Dividing a dominant group into multiple federal regions reduces these dangers. A study of world cases finds that all ethnofederal states that have collapsed have possessed core ethnic regions. The Rehnquist Court and the Political Dynamics of Federalism in Perspectives on Politics, issue 2, vol. 2, june , 233-248 ABSTRACT: The Rehnquist Court's federalism decisions have sparked contentious debate about the role of the Court in the American political system. This article examines the reasons behind the Court's revival of federalism and the controversy it has produced. The first part reviews the normative jurisprudential debate over the Court's role as it has been cast in the legal academy. In the second part, we turn to an historical-empirical, or “political regimes,” framework for understanding the role of the Supreme Court. Although this framework provides a better explanation of the Rehnquist Court's foray into federalism, the connections between this approach and normative jurisprudential debates remain important, and we explore them in the final section. The Court's recent jurisprudence on federalism reflects both consensus and division within the current political regime—consensus that federalism is an important value, but division over how best to protect that value. We argue that competing jurisprudential theories over the role of the Court illustrate these political divisions. The European Union has more to learn from the American experience of constitutionalism than from any of its own Member States. Like the United States, the European Union will have a frame of government constitution that will try to order a system of multiple and concurrent communities of interests, as happened in America, and designed by an indirectly elected assembly. The European Union and the United States will continue to manifest many differences in other crucial aspects of their institutional and cultural development.     UNIVERSIDADE DE LISBOA FACULDADE DE DIREITO A LÓGICA DOS PRINCÍPIOS FUNDAMENTAIS NA LOCALIZAÇÃO DO JUSTO Mestrado em Direito/Ciências Jurídico-Políticas Direitos Fundamentais Autor LAURO FONTES JUNIOR Professor Orientador Professora Doutora Sílvia Isabel Anjos Alves 2017 RESUMO O artigo 16º da Declaração dos Direitos do Homem e do Cidadão de 1789 é comemorado como sendo o instrumento que definitivamente colocou a humanidade, por meio dos direitos fundamentais, dentro do projeto do contrato social, arquitetura que desde sempre veio entremeando as relações sociais e os diversos matizes de forças que operaram em seu bojo. Mas não se tardou a perceber que entre a previsibilidade abstrata vazada pelos direitos fundamentais e a concretude de suas propostas haveria uma grande distância a ser rompida, como restou patente pelos desatinos patrocinados na Segunda Guerra Mundial. Foi por isso que categorias plásticas, como dignidade, com o apoio da teoria da argumentação, procurou destravar a enorme distância entre o texto e o contexto na tentativa de desvelar e funcionalizar conceitos como o justo. Afinal, se por um lado as revoluções oitocentistas tiveram o mérito de identificar e capturar o estágio de equilíbrio haurido nas relações humanas naquele momento da história, expressão da humanidade que foi suficientemente cara para se ver convertida em signos linguísticos, na prática essa estabilidade, cujo intento era conferir segurança aos homens, acabou travando-lhe os possíveis e os novos estágios de equilíbrio nessas relações intersubjetivas, sempre em mutação. Com isso, o que se percebeu foi que essa categoria de direitos passou a calibrar qualquer roteiro de justo que se visse desenvolvido, deixando-se em segundo plano aquilo que lhe é subjacente e foi idôneo para nos conduzir até aquele momento.

The author argues that the ND is a heterogeneous, pan-European “school of thought” consisting of different ideological tendencies. Yet, contrary to the predominant inter- pretation of the revolutionary right as “anti-modern” and “reactionary”, key ND thinkers, including its leader Alain de Benoist, are wedded to a revolutionary, alternative modernist con- ception of politics which is neither liberal nor socialist. The paper in question begins by assess- ing whether the ND is a fascist movement. The paper then focuses on Roger Griffin's “ideal type” definitions of modernism and fascism to argue that ND theorists fit within modernist and fascist frameworks with roots in the late 19th and 20th centuries. The ND's modernist framework seeks to “rescue” contemporary Europe from its profound “decadence” and “crises” in a seem- ingly contradictory ideological pastiche (i.e., “mazeway resynthesis”) combining premodern, modern, and postmodern political and philosophical influences.
