A careful analysis of the 1999 elec- tion results provides evidence of this New Politics. However, it is possible that the results of the up- coming election might not carry evidence of this New Politics. To comprehend this apparent contra- diction in my argument, I distin- guish between two realms of poli- tics: formal electoral politics in- volving the political parties and non-formal participatory politics often involving NGOs and other community groups who do not necessarily focus on winning elec- tions. Even if the Barisan Nasional (BN) wins the forthcom- ing election, the New Politics will prevail. The BN’s hegemony over Malaysian society will not be as comprehensive as it used to be, again. The Meaning Of New Politics Ethnicity remains a very salient aspect of Malaysian politics. The views of the authors are their own and do not represent the official position of IDSS. ___________________________________________________________________________ CRISIS OF CHINESE POLITICS IN MALAYSIA’S RULING COALITION Joseph Liow* 12 March 2003 Introduction Recent intramural crises in the two Chinese partners of Malaysia’s ruling Barisan Nasional (BN) or National Front have raised questions about the future of Chinese parties in the multiracial coalition. Indeed the current twists in the long-standing factional conflicts in the Malaysian Chinese Association and the related tensions between MCA and Gerakan Rakyat Malaysia, may even threaten BN’s continued relevance in Malaysian politics. With dissent brewing in the dominant Malay partner, UMNO (United Malays National Organisation), over the leadership succession after Prime Minister Mahathir Mohammad’s departure, and the still-smarting political wounds after its 1999 election reverses, the internal crises in MCA and the quarrels between MCA and Gerakan, are bound to have a detrimental impact on BN’s political fortunes. Some unnerving signs have already surfaced. At the November 2000 Lunas by- election in Kedah, a constituency with a substantial number of Chinese voters, it was Chinese votes, ironically, that delivered the seat to the Malay opposition candidate from Parti Keadilan. In assessing the future of Chinese politics in the coalition, three ongoing issues dominate: (1) internal crisis within the MCA, (2) MCA-Gerakan tensions, and (3) the interest and encroachment of UMNO into Chinese politics within the BN. A critical question is whether the MCA under a new leadership will continue to be willing to play a subservient role or press for more concessions from UMNO in the interests of the Chinese community.

Lim was a former Datuk Keramat assemblyperson for two terms (1995-2004). He left Gerakan and joined MCA as its Penang assistant secretary and chief of the state legal and legal aid bureau, before joining PKR after the 2008 election. NONEHe has sent his resignation letter to party president Dr Wan Azizah Wan Ismail. Lim (right) said he was attracted by PKR’s reform agenda but after three years in the party, he has lost confidence in it because it failed to fulfil its promises. “Internal squabbling among members continues to take place, so with a heavy heart, I am resigning,” he said. He is also quitting as a Penang municipal councillor, to which he was appointed by PKR. Lim said his late father, Lim Ee Heong, told him on his sick bed that he hoped he would return to Gerakan if it started to reform itself. “He said it was more painful for him to leave Gerakan than the illness he was suffering from,” Lim told a press conference today. Lim said although Gerakan lost all its state and parliamentary seats in 2008 polls, the party has undergone a process of self-examination and has lately commenced a programme of transformation and to returning to the grassroots. He added that he had observed the new trend set by the nation’s “dynamic and visionary” Prime Minister Najib Abdul Razak to transform the country in all sectors.

    The Role of Public Interest Litigation in Promoting 58 Good Governance in Malaysia and Singapore (2004) XXXIII No 1 THE ROLE OF PUBLIC INTEREST LITIGATION IN PROMOTING GOOD GOVERNANCE IN MALAYSIA AND SINGAPORE* ROGER TAN KOR MEE** SUMMARY: In this paper, a two-case study is undertaken on public interest litigation in the promotion of good governance in Malaysia and Singapore. As public interest litigation is a branch of administrative law which involves judicial review of administrative actions, it has a pivotal role to play in an administrative state particularly in the promotion of good governance. Initiated by citizens who may not be directly affected by the administrative acts, such public interest litigants are often frowned upon by the executive as meddlesome busybodies. This makes them a thorn in the executive’s side, and various obstacles were placed in the way by the executive to stymie the growth of public interest litigation. However, it was judicial self-restraint that brought the growth of public interest litigation in Malaysia to a grinding halt. In Government of Malaysia v Lim Kit Siang, the Malaysian Supreme Court took a restrictive approach to the rules of standing. But that does not mean that public-spirited individuals and non-governmental organisations should lose heart. On the contrary, they should persevere and continue to resort to public interest litigation so that it affords an opportunity for the courts to liberalise the current restrictive standing criteria. On the other hand, the absence of public interest litigation in Singapore presupposes that Singapore has a good public administration. Public interest litigation therefore promotes good governance in public administration.
