Political legitimacy and ‘the fact of expertise – (EPISTO) is a five year research project hosted by ARENA Centre for European Studies, University of Oslo. The EPISTO project is financed by the Research Council of Norway. EPISTO inquires into the role of knowledge and expertise in modern democracies. Epistocracy means rule of the knowers, and the project has a particular focus on ‘epistocratic’ developments in the European Union (EU). The kick-off conference took place in Oslo on 4 and 5 April 2013 and was the first of several international events to take place within the project. This report includes a majority of the papers presented at this conference, which was organized around three main themes: 1. Expert-rule and democratic legitimacy 2. The role of knowledge and expertise in EU governance 3. The European Commission’s use of expertise Discussions around the first theme concentrated on implications of modern democracies’ knowledge and expertise dependence for political and democratic theory, with a particular focus on epistemic approaches to deliberative democracy. Contributions addressing the second theme discussed general trends and developments in the EU with regard to the role of expertise and experts in political decision-making, the implications for the EU’s democratic legitimacy, and analytical strategies for studying expertise and democratic legitimacy in an EU context. The last theme focused on the European Commission’s use of expertise and the Commission’s expert group system in particular. I want to thank all authors for their contribution and cooperation, and Kadri Miard, Linn Hege Lauvset, Veronica Thun, Silje H. Political legitimacy and ‘the fact of expertise’ Cathrine Holst ARENA Centre for European Studies, University of Oslo The role of knowledge in political decision-making has been a central topic in normative political theory at least since Plato in The Republic recommended states to be run by philosopher kings. Recently, the topic has been re-introduced by political philosopher David Estlund in his discussions of the legitimacy of ‘epistocracy’, a ‘rule of the knowers’, referring to the Greek word episteme (Estlund 2003, 2008: 1– 20, 206–222). Estlund’s discussion is a response to the epistemic turn in normative political theory discussions of legitimacy: the idea that a political rule to be legitimate must deliver good outcomes, or what Thomas Christiano (2013) refers to as ‘truth-sensitive’ or ‘truth- tracking’ decisions.1 Estlund supports the turn to epistemic legitimacy criteria, but along with others he worries about the implications: If ‘true’ decisions and outcome improvements are all we have to consider, is it not likely that a rule of the knowledgeable and educated will outperform a rule of the people? (Martí 2006; Lafont 2006; Peter 2011). 1 Epistemic justifications of political rule are seldom regarded as sufficient. A common claim is rather that a normative defense of democracy must refer both to democracy’s instrumental value, how it is a form of rule that improves on decision quality, and to the inherent value of democratic procedures. 2 Cathrine Holst This normative political theory discussion has its counterpart in worries spurred by experiences and a range of empirical studies from the last decades that highlight how contemporary governments and political decision-making processes rely extensively and increasingly on knowledge and expertise. Critics claim that democratic government as we know it is eroding as a result of growing expert power. One expression of this is the increase in depoliticised expert bodies with substantial decision-making power, such as courts, independent governmental agencies and central banks; another is parliamentary and executive institutions’ heavy reliance on expert advice. Consider for example the European Union (EU), a case often brought forward by democratic critics, where the European Commission, in addition to relying on substantial internal expertise, routinely consults around one thousand expert groups and committees with considerable powers not least with regard to agenda-setting. In addition, there are currently more than forty increasingly powerful EU agencies and the European Central Bank, perhaps the most independent of contemporary central banks, centrally determining the Union’s monetary policy, which is a decisive variable for member state economies. Furthermore, the rulings of the European Court of Justice trump member states’ court rulings and parliamentary majorities. Adding to this are the new measures that drastically reduce member states’ scope for independent fiscal policies, newly introduced in the aftermath of the euro crisis.2 These developments, in the EU and elsewhere, raise fundamental normative questions about the limits, but also of the legitimate role, of knowledge and expertise in decision-making. On the one hand, modern societies’ rely intimately on expert knowledge and judgment, and so on a division of labor between experts and non-experts. We are confronted with a seemingly unavoidable expert dependency or a ‘fact of expertise’ (Kitcher 2011, Holst 2012)3: It is impossible – and most people recognize that it is impossible – to make rational political decisions in complex societies like ours without relying extensively 2 For an instructive overview, see Lord (2012). 3 Discussions of normative legitimacy must be based on general facts about human society, such as ‘the fact of pluralism’ (Rawls 1993). A vacuum of public trust in Australia has met with the maturation of technologically competent constituents. Changing sociopolitical attitudes and perceived government corruption and inefficiency have effected demands for accountability and transparency. Two responses are visible: the digitisation of government services and original models of digital democracy. This paper dis- cusses the role distributed ledger technology plays in decentralised governance in Australia. Unless we have it, we can give nothing - either wise, or decent to the world.’ [4] There are notable trends becoming visible to even the casual Australian observer: the widening of class structures, deepening mistrust in authority, the increasing penetra- tion of more complex technology and living services that provide design solutions for operational or governance-related problems. The concurrent development of secure transmission architecture on accessible platforms creates a solutions environment that begins to address the primary obstacle to public engagement with authority and arte- facts thus far: trust. Increased voter cynicism, symptomatic of the politics of trust,1 changing patterns of media consumption, the heightened exposure of political actors to public scrutiny and poor performance in economic policy, have eroded the capacity of elected repre- sentatives to govern. In order to engage in such forecasting Jouvenel founded Futuribles, an international group that facilitated discussion about the future of advanced industrial societies. Bell chaired a Commission on the year 2000 that aimed to anticipate social problems for policy makers. The dissertation also focuses on work done by Kahn and others at the RAND Corporation and the Hudson Institute. The origin of 1960s futurism is traced to debates held under the auspices of the Congress for Cultural Freedom, especially ideas about the “end of ideology.” The supposed exhaustion of left and right-wing political ideologies produced a desire for new theories of social change.

The goal of this workshop is to provide a multidisciplinary forum to address questions such as: How to model the interactions between people, data, and digital tools that create new spaces and forms of civic action in the digital era? How to analyse emerging properties and types of knowledge in these contexts? How to design socio-technical systems that effectively leverage data and knowledge for deliberation (or other types of participation) and collective decision making? Can we design the meta-rules of the emergent ecosystems? The Workshop brings together participants from universities and research centers in Australia, New Zealand, Spain, Brazil, Israel, UK, and the USA.

    POLICY PAPERPAPER European issues n°439 Coalition Democracy in Europe 11th July 2017 Alexis Fourmont Traditionally, political parties get bad press. This “ill that is inherent to free governments”1 is often blamed for impeding the formation of broad based support, since it instils division and a “regime of misfortune”2, there, where harmony should reign. In this regard, Gustav Radbruch noted, under the Weimar Republic, the existence of party prudery (Parteienprüderie)3. This of course has largely disappeared, but resistance still exists. Depending on the specific modes of functioning and on the country, the phenomenon of the “party State” (Parteienstaat)4 theorised by Hans Kelsen after the Great War finally became established in most countries of Europe due to the generalisation of government opinion and universal suffrage5. In their role as the ‘auxiliaries of democracy’6, political parties have contributed to the creation of a certain coherence in the multitude of individual choices available. It was all the more important to organise these rationally, since the pace of the industrial revolution and urbanisation disrupted quite significantly “the old framework” of 19th century society – such as links and traditional hierarchies, as well the cohesion of social groups. Functioning as indicators of the will of the electoral corpus, they enabled the healing of its fragmentation. However, this development was only possible because of two things: it was on the one hand vital that the issue of the regime’s legitimacy be settled, i.e. that the public institutions be accepted by all of the citizens as a whole, and, on the other, that the parliamentary and extra-parliamentary branches of the political parties work in harmony.

Wired magazine and its online cousin HotWired have joined forces to produce The Netizen, a new maga­ zine/Web site providing an innovative package of daily, weekly, and monthly coverage of the 1996 presidential election, the last campaign of the unwired generation. John Heilemann is filing an up­to­the­minute diary of the campaign in his "Impolitic" column on HotWired (www.netizen.com/). Also look for Brock N. Meeks, who is reporting daily in his column "Campaign Dispatch." Remember Alvin Toffier? A year ago he was the pop futurist you could not get away from. As the supposed mentor of future­hugging Newt Gingrich ­ then at his celebrity apex ­ Toffier's views on the current political tilt were in high demand. But this year, traditional election politics are in effect, and the future has disappeared. In fact, the future is being embalmed by presidential campaigning. We say: it's time for a look ahead. The media have decamped from Toffier's front lawn, so we asked him what he and his wife, Heidi Toffler, have been contemplating lately on anticipatory democracy, grading Newt, revising the Constitution, and other matters of civilization building. Kelly: What's the relationship between the digital generation and emerging Third Wave politics? Toffler : The rise of the digital generation is part of a larger historical process, which involves culture, economics, social institutions, and so on. But it's a very powerful part. I think we're about to see an overall change in the politics of the country, during which the digital community will become much more conscious of its own political role.
