AND Whereas Council deemed it necessary to impose a Hold provision until such time the proponent and the Municipality agreed to certain terms related to the care and maintenance of the Municipal lands and the opened portion of road know as Macgregor Road further describe as 55R10225 Parts 1, 2 & 3;

AND FURTHER THAT the agreement is to set out in perpetuity a Municipal interest on the lands in which the private road or roads are situated on the property described as:

Council asked for clarification on the Clerk's new role of Emergency Information Officer. Staff explained that the Clerk had preformed this role in the last table top exercise and that under the Emergency Management and Civil Protection Act each Municipality is required to designate an employee of the municipality as its emergency information officer.

AND FURTHER THAT the Role and Duties are described as follows: 1.Maintain a log of all actions taken. 2. Direct the activation of the Emergency Information Plan. The Public Information Officer will have a copy of the Plan and Media Kit available to him/her. 3.Consult with the Mayor and CAO on the need for news briefings and conferences, the granting of media interviews, the status of media monitoring, recommended responses to media misinformation and rumour, the content of official statements, 4.Consult with members of the Community Control Group (CCG) on the status of the emergency and on any need for resources that could be fulfilled by the dissemination of public calls for assistance through the media or other means. 5. Correct misinformation by contacting media program producer. 6. Apprise the Community Control Group members of any significant information Received from members of the public and the media. 7. Ensure that a log is kept of media reporting to be transformed into a media coverage summary and assessment component of the final operational evaluation report of public information activities. 8. Prepare and submit a final report containing an operation evaluation of Emergency Information (EI) services, analysis of media coverage and recommended adjustment to the EI Plan. 9.Arrange for the dissemination of special information e.g. emergency responders to report to a location or go on standby for callout as the case may be; citizens to refrain from using the telephone so emergency communications will remain open; provide information on health hazards as prepared by the Medical Officer of Health. 10. Schedule press conferences on a regular basis. 11.Arrange for media facilities and support near the Emergency Operations Centre (EOC). 12.Gather information from emergency services and prepare releases for the approval of the Head of Council prior to all press conferences. 13. WHEREAS the Municipality of Shuniah recognizes the importance of high-speed broadband internet to our community and the need to address gaps in connectivity because of the impact on safety, quality of life, and economic diversity and sustainability;

AND WHEREAS accessibility to high-speed broadband infrastructure is a key foundation to community economic development and vitality;

AND WHEREAS there are funding opportunities through the Province of Ontario’s Heritage Fund Corporation(NOHFC) Strategic Economic Infrastructure Program and Federal funding through the Connect to Innovate program that support bringing high-speed internet to Canadians in rural and remote communities;

THEREFOR BE IT RESOLVED that the Municipality of Shuniah supports TBayTel’s funding application to both the NOHFC and Connect to Innovate programs for the Hampton/Alder, Sunnyside, and Grandview Projects. CARRIED.

THEREFORE BE IT RESOLVED THAT Council hereby directs the Clerk to bring forward a by-law to authorize the agreement with Mark and Judy Mrakic and a By-law which will remove the Holding provision to By-law 2821-15.

Background: By-law 2821-15 was passed to rezone the above noted property from the Rural Zone to Aggregate Extraction with Processing and to place a Hold on the zone until the owner and the Municipality entered into an agreement to ensure that Macgregor Road and the road being utilized on Municipal lands was maintained by the proponent. Further, as part of an appeal and order by the Ontario Municipal Board in 2003 to the Comprehensive Zoning By-law 2038-00, the Municipality was to seek an alternate route to the gravel pits gaining their access via Mackenzie Station Road as they are not able to use Mackenzie Station Rd due to weight restrictions and safety concerns. Council sought to secure a possible future route to those properties using the roads over the above described land. The proponent has agreed to these terms however if in the event the Municipality wishes to develop these roads in the future it would be the Municipality's responsibility to have the land surveyed and transferred.

-Legislation: The Municipality must give notice to every owner of land in the area where the subject land is located, indicating that Council will be considering a by-law to remove the H. No public meeting is required.

AD HOC COMMITTEE Official Plan 2017 and Implementation of Servicing Options Master Plan Development

The Municipality of Shuniah has decided to strike an Ad Hoc Committee to review, and make recommendations to Council related to the implementation of the findings and proposals of the Service Options Master Plan Development Report conducted by KGS Engineers and other policy directives related to the Draft Official Plan. The goal is to help bring a final Official Plan document to Council for ratification and submission to the Ministry of Municipal Affairs and Housing for approval.

The focus of the Committee's recommendations will primarily involve those lands that considered to be settlement areas within Shuniah (Lakeshore Drive, Pearl, Hwy 527, Pass Lake) and those properties on the shoreline of Lake Superior and the other residential inland lakes within Shuniah.

Members of the Ad Hoc Committee are appointed by Council and will consist of: Nadene Hunley-Johansen, Clerk and Manager of Planning Councillor Donna Blunt Certified Land Planner One Member of the Public (to be advertised and subsequently appointed by Council) giving emphasis to: • Applicants who live in or own property in Shuniah. • Applicants who are competent in and familiar with land use planning policies. • Applicants representing Cottage Associations

The Committee shall:

• Appoint a Chair to oversee the meeting proceedings. • Receive various submissions and consider, evaluate, and discuss • Gather information and input from particular interest groups/stakeholders as agreed to by the Committee. • Participate, where appropriate in local public information meetings that are a part of the Legislated Official Plan processes. • Consider and evaluate input from Council and or public meetings. • Consider and evaluate any alternative courses of action. • Advise Council of their considerations and findings. • Advise Council regarding progress of the study; of issues and concerns; and of any new and unforeseen matters that might be required to be addressed (Clerk and Councillor to make verbal reports at Regular Meetings of Council and receive direction from Council). • Make written recommendation to Council respecting most desired approaches/policydirectives.

Responsibilities:

The Committee is expected to have their final recommendations/policy directives ready for Council review by ______.

Introductory meeting -- get acquainted, review Terms of Reference and confirm time lines Study meetings:

• It is expected that the Committee would need to meet not less than three times. It is anticipated that each meeting would be approximately 2 hours long. • Date, times and location to be set by the committee. • Outline study content and progress to date; review statements of purpose in detail; review collected field data/reports/past reports/maps/ any additional information focusing on the KGS Service Options Master Plan Development Report. • Review relevant Provincial policies and programs • Review current planning setting, including legislation, major documents, and including the current official plan policies and the draft official plan. • Consider background data – Context of seasonal vs recreational residency previous cottage conversion studies • Consider current and anticipated future residency demographics. • Focus on any identified issues within Association lands and develop programs/policies to work with and address any identified issues within the Associations • Develop opinions as to future development within the Municipality of Shuniah in the context of only permanent residential within the Shoreline Residential areas, • Develop programs/polices to address any identified issues related to undersized lots. • Take into consideration the Strategic Plan. • Take into consideration removing the seasonal designation and what if any additional Municipal Servicing not related to septic and water that may be required. • Consider identified issues, concerns, problems related to seasonal and permanent residency , and select and refine most desired course(s) of action incorporating the finds from the KGS Service Options Master Plan Development Report. • Consult with any outside agency who the Committee deems necessary (Ministry of Municipal Affairs, Ministry of Environment, Health Unit, Lakehead Region Conservation Authority). • Put recommendations into draft policy statements to be used within the Official Plan • Consider draft official plan and future zoning amendments (how will these policies form an appropriate and implementable Zoning By-law. • Forward recommendations to Council

Possible participation in at least one public information meeting may also be expected and will involve all members of the Committee and Council.

Upon completion of the above described tasks and responsibilities the Committee will be terminated.

Persons on the Committee other than Certified Land Planner will be paid according to Municipal Policy or by terms mutually agreed upon with the CAO.

TBT Engineering Limited has been retained by the Ontario Ministry of Transportation (MTO) to undertake detail design of the above referenced highway project (Project Key Plan attached). In addition, TBT Engineering is responsible for addressing public/agency concerns and obtaining any environmental approvals required for the project to proceed to construction.

Planned improvements for this portion of Highway 527 include pavement resurfacing, eliminate roadway distortions, review of drainage systems and improvements including ditching and replacement of selected culverts, and review of guide rail systems.

For environmental purposes, this project is a Group “C” category project and is subject to the Class Environmental Assessment for Provincial Transportation Facilities (2000). Group “C” projects are approved subject to screening for environmental effects and the application of mitigating measures where required.

During the course of design, TBT Engineering staff will be conducting field investigations and performing design activities for this project.

MEETING Date: April 24, 2017

Recommendation:

That Council hereby defers any decision regarding business licensing for food trucks in Shuniah for one year and that it be brought back for reconsideration in the spring of 2018.

Discussion:

Council had asked staff to bring back a report and draft by-law to possibly regulate and allow food trucks at Wild Goose Park or perhaps other areas in Shuniah.

Recently Council became aware of the possibility of Lakeview Lodge re-opening as a restaurant and bar. Being that Wild Goose Park is so close to the new restaurant, a food truck would introduce direct competition to one of our own bricks and mortar establishments. Therefore Council may find it prudent to withhold any by-laws allowing food trucks into Shuniah especially Wild Gosse Park at this time.

Council may also want to consider that we have a relatively small business community and a food truck located in Shuniah may in general, compete with those restaurants who pay taxes and who rely on the flux of seasonal residents moving back into the community in the summer. A food truck would likely be coming from the City of Thunder Bay and would not necessarily contribute to our community's financial base.

Re: Elevated levels of barium observed in Provincial Groundwater Monitoring Network (PGMN) Well # 474 - BirchBeach October 12, 2016 Sampling Event

The Lakehead Region Conservation Authority (LRCA) monitors water quality and quantity at nine Provincial Groundwater Monitoring Network (PGMN) wells, two of which are located on Municipality of Shuniah owned land (i.e. Loon Lake and Birch Beach)

In accordance with our responsibilities through the PGMN program, we are informing you, the property owner and Municipality, that elevated levels of barium have been found in water samples collected from the Birch Beach well. The latest sample, collected on October 12, 2016, revealed a concentration of 1,180 micrograms per litre (ug/L). This value exceeds the Ontario Drinking Water Quality Standards (ODWQS). According to Ontario Regulation 169/03 ”Ontario Drinking Water Quality Standards”, made under the Safe Drinking Water Act, 2002; the standard for barium is 1,000 ug/L.

Previous barium levels observed in the BirchBeachWell include:

November 2007 — 1,370 ug/L

December 2008 — 1,160 ug/L

November 2009 — 1,230 ug/L

October 2010 — 1,270 ug/L

2011 — Well not sampled due to pump issues

November 2012 — 1,170 pg/L

Please be advised that TransCanada will be completing routine maintenance of its’ natural gas pipeline facilities from Mainline Valve (MLV) 68, in the Municipality of Shuniah, District of Thunder Bay, and continuing east along the pipelinethrough the Township of Dorion, Township of Nipigon, Parmachene Reserve, and ending in the Municipality of Greenstone, District of Thunder Bay, at TransCanada’s Compressor Station 75 near Keemle Lake. The pipeline maintenance activitythat will be completedis an in—lineinspection (internal) of TransCanada’s pipeline (Line 100-1). This activitywill involve some short periods of excessive noise as the various tools are loaded and unloaded from the pipelinelauncher (68) and receiver (75). The trackers monitor the speed of inspection the pigs and the above—groundmarkers determine the progress of the pigs at road crossings.

The length of the pipelinebeing inspected may require the pigging operation to go through the night. SUBJECT: Whistle Cessation at Road No.5 North

Recommendation: THAT Council does not proceed with the whistle cessation at Road No.5 North based on the estimated cost of the project and lack of funding available for the project at this time.

Discussion: The purpose of this report is to move forward with a decision regarding the whistle cessation at Road No.5 North based on a request from Council.

Council reviewed a petition from May of 2015 requesting the Municipality to explore and institute a Whistle Cessation By-Law for CPR Public Crossing Number 26195 located at Mile 96.43 on the CPR Nipigon Subdivision that crosses Road No.5 North. Staff have brought back reports on the process required by Transport Canada to have a whistle cease to blow, have had a public meeting, have reviewed what other municipalities have done, reviewed the liability and costs of insurance, have completed the safety audit to determine there would be approximately $80,000 in additional safety improvements required, and have consulted with Transport Canada on available funding to complete the work identified in the safety audit. The funding available under the current program is designated to making improvements to the safety at railway crossings. However, a whistle cessation would be regarded as a decrease in safety and therefore not meet the criteria for the funding.
