As it is now, the only protection comics have is self-help, meaning comedians take punishing thefts into their own hands. This note will dive into the reasons why the current legislature and courts refuse to recognize jokes as copyrightable.

Time spent with family became something to look forward to and feel grateful for, as opposed to years ago when it felt like an irritating obligation. Is it because the older I get the more human my parents become? When their hair began turning gray, did I suddenly value their company more because I finally and tangibly understood that they're growing older and are someday going to die? Or maybe I just relate to them a bit more on an eye-to-eye level now that I'm older. And things that used to mean so much have kind of lost their value a bit. Watching sports is still enjoyable but the importance of my team winning and the agony of them losing have both softened into feelings almost indistinguishable from each other. It's a saddening realization that this softening is only a pit stop on the road to indifference. It's amazing that it took until this day, in my thirty-seventh year God, that sounds so old to have what I will consider from here on to be the greatest moment in my life.

GENDER AND THE MERITOCRATIC MYTH OF AUTHENTICITY IN THE CULTURAL PRODUCTION OF STAND-UP COMEDY BY STEPHANIE BROWN DISSERTATION Submitted in partial fulfillment of the requirements for the degree of Doctor of Philosophy in Communications and Media in the Graduate College of the University of Illinois at Urbana-Champaign, 2018 Urbana, Illinois Doctoral Committee: Professor Angharad Valdivia, Chair Professor Cameron McCarthy Professor CL Cole Associate Professor Julie Turnock ABSTRACT This dissertation demonstrates the ways in which gender plays a role in the validating of authenticity and merit in the cultural and industrial spaces of stand-up comedy. Merit and authenticity are arbitrary signifiers invoked by comics, fans, critics, and industry gatekeepers to protect the privilege of straight, white men who continue to dominate the field. I argue that the ideology of comedic authenticity is a means through which to police the boundaries of stand-up comedy while masking its underlying sexism, racism, and homophobia. More specifically, I argue that women, operationalized here as an industrial identity category, are constructed as comedy outsiders who must continually prove their worth through a shifting and slippery set of aesthetic and cultural norms and conditions. Further I explore the emotional and material labor women must perform to achieve success within the field, both on the local level and the industrial level. Funding: No grant or other funding was received for this project. 2 Abstract Why might observers label one social actor’s questionable act a norm violation even as they seem to excuse similar behavior by others? To answer this question, I use participant-observer data on Los Angeles stand-up comics to explore the phenomenon of joke theft. Informal, community-based systems govern the property rights pertaining to jokes. Most instances of possible joke theft are ambiguous owing to the potential for simultaneous and coincidental discovery. I find that accusations are not strongly coupled to jokes’ similarity, and enforcement depends mainly on the extent to which insiders view the comic in question as being authentic to the community. Thus comics who are oriented toward external rewards, have a track record of anti-social behavior, and exhibit lackluster on-stage craft are vulnerable to joke theft accusations even in borderline cases— because those inauthentic characteristics are typical of transgressors.

In particular, it explores how individuals navigate these uncertain, project-based fields, which are characterized by network forms of organization. Drawing from of five years of ethnographic research into stand-up comedians in Los Angeles, I crafted three chapters that examine participants’ decision-making and social organization. The first chapter covers the underlying processes and mechanisms for career development among artists. It introduces and defines the model of a layered career. In the case of stand-up comedy, individuals progressively move through three layers. Each exhibits its own distinctive organizational bases, challenges, interactional processes, relationship types, and rewards. While development involves one matriculating through layers, it also requires artists to maintain their participation in prior layers, because each is ideally suited for different aspects of practice, creativity, and social support. Careers ii in these contexts involve building a durable infrastructure rather than a simple passage through discrete statuses. The second chapter explores the informal enforcement of intellectual property rights in stand-up comedy.
