Charlotte Shaw death: Ten Tors teacher and school sued

The mother of a Devon schoolgirl who drowned while training for the Ten Tors expedition on has begun a High Court damages action.

Charlotte Shaw, 14, was a pupil at Edgehill College, now called Kingsley School, in , when she fell into a swollen brook on 4 March 2007. Charlotte was throwing a rucksack to a friend when she slipped and fell Conditions on Dartmoor were poor as the school group prepared for the trek.

Jennifer Wilkin-Shaw alleges teacher Christopher Fuller, the team manager, and the school were to blame.

The 48-year-old claims Mr Fuller was not sufficiently qualified or experienced and the risk assessment by Kingsley School Bideford Trust Company Ltd was inadequate.

A teacher has been sued by the Canadian International School for not declaring a sexual harassment complaint made by a student at a school he was previously employed at.

According to a writ filed to the Court of First Instance, the school said Sanjay Lalwani should have disclosed a sexual harassment complaint that was made before he began working at CDNIS.

Lalwani joined the CDNIS in June 2008 and his contract was renewed five times, with the latest one being effective from August l last year to July 31 this year.

He was made redundant by the school on Apri12, 2015, after a 23-year-old student lodged a formal complaint in October 2011,.

It emerged on October 16, 2014 that at a previous school that Lalwani worked at, the English Schools Foundation's Kennedy School, a parent of a student filed a complaint in October 2003 alleging that Lalwani had sexually harassed a 12-year-old student. Lalwani worked for the Kennedy School from October 1995 to February 2001,. The Kennedy School suspended Lalwani and terminated his contract in 2004.

A father who was fined £12o for taking his daughter on holiday during term time has claimed many parents are doing the same thing, before a high court review of his case on Friday.

Jon Platt, of Nettlestone on the Isle of Wight,took his seven-year-old daughter on an unauthorised eight-day holiday to Disney World in Florida in April 2015,for which she was absent from school for six days.

He was cleared by Isle of Wight magistrates after arguing that his daughter's absence did not mean she failed to attend school regularly, but Isle of Wight council took the case to the high court to seek clarification on what constitutes regular attendance.

Platt told the Radio 4 Today programme: "I'll take my kids on holiday whenever I want -they're my lcids. You're presuming that all parents aren't doing it, but look at the figures. One of the FOI[freedom ofinformation] requests I looked at recently showed 86,000 fines across [nearly loo] councils.

"Of course there will probably be a same number who didn't get fined.[Fining] is not changing behaviour to any significant degree. All it's doing is criminalising or attempting to criminalise parents who largely are doing absolutely the right thing and abiding by the law. This idea that local authorities have got in their head that they know better than you, as a parent, what's best for your kids, has to come to an end.

"The rules are your children attend school regularly. section 444 of the Education Act does not require attending school every single day."

Platt maintained that his daughter had fulfilled the obligation of attending go% of school days."The myth is that it's against the law to take your kids on holiday during term time. That's not what the law says. The law says your children must attend school regularly, so if I had paid that fine it would have been an acceptance that my children's attendance was so poor as to warrant criminal sanction," he said.

"It wasn't. My kids, right throughout their schooling, have never had less than 93% attendance across the entire school year. That's really good attendance, it's better than the great majority of politicians."

Teachers are facing increasingly abusive behaviour from parents and pupils, according to research revealed today.

More than a third(3g%) of teachers have been confronted by an aggressive parent or guardian, and nearly a quarter of teachers have endured physical violence from a student.

The research,from the Association of Teachers and Lecturers (ATL), comes after the head of the union launched a devastating attack on parents, accusing many of failing in their responsibilities and undermining schools. Writing in yesterday's Observer, Mary Bousted said that children were arriving at school ill-prepared by their parents, with a lack of respect for authority and lacking basic social and verbal skills.

The survey of l,000 school and college staff, published to coincide with the start of the ATL conference in Liverpool today,found incidents of insults, derogatory comments and intimidation by parents swearing at or threatening teachers.

Inmost cases, parents became aggressive because their child was disciplined in class or received poor grades and students often copied their behaviour.

Although 87% of staff had told their school about the aggression, a fifth felt they did not receive adequate support.

Teachers made over 20o personal insurance claims cases to the union for damage to property by pupils over the last two years - 6g incidents of malicious damage to vehicles, such as "keying" of cars, and 146 of damage to property.

A secondary teacher in Bristol, questioned for the survey, said: "Lack of support of teachers by parents is the most disheartening part of this profession and the thing most likely to make me leave it.

"Poor student behaviour reflects the standards that they see at home and children cannot be held completely accountable for the values, or lack of, instilled in them at home."

One-in-10 head teachers 'attacked by parents'

As many as one-in-10 head teachers has been physically assaulted by a pupil's parent or carer, a survey by the NAHT school leaders' union suggests.

Incidents reported by the 1,362 Survey respondents reported being punched and kicked heads surveyed in England, Wales and Northern Ireland included being punched, spat on, kicked, head butted, bitten and sexually assaulted.

Twice as many reported being victimised on social networking websites.

The government said attacks on teachers were "completely unacceptable".

About 1,300 of the NAHT's 28,000 members in primary and secondary schools took part in the survey.

SCHOOLS have begun ripping out swings and slides from playgrounds because they can no longer afford huge compensation payouts when children suffer minor cuts and grazes.

The claims have become so common that even school trips to the seaside are being cancelled in case pupils injure themselves while paddling in the. sea and their parents then sue.

Education authorities face big bills even if a child is hurt while defying school rules by climbing walls or trees.

Lawyers all over the country are fuelling the problem by offering parents no-win no-fee deals. Some firms have even setup telephone hotlines to encourage parents to sue.
