1.0 Introduction

The RIIDP is composed of selected road sections for rehabilitation and improvement under the Department of Public Works and Highways (DPWH). It is funded by the Asian Deve lopment Bank (ADB) through Loan 2836-PHI: Road Improvement and Institutional Development Project (RIIDP), with the supporting funding from the OPEC Fund for International Development (OFID).

CP Lot 4.1: North Road Project, -La Libertad Road Section is one of the road packages of the RIIDP. It starts from KM. 53 + 428.81 (Boundary point with Dumaguete City along the Manjuyod-Road Section) to KM. 108 + 967.00 (Boundary point to La libertad-Vallehermoso Road Section). From the start of the project in the Municipality of Manjuyod, the project road proceeds to a northward direction over flat, gentle terrain to rolling and mountainous terrains and traverses several towns of Negros Oriental namely, , , , and part of the Municipality of La-libertad. The entire stretch of the road is under the jurisdiction of the DPWH Negros Oriental First Engineering District with its new office site in the Municipality of Bindoy. The road section covers a gross length of 55.538 kilometers with exceptions. The exempted sections are 25 bridges (0.962 KM.) and the areas covered by the 2015 budget for DPWH Infra Project which covers a total length of 1.624 ki lometers. The road section is a combination of existing ACP that covers a length of 8.313 kilometers and existing PCCP with a length of 47.225 kilometers. The net length is 52.952 kilometers.

This 24-hour air quality and noise level sampling is conducted as part of and in compliance to the requirements of the ADB approved IEE Environmental Management Plan (EMP).

2.0 Sam pli ng Me thod ol ogy

2.1 Ambient Air Sampling

The DENR standard ambient sampling equipment and analytical procedures were used in the sampling activity. These equipment and procedures are specified below:

Particulate Matter (PM10)

Total Suspended Particulates (TSP)

Sulfur Dioxide (SO 2)

Method of Analysis: Colorimetric, Greiss Saltzman

After each sampling activity, all sam ples were preserved in an ice box while the filters that were used to collect TSP and PM1o were placed inside a sealed plastic container. The samples were immediately transported to ELARSI, INC., a DENR-EMB accredited laboratory for testing and analyses.

2.2 Noise Measurement

A precision type, digital sound level meter was used in noise measurement. The said instrument is an AM PROBE SM-10. As declared in the Certificate of Conformity, with the accuracy of 1.5d8, the sound level meter fulfills the guidelines of 89/336/ECC. The sound level meter conforms also with DIN EN 60651, (IEC651), Class 2 Standards.

Th e sound level meter was ca librated by Switchtek Measurement Systems using a Lutron Sound level calibrator model SC-940. By comparative technique, Standard Sound Generator was introduced to the AMPROBE at a constant value of 94.0 dB and at a uniform frequency of 1000 Hz. Data were gathered and tabulated.

The results of the ca libration found that there was a +-0.00 dB standard error between the reference reading and the test reading with a confidence level of not less than 95%. The procedure of the test is traceable to the requirement of OIML 88 guidelines, IEC 60942 Type II, a Standard of the NIST and National Physical Laboratories (NPL).

Right after collecting ambient air samples, in the same t wo sampling locations, Noise measurement was conducted. Fifty (50) instantaneous readings in decibels - A weighing (dBA) were recorded for about 2 to 3 minutes. Statistical values such as minimum, maximum, mean and median were determined from the readings.

3.0 The Sampling Location

The approximate locations of the sampling stations are shown in the attached sampling map and are briefly described as follows:

5.0 Discussion of Results

5.1 Ambient Air Sampling

The results of the aforementioned sampling activities were compared to the National Ambient Air Quality Standards for Source Specific Air Pollutants (NAAQSSAP) as stipulated in Table 3, Section 1, Rule XXVI, Part VI I of the Implementing Ru les and Regulations (IRR) of the Philippine Clean Air Act.

The Ambient Air Sampling for all stations was conducted on a sunny weather condition with light wind direction. The results of the sampling analysis shows that the ambient concentrations were all within the DENR Standards limit in all sampling stations.

5.2 Noise Measurement

The DENR Environmental Quality Standards for Noise is based on the 1978 Rules and Regulations of the National Pollution Control Commission. AS per these regulations, noise is measured in 11A" weighting network and 11slow response" with different limits for various time of the day and area category.

The results of noise level measurement were compared to the standards based on the existing land use within the sampling locations. All stations are located at mountain area and residential area/site, therefore considered Class C (Commercial Area). All noise level measurement were all within the DENR limit for Class C area.

The main sources of noise observed during sampling were mostly from vehicles and people passing t hru Western Nautical Highway of Jimalalud and Tayasan, Negros Oriental.

1.0 Introduction

The RIIDP is composed of selected road sections for rehabilitation and improvement under the Department of Public Works and Highways (DPWH). It is funded by the Asian Development Bank (ADB) through Loan 2836-PHI: Road Improvement and Institutional Development Project (RIIDP), with the supporting funding from the OPEC Fund for International Development (OFID).

CP Lot 4.2: Dumaguete North Road, La Libertad- Vallehermoso Road Section is one of the road packages of the RIIDP.

It starts at KM 108+967 at La Libertad- Vallehermoso Section and stretches northward up to the end of the project at KM 150+475.772 (the beginning point of Vallehermoso- San Carlos City/ Calatrava Boundary Road Section or the Bacolod North Road). It runs over a flat to rolling to mountainous terrain and traverses the town of La Libertad, and Va llehermoso and is under the jurisdiction of Negros Oriental First Engineering District Office. The road section covers a gross length of 41.509 kms with exceptions, wherein, the exempted sections are all bridges 0.332 kms and the 2015 budget for DPWH Infra Project which covers a length of 8.891 kms of road length. The road section is a combination of existing ACP covering a length of 25.655 kms and existing PCCP with a length of 15.854 kms. The net length is 32.286 kms.

This 24-hour air quality and noise level sampling is conducted as part of and in compliance to the requirements of the ADB approved IEE Environmental Management Plan (EMP).

2.0 Sampling Methodology

2.1 Ambient Air Sampling

The DENR standard ambient sampling equipment and analytical procedures were used in the sam pling activity. These equipment and procedures are specified below:

Particulate Matter (PM10)

Method of Analysis: Colorimetric, Greiss Saltzman

After each sampling activity, all samples were preserved in an ice box while the filters that were used to collect TSP and PM10 were placed inside a sealed plastic container. The samples were immediately transported to ELARSI, INC., a DENR-EMB accredited laboratory for testing and analyses.

2.2 Noise Measurement

A precision type, digital sound level meter was used in noise measurement. The said instrument is an AMPROBE SM-10. As declared in the Certificate of Conformity, w ith the accuracy of 1.SdB, the sound level meter fulfills the guidelines of 89/336/ECC. The sound level meter conforms also with DIN EN 60651, (IEC651), Class 2 Standards.

The sound level meter was ca li brated by Switchtek Measurement Systems using a Lutron Sound level calibrator model SC-940. By comparative technique, Standard Sound Generator was introduced to the AMPROBE at a constant value of 94.0 dB and at a uniform frequency of 1000 Hz. Data were gathered and tabulated.

The results of the calibration found that there was a +-0.00 dB st andard error between the reference reading and the test read ing with a confidence level of not less than 95%. The procedure of the test is traceable to the requirement of OIML 88 gu idelines, IEC 60942 Type II, a Standard of the NIST and National Physica l Laboratories (NPL).

Right after collecting ambient air samples, in t he same two sampling locations, Noise measurement was conducted. Fifty (SO) instantaneous readings in decibels - A weighing (dBA) were recorded for about 2 to 3 minutes. Statistical values such as minimum, maximum, mean and median were determined from t he readings.

5.0 Discussion of Results

5.1 Ambient Air Sampling

The results of the aforementioned sampling activities were compared to the National Ambient Air Quality Standards for Source Specific Air Pollutants (NAAQSSAP) as stipulated in Table 3, Section 1, Rule XXVI, Part VI I of the Implementing Rules and Regulations (IRR) of the Philippine Clean Air Act.

The Ambient Air Sampling for all stations was conducted on a sunny weather condition with light wind direction. The results of the sampling analysis shows that the ambient concentrations were all within the DENR Standards limit in all sampling stations.

5.2 Noise Measurement

The DENR Environmental Qua lity Standards for Noise is based on the 1978 Rules and Regulations of the National Pollution Control Commission. AS per these regulations, noise is measured in "A" weighting network and "slow response" with different limits for various time of the day and area category.

The results of noise level measurement were compared to the standards based on the existing land use within the sampling locations. All stations are located at mountain area and residential area/site, therefore considered Class C (Commercial Area). All noise level measurement were all within the DENR limit for Class C area.

The main sources of noise observed during sampling were mostly from vehicles and people passing thru Western Nautical Highway of City of Gu ihilngan, Negros Oriental.

1.1. Compliance to Environmental Permits and Licenses The Contractor has complied with the GOP statutory requirements by securing the Environmental Compliance Certificates (ECG) from the DENR-EMB. However the Local Government Unit (LGU) requirements are for renewal for 2018 as shown in the table below.

No flagman. Motorist s are going the wrong way. Flagman wrongly stationed at the middle section of the ongoing works with no PPE 2. There are not enough flagmen stationed at the work areas and are not directing traffic 24 x 7. The flagmen that are stationed are not wearing PPEs and/or don't have flags. Traffic management needs improvement. As per the Contractor's EHS officer, there are already many reports of altercations among/between irate motorists and construction workers. This issue has already come to the attention of the local police and barangay captains through informal complaints by the affected motorists.

3. The cross drain that is being constructed at Km. 74+200, Barangay Tiguib in Ayungon discharges in front of houses. There is already a written complaint by one house owner addressed to the Barangay Captain (please see attached document). As mentioned in the previous site visit, some of the cross• drains that are now under construction are not connected to waterways e.g. at Km 82+440 and Km 84+50.

IV. Recommendations

1. Improve traffic management. Strictly require all workers especially the flagmen to wear PPEs at al l times during works. Follow the requirements on the proper warning signs and dimensions as specified in the contract. 3. Identify a specific area for storage of other wastes/Material Recovery Facility (MRF) (e.g . busted lamps, used tires, empty drums, etc.) and should be properly segregated. 6. Background:

The site visit was conducted to follow-up on mitigating measures undertaken by the contractor to address the environmental issues raised during the meeting between the DPWH-UPMO, CSC and ADB which are also contained in the Memorandum of the Director of DPWH-UPMO• RMC II to the contractor dated March 16, 2018 (Appendix A). Commitment to comply was made by the Project Manager Mr. Huang during a meeting with Engr. Baguio and the CSC RE Engr. Batiao and QE Engr. Onas at the CSC office (please see Appendix B).

I. Background:

The site visit was conducted together with the ADB Mission on April 18-20, 2018 to observe ongoing work activities and follow-up on the implementation of environmental corrective actions agreed during the October 2017 Mission.

II. Site Visit Findings

Contractor's Camp, Batching Plant and Stone Crusher Compound V I -.,

1. Fugitive cement dust during cement loading. Direction depends on wind direction and may affect motorists plying the road beside the batching plant. Cement loading system should be improved. 2. Some workers are not wearing PPEs speciall y the workers of the subcontractor/s. Wearing of PPEs by the workers should be strictly implemented.

3. Settling pond at the batching plant is full causing cement to flow through a small canal. The settling pond should regularly be cleaned. Ill. Actions Taken on Findings of Previous CTC Site Visits and Recommendations

I. Compliance to Statutory Requirements and Contract

1.1. Compliance to Environmental Permits and Licenses

The Contractor has still not complied with the GOP statutory requirements by securing the Environmental Compliance Certificates (ECC) from the DENR-EMB. While the 3rd party supplier quarries have already complied, the batching plant and construction and workers camp compound which is owned by the Contractor is yet to secure an ECC. Simi larly, a building permit has already been issued to the Contractor's facilities but there is yet no Mayor's permit.

The Contractor has already submitted a Contractor Environmental Management and Monitoring Plan (CEMMP). However, as per comments from the ADB, the CEMMP needs to be revised and resubmitted. There is yet no submission of the revised CEMMP. The Contractor also did not conduct 24-hr air quality and noise level sampling for the 2nd semester of 2017 at sensitive areas along the project alignment. The dust has been the subject of numerous informal complaints but has not been acted upon by the Contractor.

5. Waste segregation bins are present. However, these were not properly utilized. Solid wastes were also noticed at the motor pool and storage areas in the compound. A structure labeled as a material recovery facility (MRF) was constructed but is still not being used. Recyclable materials were found outside of the MRF.

IV. Recommendations

1. Implement mitigating measures to prevent mud from being carried into the national highway which causes dust when it dries by improving the muddy access road in the contractor's camp/batching plant compound. Water showering on the mud to prevent dust is not the solution as washed away mud goes to the canals and contributes to the siltation of the waterways. 2. Secure the ECC for the contractor's camp/batching plant and the stone crushing plant, if required, as soon as possible. The facility is already in violation of PD 1586 and its implementing rules and regulations. 3. The Safety Officer should attend training and apply for PCO accreditation as required by the DENR-EMB. 4. Waste segregation bins installed in the batching plant should be properly used. Orient workers on proper solid waste management and improve housekeeping. 5. Use the newly constructed Material Recovery Facility (MRF) for storage of other recyclable wastes/ (e.g. busted lamps, used tires, empty drums, etc.) and should be properly segregated. 6. Make a drainage with impermeable flooring around the motor pool draining into an oil and water separator. Specify final disposal procedure for used oil and other materials in the MRF. 7. Prepare and submit CEMP soonest. 8. Conduct 24-hour air quality (TSP and PM10) and noise level sampling at areas with sensitive receptors for the 1st semester of 2018 as stipulated in the ADB-IEE EMB .

Contractor's Camp/ Batching Plant 2. Due to the uncontrolled release of cement dust, the areas surrounding the batching plant are already stained with cement dust including the contractor's structures, vegetation, trees and residences. Overall the situation at the surrounding areas during batching operations is unhealthy and polluted.

3. The waterway at the side of the batching plant needs to be checked as it seems to be already also polluted.

I. Background:

The site visit was conducted together with the ADB Mission on April 18-20, 2018 to observe ongoing work activities and follow-up on the implementation of environmental corrective actions agreed during the October 2017 Mission.

II. Site Visit Findings

Contractor's Camp, Batching Plant and Stone Crusher Compound 1. The issue on cement dust from cement loading has been addressed with the installation of an enclosure. However, fugitive dust is still observed at the uncovered portion located just above the ground. t""i.;=;;;;;;;;;;;

2. Workers loading cement in the concrete batching plant are subject to prolonged exposure to fine cement dust without the correct PPEs. Contractor should provide proper PPE and minimize cement dust exposure by reducing the number of work hours and/or rotating workers in this work area.

3. Drainage and road has been improved beside the contractor's camp. However, the cross• drain at the national highway has reportedly been blocked and therefore the water cannot flow causing flooding at the residential area. Actions Taken on Findings of Previous CTC Site Visits and Recommendations

Findings:

I. Compliance to Statutory Requirements and Contract

1.1. Compliance to Environmental Permits and Licenses

The Contractor has complied with the GOP statutory requirements by securing the Environmental Compliance Certificates (ECC) from the DENR-EMB for the Contractor's camp/batching plant compound. However, the contractor is reminded that one of the conditions of their ECC is the regular submission of quarterly self-monitoring reports (SMR) and semi-annual compliance monitoring reports (CMR) to the DENR-EMB. Non• submission will result to Notice of Violations from the DENR-EMB. Compliance to this requirement will be checked in the next site visit.

The LGU building permit for the contractor's office and workers camp has already been acquired while those for the batching plant, stone crusher warehouse and motor pool have already been applied for and are in process.

The Contractor does not operate a quarry but buys aggregates from suppliers thus there is no need to verify statutory compliance.

II. Field Inspection Findings

Project Alignment

1. PCCP pouring activity was ongoing at Sta 1258+104 to 200 during the site visit. It was observed that the workers were wearing PPEs, warning sign is in place and 3 flagmen stationed at the beginning, middle and end of workarea directed traffic.

2. Warning signs were also installed in other work areas. However, there is a need to check some warning signs and yellow tapes that were already damaged or displaced. Contractor's Camp/ Batching Plant/ Stone Crusher

Previous site visit on Jan 24, 2018 Site visit on March 7, 2018 3. The overall housekeeping in the Contractor's camp/ batching plant/ stone crusher compound has improved. Further improvement efforts are continuously being undertaken by the contractor.

4. The batching plant, stone crusher and trucks and heavy equipment were in operation during the visit. There was no noticeable air pollution from the vehicles or dust from vehicle movement observed. Engineer's Facilities

6. Construction was ongoing at the Engineer's facilities during the time of the visit. Workers were observed to be wearing PPEs. However, trash were scattered at the construction site and no trash bins were observed. The work area is beside a creek/stream.

Update: The littered area at the Engineer's office work site was immediately cleaned-up by the contractor on March 8, 2018

No. 13, Series of 1998, On Occupational Safety and Health in the Construction Industry, has instructed thP said contractor in a letter dated Januory 16, 2018 (refer to attachment) to carryout the necessary corrective and mitigating precautionary meaures, i.e., provide and maintain advance warning and directional signs, to preclude any untoward incident to the travelling public and safety of the workers. Introduction:

The site visit/ environmental monitoring was undertaken to ensure that the required mitigation measures in the EMP were implemented, assess whether the action/s has adequately protected the environment, and determine whether any additional measures may be necessary. The site visit/ environmental monitoring also followed-up on the actions taken on the previous site visit findings.

During the site visit, the ambient air quality and noise monitoring was ongoing. The tree cutting activity was also ongoing. Prior Permit to Cut (see Appendix A) has already been secured from the DENR.

The acti vity was coordinated and jointly conducted with the DPWH, Contractor and Construction Supervision Consultant (CSC) staff, namely: csc Herbert Narisma - CSC Environmental Specialist Joselito Alintahanin - CSC Project Inspector Contractors Malou Sembrano - Environment and Health and Safety Officer, China Wuyi (Contractor)

After the environmental monitoring activity, the findings and observations were discussed and mitigating measures and next steps were formulated and agreed upon for implementation.

1 Picture 2 1. Workers were wearing PPEs at the ongoing PCCP pouring activity work site (Picture 1 ). However, in some work areas along the alignment, not all workers are wearing PPEs (Picture 2).

Picture 6 2. Warning signs, bollards with tied yellow tapes were installed in the work areas. Traffic signal/warning lights was used for long stretch work areas with the operators equipped with 2-way radios (Picture 6).

3 Contractor's Camp/ Batching Plant/ Stone Crusher Plant

Picture 8 3. The batching plant, stone crusher and trucks and heavy equipment were in operation during the visit. There was no noticeable air pollution from the vehicles or dust from vehicle movement observed. There was also no noticeable cement dust. The batching plant is equipped with a pollution control device (filter) that is regularly maintained by the contractor to minimize/prevent the cement dust from escaping into the air.
