Les Relations Canoniques Des Évêques Diocésains Et Des Instituts Religieux De Droit Diocésain : La Juste Autonomie (Cc LES RELATIONS CANONIQUES DES ÉVÊQUES DIOCÉSAINS ET DES INSTITUTS RELIGIEUX DE DROIT DIOCÉSAIN : LA JUSTE AUTONOMIE (CC. 578 ET 586) AVEC UNE APPLICATION PARTICULIÈRE À L’ÉGLISE AU BÉNIN par Gisèle ACOTCHOU Thèse soumise à la Faculté des études supérieures et postdoctorales dans le cadre des exigences du programme de doctorat en droit canonique Sciences Humaines Faculté de droit canonique Université d’Ottawa © Gisèle ACOTCHOU, Ottawa, Canada, 2013 RÉSUMÉ Par cette thèse qui veut être une modeste contribution, son auteur a voulu rechercher des voies et moyens pratiques pour assurer la « juste autonomie » des instituts religieux de droit diocésain et faciliter de bons rapports entre eux et les évêques diocésains, en particulier au Bénin, à partir de l’étude des principes canoniques prévus par l’Église dans ce domaine. D’où le titre de la thèse : Les relations canoniques des évêques diocésains et des instituts religieux de droit diocésain : la juste autonomie (cc. 578 et 586) avec une application particulière à l’Église au Bénin. Le premier chapitre établit un contexte historique pour analyser les traits communs qui ont marqué les instituts religieux au moment de leur implantation au Bénin. Il retrace d’abord l’évènement de l’évangélisation de ce pays et décrit ensuite l’apport des missionnaires dans cette évangélisation qui aboutit à la promotion du clergé béninois et à la fondation des instituts religieux autochtones. Le deuxième chapitre est une étude de l’autonomie des instituts religieux selon les normes antérieures et postérieures au Code de 1983 : celle qu’on retrouve dans le Code de 1917, les documents du Concile Vatican II et les documents post-conciliaires. Elle portera notamment sur Lumen gentium, Christus Dominus, Perfectae caritatis, Ad gentes, Ecclesiae sanctae, Evangelica testificatio, Religieux et promotion humaine, Redemptionis donum et Vita consecrata. Le troisième chapitre dégage divers aspects du principe de « juste autonomie » reconnue aux instituts, selon le Code de 1983 par rapport à Mutuae relationes, en partant des implications de l’ecclésiologie de communion dont découle l’exigence de la protection de cette « juste autonomie ». Le quatrième chapitre fait d’abord le bilan de l’application par les évêques diocésains et les instituts religieux autochtones au Bénin des principes normatifs de leurs relations, avant d’orienter les deux parties vers de nouvelles pistes d’avenir, présentées dans un « Code de partenariat » qui contient des propositions pratiques susceptibles d’améliorer leurs rapports. With great joy I write to you, Venerable Brother, as you prepare to visit for the second time the young Christian community which dwells in the vast Asian country of Mongolia, rich in history and cultural traditions. Last July you visited Ulaanbaatar, the capital of the Mongolian nation, in order to celebrate the the tenth anniversary of the establishment of diplomatic relations between Mongolia and the Holy See and to highlight the lively presence in the region of a Christian community of relatively recent foundation. Although the first evangelization of Mongolia was due to the arrival of Nestorians from Persia in the seventh century, it was only in the first half of the twentieth century that a mission in that distant region was entrusted to the Congregation of the Immaculate Heart of Mary. The pro- Communist regime of the time at first prevented the missionaries from entering the region. With the end of the Communist dictatorship the doors were finally opened to the Gospel, and from 1991 on the first evangelizers began to arrive: priests, men and women religious, and laypersons actively engaged in the "Lord's vineyard." To demonstrate the fruitful and positive advances made in this decade, last year witnessed two events fundamental for the life of the Church: the elevation of the Mission sui iuris of Urga, Ulanbator to the rank of Apostolic Prefecture with the new name of Ulaanbaatar, and the subsequent appointment of the first Apostolic Prefect in the person of the Reverend Father Wenceslaw Padilla, C.I.C.M., as well as the first ordination of three priests and a deacon who, while not natives of the country, consider Mongolia as their adopted homeland.

Apart from the Ember Days (Quattuor Tempora), whose arrangement is now rightly referred to the national Conferences of Bishops, in the General Roman Calendar the cycle of seasons is marked by some important litur- gical celebrations. Coinciding with the be- ginning of winter (solstice: 21/22 Decem- ber) we observe Christmas.
