(2020) 32 SAcLJ 458 THE COURTS AND THE ENFORCEMENT OF HUMAN RIGHTS This article examines how the Malaysian courts have dealt with substantive human rights issues in the cases that have come before them, focusing particularly on the last ten years. It highlights cases where the courts demonstrated greater willingness to review executive action and parliamentary legislation and test them against constitutional provisions that protect fundamental liberties such as the right to life, and freedom of expression, association and assembly. It also looks at cases which have taken a less flexible approach on these issues. The article also touches on the issues of access to justice, locus standi and justiciability of cases involving human rights issues before the Malaysian courts. Ahmad Zahid to Take Proposal for Bernam Valley Development to Cabinet Bernama June 14, 2016 SUNGAI BESAR, June 14 (Bernama) -- The area of Bernam Valley has vast potential to be turned into a new development area known as Bernam Valley Development Area, according to Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi. He said he would take the proposal for the development to the federal government as the valley covers the areas of Kuala Selangor, Tanjong Karang, Sungai Besar and Sabak Bernam in Selangor, as well as Tanjung Malim and Bagan Datoh, Perak, which had vast potential to be developed. "These areas used to be lagged behind, but (Selangor Barisan Nasional (BN) chairman) Tan Sri Noh Omar and I have a big plan to develop this area. "It is because our areas have potential for new development," he said at the gathering and breaking-of-fast programme with orphans and senior citizens in Sungai Panjang, here Tuesday. He said if the proposal was accepted, each area would be developed to enable the people to enjoy development and improve their social status. Ahmad Zahid, however, did not specify when he would take the proposal to the Cabinet. Instead, he said if all elected representatives in the areas involved had strong support from the local people, then the tabling of the proposal can be expedited. "If our elected representatives have strong support from the people, insya-Allah (God willing), the development of the areas can be expedited and more projects will be enjoyed," he said. Meantime, he said even though Selangor was not under BN rule, the presence of BN representative, Budiman Mohd Zohdi, contesting in the Sungai Besar by-election would ensure the continuation of efforts taken by the late Tan Sri Noriah Kasnon. -

POWER-SHARING BY PAKATAN RAKYAT IN SELANGOR STATE GOVERNMENT FROM 2008-2013: AN ANALYSIS FROM THE CONSOCIATIONAL APPROACH BY MUHAMMAD AZZUBAIR AWWAM MUSTAFA A thesis submitted in fulfillment of the requirement for the degree of Master of Human Sciences in Political Science Kulliyyah of Islamic Revealed Knowledge and Human Sciences International Islamic University Malaysia MAY 2019 ABSTRACT This study examines the power-sharing practice by Pakatan Rakyat (PR) in Selangor state government from 2008 to 2013. It uses two components of consociational theory; grand coalition and proportionality to analyze the power-sharing of three parties in PR; Parti Keadilan Rakyat (PKR), Democratic Action Party (DAP), and Parti Islam Se-Malaysia (PAS). The data for this research are collected from interviews with PR‘s Selangor State Assemblypersons, Selangor State Assembly Hansard and online news. The findings can be categorized into three aspects. Firstly, the study suggests that the grand coalition of the three parties worked as an electoral pact prior to March 2008 elections and the inability of any party to gain absolute majority required the parties to practice power-sharing in administering the Selangor state government. Secondly, the study also suggests that the distribution of state electoral seats and State Executive Committee (EXCO) posts were done based on ethnic consideration rather than parties consideration. PRK ini diadakan berikutan kematian kedua-dua ahli parlimen BN yang terlibat dalam nahas helikopter ketika PRU DUN Sarawak pada Mei 2016. Justeru adalah menjadi tujuan kajian ini untuk mengkaji pengaruh identifikasi parti dan politik pembangunan dalam PRK Parlimen Sungai Besar, Selangor; dan Parlimen Kuala Kangsar, Perak. Metod atau data kajian ini diperoleh melalui pemerhatian di lapangan, analisis data primer keputusan PRK di kedua-dua kawasan parlimen tersebut dan sumber sekunder daripada buku- buku akademik, artikel jurnal dan kertas seminar/prosiding yang berkaitan. Hasil kajian menunjukkan bahawa BN terus mengekalkan ‘status quo’ kerana faktor identifikasi parti dan mentaliti politik pembangunan yang menebal dalam pemikiran pengundi di kedua-dua kawasan tersebut. Pertandingan tiga penjuru yang mengakibatkan perpecahan parti-parti pembangkang antara PH dengan PAS turut memberi kelebihan kepada BN untuk terus kekal dengan pertambahan majoriti yang lebih tinggi. -

We won’t bow to pressure from Selangor DAP rep, says PAS leader Malaysian Insider Nov 3, 2015 Selangor PAS said it would not bow to the pressure of a Selangor DAP representative who called for PAS executive councillors to be removed from the state administration line-up. Selangor PAS commissioner Datuk Iskandar Abdul Samad said the party would maintain its status quo in the administration. Iskandar, who is also Cempaka assemblyman, said DAP should stop the political intimidation against PAS and remember that the opposition's victory in Selangor in the last general election was due to the agreement and cooperation between PAS, DAP and PKR. "PAS is still in the state government and our task is to carry out our responsibilities as part of the administration which is focusing on the budget," he told Bernama. Iskandar was commenting on a report which quoted DAP Kajang Baru chairman Chiong Yoke Kong proposing to DAP's top leadership that more pressure be put on Selangor Menteri Besar Mohamed Azmin Ali to quickly sack PAS representatives in the state administration. Chiong, who reportedly made the remarks during the Selangor DAP annual convention in Petaling Jaya, was also quoted as saying that if Azmin failed to remove the PAS representatives, DAP would "walk out" of the state government. Azmin was previously reported as saying that PKR had decided to continue its cooperation with all opposition parties, including PAS in Selangor, and that it did not require the establishment of Pakatan Harapan in the state as was the case in Penang because the political situation in the two states were different. -

Saifuddin Nasution Ismail manakala rasmi melalui keputusan- gabungan PKR, DAP, Amanah dan manakala Mohamad Sabu, Tan Sri Mesyuarat juga telah memilih Bersatu pula diwakili oleh Datuk nya dalam Muktamar ke Bersatu minggu depan apabila logo Muhyidin Yassin dan Lim Guang Eng Saifudin Abdullah sebagai setiausa- Seri Mukhriz Mahathir, Tan Sri Abdul S63 hujung minggu lalu, Pakatan yang sesuai dipilih selepas peme- pula dinamakan sebagai naib-naib ha agung gabungan itu manakala Rashid Abdul Rahman dan Dr Shah- Harapan (PH) kini bersedia untuk gang jawatan dan perlembagaan pengerusi.
