Organisation for Economic Co-operation and Development (OECD). His role includes drafting a key chapter for the 2018 Regulatory Policy Outlook based on the Indicators of Regulatory Policy and Governance. He presented preliminary results and ran key discussions on the draft results as part of the OECD Secretariat reporting to the Regulatory Policy Committee as well as other related work to a wide range of audiences, including the Finnish regulatory oversight body. As part of the 10th OECD Measuring Regulatory Policy Conference held in Mexico City, he conducted a breakout session on data requirements for regulatory proposals, which looked at broad stakeholder engagement practices across OECD countries. Mr Paul Davidson is currently responsible for managing a report into regulatory practices across the entirety of the European Union, the first time that such an exercise has ever been undertaken on a consistent basis.

Peter Ladegaard

Lead Private Sector Specialist, Global Business Regulation, Macro, Trade and Investment Climate (MTI) Global Practice, World Bank Group. Mr. Ladegaard leads the World Bank’s work on Regulatory Policy and Management. He has more than 15 years of experience with different aspects of regulatory governance and reform. Initially at OECD’s Regulatory Policy division, Peter led a number of benchmarking studies and country reviews of OECD Member Countries’ regulatory management systems. At the World Bank Group since 2005 he developed and directed the Better Regulation for Growth Program which adapted developed-country tools and experiences in regulatory reform to transition economies. Peter subsequently headed up the International Finance Cooperation (IFC)/World Bank Group’s Investment Climate Program in East and Southern Africa. In this capacity, Peter oversaw investment climate programs in 18 countries in the region. From July 2014, Peter was the Global Lead for the newly established Regulatory Policy and Management business line in the World Bank’s Governance Global Practice. Peter is the initiator and current co-lead of the World Bank’s Good Regulatory Practice (GRP) program. Peter joined the MTI practice in January 2018. In these various capacities, Peter has advised more than 40 governments on regulatory reform strategies and implementation. Prior to joining OECD and the World Bank, Peter worked in management consulting and for the Danish Ministry of Finance. He holds an MA in Political Science.

Datuk Dr. Anis Yusal Yusoff

Datuk Dr. Anis Yusal Yusoff is currently Director General of the National Integrity and Good Governance Department, Malaysia. Prior to this, he was the President and Chief Executive Officer of the Malaysian Institute of Integrity (INTEGRITI). He has served over ten years at The United Nations Development Programme (UNDP) as well as at the United Nations Volunteers (UNV) Headquarters in Bonn, Germany. Before joining INTEGRITI, he was recently appointed as an Adjunct Professor by Tun Hussein Onn University (UTHM) from January 2018. Datuk Dr. Anis Yusal has served on a number of national advisory councils such as the Advisory Panel for the Consultation and Prevention of Corruption Commission. He was also an advisory member of the panel for the National Advisory Consumer Council & the National Unity and Integration Training Institute. Datuk Dr. Anis Yusal was also recently reappointed by DYMM Yang Di Pertuan Agong as a Commissioner and Deputy Chairman of The Enforcement Agency Integrity Commission (EAIC).

MODERATOR Hairil Yahri Yaacob

Mr. Hairil Yahri Yaacob's tenure at Embassy of Malaysia in Washington D.C. commenced on December 13, 2011. Prior to his posting to Washington D.C., he was the Director of Policy & Strategy, Ministry of International Trade and Industry. His career with the public sector began in 1995 when he joined Malaysia’s Administrative and Diplomatic Service. From 1995 to 2012, his public service has taken him from serving in the Ministry of Foreign Affairs, Ministry of Plantation Industries and Commodities, to the Ministry of International Trade and Industry, where he has held various positions including Trade Counselor in-charge of agriculture and non- agriculture at the Permanent Mission of Malaysia to the World Trade Organization in Geneva, Switzerland from 2005-2008. Mr. Hairil holds a Master of Arts in Strategy and Diplomacy from the National University of Malaysia. His undergraduate degree is Bachelor of Arts (Honours) in Politics and International Relations from the University of Kent at Canterbury, United Kingdom in 1994.

SESSION 3: THE IMPACT OF PUBLIC CONSULTATION ON STAKEHOLDERS Tan Sri Rastam Mohd Isa

Tan Sri Rastam Mohd Isa is Chairman and Chief Executive of the Institute of Strategic and International Studies (ISIS) Malaysia. Tan Sri Rastam is a former Secretary General of the Ministry of Foreign Affairs Malaysia. He served in various capacities at the Ministry of Foreign Affairs and Malaysian diplomatic missions abroad, including as High Commissioner of Malaysia to Pakistan, Ambassador of Malaysia to Bosnia Herzegovina, Ambassador of Malaysia to the Republic of Indonesia and Permanent Representative of Malaysia to the United Nations in New York. Tan Sri Rastam is Chairman of the Malaysian National Committee for the Pacific Economic Cooperation Council (PECC) and Chairman of the Malaysian National Committee of the Council for Security Cooperation in the Asia Pacific (CSCAP). He is also a member of the Asia-Pacific Economic Cooperation (APEC) Business Advisory Council – ABAC and Board Member, China-Southeast Asia Research Center on the South China Sea (CSARC). He is currently Chair of ASEAN-ISIS.

Noor Yang Azwar Kamarudin

Azwar heads Pfizer Malaysia’s Corporate Affairs, Health and Value Division for Malaysia and Brunei. She is responsible for the company’s public affairs and policy, communications and market access. She oversees all product communication, media relations and oversees the company’s Corporate Social Responsibility projects such as Care-A-Van, MenCare and Health Fellows Programme. Under Health and Value portfolio, she is responsible for the company’s market access strategy as well as sustaining government tender business. She is also SEA representative to Pfizer’s APAC Corporate Affairs Board. Prior to joining Pfizer Malaysia, Azwar was attached to Ministry of International Trade and Industry as Assistant Director and then with Prime Minister Department of Malaysia. She is actively involved with Pharmaceutical Association of Malaysia (PhAMA), Malaysian International Chamber of Commerce and Industry (MICCI) and American Malaysian Chamber of Commerce (AMCHAM) in leading healthcare and intellectual property policy. She was elected as the Trustee for PhAMA in 2015 till current. She has also served several times as Judge for A+M Marketing Award for Malaysia and Singapore. She was nominated for Pfizer Inc’s Great Manager Award, amongst 200 nominated globally. Most recently, she was awarded the Beacon of Light Award by ASLI, Ministry of Women and NCWO for her work in representing women in the workplace and corporate Malaysia.

Ar. Ezumi Harzani Ismail

Ezumi Harzani is the current President of Pertubuhan Akitek Malaysia (PAM). He is also a Director of Arkitek MAA Sdn Bhd and a board member of Board of Architects Malaysia (LAM). He represents PAM in various government working groups and committees. He also represents the private sector to the APEC Workshop in Reforming Regulatory System in Building Construction held in Singapore in October 2010. He is also a member of Focus Group on Dealing with Construction Permits (FGDCP) set up under PEMUDAH to facilitate the process of development and obtaining construction permit. Through FGDCP, he actively involves in reviewing the OSC process and procedures, and facilitates the workshops engaging local authorities and technical agencies. He graduated with Bachelor of Science in Housing and Bachelor of Architecture from University of Science Malaysia and Master of Philosophy (Policy Studies) from University of Technology Malaysia.

MODERATOR Nuraslina Zainal Abidin

Nuraslina is the Founder and Group Managing Director of Genaxis Sdn Bhd and Chief Executive Officer of IA Consulting Sdn Bhd (iAC). A visionary in strategic business transformation, she brings with her 15 years of experience in transforming and optimising business process performances of major organisations and conglomerates, such as UEM Sunrise, PLUS, Pharmaniaga, Boustead Naval Shipyard, TM Berhad, UEM Group, and CIMB Berhad – to name a few. Her keen interest in Six Sigma, Quality, Safety, Health and Environment (QSHE) certifications has helped her redesign new best-practices and processes that have assisted respectable corporations such as Volvo Cars Malaysia, Sime Continental Berhad and Lubrizol Pty Ltd. British American Tobacco to become ISO-certified organisations. Nuraslina has led various government’s strategic transformational initiatives, notably instrumental in redesigning and reengineering over 200 processes of Royal Malaysia Customs Department (RMCD) for government to implement the uCustom system. She was also previously appointed as advisor to Integrated Government Financial and Accounting Management System (currently known as iGFMAS) project sponsors for the implementation approach, strategy, and change request management that went live on 1st January 2018 – the Government’s largest transformation initiative thus far. With her recent substantial acquisition of iaC - the consulting firm responsible for developing iGFMS; Nuraslina has found her role redefined from advising to managing and overseeing the continued success of the mega project for the next two phases. A successful entrepreneur and technopreneur, she has received various accolades in recognition of her contributions and achievements as industry influencer, including (but not limited to) the Women Exporters Development Program 2009 - 2017 (MATRADE), Recognition for Contribution to Malaysia’s 5th Position for Trade Across Border 2014 and SME Award for Technology Adoption 2018 (SME).

SESSION 4: THE CHALLENGE TO GOVERN BETTER PUBLIC CONSULTATION Tobias Schroeder Tobias Schroeder is a project manager within the eRulemaking Program Management Office (PMO). eRulemaking is a cross-agency initiative created under Section 206 of the E-Government Act of 2002. The vision of the program is to enable the public ease of access to participate in a high quality, efficient, and open rulemaking process. Tobias is the newest member on the PMO, and his role is to lead the effort to expand the partnership’s capabilities in cross-federal data analytics and provide leadership for the Federal Docket Management System. A former United States Marine Corps infantry rifleman and embassy guard, Tobias left the service to pursue a degree in Environmental Policy. He has 18 years of professional civilian experience in private sector consulting as federal, state and county government. Prior to joining the eRulemaking PMO, he helped to initiate E-Enterprise, a collaborative initiative to simplify, streamline and modernize the implementation of environmental programs among environmental regulators in federal, state, local and tribal governments. Arfan Faiz Muhlizi Arfan Faiz Muhlizi is Head of Division of Politics, Law, Security and Governance Centre for Analysis and Evaluation of National Law, National Law Development Agency, Ministry of Law and Human Right of Republic of Indonesia. Previously, he was Head of Sub-Division of Research Facilitative, Centre of Law System Research and Development, National Law Development Agency, Ministry of Law and Human Right of Republic of Indonesia and Head of Sub-Division of Program and Report, Centre of Law System Research and Development, National Law Development Agency, Ministry of Law and Human Right of Republic of Indonesia.

Laurence Todd Laurence is Director of Research and Development at the Institute for Democracy and Economic Affairs (IDEAS). Laurence is responsible for the overall management of research programme. IDEAS is an independent research institute based in Malaysia. IDEAS’ research seeks to promote debate and propose solutions to Malaysia’s policy challenges. The research is focused in three areas: i) economics and business; ii) democracy and governance; and iii) social policy. Laurence previously worked for the British government, specialising in economic and foreign policy. Laurence was previously the Head of Migration and Labour Markets in Her Majesty’s Treasury and Head of EU Policy and Research at the Prime Minister’s Office. Laurence has held various other roles in the Prime Minister’s Office and the Ministry of Defence.

MODERATOR Dr Izhar Che Mee Dr Izhar is actively providing consultancy in the area of digital transformation of public service delivery in Malaysia and internationals. His consultancy works cover the area of reducing unnecessary regulatory burdens on business within the public sector delivery services. His works continue with digitalising the services. The scope of his consultancy services include the field of performance management, measurement, excellence, productivity and ICT. In recent years, he has been engaged by the Asia Productivity Organisation (APO) to be the national expert on the productivity measurement of universities research project. The Economic Research Institute of ASEAN (ERIA) engaged him to coach the ASEAN countries' project teams on the subject of reducing unnecessary regulatory burdens on business. The Malaysia Productivity Corporation (MPC) recognises him as a Productivity Specialist. His corporate, entrepreneurship and academic experiences are invaluable to his works. Dr Izhar obtained his PhD in Information System Engineering from University of Bradford, UK, in 1991. In early 2007, he was awarded Doctor of Management (Economic Regulations - Specialising in regulatory burdens on business) from the Universiti Utara Malaysia.

SESSION 5: CONSULTATION AT THE EX-POST EVALUATION: CLOSING THE POLICY Dr. Marcos Avalos Bracho

Mr. Marcos Avalos is the General Coordinator of Regulatory Impact Assessments in the CONAMER. His scope of work includes coordinating and reviewing the federal policy of better regulation for transport, tourism and energy sectors and implementing the international regulatory cooperation agenda. He is specialized in Competition, Economic Regulation, and Industrial Organization with over 15 years of experience as a consultant in Mexico and several Latin American countries, as well as to international organizations such as OECD, IDB, ECLAC, SIECA, and UNCTAD. Prior to taking up his current position, Mr. Avalos has worked as Strategies Coordinator in COFEMER, Director of Economic Affairs of ECLAC, Mexico; General Director of Evaluation in the Ministry of Security and as Deputy Director in the Federal Competition Commission. He has been Professor and Researcher for the Iberoamerican University, the Anahuac University, the Monterrey Institute of Technology and Higher Education (ITESM), the National Autonomous University of Mexico (UNAM), the Autonomous Technological Institute of Mexico (ITAM) and the School of Senior Management and Administration of Barcelona; additionally in recognition of his research work he has been member of the National System of Researchers (2006-2011). Mr. Marcos Avalos holds a bachelor's degree in Economics from the UNAM, a Master in Economics from the Center for Research and Teaching in Economics (CIDE) and a Ph. D, in Economics from Essex University.

Punita Nook Naidu

Punita Nook Naidu has 19 years of vibrant working experience with private sector and government. Having worked in both private and public sectors gave her a unique perspective in solving problems, identifying opportunities as well as strategizing and rolling out the best action plans. Her working experience ranged from formation of policies, strategies and action plans, industry restructuring activities, tariff setting mechanisms, drafting of regulations, developing benchmarking mechanisms and technical specifications, re-engineering of business processes to increase effectiveness and efficiencies, strategic planning of sewerage infrastructure development, rolling out the implementation plans and negotiate stakeholders buy in for the various functions that she has undertaken.

Nguyen Anh Duong

Mr. NGUYEN Anh Duong holds a Bachelor of Economics and a Master of Economics, both from the Australian National University (Australia). He joined the Central Institute for Economic Management (CIEM) – the leading think-tank in Viet Nam in 2004. Currently being the Director of the Department for Macroeconomic Policy and Integration Studies, Mr. Nguyen has various important research papers and policy recommendations to the Government of Vietnam on reforms of microeconomic foundation, macroeconomic policies and integration process. Since 2011, Mr. Nguyen has been the official representative of Viet Nam to the Economic Committee of APEC, where he acts as Friends-of-the-Chair coordinator on Corporate Law and Governance. He also leads Viet Nam’s individual action plan to implement APEC New Strategy for Structural Reform (ANSSR) and Renewed APEC Agenda for Structural Reform (RAASR). As part of his work, he has formal obligations on reviewing unnecessary regulatory burden on business in GVCs and implementation of FTAs, and promoting GRPs in Viet Nam.

Mohd Sofiyuddin was called to the Malaysian Bar in 2002 and commenced his legal career as a litigation lawyer in the firm of Messrs. Amir Yussof & Zol. He subsequently left private practice to pursue a career as the Legal Officer and Company Secretary of Malaysian Rating Corporation Berhad (a credit rating agency). Later, he returned to private practice with Messrs. Albar & Partners, during which he was also the company secretary of the Perdana Leadership Foundation, a premier foundation under the guidance of its honorary president, Y.A.B. Tun Dr. . In 2009, he assumed the position of Head of Legal and Alternate Company Secretary of Asian Finance Bank Berhad (a foreign Islamic bank and part of the Qatar Islamic Bank group). In January 2011, he continued his career in legal practice and joined the Islamic Financial Services Practice of Messrs. Zaid Ibrahim & Co., where in January 2013, he was made a Partner and Head of the Compliance & Governance Practice. He is currently the Executive Partner of ZICO Law Thailand, a Director of ZICO Law Myanmar, a Partner with Zaid Ibrahim & Co. (a member of ZICO Law), a Director of ZICO Trust Limited (Labuan) (a subsidiary of ZICO Holdings Inc.), an advisor to ASEAN Advisory Pte. Ltd., the management consultancy arm of ZICO Holdings Inc. He is also an advisor to a Malaysian statutory body, the Malaysia Productivity Corporation, and a Director of the Malaysia-Thai Chamber of Commerce.

SESSION 6: DRAFT FINDINGS ON PUBLIC CONSULTATION PRACTICES IN MALAYSIA Sue Elaine Holmes

Sue Holmes is a consultant working for Gunningham and Associates and previously was an Assistant Commissioner at Business Benchmarking Regulation Branch Inquiry Division, Productivity Commission, Canberra. She managed a team of economists to deliver the Productivity Commission publications and worked with a number of delegations from Asia who are interested in improving how they assess and manage regulation. She also was an Assistant Commissioner at Regulation Stocktake Branch Inquiry Division, Productivity Commission, Inquiry Research Manager at Inquiry Division of Productivity Commission, Administrator at Regulation Management and Reform Division and Director Office of Regulation Review at Canberra. Her working achievements with MPC include: 120 engagement sessions with stakeholders to obtain and validate information, 60 recommendations to improve quality regulations for NKEAs sectors, 10 RURB training sessions for knowledge transfer, 7 RURB projects completed, 1 guidebook on RURB Core Concepts published, 15 media appearances on projects undertaken, 10 certified RURB Malaysian Experts and 4 new Standard Operating Procedures established (RURB framework, press & report release procedures, triage assessment for project prioritization, and conduct of business meetings). Dato' Abdul Latif Hj.Abu Seman is currently the Deputy Director General of Malaysia Productivity Corporation (MPC). He holds a Bachelor of Economics (majoring in Public Administration) from the University of Malaya and a Master degree in Policy Studies from Saitama University, Japan. He began his career with MPC as a Training & Investigating Officer in 1984, and had served as Assistant Regional Head of MPC Sabah and a Senior Consultant at the Directorate of Policy Research, MPC HQ. He was the Manager of Best Practices Division in August 2000, Director for Promotion and Joint Venture Division in 2002 and MPC Sarawak Regional Director in February 2005. He assumed the position of Deputy Director General MPC in February 2010 which also oversees the Department of Regulatory Review undertaking comprehensive review of business regulations. In 2008, Dato’ Latif attended the Advanced Management Programme held at INSEAD, Fointainbleau, France. He has vast experience as lead assessor for the Prime Minister’s Industry Quality Award, Quality Management Excellence Award, the Sarawak Chief Minister’s Quality Award and the Federal Secretary Award. 14
