Foreword

The President, on the recommendations of the Constitutional Council appointed the following members on 2015-11-17, the Election Commission was established:

Vision and Mission of the Election Commission

“A nation that safeguards universal franchise” is the Vision of the Election Commission.

The mission statement of the Election Commission viz., “Raise critical consciousness among all stakeholders, ensuring the protection of people’s rights, and conduct free, fair and credible elections efficiently and effectively that safeguard the people’s sovereignty and universal franchise based on democratic principles”, is designed to achieve that vision.

Goals and Objectives

 All qualified citizens exercise their franchise fearlessly, freely and confidentially in elections conducted in a free and fair manner.

 The citizen realizes that the exercise of franchise is an inalienable right and involves him or herself in the election process actively.

 Equal and fair opportunities exist for all candidates during election periods.

 An all-inclusive, updated voter list is in place before every election.

 All citizens in the marginalised sectors of society engage in the electoral processes confidently and satisfactorily.

 The election process is administered competently and transparently.

 The needs of the stakeholders for data and information related to the election process and the Election Commission are satisfactorily fulfilled in a timely manner.

1 Functions of the Election Commission

Matters relating to the election process, which were hitherto attended to by the Department of Elections under the supervision of the Commissioner of Elections, were vested in the Election Commission with its establishment on 17.11.2015. In terms of Article 103(2) of the Constitution, the conduct of free and fair elections is the fundamental duty of the Election Commission. Accordingly, the Election of the President and the conduct of Parliamentary Elections, Provincial Councils Elections, Local Authorities Elections and Referenda in a free and fair manner and in connection therewith the revision of the Electoral Register on an annual basis, have to be attended to by the Commission. In addition to these statutory functions, filling of vacancies of members in Parliament, Provincial Councils and Local Authorities and recognition and registration of political parties are the other statutory functions that have been assigned to the Election Commission.

1. Provincial Councils Elections (Amendment) Act, No. 17 of 2017

The Provincial Council Elections Act, No. 17 of 2017 was being amended by introducing a mixed representation system instead of the proportional representation system, which was implemented for the election of Members to the Provincial Councils established for nine provinces, in terms of the Provincial Council Elections Act, No. 2 of 1988.

Administrative districts within the authorities of provincial councils shall be divided into the specified number of wards, a number and a name shall be provided for these wards for the purpose of identifying those areas and the delimitation of the wards shall be commenced. Then the relevant report shall be handed over to the Minister in charge of the Provincial Councils within four months from the date on which the Delimitation Commission is asked to delimit wards and such delimitation shall be passed in the Parliament with a majority of two - thirds.

Accordingly, to submit candidates who are to be elected from an administrative district as Member of a Provincial Council, political parties and independent groups have to submit the nomination paper in two lists namely, one list of candidates to be elected under wards and an additional list of candidates to be returned according to the proportional system. The candidate list of the electoral district is similar to the number of wards and the number of candidates in the district list shall be more than 3 members of the number of Members to be returned.

Following the distribution of electoral districts, the Election Commission, at an election, published the number of Members to be elected from the district list and the ward lists under the administrative districts of each Provincial Council, considering the number of Members decided to be elected for each Provincial Council from the district list and the ward list and declared the number of women which shall be in the ward and district candidate list.

Accordingly, the relevant parties are legally bound to submit nominations along with a number of women not fewer than 1/6 of the ward candidate list of the district and not fewer than 50% of the district candidate list.

1.1. Local Authorities Election - 2018

The First Past the Post electoral system in force in since 1865 was first amended as a proportional election system through Act, No. 27 of 1987.

This mixed proportional representation system was thereafter gradually established by the Local Authorities Elections (Amendment) Act, No. 22 of 2012. A delimitation committee was set up to establish electoral districts according to this new mixed proportional system. A Review Committee was established to review the report submitted by that Committee and even though the committee’s term of office expired in 2008, no election was held at the proper time and in accordance with the new provisions amended by Act, No. 22 of 2012 the opportunity has come to hold the local authorities elections.

Also, the Local Authorities Elections Act No. 16 of 2017 was passed to correct the technical errors of the Act that was to be implemented and to make changes in the electoral system.

The introduction of special provisions for women's representation has been identified as a positive impact of this act. Accordingly, the nomination paper was made up of two parts, 10% of the candidates in the first nomination list and 50% of the candidates in the second nomination list viz., marking up an additional nomination paper should comprise women and a least 25% of women’s representations were required for each of the councils. Also, a special amendment of this Act is, if a party or a group wishes to nominate a nominee for the vacant post of a female member, it should definitely be a woman nominee.

Although the necessary laws were amended regarding the holding of Local Authorities Elections in 2017, there was a tendency of postponing since the relevant procedures were not published in the gazette. However, there was disaffection among the mass organizations and the public and the media, civil organizations and the people submitted facts in this regard and pressured to hold elections. Accordingly, the Government published the local authorities procedural Gazette No. 2013/29 dated 07.04.2017 and it was published by Gazettes No. 2025/35 dated 30.06.2017 and 2043/56 dated 02.11.2017. Accordingly, the Returning Officers published the nomination notice on 27.11.2017. As this was stated before the court, the nomination notice was published for the non problematic local authorities by then. Thus it was decided to receive the nominations from 11.12.2017 to 14.12.2017.

Accordingly, the following days had been scheduled for the activities relating to the Local Authorities Elections.

Instead of previously held centralized counting, counting was carried out at each polling station or the ballot boxes of all polling stations of the division were brought into one polling station in the division and were separately counted.

Nomination papers were handed over (by political parties and independent groups) at both stages and some of them were rejected due to non-conformity with the provisions of the Local Authorities Elections Ordinanace. The aggrieved parties in this regard and in regard to the cases where the names of candidates were rejected took 54 court actions and except the petition relating to the Elpitiya Pradeshiya Sabha all other 53 petitions were rejected by the honorable court before the poll day.

4 Accordingly, the local authorities election was held at 340 local authorities island wide (except for Elpitiya Pradeshiya Sabha) on 10.02.2018. Election to Elpitiya Pradeshiya Sabha could not be held due to court proceedings. Election was held peacefully and without special influence. As prescribed the Returning Officers of the respective districts and local government bodies have released the results after counting the votes. There was some delay in publishing the results at the national level and it was revealed that it was due to technical errors in the computerization of the results at the polling station level. However, as a whole this election was a new experience which was held under a different voting system while formulating all forms and ballot papers separately as Local Authorities, covering the whole island. According to the electoral register of 2017, the number of registered electors was 15,760,867 and the votes polled pertaining to the local authorities election was 12,561,193. It is a high rate of 79.69% and is a higher polled value, no matter what the election or the circumstance. Also, this was the first election held after the establishment of the Commission. Further, the ability to hold a free and peaceful election within a very short period of time by overcoming all the obstacles can be considered as a victory achieved by the Election Commission.

02. Registration of Electors Act, No. 44 of 1980

Revision of Electoral Registers – 2017

2.1. The notice of the commencement of the enumeration of electors for the year 2017 under Section 12(1) of the Registration of Electors Act was published in Gazette No. 2019/7 dated 15.05.2017. In addition, the same published in Sinhala, Tamil and English newspapers, on the same day.

2.2. At the end of the completion of the activities relating to multiple registrations and inquiries into claims and objections the re-scrutinizing of the names of all electors with the enumeration forms (BC Forms) was carried out. The Electoral Register was certified on 12.10.2017 in terms of Section 18 of the Registration of Electors Act, No. 44 of 1980 and the notice in this regard was published in Gazette No. 2040/36 on 12.10.2017 and in newspapers on the same day, under Section 20 of the Act.

2.3. At the end of the certification of the Electoral Register for the year 2017, the Registering Officer of each electoral district provided statements on total number of names in the electoral register to the Election Commission, in terms of Section 23 of the Registration of Electors Act. Based on these figures the Election Commission, in terms of Sub - Article 98(8) of the Constitution, published in Gazette No. 2047/12 of 27.11.2017 the details on the number of members to be elected for each electoral district at a Parliamentary Election, for the year 2017. Details are shown in Table I.

2.4. At the field activities of the enumeration of electors in relation with the revision of electoral register 2018, action was taken to use the electoral register 2017 to recognize household units of which all eligible citizens resided at the relevant area in 2018.

2.5 Hence in 2017, when compared with 2016, there is no change in the number of members to be elected for each electoral district under Article 98 (8) of the Constitution. Comparative statement in that regard is given in Table II.

03. Revision of Electoral Registers – 2018

3.1. The notice under Section 12(1) of the Registration of Electors Act relating to the commencement of the enumeration of electors for the year 2018 was published in Gazette No. 2071/10 on 15.05.2018 and steps were taken to publish the same in Sinhala, Tamil and English newspapers, on the same day.

3.2. House to house enumeration was used to commence on 1st of June every year until the year 2012 and after the year 2012 it was advanced to mid - May of the relevant year. Hence, the enumeration of electors for 2018 was commenced on 15.05.2018. However, in terms of the Registration of Electors Act, No. 44 of 1980, 1st of June in 2018 was considered as the qualifying date to be an elector.

3.3. Written instructions regarding the enumeration of electors in all electoral districts were issued to District Registering Officers on 02.03.2018 and the Election Commission enlightened the secretaries of the recognized political parties in writing on 02.03.2018 about the procedure of appointing representatives of each political party for the revision of electoral register.

3.4. With the objective of inclusion of all qualified electors in the electoral register, much attention was drawn in this year too to identifying and registering the ethnic groups as well as marginalized groups, who have not been included in the electoral register hitherto, as electors. Accordingly, instructions were given to relevant District Registering Officers/ Government Agents as well as to Deputy/ Assistant Commissioners of Elections that it is essential to register low income earners in urban areas, people living in urban high rise apartments, people migrating to urban areas, Tamil speaking people working in plantation related jobs in Central, Uva and Sabaragamuwa Provinces as well as Kalutara, and Matara Districts and, internally displaced persons living in various areas of the Island due to actions of armed persons in Northern and Eastern Provinces. Also, a supplementary register was prepared under the Registration of Electors (Special Provisions) Act, No. 10 of 2017 for the persons who had been internally displaced after 2009 and had not registered elsewhere in the electoral register. Accordingly, the task of registering all qualified persons was successfully completed in the year 2018.

3.5. As in the previous years instructions were given to implement a special program in the year 2018 too, under the personal supervision of each Deputy / Assistant Commissioner of Elections in the districts, to register Tamil speaking persons serving in the plantation sector and other related jobs who have not registered as electors due to various reasons, viz. inability to confirm the date of birth, issues in relation to citizenship, being away from home during the enumeration period and lack of interest in registering as electors. The support of the Superintendents of Estates, Plantation Community Facilitators, Welfare Officers of estates and Grama Niladharis serving in the divisions in estate areas was sought in inserting the names of many persons in the estates in the electoral register. A special program at district level was also launched during the claims and objections period to insert the names of electors in estate areas who have failed to have their names inserted at the preliminary stage of enumeration.

3.6. To prepare an electoral register where no any eligible citizen is left behind, the Election Commission paid special attention to the following communities / groups at the revision of electoral registers 2018.

 Factory employees of the investment promotion zones of Katunayake, Biyagama, Koggala, etc., who came from various areas of the island and housekeepers/house maids of various areas,

 Migrant workers who had worked overseas viz., in countries like South Korea, Saudi Arabia etc., in the recent past,

 People with upcountry ordinary residency and low country estates who are coming to work in the capital or other urban areas,

 The fishing community that migrates to the eastern area from the southern and western coastal areas during the off season,

 People residing in rented houses, especially who are in municipalities and towns on rent or lease basis,

 General public residing in housing complexes in which there are many household units and in apartments.

Special programs were implemented to register the above mentioned Sri Lankan citizens on the electoral register. In particular, when registering residents in rented houses, a house number has been issued with the letter "R" and the relevant home number, and registered on the electoral register.

7 3.6.1. A pilot project was implemented in fifteen (15) Grama Niladhari Divisions to introduce a new form for enumeration of electors which is simple and easy to use compared to the existing form for enumeration of electors. The details of the above 15 Grama Niladhari divisions are in Table III. This pilot project was successfully implemented and the positive feedback given by the people, Grama Niladharis and officials in charge of polling divisions who were attached to the District Election Offices of the Election Commission, on this new form of enumeration of electors is a very important factor. Accordingly, it is expected to further expand this pilot project in all other districts of the island in the year 2019 too.

3.7. As in the year 2017, in 2018 too, house to house enumeration of electors could be carried out in all areas of the Northern Province but house to house enumeration of electors was not possible in 28 polling districts in Electoral District and 01 polling district in Vanni Electoral District, where people had not yet resided in their original places of residence. In relation to these areas the names of those in the previous electoral register and the names of newly qualified persons were inserted in the electoral register, except the names of those who were reported as dead. Relevant details of the polling districts where house to house enumeration was not carried out as above are shown in Table IV.

3.8. Field work relating to the revision commenced on 15 May, 2018. Although initially it was planned to be completed by 31 October 2018, it was decided to certify the electoral register on 05.10.2018 to be used for the Provincial Council election, if it is held. However, the certification of the electoral register had to be postponed till 25.10.2018 due to adverse weather conditions and other practical issues.

3.9. Accordingly, action was taken to conclude field activities of the enumeration of electors, which commenced on 15th May 2018, by the first week of August 2018, to prepare the “A” list, which contains the names deleted from the electoral register of the year 2017 and the “B” list, which contains the newly inserted names to the operative register, by 09.08.2018 and to exhibit “A” and “B” lists at all District Elections Offices, Divisional Secretariats, Grama Niladhari Offices and Local Authorities, under Section 13 of the Registration of Electors Act No. 44 of 1980, during the period from 10.08.2018 to 06.09.2018, for the perusal of the general public and enable them to submit their claims, if their names were not included in the register until then. In the revision of electoral registers for the year 2018, there were 861,032 names to be deleted (“A” list) and 1,093,951 new names to be inserted (“B” list) to the operative register (2017) in relation to all electoral districts. Relevant details are shown in Table V. Claims and objections were accepted during this period of exhibition. The District Deputy/Assistant Commissioners of Elections (Assistant Registering

8 Officers) were advised to consider the written complaints received by the District Election Offices as well as the messages submitted through the website as “a request for claim”, even though they were not submitted in the specific claim format. The notice about the exhibition of “A” and “B” lists under Section 13(2) of the Registration of Electors Act was published in Gazette No. 2083/40 of 10.08.2018 and in Divaina, Virakesari and Daily News newspapers on 10.08.2018.

3.10. Prior to the commencement of the enumeration, steps were taken to inform all recognized political parties to appoint representatives on their behalf to participate with the enumerators in the activities of house to house enumeration of electors, observe the delivery of enumeration forms (BC forms) to the chief occupants and acceptance of such forms, examine the same at the enumerators’ office, at the end of field enumeration and to submit their observations. Since 1981 this opportunity has been extended to all recognized political parties to engage their representatives in observing the duties of the enumerators and special enumerators. This will be a tremendous support in the preparation of an accurate electoral register. It is also the responsibility of all political parties to ensure the participation of their representatives in the enumeration process and ensure that the enumeration has been done correctly, without making complaints about depriving of the franchise of their party supporters, during an election period or when their supporters make complaints. However, only a very limited number of political parties appointed their representatives for this purpose and an insignificant number of those appointed also, contributed to this activity. During the year 2018 a series of awareness programs was implemented by Deputy/Assistant Commissioners of Elections of District Elections Offices to educate those who were appointed by political parties about the process of revision of electoral registers and the responsibility of the party representatives. The details regarding appointments and participation of representatives of political parties in the revision of the electoral register 2018 are given in Table VI.

3.11. In the revision of 2018 too, action was taken to inform chief occupants of households in writing and to obtain further information about the incidents of which the enumerators, at the time of accepting checked forms for enumeration of electors (BC Forms) from the enumerators, had not recommended the inclusion of the names on various grounds though the chief occupants entered those names, or all the electors of a household were deleted in the year 2018 though they were registered in the year 2017 or when the names were deleted for various reasons such as failure to handover the forms for enumeration of electors (BC forms). Based on the responses received from the chief occupants and the recommendations of the enumerators, the names which could be accepted to be registered at the place applied for were accepted and “B” listed and all other claims

9 were treated as claims received during the period for claims and the applicants were called for inquiries. Action was taken to insert the names in the electoral register which could be accepted according to the information revealed at the inquiries.

3.12. Under the displaying of “A” and “B” lists, 90,306 claims and 1,166 objections under all electoral districts were received by the District Registering Officers, relevant to the revision in the year 2018. With a view to safeguarding the rights of all to vote and to make available in an all inclusive register of electors, action was taken too to call every person for inquiries treating all submissions made by them in any manner as claims namely, requests received through letters during the period of revision, UE Forms, requests received in respect of the letters sent to the names which were not recommended by the Grama Niladharis but were in the BC forms handed over to the Election Offices by the enumerators with or without the recommendations of the Grama Niladhari. For the first time action was taken in 2016 to introduce a computer programme where the general public can refer their issues relating to the Revision of the electoral register via the official website of the Commission. Hence in this year also the draft register of electors 2018 containing the names deleted (A) and names included (B) was displayed on the website from 10.08.2018 to 06.09.2018 and the opportunity was accorded to the electors to submit their problems on incorrect names and ID numbers etc,. In addition, the draft electoral register was exhibited at District Election Offices and all Grama Niladhari Offices. Similar to year 2017, in 2018 too the public was made aware through the paper advertisements and electronic media opportunities to peruse the electoral register to check whether his/ her name has been included and if not, to inform the Election Commission or the District Election Office on or before 06.09.2018. The District Registering Officers were required to conclude the inquiries into claims and objections before 22.09.2018. The numbers of claims and objections received, accepted and rejected at electoral district level are given in Table VII.

3.13. A program similar to the program implemented to detect multiple registrations in the Electoral Register of 2017 was implemented in 2018 too. Accordingly, in the revision of the electoral register for the year 2018,

3.13.1. Multiple registrations among newly added names in the district, i.e.

 multiple registrations among newly added names in the district and the names in the operative electoral register (2017) of the district,  multiple registrations among newly added names in the district and the names in the operative registers in rest of the other districts, and

were examined and ascertained by using methods to check multiple registrations.

Instances where two or more persons have been registered under the same National Identity Card number were also revealed at the inquiries conducted by sending letters to the relevant electors.

3.13.2. In the year 2018, the names of 131,902 electors were revealed as multiple registrations and steps were taken to register them under only one eligible address and the details of the number of names so deleted on grounds of multiple registrations of each electoral district are given in Table VIII.

3.13.3. Enumerators were instructed to make every effort at the enumeration to record the National Identity Card Numbers of all electors, who have obtained National Identity Cards, as the submission of a valid identity card has been made compulsory at the time of voting according to the Elections (Special Provisions) Act, No. 14 of 2004. Steps were taken to inform the Department for Registration of Persons and the elector concerned, when the computer program used to prepare the electoral register detects incorrect numbers although the National Identity Card was submitted at the time of enumeration. Through this process it was possible to correct a large number of errors in identity card numbers and to prevent attempts made by electors to enter their names under several addresses for whatever reasons. Particulars of the persons, who produced their National Identity Card numbers at the enumeration of electors in 2018 and the comparative statement on the number of persons, who have produced the same National Identity Card numbers at the revision of electoral registers from year 2009 – 2018, are shown in Table IX and X respectively.

3.13.4. Particulars of the number of persons in each Grama Niladhari Division who did not have identity cards in their possession and the reasons for not obtaining them by now namely, inability to produce the birth certificate or any other document to prove their date of birth, not interested in obtaining the identity card or other reasons, were obtained from the Grama Niladharis at the 2018 revision and steps were taken to inform them to the Commissioner of Registration of Persons. Accordingly, the Department for Registration of Persons took action, during the year 2018 to implement a new program to issue identity cards to those persons.

3.13.5. Under the recommendations of the Director/Legal of the Election Commission and with the approval of the Election Commission, action was taken to investigate and delete the names of 47 persons from the electoral register as the Department of Elections/Election Commission received reports, during the year 2018 and earlier years, that they were serving imprisonment for offences committed under the Act to Investigate Allegations of Bribery or Corruption and election laws or on other grounds. Details of the names deleted due to various reasons are given in Table XI.

3.13.6. The draft register was forwarded to Grama Niladharis from 08.10.2018 to 13.10.2018 to confirm the accuracy.

3.13.7. The Electoral Register for the year 2018 was certified on 25.10.2018 under Section 18 of the Registration of Electors Act, No. 44 of 1980. The Notice in that regard was published in Gazette No. 2094/33 of 25.10.2018 and in the newspapers on the same day, under Section 20(1) of the Act. The number of registered electors in 2017 and 2018 according to the electoral districts is given in Table XII. The huge contribution received from the officers of the Head Office of the Election Commission as well as the District Registering Officials/Government Agents, the District Deputy/Assistant Commissioners of Elections and their staff and all the other stakeholders should be commended. The name list of District Assistant Registering Officers who have certified the electoral register 2018 is given in Table XIII.

3.13.8. The total number of registered electors in 2017 and 2018 is 15,760,867 and 15,992,096, respectively. Accordingly, there were 231,229 more electors when compared to the year 2017 and the increase of the electors in the year 2017 when compared to the year 2016 was 148,897. Therefore, there was a numerical increase in the number of electors in the year 2018 compared to the year 2017. In 2016 and 2017, the percentage growth of registration of electors relative to the previous year was 1.23% and 0.95%, respectively and it shows an increase by 1.41% in 2018. It is observed that the awareness programs and other initiatives that have been carried out in the previous years by the Election Commission, relating to the registration of electors, have contributed to this increase. Details in that regard are shown in Table XIV.

3.13.9. A comparative statement on the number of electors in polling divisions of each electoral district from the year 2009 to 2018 is given in Table XV.

12 4. Registration of Electors (Special Provisions) Act, No. 10 of 2017

4.1. In terms of the above Act’s provisions the objective of this Registration of Electors (Special Provisions) Act, No. 10 of 2017 is to provide such persons with the right to vote, as were internally displaced after 2018 as a result of acts of terrorist or armed groups. In fact, this was a further enforcement of the Registration of Electors (Special Provisions) Act, No. 27 of 2013. In the year 2018 too, the registration of electors was carried out according to the provisions of this Act. Accordingly, through the publications on Divaina, Daily News, Virakesari newspapers on 02 November 2018, people were informed to claim to register on the electoral register, if they were displaced in the above manner. The time given for claims was from 01 November – 10 November 2018. Accordingly, 6 claim applications were received and after investigations 2 in the Mullaitivu District were accepted. These 2 electors were provided with the right to vote in the elections, which will be held based on the electoral register in 2018. Accordingly, in terms of Section 3.1 of such Act, the Gazette notification No. 2094/35 dated 26.10.2018 was published to register them in the electoral register, if there are persons who are in need. In addition, a public paper advertisement was also published in this regard. The list of registration details in 2017 and 2018 under the Registration of Electors (Special Provisions) Act, No. 10 of 2017 is shown in Table XVI.

4.2. Order under Article 98 (8) of the Constitution

The list of the Members of Parliament who are eligible to be elected for each electoral district in future Parliamentary Elections, according to the electoral register 2018 is given in Table XVII.

4.3. The comparative statement of the number of Parliamentarians, who are entitled to be elected for each electorate from the year 2009 to 2018, is given in Table XVIII.

5. Voters’ Day – June 01

5.1. As in the previous years, steps were taken during the revision of electoral register 2018 too, to implement various programs at the district level in parallel with the awareness programs carried out through electronic and print media for the benefit of the general public based on Voters’ Day which falls on 1st June. The main function of Voters’ Day in the year 2013 was held in and after 2014 steps were taken to carry out various programs for Voters’ Day in other districts as well. With the need for emphasizing the necessity of registering in the electoral register, many projects such as press conferences, motorcades, public meetings, walks, street dramas, short documentaries, distribution of handbills, displaying of posters, cutouts and banners etc., were implemented. In the year 2018,

13 the 9 main public awareness functions were conducted in Kegalle, Moneragala, Kalutara, Jaffna, Medawachchiya, Deniyaya, Saindamarudu, Kalpitiya and Rattota towns covering all provinces of the island. A major program was organized at the University of Peradeniya as part of the awareness program for registering the university community in the electoral register. Action was taken to conduct awareness campaigns in all districts of the country parallel to the major functions of Voters’ Day. In addition, various comprehensive public awareness programs were organized in all districts, covering every citizen including employees of private and public sector, farmer and fisher communities, estate sector employees and marginalized groups. Extensive support of the officers of the Head Office of the Election Commission, District Registering Officers/Government Agents and District Deputy/Assistant Commissioners of Elections and their staff and the utmost contribution of all stakeholders, which made the above island wide programs a success should be commended.

5.2. In relation to the Voters’ Day, door to door collection of enumeration forms in selected Grama Niladhari divisions of selected Municipal Council and Urban Council areas covering all districts was conducted on 03.06.2018 by the enumerators as well as officers of the Elections Offices. According to the observations of the District Deputy/Assistant Commissioners of Elections in this connection, it was an opportunity to identify genuine residents and to accept BC forms from them under these arrangements and hence the attempts to insert the names fraudulently especially with the view to getting the children admitted to popular schools could be minimized.

5.3 Parallel to the programs conducted for Voters’ Day 2018, awareness of students studying in universities and other higher educational institutions that is youth citizens, was raised on the sovereignty of the people, franchise, electoral register and the electoral process. Organization of a seminar jointly by the Election Commission and the International Foundation for Electoral Systems (IFES) under this program, at Peradeniya University on June 5, 2018 was a remarkable event.

6. Parliamentary Elections Act, No.1 of 1981

6.1. Recognition of Political Parties and Filling Vacancies in the Memberships of Parliament

6.1.1. Although an advertisement for calling applications for the recognition of political parties shall be published in public newspapers in terms of Section 7 (4) (a) of the Parliamentary Elections Act, No. 1 of 1981, new political parties could not be recognized according to the provisions of the Act since activities

14 relating to the local authorities elections had already begun. Even after the poll was over, the relevant advertisement could not be published in view of the interim order granted on behalf of the Elpitiya Pradeshiya Sabha. Therefore, the Attorney General was consulted about the registration of new political parties and he advised suspending the new registration of political parties until the legal proceeding relating to the Elpitiya Pradeshiya Sabha come to its end. Therefore, no new political parties relating to this year have been registered to this date and there are 70 registered political parties that are registered with the Election Commission. The list of these parties is shown in the Table XIX.

6.1.2. No new parties were registered during the period under preview and following amendments of the recognized political parties were done during 2018.

6.7.1. Details relevant to filling vacancies in Municipal Councils, Urban Councils and Pradeshiya Sabhas during the year 2018 are included in Table XXII.

7. Special Facts

7.1. Special Projects

Five awareness programs for women and 10 Student Parliament programs to enlighten school students were conducted at district level and 01 awareness program was conducted in District for the Teacher Trainees in National Colleges of Education to create awareness on democracy and universal suffrage.

Further, awareness programs on democracy and universal suffrage viz., two awareness programs for Principals and Teachers were conducted in district and 05 awareness programs were conducted for youth at district level.

Three programs were conducted at district level to raise awareness of Police Officers on the election process and universal suffrage as well as on election laws.

The Election Commission has taken measures to conduct 40 awareness programs on democracy and universal suffrage and on the importance of elector participation at the grassroots level. One hundred and sixty four awareness programs were conducted at district level for other awareness programs in the four-year strategic plan of 2017-2020 other than the voters

16 day programs and 131 community-based awareness programs were also conducted to make aware the general public.

7.2. Legal Amendments

The Election Commission took action to submit the laws drafted by it on the control of election campaign, to the Legal Draftsman and thereby to the Attorney General.

Discussions relating to the amendment of the Assets and Liabilities Act were held with the Commission to Investigate Bribery or Corruption and action was taken by the Legal Division of the Election Commission to provide the necessary assistance to draft these amendments.

Special attention was drawn on the provisions of making deposits under the Provincial Councils Elections (Amendment) Act.

7.3. Other Facts

The terms of office of the North Central, Sabaragamuwa and Eastern Provincial Councils ended with effect from 01.10.2017, 26.09.2017 and 30.09.2017, respectively. Accordingly, even though the election to these provincial councils had to be held, they could not be held until the end of the work of the delimitation of the wards, relating to the mixed- member proportional representation introduced by Parliament through the amendment of the Provincial Councils Elections Act, No. 2 of 1988 by the Provincial Councils Elections (Amendment) Act, No. 17 of 2017. Further, the delimitation commission, appointed on October 2017 to demarcate wards in the Provincial Councils to hold the election under mixed proportional system, submitted the delimitation committee report in February 2018. However, it was rejected when it was submitted for the approval of the honorary Members of the Parliament on 24 August 2018. Therefore, in terms of the provisions in the Act, No. 17 of 2017 Hon. Speaker appointed a five member review committee, which was led by the Prime Minister to review the above commission report. The term of office of this committee is two months. Delimitation of electoral districts of the Provincial Councils will not be valid until the report of the Committee thereafter is submitted to the Hon. President and published through a Gazette notification.

Since the term of office of the Provincial Council in the Central, North and North Western Provinces ended in October 2018, the Election Commission took action to enlighten the Hon. Speaker, political parties represented in Parliament, other recognized political parties, civil organizations, mass media and interested citizens that the following two activities need be simultaneously carried out viz.,

17 (i) Approval of this delimitation review report and (ii) Correction of technical errors in the Provincial Councils Elections Act ( incorporating policy points when applicable)

to hold elections to the already expired Provincial Councils and elections to these three Provincial Councils promptly.

However, during this period, it was observed that some political parties and their leading politicians and citizens, through the media and through social networks, criticized the Election Commission, in particular its Chairman, that the Election Commission has the responsibility of holding the election, the Election Commission should take action to hold the election in accordance with the old proportional system with preferences, if there are disturbances to hold the election according to the newly proposed mixed proportional system and if not, the Election Commission has neglected its responsibilities.

Even though it has been pointed out that the elections cannot be held as per the new system until the tasks of the Review Committee and passing of amendments to acts in Parliament are finalized, and even to conduct elections as per the old system the Parliament has to take measures in that regard, the said criticisms are further being projected.

8. Staff

By his letter No. DMS/1288 Vol. 1 dated 31.12.2018, the Director General, Department of Management Services of the Ministry of Finance approved one post of Assistant Commissioner of Elections, Grade III/II of Sri Lanka Administrative Service for the Dispute Resolution Division of the Election Commission.

8.2.1 Mr. J. G. A. T. Kumara of Class III of Sri Lanka Accountants’ Service, who was attached to this Commission from 06.02.2018 by the letter No. MPubAd/Acsd/10/3039 dated 08.01.2018 of Secretary to the Ministry of Public Administration and Management was appointed by the Commission as the Accountant (Procurement) at the Election Commission with effect from 06.02.2018.

Regan, Sri Lanka Administrative Service Class III, attached to this Commission from 23.02.2018 by letter No. R/1/1/POSTING/2017 dated 19.02.2018 of the Secretary to the Ministry of Public Administration and Management, was appointed by the Commission as the Assistant Commissioner of Elections at District Election Office with effect from 01.06.2018.

8.2.5 Ms. W. M. D. U. Weerasekere of Class III of Sri Lanka Administrative Service, who was attached to this Commission from 23.02.2018 by letter No. R/1/1/POSTING/2017 dated 19.02.2018 of the Secretary to the Ministry of Public Administration and Management was appointed by the Commission as the Assistant Commissioner of Elections (Legal) with effect from 01.06.2018.

8.2.6 Ms. T. W. P. Kaumadi, Sri Lanka Administrative Service Class III, attached to this Commission from 23.02.2018 by letter No. 75/10/5941 dated 21.02.2018 of the Secretary to the Ministry of Public Administration and Management, was appointed by the Commission as the Assistant Commissioner of Elections for Matara District with effect from 01.06.2018.

8.2.7 Mr. S. Achchuthan, Sri Lanka Administrative Service Class I, attached to this Commission from 17.07.2018 by letter No. 75/10/4384 dated 12.07.2018 of the Secretary to the Ministry of Public Administration and Management, was appointed by the Commission as the Deputy Commissioner of Elections at the Election Commission with effect from 23.07.2018.

8.2.8 Mr. M. B. M. Sufyan, Sri Lanka Administrative Service Class III, attached to this Commission from 23.02.2018 by letter No. R/1/1/POSTING/2017 dated 19.02.2018 of the Secretary to the Ministry of Public Administration and Management, was

8.2.9 Ms. A. A. Anandi of Class III of Sri Lanka Administrative Service, who was attached to this Commission from 23.02.2018 by letter No. R/1/1/POSTING/2017 dated 19.02.2018 of the Secretary to the Ministry of Public Administration and Management, was appointed by the Commission to the post of Assistant Secretary at the Election Commission with effect from 26.10.2018.

8.2.10 Mr. W. W. K. J. Fernando, Sri Lanka Administrative Service Class I, attached to this Commission from 08.10.2018 by letter No. 76/1/15/18(I)XV Volume dated 28.09.2018 of the Secretary to the Ministry of Public Administration and Management, was appointed by the Commission as the Deputy Commissioner of Elections for Kalutara District with effect from 15.11.2018.

8.2.11 Mr. S. Sudakaran, Sri Lanka Administrative Service Class I, attached to this Commission from 02.11.2018 by letter No. 76/1/15/18(I)XV Volume dated 28.09.2018 of the Secretary to the Ministry of Public Administration and Management, was appointed by the Commission as the Deputy Commissioner of Elections for with effect from 15.11.2018.

8.2.12 Mr. K. U. Chandralal, Sri Lanka Administrative Service Class I, attached to this Commission from 01.11.2018 by letter No. 75/10/4183 dated 15.10.2018 of the Secretary to the Ministry of Public Administration and Management, was appointed by the Commission as the Deputy Commissioner of Elections for Galle District with effect from 15.11.2018.

8.2.13 To fill the vacancies of the Public Management Assistants’ Service in the Election Commission, newly recruited officials of the Public Management Assistants’ Service were provided by the Ministry of Public Administration and Disaster Management i.e. 36 new officers on 15.05.2018, 03 new officers on 19.10.2018 and one new officer on 29.10.2018, respectively.

8.2.14 Applications were called to fill in the vacancies at Grade III in the Drivers Service of the Election Commission by publishing a public notice and a notice on the website of the Commission and thereby action was taken to provide permanent appointment letters to 05 qualified persons and another 02 qualified persons with effect from 04.01.2018 and 15.08.2018, respectively. After these recruitments, one other driver vacancy is left.

20 8.3 Promotions (Staff Grade)

8.3.1 Mr. M. A. P. C. Perera, Special Class of Sri Lanka Administrative Service who was serving as the Additional Commissioner of Elections (Parliamentary Elections) at the Head Office, was appointed to the post of Commissioner General/Director General of Elections at the Election Commission with effect from 23.08.2018.

8.3.2 Due to the retirement of Mr. M. A. P. C. Perera, the Commissioner General/Director General of Elections of the Election Commission, on 29.11.2018 Mr. M. M. Mohamed, Special Class of Sri Lanka Administrative Service, who was serving as the Additional Commissioner of Elections (Legal and Investigation) at the Head Office, was appointed to the post of the Commissioner General/Director General of Elections at the Election Commission with effect from 29.11.2018.

8.3.3 Mr. H. R. P. Peiris, Special Class of Sri Lanka Administrative Service, who was serving as the Deputy Commissioner of Elections of Kalutara District Election Office was appointed to the post of Additional Commissioner of Elections (Parliamentary Elections) at the Head Office with effect from 15.08.2018.

8.3.4 Mr. G. R. A. K. Gamlath, Class I of the Sri Lanka Accountants’ Service, who was serving as the Chief Internal Auditor, was appointed as the Chief Accountant with effect from 09.05.2018.

8.3.5 Mr. Gamlathge Dilip Nishantha De Silva, Class II of Sri Lanka Administrative Service, who was serving as the Assistant Commissioner of Elections of Kegalle District Election Office was appointed to perform the duties of the Deputy Commissioner of Elections at District Election Office with effect from 15.05.2018.

8.3.6 Ms. Sujani Yasarathna of Sri Lanka Accountants’ Service Class I, who has served as the Accountant (Payments) at the Head Office, was appointed to the post of Chief Internal Auditor with effect from 01.08.2018.

8.3.7 Mr. Suranga Ambagahatenne, Class III of Sri Lanka Administrative Service, who was serving as the Assistant Commissioner of Elections at Ratnapura District Election Office was appointed to perform duties in the post of Deputy Commissioner of Elections at Ratnapura District Election Office with effect from 24.08.2018.

8.3.8 Mr. Nalaka Ratnayake, Class III of Sri Lanka Administrative Service, who was serving as the Assistant Commissioner of Elections (Admin) at the Head Office was appointed to perform

21 duties in the post of Deputy Commissioner of Elections at Kalutara District Election Office with effect from 03.09.2018.

8.3.9 Mr. Saman Sri Ratnayake, Special Grade of the Sri Lanka Administrative Service, who has served as the Additional Commissioner of Elections at the Head Office (Local Authorities Elections), was appointed to the post of Additional Commissioner of Elections (Admin), in addition to his permanent post, with effect from 01.11.2018.

8.4 Promotions (Non-Staff Grade)

8.4.1 Since they passed the Open Competitive Examination for recruitment to Grade III of Public Management Assistants' Service, Miss. L. Sulochana, Grade III Document Assistant of the Election Office, Ms. H. M. H. D. Ratnayake, Grade III Document Assistant of the Head Office and Mr. M. S. Ahamed, Grade III Office Employees Service of the Election Office received new appointments at Grade III of the Public Management Assistants’ Service in the Election Commission.

8.4.2 Similarly, employees of Office Employees Service, namely, Mr. R. G. R. K. Wijesinghe and Mr. T. M. L. K. Gnanathilake of Polonnaruwa District Election Office, Mr. M. K. M. Sakeer of Election Office, Mr. J. M. D. S. Bandara of Nuwara Eliya District Election Office, Mr. M. S. Ahamed of Hambantota District Election Office were released from their posts in the Office Employees Service after their service on 13.05.2018 to assume duties at Grade III of the Public Management Assistants’ Service since they passed the open competitive examination for recruitment to Grade III of Public Management Assistants’ Service.

8.5.6. Mr. Sajith Welgama of the Sri Lanka Administrative Service Class III, who has served as the Assistant Commissioner of Elections for Trincomalee District was appointed as the Assistant Commissioner of Elections for Kegalle District with effect from 10.04.2018.

8.5.7. Mr. P. S. Pathirana of Sri Lanka Administrative Service Class III, who has served as the Assistant Commissioner of Elections at the Election Commission, was appointed as the Assistant Commissioner of Elections for Nuwara Eliya District with effect from 10.04.2018.

8.6.1. Mr. H. W. N. Kumara of Class 1 of the Sri Lanka Accountants Service, who served as the Chief Accountant of the Election Commission, was released from the service of the Election Commission from 08.05.2018 to assume duties in the National Procurement Commission, according to the letter No. MPubAd/ACSD/Transfer Policy dated 27.09.2017 issued by the Secretary to the Ministry of Public Administration and Management. We gratefully appreciate the service rendered to the Election Commission by him.

8.6.2. Miss. K. A. R. S. Hemachandra of Class 2(II) of Sri Lanka Information and Communication Technology Service, who served as the Information and Communication Technology Officer of the Election Commission was released from the service of the Election Commission on 29.06.2018 to assume duties at the Department of Inland Revenue in terms of the letter No. CS/ICTS/02/0631 dated 09.06.2018 of the Secretary to the Ministry of Public Administration, Management and Law & Order. The service rendered to the Election Commission by her is appreciated.

8.6.3. Mr. A. B. I. De Silva, Special Class of Sri Lanka Administrative Service was released from the post of Additional Commissioner of Elections (District Coordinator) of the Election Commission with effect from 13.07.2018, to enable him to assume duties in the Southern Provincial Council as per letter No. 75/10/3746 dated 11.07.2018 of the Secretary to the Ministry of Public Administration and Management. The service rendered to the Election Commission by him is appreciated.

8.6.4. According to the letter No. 75/10/4984 dated 03.08.2018 of the Secretary to the Ministry of Public Administration and Management, Mr. R. R. A. S. K. Ratnayake, Class III of Sri Lanka Administrative Service who served as the Assistant Commissioner of Elections of Anuradhapura District was released from the service of the Election Commission to assume duties as the Divisional Secretary of Nochchiyagama with effect from 13.08.2018. The Service rendered by him to this Commission is appreciated.

24 8.7.Transfer from the Election Commission (Non-Staff Grade)

8.7.1. Since Mr. D.M.C.P. Dissanayake, who served attached to the Moneragala District Election Office as an O.E.S. III, was qualified to be appointted to a post of Grade III Drivers’ Service of the Election Commission, steps were taken to permanently release him from the Office Employees Service after his service up to 03.01.2018 to assume duties in a post of Grade III of Drivers’ Service.

8.7.2. As Ms. W. G. T. P. Wickramaratne of Public Management Assistants’ Service III, who served attached to Gampaha District Election Office, has been offered an appointment to a post of Sri Lanka Teachers’ Service Class III Grade 1 (A), she was released permanently from the Public Management Assistants’ Service after her service up to 21.07.2018 enabling her to assume the duties of that post.

8.7.3. Mr. R. Niruban, O. E. S. III of District Election Office was permanently released from the Office Employees Service after his service up to 04.08.2018 since the Ministry of Education, Cultural Affairs, Sports and Youth Affairs of Northern Province offered him a Graduate Teacher appointment.

8.7.4. Ms. R. P. T. D. Weerasinghe of Kurunegala District Election Office, who was in the Public Management Assistants’ Service III, was permanently released from the Public Management Assistants’ Service after her service up to 12.10.2018 due to her appointment to the post of Assistant Bursar of the North Western University.

8.7.5. Since Mr. W. V. S. L. Weerasinghe of the Public Management Assistants’ Service III, who served attached to the Elections Secretariat, was appointed to the post of Agrarian Development Officer Grade II, he was permanently released from the post of the Public Management Assistants’ Service after his service up to 15.11.2018 enabling him to assume the duties of his new post.

8.7.6. Ms. S. Archchana of the Public Management Assistants’ Service III, attached to the Trincomalee District Election Office, was permanently released from the Public Management Assistants’ Service after serving up to 30.11.2018 due to her appointment as the Assistant Registrar of South Eastern University of Sri Lanka.

8.7.7. Eight officers of the Public Management Assistants’ Service were transferred from the Election Commission under annual transfers of 2018.

25 8.7.8. Seven officials of Public Management Assistants’ Service were transferred from the Election Commission without replacements.

8.8. Officers transferred to the Election Commission

8.8.1. Eight officers of Public Management Assistants’ Service, who were transferred to the Election Commission under annual transfers 2018, reported to the duty.

8.8.2. Transfers of 09 officers of Public Management Assistants’ Service, who expressed their willingness to come to this Commission under inter - departmental transfers, were made on the approval of the Election Commission.

8.8.3. Ministry of Public Administration and Disaster Management provided 36, 03 and 01 new officers of the Public Management Assistants’ Service with effect from 15.05.2018, 19.10.2018 and 29.10.2018, respectively, to fill the vacancies existing at the Public Management Assistants’ Service of the Election Commission.

8.9. Retirements

8.9.1. During the year 2018, 02 staff grade officers, 18 officers of Public Management Assistants’ Service, 06 members of Office Employees’ Service and 02 members of Drivers’ Service of the Election Commission retired from service.

8.9.2. The First Commissioner General of the Election Commission, Mr. R.M.A.L Ratnayake (Special Grade of Sri Lanka Administrative Service) retired after his service on 21st August 2018, after more than 33 years of public service in the Department of Elections/Election Commission. Since 1986, he has served as an Assistant, Deputy Commissioner of Elections and rising in 2011 to be an Additional Commissioner of Elections and has served in Trincomalee, Nuwara Eliya, Puttalam and Kegalle Districts. This opportunity is taken to appreciate the service rendered to the Department of Elections as well as to the Election Commission by him.

8.9.3. Mr. M. A. P. C. Perera, Sri Lanka Administrative Service (Special Grade), successor of Mr. R. M. A. L. Ratnayake took action to retire from the public service after his service on 28 November 2018 as the Commissioner General. He, who joined the Sri Lanka

26 Administrative Service in 1985, is an experienced person who has served as an Assistant Commissioner of Elections in Polonnaruwa and Kegalle districts from 1986 respectively, as the Senior Assistant Commissioner of Elections in Ratnapura District from 1996, as an Deputy Commissioner of Elections in Gampaha and Ratnapura Districts from 2011 and as an Additional Commissioner of Elections in Elections Secretariat since 2016. The Service rendered by him is appreciated.

8.9.4. Public Management Assistants namely, Ms. P. K. Munasinghe of Kalutara District Election Office, Ms. R. A. K. Ranathunge of Kegalle District Election Office, Mr. G. K. Prabhath Bandu of Galle District Election Office, Mr. W. S. M. Chandrasena of District Election Office, Mr. M. P. P. Gamini of Gampaha District Election Office, Ms. T. I. Jasenthuliyana of Kalutara District Election Office, Ms. K. L. A. Vajira Kamburugamuwa of Anuradhapura District Election Office, Ms. T. Malini of Batticaloa District Election Office, Ms. T. M. W. S. Malik of Election Office, Mr. H. M. S. A. K. Dehikumbura of Kurunegala District Election Office and employees of Drivers’ Service namely, Mr. K. A. T. K. Karunasekere of Gampaha District Election Office and Mr. R. M. Jayathissa of Moneragala District Election Office retired during the year 2018. The service rendered to the Department of Elections/Election Commission by all of these retired persons, for 25 years or more than 30 years by some officers, is commended. The detailed report of the retired officers and employees is shown as Table XXIII.

9. Sudden Deaths While On Election Duties

Mr. M. K. Udara Lakmal (Office Employees' Service III), who was recruited on 02.10.2014 for Office Employees' Service, met with an accident and died on 03.02.2018 while on election duties of the Local Authorities Election then due to be held on 10.02.2018. The service rendered by him to the Department of

27 Elections and the Election Commission within a very short period of time is commended.

10. Training

10.1. Local

10.1.1. Officers of the Election Commission were participated in the training courses conducted by the Department of Public Finance, Department of National Budget, Divisional Secretariat of Sri Jayawardenepura, National Institute of Language Education and Training, Miloda Institute, Institute for Development Administration of Sri Lanka, Skills Development Fund Institute with the aim of improving the service efficiency and effectiveness.

10.1.2. Four operational and evaluation training workshops to create awareness of the implementation of progress review activities in the programs of four-year strategic plan 2017-2020 according to the information technology systems have been conducted in Kurunegala, Moneragala, Vavuniya and the Head Office.

10.1.3. The training of trainers programs were conducted with the assistance of the International Foundation for Electoral Systems at the Ohiya training institute affiliated to the Management Development Institute of the Uva Provincial Council from 27.06.2018 to 29.06.2018, in order to assist the implementation of awareness programs in the Strategic Plan expeditiously.

10.1.4. A Leadership Workshop to implement awareness programs stated in the Strategic Plan was held on 05.07.2018 and 06.07.2018 at the Gateway Hotel (Airport Garden Hotel) in Katunayake with the participation of 30 staff officers of the Head Office of the Election Commission and the District Election Offices.

10.1.5. A training workshop on the strategic plan for the staff officers who came to the Election Commission after 2016 was held at the Election Commission on 27.11.2018.

10.1.6. An orientation program for Public Management Assistants and Development Officers who came to the Election Commission on new appointments and transfers was held at the Sarvodaya Development Education Institute, Bandaragama on 13, 14 and 15 August 2018.

10.1.7. Steps were taken to conduct training programs on procurement, document maintenance, report keeping and banking of daily

28 receipts, in the Sinhala and Tamil Languages, to Deputy Commissioners of Elections/Assistant Commissioners of Elections/Chief Public Management Assistants/officers in charge of Accounting (1, 2 and 3)/officers in charge of the strategic plan/officers in charge of stores, by the officers of the Auditor General's Department.

10.1.8. On the instructions of the Election Commission and in relation with the participatory strategic plan 2017 - 2020, a capacity building training program for developing knowledge on this participatory strategic plan, developing skills such as more efficient and productive performance, self-confidence, teamwork, risk handling of officers of the Head Office and Colombo District, Colombo City, Moneragala, Ratnapura, Badulla, Ampara, Nuwara Eliya, Matara and Hambantota Election Offices, was conducted at Uva Kudaoya Commando Regiment Headquarters from 16.12.2018 to 18.12.2018, with the coordination of the Assistant Commissioner of Elections, Moneragala.

10.2. Overseas Conferences and Official Tours

10.2.1. Of the official visits made by the Chairman, Members and other officers of the Election Commission from January 1, 2018 to December 31, 2018, observation of the 2018 Presidential Election in The Maldives and the Parliamentary Election in Bangladesh are momentous occasions and the opportunity given to the Chairman and several officials of the Election Commission to attend the 9th Forum of the Election Management Bodies of South Asia helped to identify the innovations of each electoral management institution in the region.

10.2.2. Prof. S. R. H. Hoole, Member of the Election Commission attended the workshop on Assessment of Fair Elections held in Indonesia from 01 to 04 May 2018.

10.2.3. Mr. H. M. T. D. Herath, Secretary of the Election Commission has attended the program on election education in Indonesia from 26 – 28 June 2018 and reported that there have been extensive discussions on the holding of free and fair elections.

10.2.4. Mr. Mahinda Deshapriya (Chairman, Election Commission), Mr. Channa P. de Silva (Director, Research and Planning) and Mr. Rizan M. A. Hameed (Coordinating Secretary to the Chairman) participated in the 9th Forum of the Election Management Bodies of South Asia held in Bangladesh from 05 to 07 September 2018.

29 10.2.5. Prof. S. R. H. Hoole (Member, Election Commission) and Mr. Rasika Peiris (Additional Commissioner of Elections – Parliamentary Elections) participated in observing the Maldives presidential election 2018, from 20 to 26 September 2018 and provided a detailed report on the poll.

10.2.6. Mr. M. M. Mohamed, Additional Commissioner of Elections (Legal and Investigations) participated in the discussion on the independence of election management institutions held in The Philippines from 8 to 10 October 2018, where he had extensive discussions on issues that have arisen in the holding free and fair elections and submitted a report in that regard.

10.2.7. Mr. K. J. S. Madhawa, Deputy Commissioner of Elections of Gampaha participated in the International Conference of Election Commissioners and Election Authorities held in Mumbai, Maharashtra State, India on 25 and 26 October 2018.

10.2.8. Mr. N. J. Abeyesekere (Member, Election Commission), Mr. H. M. T. D. Herath (Secretary, Election Commission) and Mr. J. A. S. P. Jayasinghe (Deputy Commissioner of Elections, Admin) participated in the Parliamentary election observation program in Dhaka, Bangladesh from 27 to 31 December 2018 and a report was also submitted on the observations of the above election.

10.3. Foreign Trainings and Scholarships

10.3.1. Mr. T. A. C. N. Thalangama (Deputy Commissioner of Elections, ), Mr. W. A. L. Wickramarachchi (Assistant Commissioner of Elections, Nuwara Eliya), Mr. S. Pulasthi Pathirana (Assistant Commissioner of Elections, Election Commission) and Mr. Sreen Yapa Boralessa (Assistant Commissioner of Elections, Local Authorities) took part in Capacity Building for Voter Registration, for election Officials, (BIMSTEC Member Countries) programme held in India from 26 to 30 March 2018.

10.3.2. Mr. M. K. S. S. Ratnayake (Additional Commissioner of Elections, Local Authorities), Mr. T. A. C. N. Thalangama (Deputy Commissioner of Elections, Kandy), Ms. G. K. S. C. K. Yasarathna (Accountant, Payments), Mr. Nalaka Ratnayake (Assistant Commissioner of Elections, Admin), Mr. Suranga Ambagahathenne (Assistant Commissioner of Elections, Ratnapura), Mr. Indunil Bandara (Assistant Commissioner of Elections, Gampaha) and Mr. Sajith Welgama (Assistant Commissioner of Elections, Kegalle) participated in the Training Workshop on Public Administration for Public Officers of Asian Countries held in China from 04 to 24 June 2018.

10.3.3. Ms. R. K. D. K. K. Ratnayake (Assistant Director, Information Technology) and Mr. W. A. Ranjan Nishantha (Assistant Director, Information Technology (Actg.)) took part in the training program on Electoral Best Practices, Data Management and Usage of Electronic Voting Machines held in The Philippines from 03 to 07 July 2018. A report was also submitted on the use of information technology at the elections, including the facts obtained from the above program.

10.3.4. Mr. E. P. T. Gayan Pathirana (Assistant Commissioner of Elections, Moneragala), Mr. D. T. I. Wickramaratne (Assistant Commissioner of Elections, Ampara) and Mr. R. C. Amalraj (Assistant Commissioner of Elections, Kilinochchi) participated in the Election Management Capacity Building Programme held in South Korea from 01 to 11 August 2018.

10.3.5. Mr. Channa P. de Silva, Director (Research and Planning) participated in the Seminar for Sri Lanka on Project Identification, Planning, Implementation and Management held in China from 03 to 25 August 2018.

10.3.6. Ms. W. M. D. U. Weerasekere (Assistant Commissioner of Elections, Legal), Ms. A. N. Nuzrath (Assistant Commissioner of Elections, Local Authorities) and Ms. R. K. D. K. K. Ratnayake (Assistant Director, Information Technology) participated in the Capacity Development Program on Technology related to the Elections conducted by India International Institute of Democracy and Election Management (IIIDEM), India from 01 to 08 September 2018 and according to these officials the experience gained from there is very important.

10.3.7. Mr. J. A. S. P. Jayasinghe (Deputy Commissioner of Elections, Admin) and Ms. G. K. S. C. K. Yasarathna (Chief Internal Auditor) participated in the Diploma in Public Procurement and Contract Administration (DIPPCA) Partial Fulfilment – 2nd Country Visit: held in Japan from 09 to 19 September 2018.

10.3.8. Chief Financial Officer Mr. E. A. Weerasena attended the international conference on Public Financial Management in Abu Dhabi from 21 to 25 of September 2018.

10.3.9. Mr. S. Achchuthan (Deputy Commissioner of Elections, Special Projects), Mr. T. Akilan (Deputy Commissioner of Elections, Jaffna), Mr. S. Y. Boralessa (Assistant Commissioner of Elections, Local Authorities) and Mr. J. U. Piyanath (Administration Officer) participated in the Specialized Training Program on ICT-Based

31 Election Management for Policy-Making Authorities held in South Korea from 14 to 19 October 2018.

10.3.10. Director, Information Technology, Mr. S. Ekanayake participated in the Specialized Training Program on ICT-Based Election Management for Engineers held in Korea from 14 to 26 October 2018 and also took action to conduct a session to disseminate the experience obtained.

10.3.11. Additional Commissioner of Elections (Local Authorities), Mr. M. K. S. S. Ratnayake, attended the international workshop on Preventing Election Violence in Asia – Tools for Practitioners and Policymakers held in Bangkok, Thailand from 13 to 15 November 2018.

10.3.12. Ms. Sanduni Maleesha Ratnayake (Development Officer), Coordinating Secretary to the Commissioner General/Director General of Elections attended the Certificate Course on Office Productivity conducted under the Indian Technical & Economic Cooperation Programme from 27 November 2018 to 06 January 2019 and a program has been prepared to practically use the experiences, she gained on office productivity, in the future.

10.3.13. Mr. M. B. M. Sufyan (Assistant Commissioner of Elections, Anuradhapura) and Mr. K. Kantheepan (Assistant Commissioner of Elections, Mullaitivu) participated in the Capacity Development Program on Election Management conducted by India International Institute of Democracy and Election Management (IIIDEM) in India from 02 to 14 December 2018.

11. Constructions and Assets

11.1. Constructions and Repairs

11.1.1. Object - 2001 In terms of the amended Procurement Plan as at 31.12.2018 out of 64 items under the object 2001 for constructions/repairs in the year 2018, 58 items had been completed by 31.12.2018.

11.1.2.Object - 2104 The construction work of the official quarters of the Assistant Commissioner of Elections of Batticaloa is nearing completion. Action was taken to pay the Mobilization Advance to the Building Department with regard to the construction of the Election Office.

12. Audit and Finance Particulars

12.1. The cost incurred for the preparation of the electoral register of the year 2018 was approximately Rs.133.5 million. It shows a Rs. 3.5 million

33 increase compared to the cost incurred in the year 2017 in this regard that is Rs. 130 million and the increment percentage is 2.69%.

12.2. The recurrent expenditure in the years 2018 and 2017 was Rs. 4,052.69 million and Rs. 788.6 million, respectively. The recurrent expenditure as a whole shows a huge increase when compared to the previous year. Incurring of costs for activities of Local Authorities Election, which was held in 2018, caused the increase in recurrent expenses.

12.3. A total of 14.7 million rupees was spent on the awareness programs including the activities relating to Voters’ Day, which is held on 1st of June every year.

12.4. The capital expenditure in 2018 was Rs. 52.57 million and while compared to the year 2017, it dropped by Rs. 53.23 million. Local authorities elections held in the first quarter of the year and non-recipience of adequate imprest required for payments from the Treasury, affected these expenses.

12.5. Out of 250 applications of officers/employees for distress loans, 244 were granted in this year and loans up to Rs.35.65 million were paid out.

12.6. Revenue earned in the year 2018 by issuing extracts of the electoral register was Rs.5.91 million. It does not show a considerable increase when compared with the previous year since the revenue earned in 2017 was Rs. 5.87 million.

12.7. The compilation of the electoral registers as books was limited and their preparation as CDs was done. The income earned in this year by selling them was about Rs.9 Lakhs. This income has received due to the sale of CDs to the political parties since activities relating to hold the local authorities elections in this year have been started.

12.8. Rs. 5.11 million was spent on local and foreign training courses of officers/employees to improve the performance of the staff of the Election Commission. This expenditure has increased by nearly Rs. 2.71 million compared to 2017.

12.9. During the year 2018, 28 Audit Queries have been carried out by the Internal Audit Division and 13 Audit Reports were submitted. Also, four Audit and Management meetings were held as one for each quarter.

12.10. For the year 2018, seven audit queries were received till 31.12.2018 under various subjects. Arrangements were made to answer them within the due period of time.

34 12. Conclusion

The Department of Elections that had been in existence for a period of 60 years was established as the Election Commission in terms of the provisions in the 19th Amendment to the Constitution, has not confined to its fundamental duties such as certification of the register of electors and conducting of elections. This has expanded its tasks according to the four year strategic plan to achieve the wide vision “A nation that safeguards universal franchise “and as its mission “To raise critical consciousness among all stakeholders, ensuring the protection of people’s rights and conduct free, fair and credible elections efficiently and effectively that safeguard the people’s sovereignty and universal franchise based on democratic principles“. Guidance of this highly challenging responsibility through an accurate path is now a major function of the Election Commission and in the year 2018, this work was successfully carried out.

Last Local Authorities Election, was an important and significant event since it was the first election held after the establishment of the Election Commission, the local authorities election held simultaneously throughout Sri Lanka and the introduction of a new electoral system consisting of proportional and ward systems. However, it should be specifically noted that the Commission was able to successfully achieve this challenging target and it could be properly achieved due to the support given by the officers of the Election Commission as well as every stakeholder including the officers of external institutions. It should also be stated that at this election opportunity was made to implement some measures, which were not used until this election to enforce election laws, to hold the election freely and fairly.
