RESTRICTED GPA/ACC/NZL/6 5 De Febrero De 2013 (13-0606) Página RESTRICTED GPA/ACC/NZL/6 5 de febrero de 2013 (13-0606) Página: 1/15 Comité de Contratación Pública Original: inglés ADHESIÓN DE NUEVA ZELANDIA AL ACUERDO SOBRE CONTRATACIÓN PÚBLICA COMUNICACIÓN DE LA UNIÓN EUROPEA La siguiente comunicación, de fecha 31 de enero de 2013, se distribuye a petición de la delegación de la Unión Europea. _______________ OBSERVACIONES DE LA UNIÓN EUROPEA PARA QUE NUEVA ZELANDIA INTRODUZCA MEJORAS EN SU OFERTA PARA EL APÉNDICE I (GPA/ACC/NZL/1) La Unión Europea felicita a Nueva Zelandia por los esfuerzos que ha realizado para adherirse al Acuerdo sobre Contratación Pública mediante la presentación de su oferta inicial de 1º de octubre de 2012 (GPA/ACC/NZL/1). La Unión Europea valora algunos elementos muy positivos de la primera oferta de Nueva Zelandia, a saber: una amplia cobertura de entidades del Gobierno central, una oferta exhaustiva de bienes, servicios y servicios de construcción, y umbrales que corresponden a los del ACP. Por medio de este documento, la Unión Europea presenta sus observaciones para que se siga mejorando la oferta de Nueva Zelandia para el Apéndice I. La Unión Europea se reserva el derecho a retirar, modificar, reducir o ampliar su petición revisada a la luz de las negociaciones con Nueva Zelandia y de las peticiones revisadas de otras Partes en el ACP. La Unión Europea acogería con agrado que se introdujeran varios cambios en la oferta de Nueva Zelandia para que ésta fuera equivalente al nivel de los compromisos contraídos por la Unión Europea en el marco del ACP. A continuación figuran explicaciones sobre las mejoras que la Unión Europea considera necesarias. Las observaciones contenidas en la versión con control de cambios de la oferta de Nueva Zelandia, que figura infra, complementan dichas explicaciones. Entidades abarcadas La Unión Europea considera que Nueva Zelandia debería asegurar la cobertura más amplia posible de entidades en el marco de sus futuros compromisos en virtud del ACP. La Unión Europea observa que Nueva Zelandia ha optado por presentar una lista positiva de las entidades abarcadas por el Anexo 1. Si bien la Unión Europea valora que Nueva Zelandia haya incluido en su oferta a sus principales departamentos de servicios públicos, cree que la cobertura propuesta del Anexo 1 debería establecerse mediante una cláusula de inclusión general que contuviera una definición genérica y una lista indicativa de las entidades abarcadas. La Unión Europea observa que la oferta de Nueva Zelandia incluye, además de los departamentos, algunas entidades como la Policía y las Fuerzas de Defensa. La Unión Europea considera que las entidades independientes como el Servicio de Inteligencia y Seguridad de Nueva Zelandia (New Zealand Security Intelligence Service) y el Banco de la Reserva de Nueva Zelandia (Reserve Bank of New Zealand), que desempeñan funciones reguladoras, también deberían estar abarcadas por el Anexo I. GPA/ACC/NZL/6 - 2 - Asimismo, la Unión Europea pide a Nueva Zelandia que incluya las entidades correspondientes en la cobertura de los Anexos 2 (entidades de los gobiernos subcentrales) y 3 (otras entidades/servicios generales), respectivamente. La Unión Europea desea señalar que la lista que incorpora su oferta contiene, en su Anexo 2, una definición genérica de las entidades de los gobiernos subcentrales (divididas en dos categorías: entidades de nivel regional y local y organismos de derecho público) junto con una lista indicativa. De ese modo quedan comprendidas todas las entidades de nivel subcentral de la Unión Europea. La Unión Europea está dispuesta a ofrecer la cobertura total de esas entidades en régimen de reciprocidad. La Unión Europea considera que en el Anexo 2 de la oferta de Nueva Zelandia deberían incluirse entidades de los gobiernos locales y regionales, como los consejos regionales, municipales y de distrito. Además, la Unión Europea observa que, en el marco de los servicios estatales, hay un número significativo de organismos de Nueva Zelandia que funcionan como instrumentos de la Corona respecto del Gobierno de Nueva Zelandia y forman parte de las entidades gubernamentales ("entidades de la Corona"). Entendemos que estas entidades prestan servicios básicos y desempeñan diversas funciones públicas en la esfera de la salud, la educación, el turismo, la vivienda social y la investigación pública, y que están sujetas a las instrucciones del Gobierno. Asimismo, tenemos entendido que aunque estas entidades de la Corona estén registradas como empresas (como Radio New Zealand, Television New Zealand, etc.) no tienen un carácter completamente comercial y persiguen principalmente objetivos públicos. La Unión Europea considera que las entidades de la Corona corresponden a la categoría de la Unión Europea que comprende organismos de derecho público, y que figura en el Anexo 2 de su oferta. Por estas razones, la Unión Europea solicita que Nueva Zelandia incorpore en su Anexo 2 las entidades que están controladas en medida sustancial por el gobierno central, o los gobiernos regionales o locales, o dependen de ellos o están bajo su influencia, y que persigan objetivos públicos y no realicen actividades comerciales o industriales. Se ha añadido en el texto, mediante la función "control de cambios", una lista indicativa de esas entidades. En su Anexo 3, la Unión Europea ofrece la cobertura de las autoridades contratantes y empresas públicas que operan en el ámbito de los "servicios públicos" (se ha añadido como indicación la definición de la Unión Europea de las actividades pertinentes). La Unión Europea entiende que la categoría de empresas públicas corresponde principalmente a las "empresas estatales" en Nueva Zelandia (y a sus entidades subordinadas), que son propiedad del Gobierno. La Unión Europea invita a Nueva Zelandia a que incluya en su Anexo 3 las empresas estatales y otras entidades (incluidas aquellas que están controladas en medida sustancial por el gobierno central, o los gobiernos regionales o locales, o dependen de ellos o están bajo su influencia) que operan en el sector de "servicios públicos". Se ha añadido en el texto, mediante la función "control de cambios", una lista indicativa de esas entidades. Además, la Unión Europea considera que Nueva Zelandia debería incluir en el Anexo 3 de su oferta las empresas cuyas políticas de contratación están controladas en medida sustancial por el gobierno central, o los gobiernos regionales o locales, o dependen de ellos o están bajo su influencia. Se ha añadido en el texto, mediante la función "control de cambios", una lista indicativa de esas entidades. Asimismo, en aras de la claridad, la Unión Europea ha agregado, en su lista, una nota en los Anexos 1 y 2, por la que se aclara que se incluyen todas las entidades subordinadas, es decir, las entidades que no tienen personalidad jurídica propia, pero que están subordinadas a las entidades incluidas en los Anexos 1 y 2. La Unión Europea pide a Nueva Zelandia que proceda de la misma manera. Bienes abarcados La Unión Europea acoge con agrado la oferta de bienes de Nueva Zelandia. GPA/ACC/NZL/6 - 3 - Servicios abarcados La Unión Europea acoge con agrado la oferta de servicios de Nueva Zelandia. Servicios de construcción abarcados La Unión Europea acoge con agrado la oferta de servicios de construcción de Nueva Zelandia. Notas Generales La Unión Europea invita a Nueva Zelandia a aclarar la lista de excepciones y exenciones, en particular: a. en los casos abarcados en el punto i., la excepción parece demasiado amplia; b. sería necesario proporcionar más información para que sea comprensible la diferencia entre el alcance de la excepción establecida en el punto ii. y la establecida en el punto iii.; c. en cuanto a los acuerdos de auspicio comercial, a nuestro juicio, se trata de una cuestión que no corresponde a la definición de contratación pública; agradeceríamos que se hicieran aclaraciones al respecto; d. por lo que respecta a la redacción de los puntos v. y vi., la Unión Europea entiende que estos puntos se refieren a una "excepción interna"; la Unión Europea agradecería recibir una confirmación al respecto y más información sobre la diferencia entre la excepción prevista en el punto vi. y la prevista en el punto v.     5 Forecast Financial Statements These forecasts have been prepared in accordance with the Public Finance Act 1989. They are based on the accounting policies and assumptions that follow. As with all such assumptions, there is a degree of uncertainty surrounding them. This uncertainty increases as the forecast horizon extends. The Risks and Scenarios and Specific Fiscal Risks chapters discuss the risks to the fiscal forecast in more detail. The forecasts have been prepared in accordance with the Statement of Responsibility and reflect the judgements and information known at the time they were prepared. They reflect all government decisions and circumstances communicated to 3 December 2013. The finalisation dates and key assumptions that underpin the preparation of the Forecast Financial Statements are outlined on pages 42 to 44. B.6 | 85 2013 . HALF YEAR ECONOMIC AND FISCAL UPDATE . Statement of Accounting Policies Significant Accounting Policies These Forecast Financial Statements have been prepared in accordance with the accounting policies that are expected to be used in the comparable audited actual financial statements of the Government. These Forecast Financial Statements comply with generally accepted accounting practice (GAAP) as required by the Public Finance Act 1989 and have been prepared in accordance with Financial Reporting Standard 42: Prospective Financial Statements. All forecasts use the accrual basis of accounting. Forecasts have been prepared for the consolidated financial statements of the government reporting entity, which includes all entities controlled by the Government (as defined by applicable financial reporting standards).
