Section 170 of the Tax Code provides for the treatment of contributions to the SVGS as a deductible contribution by the donor. Bequests, legacies, devises, transfers, or gifts to the SVGS may be deductible for Federal estate gift tax purposes, if they meet the applicable provisions of sections 2055, 23106, and 2522 of the Tax Code.

MEMBERSHIP: Each SVGS member will be mailed a copy of the "Society's" quarterly, the VIRGINIA APPALA CHI.AN NOTES 01 AN). The VAN is usually published quarterly. The annual index. will be included in the Fall issue of the VAN for that year. Society memberships are on a calendar year basis and those memberships, which are not renewed by January 30, will be deemed as inactive and removed from the VAN mailing list. Single or family memberships are $20.00; Organization and Library memberships are $15.00. Members with mailing addresses outside the United States shall add $ 10.00 to the above fees and all monies are payable in U. S. currency. Happy Holidays, Fellow Researchers!

Holidays and family gatherings are great times to hear about those elusive ancestors and hear family legends. My great aunts and uncles were all school teachers or school principals. My Great uncle Charles was principal at one of the first desegregated schools in Roanoke in the 1960's. What stories they could tell!

Researching genealogy has gotten easier with the use of the World Wide Web but lacks good stories. It's the stories that put a human face on our ancestors and make us proud or amused by our sometimes too human relatives. It's the stories that connect us.

Members have a wonderful opportunity to contribute to a major undertaking in genealogical research in the Roanoke area. There are years that the Roanoke Times is not indexed. We are starting with 1897 to 1906. The project starts January 3, 2007. If you would like to be part of this project please call Alicia Sell, (Archivist) in the Virginia Room (853-2073). ·

It has been a great year. It has been a privilege to work with all who have contributed their time and talent to make our Society a great organization. I hope we can keep building on the foundation that has developed over the years and that next year will be even better!

On Septen1ber 17, 2006 Gene Swartzell was honored in a Farewell Luncheon at the Red Lobster in Roanoke. Gene has faithfully served in a number of capacities, including President, during her many years as a member of the Southwest Virginia Genealogical Society. She has relocated to Texas to be near her family. We wish her well in all her future endeavors.

BEAUTIFUL HOME CEREMONY

FLOYD, VA. October 16-A marriage the news of which will be received with interest throughout the State of Virginia and Tennessee, was solemnized Wednesday, October I I , at "The Aspens." Floyd county Va, at high noon, when Miss Lillian Beatrice Pendleton be­ came the bride of Mr. David L. Vestal, of Knoxville, Tennessee.

The nuptials were consummated at the home of the bride's grandparents, Major and Mrs. William H. Barman. The ceremony was performed by Rev. J. K. Harris in the presence of a party of relatives and friends.

The marriage took place in the parlor of the residence. Columns and banks of goldenrod and potted plants adorned every available portion of the lower floor of the house, the color sche~c being yellow and green. Promptly at 12 o'clock the opening chords of Mendelssohn's_wed .ding march was struck and the bridal party proceeded to the altar. First came Mr. Vestal Wtth his best man. Mr. E dmund M. Pendleton, brother of the bride, then came little Mary Spencer Pendleton A sister of the bride, dressed in white organdy, carrying the wedding ring on a silver waiter; next came Mrs. F. Willis Michael, a brunette of rare beauty, sister of the bride as matron of honor, costumed in white crepe de chine on taffeta carrying yellow chrysanthemums. The brjde entered with her father, Dr. William Pendleton, who gave her in marriage. Her gown was exquisite v iolet chiffon with hat and gloves to match and she carried violets. The color scheme was carried out in the elegant luncheon which was served after the ceremony.

The bride is one of Virginia's prettiest daughters, a vivacious brunette, and is noted throughout the state for her charm and beauty, is a daughter of D1·. William Pendleton, of Floyd, VA, a descendant of Judge Edmund Pendleton of the Supreme Court, a granddaughter of Maj or William H. Hannan of Floyd Va., and a niece of Mr. F. P. Harman, of Lynchburg.

T~e groom is a prominent business man of Knoxville and is held in high esteem by all who know him. After a Southern trip of two weeks, Mr. and Mrs. Vestal will make their home in Roanoke for the winter.

~OTE.: This wedding announcement was found in the Bible along with many obituaries mcludmg one for Dr. C. M. Stigleman. Dr. William H. Harman's wife was the former Mar-y 1'.tta Yearou! and their home was called "The Aspens," named for the row of Aspens on either side of the dnveway leading to their home on what is now Bethlehem Church road in the Northeast section of Floyd county.

Dr. C M. Stigleman is Dead

Dr. C. M. S~gleman "the belov~ physician," is dead, and although there had been for some weeks pa_st, ltttle or no hope of his recovery, yet his death sent a shock through the town and commumty, and many many hearts were sad at the announcement of his demise.

Dr. Stigleman breathed his last peacefully and quietly on Sunday the 291h of January, at 4 :30 p.m. and all that was mortal of him was laid to rest on Tuesday mo ming following, at the cemetery by the side of his beloved wife who preceded him to the grave 16 years ago. Dr. Stigleman was born in Floyd county, near Rose Hill, on the J 3lh of March, 1833.

Dr. Stigleman received his academic education at the school conducted here by Wm T. Gannaway, was always a bright student, excelling io mathematics and almost every other branch of study. He, by his own exertions, accumulated sufficient means to take and complete the course of medicine at the Medical College of Virginia. When he graduated in the spring of 1857, and during the same year, commenced bis career as a practitioner of medicine in this county, locating at the courthouse. In the fall of that year he was united in marriage to Miss Ellen M. Shelor, a daughter of Rev. Thomas G. Shelor, who at that time lived at this place.

At the beginning of the Confederate War, Dr. Stigleman was captain of a military company known as the F loyd Rifles," which he took into the service in May, 1861 . This company was incorporated in the 4th VA R egiment at Lynchburg, along with Col. Jubal A. Early commanding, and in a short time went to the front at Manassas. Capt. Stigleman being the senior captain his company was designated as Company A.t and took its place at the head of this gallant regiment. Capt. Stiglcmnn served faithfully during the first year of the war, when he returned home and resumed the active practice of his profession, which continued up to the commencement of his only serious and last sickness, though for several years past he had been trying to retire from active practice and to some extent succeeded. Still there were many of his old friends and patrons who would, to the last, persist in having him to attend them in times of sickness. And in many serious cases, far and near, he was often called in consulration.

Dr. Stiglemnn was by far, for many years, the most widely known and the most extensive practitioner in this county and section, his practice extendi ng largely into the adjoinjng counties, especially F.-anl

Dr. Stigleman was the first Superintendent of Schools ofFloyd County, which position he efficiently filled until ousted under the Mahone regime in 1880. Without any disparagement of the services of his successors in this office it may be said that Floyd county never had more able and faithful superintendent of schools, and one who took more pride in his work. 01·. Stigleman organized the schools of the county with more dispatch and with better school houses than was done in any other county in this section of the State.

Dr. Stigleman was a true southern man. H e always maintained that the South was right in the struggle of 1861-65, and nothing could ever induce to become false to his people or section. No thirst for office or hope of gain could swerve him from his devotion to the Sunny South and her cause.

Dr. Stigleman loved and honored the old Confederate soldiers and it has been by his efforts and at his expense principally that the "old boys" have held several reunions in the past years.

The crowning act ofDr. Stigleman's life in his devotion to the Confederate soldier and d1 e cause for which so many fought and died stands today in the courthouse yard- the bronze monument " in m emory of the Confederate dead"- which he only lived to see erected under his supervision and principally through his inspiration and exertions and then as ifhe said, " it is finished," he laid him down and died.

WITT and FRANK(S) FAMILY LETTER

The following letter was submitted by Lois Blankenship who found the letter in a box of items purchased at an estate sale.

Old Witt Fann Rt. 221, Bedford, Va. August 7, l 979

Dear Aunt Helen:

Here you're going to be 95 tomorrow and I am still not able to hand you a copy of the Witt Family as I have gathered it since I was a girl in high school. I started when Mrs. Mary Latham Norton of California organized the Huguenot Society of the founders ofManakintowne of Virginia about 1924. J opened a lette.r she had written to your mother, Mrs. Booker T. Wi~ giving the line of descent of t~e Witts from William Witt, who came to Manakin in 1695_ w e are descendants of one ofh1s sons, Lewis Witt They were French Huguenots, who fled France after the Edict ofNantos. As I understand it he moved on to Nelson County where "Roselands" became the o ld Witt home. I have not been able to visit there, but that's what the various yearbooks of the Huguenot Society report. His son, Lewis did not fight in the Revolutionary War but he gave aid to the troops and thus, if anyone in o~r family wants to join the Daughters or Sons of the American Revolution they can do so on his line. Here are the descendants as I have them listed when I joined the state society. Jane, my sister, still is active in the Suzanne Rochet Chapter,, which was organized in Lynchburg and I often attend their meetings but I had to give up belonging to things when I worked on the newspaper here and had to keep up with what other people belonged to.

Willi~m Witt father of Lewis Witt who lived in Amherst County. William was born in 1675 m France and died in 1754.

Lewis Witt, who died in 1774, was married to Ann Mills, who died Oct. 28, 1816.

Their son, Mills Witt who is listed as a " pioneer in Bedford County" married Betha ni Creasey, April 27, 1797. ' Their son, Abram Witt, married Alcinda James in 1831 . She died Oct. 11 , __

Their so~ Booker T. Witt (b. 4-8-1 834, d. 4-1 2-1896) married Eliza Jane Frank (b. 10-30- 1844, d. 12-27-1910)

Their so~ Abram Witt, married Lelia D. Anderson June 10, 1897. She died July 24, 1920 ; he died Mar. 17, I 941. They are my parents.

Now about the Franks who are buried on the farm next to ours.

I have a record of John Frank, our grandfather, as early as 1809 when he went on a marriage bond of his daughter, Sukey Frank. He bought the land Dr. J. A. Wente, Jr., now owns adjoining our farm. I have a date of 1832 for that farm which included the 100 acres we live on. You told me that he gave this part to his son, Washington Fran~ for a wedding present. John's wife was Sarah Catherine . She was born 1811, according to my father. She died Jan. 17, 1898. John Frank (Franks) died April 1854. They are buried on that farm, along with their son, Washington Frank and his wife, Catherine Powell. Their daughter, Nancy Fran~ married Silas Ramsey. After John's death in 1854, his wife came to live on the Washington Frank fann and the Ramsey's took over the other fann. Nancy Frank Ramsey died in 1851 and is buried there with her parents. Her tombstone is one of the two we can find that have not fallen into holes, etc. I learned from Mrs. Mary Ramsey Venable, a granddaughter of cousin Calvin Ramsey, that Mr. Silas Ramsey moved to Rockbridge County after Nancy's death and that family has had a prominent part in the life of the county. He was county clerk, and I think, an ancestor [descendant?] is now running for the State Senate. The others buried there are four of your little brothers and sisters, as you gave them to me. Uncle Lee's daughter, who is now dead, gave Booker a copy of the old fa1nily Bible in which all are listed. She thought her father did the writing in the Bible. Anyway, here they are so you will have a record: George W. Witt- b. 3-22-1860; d. 6-25-1861 John W. Witt- b. 6-6-1863; d. 9-27-1871 Mattie N. Witt - b. 5-10-1875; d. 2-16-1879 Harold J. Witt - b. 6-10-1878; d. 6-10-1878 There are no stones for the Franks or Witts, except one almost buried, but someday, the Lord willing, I shall have them properly identified. I have checked on the cost of a marker listing all of them. Dr. Wente is good about keeping it mowed. He loves that old fann and if the time comes that this fann gets out of our "Witt" hands I hope he can but this, too. He beautifies everything he touches and has a sense of appreciation for the family that lived there so Jong ago. Your parents got their marriage "consent" on June 10, 1859, according to t11e records in the Bedford County Courthouse, but I also have an 1858 date from somewhere. Here's your mother's obituary which I copied from the Bedford Bulletin-Democrat This was in the issue of 1-5-1911. She died Dec. 27, 1910:

A Good Woman Gone Mrs. Eliza J. Witt, who has been quite ill for a long while, died on Wednesday night of last week at 9 o,clock , aged 67 years. She was the widow of Booker T. Witt, at one time a well-known contractor and builder, who preceded her to the grave twenty odd years ago.

The funeral and interment took place at 11 o clock and the service was conducted by her pastor, Rev. C. W. Collier, which was attended by a long concourse of sorrowing friends. The pallbearers were Wm. Smith, Harold Stanley, James Mcintyre, F. 0. Thomas, C.R. Bondurant, and C. J. Ramsey.

In part it states: Mrs. Helen Witt Nave, who was born and reared on the old Witt farm on Little Otter, Route 22 l , celebrated her 95th birthday Wednesday Aug. 8. She was the dinner guest of her son Cecil W. Waugaman of Roanoke. Also present were her daughter, Mrs. Virginia Thomas with whom she now lives in Vinton, and her nieces, Mrs. R. E. Carneal and Miss Bobby Witt, and Robert C. Peterson of Bedford. Mrs. Nave's other daughter, Mrs. Marietta Waugaman Hockett, lives with her husband, Robert E. Hockett, at Orange. She was married to George Emory Waugaman Sept. 17, 1907. After his death she married Th01nas Nave in 1914 and had one son, Frank Nave who was lost aboard the submarine, "The Grunion"in the Aleutian Islands Aug. 2, 1942~ Mrs. Nave's parents were the late Booker T. and _Sarah Frank Witt. Mrs. Nave became a nurse in her youth and continued in that profession the gre~ter part of her life, doing private duty at one time at Johns Hopkins and Walter Reed ~osp 1 tals until her retirement in 1961, when she moved back to Virginia. She served ~ assis~t postmistress in the Vinton Post Office during the 1920s and 1930s and was active there m the Baptist church. She became weU-known in the Roanoke area because of her perio_d of service as a nurse for the late Dr. Semones who pioneered the practice of oste~pathy m Ro~ok~. Mrs. Nave wears a hearing aid, does not see well and has difficulty walkmg but her mmd is as clear as when she grew up in the Center Point neighborhood. She visits her old home once_ or twice a year and walks around the old orchard and other places where she played as a child, a~d where she and her sisters planted daffodils which still bloom all over the farm. Her health ts good and she looks forward to her 96t11 birthday.

Funeral homes recently have been using the excuse of HIPAA privacy regulations to deny access to their records. As indicated by this federal advisory this is not true.

ADVISORY CONCERNING THE HIPAA PRIVACY RULE

The HIPAA Privacy Rule, a federal regulation which is required by the Health Insurance Portability and Accountability Act, will take effect on April 14, 2003. Basically, the HIPAA Privacy Rule will require all health care providers, such as hospitals, nursing homes and doctor offices, to adopt and implement strict privacy procedures for patient's medical records.

Detailed information regarding the HIPAA Privacy Rule will be published in the next few weeks. However, with the compliance date of April 14, 2003 right around the corner, it is critical for funeral homes to understand several important aspects of how the HIPAA Privacy Rule does and does not impact funeral service.

1. Funeral homes are not covered by the HIPAA Privacy Rule. Covered Entities, which are those businesses that are subject to the HIPAA Privacy Rule requirements, consist of health plans, health care clearing houses, and health care providers. Although funeral homes may receive or have access to health information of the decedents they care for, they are not Covered Entities. Therefore, funeral homes are not subject to the HIPAA Privacy Rule and do not have to comply with the obligations imposed upon Covered Entities regarding the development of privacy practices and the protection of patient health care information.

2. Funeral homes are not Business Associates. When a Covered Entity has another business perform functions or activities on behalf the Covered Entity, and that business is provided patient health information, the s.µsiness is required as a "Business Associate" of the Covered Entity. While the HlPAA Privacy Rule does not directly regulate Business Associates, it does require Covered Entities to regulate the activities of Business Associates. The Covered Entity must enter into a contract with the Business Associate that mandates that the Business Associate's use of protected health information will be consistent with the privacy policies of the Covered Entity.

In nearly all cases, funeral homes would not be regarded as a Business Associate of a Covered Entity. Therefore, if a hospital or nursing home requests that the funeral home enter into a Business Associate contract, the funeral home should not do so. The only exception would be if the funeral home was providing services for the hospital. For example, if a funeral home .ran the morgue at the hospital, it would be a Business Associate. However, in the overwhelming majority of the cases, funeral homes are not Business Associates and should not enter into Business Associate contracts with hospitals, nursing homes, doctor offices or other Covered Entities.

3. Funeral homes may receive confidential medical information. Under the HIPAA Privacy Rule, Covered Entities are permitted to make disclosure of confidential patient health information to funeral homes as necessary for the funeral home to carry out its duties with respect to the care of a deceased body. Therefore, hospitals could disclose to funeral homes the presence of a contagious disease or the fact that organ and tissue donations were taken from the deceased body.

Hospitals and nursing homes may be contacting funeral homes to discuss these disclosure policies. Certainly, it would be appropriate for funeral homes to participate in the development of these disclosure policies to insure that the funeral home receives the necessary information to perform its duties for the decedent while protecting the health and safety of its staff.

A new edition of Raymond Barnes' huge A Historyofrhe CityofRoanokewill be published by the Historical Society of Western Virginia this fall. This edition will contain two paperback volumes with the 115-page index compiled by Betty Low after Barnes' death. The price for the two volumes will be $75, postpaid. The history has been out of print and in demand for many years. Barnes, a Roanoke lawyer of the old school, published his 844-page history in 1968. Beginning with the organization of the Town of Roanoke in 1882, he wrote of the everyday happenings ofRoanokers in chapters for each year until 1940. Although criticized for some inaccuracies. the book contains an excellent picture oflife-business, social and government-in the first half of Roanoke's history. Most of the Roanoke County cemeteries, and some Roanoke City cemeteries were transcribed by Thomas S. Klatka in 2000. Klatka is on the staff of the Roanoke Regional Preservation Office of the Virginia Department ofHistoric Resources. The document is rather long but beginning on Page 63 you will find, in alphabetical order, dozens of documented and transcribed cemeteries.
