THAT Council hereby receives the report from the Deputy Clerk and supports the request to relocate the existing drainage easement located on property owned by Peter Stetsko being Lot 6, Plan 55M-429, fronting on Bass Lake Road, as outlined within the said report and further to relocate the existing .03 metre strip of land owned by the Municipality located along the north property line of the said Lot 6;

AND THAT the Municipality not sign any transfer documents and/or releases until such time that any applications required have been submitted to and approved by the Committee of Adjustment and that the reference plan outlining the new locations of the .03 metre strip of land and right of easement to the Municipality is drawn and registered on title; AND THAT the Mayor and Clerk are hereby authorized to execute all transfers acknowledgements and other documents for the purposes of relocating the said .03 metre strip of land and drainage easement;

AND THAT any and all costs incurred to complete the needed steps be borne by the applicant.

THAT Council hereby directs the Clerk to move forward with the sale of unopened road allowance, being described as Parts 2 and 3 of Reference Plan (RP) 55R-14142 to Steven Rose owner of Lot 3 Plan M-100 including Part 1 of RP 55R-14142 and Part 3 RP 55R-8191 conditionally that Mr. Rose further purchase in title Part 3 of RP 55R-9242 from the abutting neighbour and that the properties contain a restriction under Section 118 of the Land Titles Act to stipulate that no independent transfer of the parcels of land shall occur unless the said parcels are transferred to the same transferee;

AND FURTHER THAT a by-law be prepared to stop up and close and sell the said unopened road allowance; to be advertised as per the policy for the disposition of Municipal lands and that all costs associated with the advertisement and sale including any surveys shall borne by the applicant. CARRIED.

iii) Authorize Sale of Shoreline Road Allowance

Discussion occurred over the information given in the reports. Questions were asked about outcomes is owners don't agree before the sale. The expectations would be that Shuniah could have the fire pit removed as it is currently on Shuniah property

MAYOR- This meeting is held by Council under Section 17 of the Planning Act to consider a proposed amendment to the Official Plan for the Municipality of Shuniah.

This public meeting is prescribed under legislation giving those who wish to support or oppose the amendment the opportunity to be heard. Council is legally obligated to deliver fair and unbiased consideration to all matters that are brought to its attention. Council members cannot enter into discussion and/or debate as long as the formal public meeting is in session. A report may be made to Council giving a planning evaluation and, in some instances recommendations concerning the issues if any have been raised.

I can confirm that notice of this public meeting was completed as per the requirements of the Planning Act and I have a signed confirmation from the Manager of Operations that notice of this public meeting was posted at the location that is the subject of this application.

The purpose and effect of this site specific Official Plan amendment is to recognize a portion of Lambert Lane for land severance purposes which would allow the owner of Lot 13: Plan 55M-505 to apply to the Committee of Adjustment to create a new lot.

Comments received to date will be listed at the meeting. Those comments will be reviewed and a report will be brought to Council with possible recommendation stemming from those comments.

5. Public Participation a) Oral Submissions

The Mayor asked if anyone wished to speak on the matter at hand. With it being a zoom meeting those wishing to speak were to contact administration ahead of time so they would have access to the meeting to speak. CAO had a request from Codey Fraser on behalf of the applicant.

Mr. Fraser is the council representing the applicant for this amendment and gave council the historical context on this property and what the applicant intentions are. The applicant owns 2 shares and was his intent to sever the property and create 2 lots. The lot with the existing cabin he will keep and eventually sell the vacant lot. This amendment is required in order for the applicant to proceed to committee of adjustment for the severance.

b) Written Submissions

CAO read out the main items for the written submissions.

Lakehead Region Conservation Authority submitted a document on July 9, 2020 and they have no objections to the amendment,

Shane Judge submitted a comment on July 9, 2020 and inquired about the consent order that created the managed forest on Lambert Island and expired in 2018, was it renewed. If there is still managed forest does this have an affect on the OP amendment.

CAO indicated that the managed forest will not affect the amendment but will need to be considered for a severance application.

-Recommendation-

That the Clerk is hereby directed to bring forward a by-law to authorize the sale of the Shoreline Road Allowance in front of Lot 1, Plan 823, know as 2739 Birch Beach Road.

-Background-

Carol Brink, owner of Lot 1, Plan 823, is applying to purchase the shoreline road allowance laying in front of Lot 1, shown as Part 1 of Reference Plan 55R-14703. A road allowance owned by the Municipality abuts the property on the West side and the owner of Lot 2 Plan 823 has signed the sketch submitted and is also applying to purchase the shoreline road allowance.

It appears that the application meets the requirements of the Policy for the disposition of the shoreline allowance and as the lines as drawn are agreed upon and appear to be in line with the policy as shown on reference plan 55R-14703. The owner of 2735 Birch Beach Road has signed the sketch submitted; however, this property does not abut as there is a municipal road allowance between the properties on the west side of subject land. The owner of Lot 2 on the east side has signed the sketch.

Staff will complete a site visit prior to the Council meeting and will give a verbal report at the meeting. In the meantime, we have prepared the draft by-law for Council’s consideration unless the site visit recommends the by-law be deferred.

-Background-

Fiona Buchan, owner of Lot 2, Plan 823, is applying to purchase the shoreline road allowances lying in front of Lot 2. Both abutting owners have signed the sketch submitted with the application. The owner of Lot 1 is also applying to purchase the shoreline road allowance.

-Findings-

Recommendation:

THAT Council hereby receives the report from the Deputy Clerk and supports the request to relocate the existing drainage easement located on property owned by Peter Stetsko being Lot 6, Plan 55M- 429, fronting on Bass Lake Road, as outlined within the said report and further to relocate the exisiting .03 metre strip of land owned by the Municipality located along the north property line of the said Lot 6;

AND THAT the Municipality not sign any transfer documents and/or releases until such time that any applications required have been submitted to and approved by the Committee of Adjustment and that the reference plan outlining the new locations of the .03 metre strip of land and right of easement to the Municipaltiy is drawn and registered on title;

AND THAT the Mayor and Clerk are hereby authorized to execute all transfers acknowledgements and other documents for the purposes of relocating the said .03 metre strip of land and drainage easement;

AND THAT any and all costs incurred to complete the needed steps be borne by the applicant.

Background:

In 2009 the Municipality purchased Registered Plan 55M-429 from the Buryniuk Family conditionally: - that Lot 6 of Plan 55M-429 be transferred back to the seller, Mr. Burnyiuk, abutting land owner at the time; - a 20’ wide strip of land be transferred as right of easement to the Municipality for the length of Lot 6; and - a 1 foot reserve be transferred to the Municpality along the North boundary of Lot 6.

This was completed and surveyed as Parts 1 and 2 of Referance Plan 55R-13088, copy attached.

Applicatant’s Request:

The sketch submitted and attached is colour coded and referred to throughout this report.

Kaspar Fiedler-Tingley, Lawyer with Weiler, Maloney, Nelson is acting on behalf of Peter Stetsko, the current owner/applicant of Lot 6, Plan 55M-429 who currently has a purchase agreement with the abutting land owner, Darcy Burnyiuk, to purchase 29.7 metres of property north of Lot 6 to accommodate the construction of a new structure. Attached is a sketch outlining the coniditions of the sale, being:

Discussion:

Mr. Fiedler-Tingley has included a comprehensive drainage study completed by TBT Engineering for the proposed relocation of the drainage easement which indicates it is the most functional and feasible location and recommends an .8 metre wide easement, copy attached.

Staff have reviewed the request and have no concerns with the proposed relocation of the easement and or the .03 metre strip of land as drawn on the attached sketch.

If Council agrees to accept the proposed relocation of the one foot strip of land and of the drainage easement which would include the release of ownership of the exisiting 0.3 metre strip of land along with the exisiting easement being Parts 1 and 2 of RP 55R-13088, an application would need to be submitted to the Committee of Adjustment for consent for an addition of property to Mr. Stetko’s property.

If the Committee of Adjustment grants the request, its decisions would contain conditions to ensure that Mr. Stetsko’s existing land along with the portions he would be obtaining (shown in orange, pink and green) are registered on title as one transferrable lot along with other coniditions such as, but not limited to, the following: 1) that the proposed .03 metre strip of land (see new Part 3 outlined in blue) be deeded to the Municipality at no charge and be registered on title prior to completing Condition 2) of this decision; 2) that the Municipality transfer the exisiting .03 metre strip of land being Part 2 of RP 55R-13088 (see Part 2 outlined in orange) to the owner/applicant; 3) that a right of easement 8 metres wide, as described in the application submitted, be registered on title to the Municipality for drainage purposes (shown as Part 4 outlined in green)

Reference: Drainage Study - Proposed Drainage Easement Relocation Bass Lake Road, Shuniah Ontario

1.0 Introduction:

TBT Engineering Limited (TBTE) was retained to undertake a drainage study for the property described as Part of Lot 6 Registered Plan 55M-429 & Part of South V2 of N.W.% Section 6, Concession 6. The property is located on Bass Lake Road, Shuniah, Ontario and is within the Recreational Cottage Zone- Bass Lake (REC-BL) . The study area is identified in enclosure 19-357-C1.

It is understood that the owner is exploring the acquisition of land north of the property to accommodate the construction of a new structure. The municipality has retain'ed a drainage easement along the north limit of the property limit that conflicts with the proposed building. The purpose of this report is to determine a feasible easement relocation option and ensure the new easement location can accommodate the Municipality's drainage requirements.

2.0 Existing Conditions:

The subject property abuts the shoreline of Bass Lake and is partly cleared. A gravel driveway from Bass Lake Road provides access to the subject property. A 6 metre wide drainage easement retained by the Municipality of Shuniah exists along the north limit of the property and is mainly forested. The easement generally slopes towards Bass Lake with uneven ground. See enclosed photos of existing features for reference.

The existing drainage of the study area is detailed in enclosure 19-357-C1 . An existing ditch along the east side of Bass Lake Road is graded northerly to an entrance culvert at the end of the cul-de-sac. Runoff flows through the 450mm CSP entrance culvert westerly to a low-lying area. The topography on the west side of the road has minor undulations but generally slopes towards Bass Lake and the runoff that doesn't infiltrate eventually drains to Bass Lake. Within the study area, a ditch does not exist along the west side of the road. During the field review, a ditch was not found within the existing drainage easement.

3.0 Development and Evaluation of Alternatives:

TBTE undertook a detailed field review and topographic survey of the key drainage features to assist with the development and analysis of easement relocation alternatives.

The following two relocation alternatives were developed and evaluated: 1) Relocate the existing drainage easement to the new north property limit. 2) Relocate the existing drainage easement to the existing south property limit.

The evaluation of alternatives was considerate of terrain , topography, existing road infrastructure, future drainage improvements and zoning requirements.

3.1 Proposed South Easement

TBTE evaluated the feasibility of relocating the existing drainage easement to the south property limit. To provide drainage to the south property limit, ditching within the road right-of-way would be required. In addition, an entrance culvert would be required at the properties entrance. Runoff would reach the south limit of the property and west towards Bass Lake, similar to the existing easement.

Based on surveyed toe elevations along the west side of Bass Lake Road, significant ditching would be required to provide drainage to the south property limit. The existing toe elevation of the road at the southeast corner of the property is approximately 1 metre higher than the outlet of the existing entrance culvert at the end of the cul-de-sac. Additional excavation depth would also be required to provide a minimum slope for positive drainage. It is unlikely the grading limits of the proposed ditch could be accommodated within the existing Bass Lake Road right-of-way

Relocating the easement to the south property limit would facilitate zoning requirements but due to the unfavourable topography and conflict with the existing entrance, this alternative is not preferred.

3.2 Proposed North Easement

TBTE evaluated the feasibility of relocating the existing drainage easement to the new north property limit. This alternative is detailed within enclosure 19-357-C2. To ensure runoff will reach the proposed north property limit, the easement would need to extend north of the Bass Lake Road right-of-way.

A slight raise in existing grade is encountered for 15m while heading westerly along the north property limit. Beyond the first 15 metres, the grades slope steeply towards Bass Lake. Clearing and ditching would be required along the length of the easement to ensure runoff is contained within the easement. The location of this easement could accommodate runoff from a 0.5 metre deep ditch along the west side of Bass Lake Road if the Municipality deemed the ditching necessary in the future. However, this study did not review if new ditching along the west side of Bass Lake Road could be accommodated within the current right of way.

TBTE was provided with the approximate location and dimensions of the proposed new structure. A 3 metre buffer is proposed between the edge of the easement and the new building. This will ensure any grading requirements between the proposed easement and building can be facilitated and ensure zoning requirements can be met comfortably. With an 8 metre easement as detailed within enclosure 19-357-C2, the minimum side yard requirement of 4.5 metre for properties within Recreational Cottage Zone- Bass Lake (REC-BL) can be easily achieved.

4.0 Design & Hydrologic/Hydraulic Analysis

TBTE completed a hydrologic and hydraulic analysis to provide recommendations for minimum ditch dimensions. These recommendations are provided for the event the Municipality deems it necessary, in the future, to construct a ditch along the proposed easement.

TBTE used the Rational Method to estimate the peak flow for a 25-year storm event. This method is accepted by the MTO for watersheds less than 100 hectares. The watershed for the study area was estimated to be 2.4 hectares. The watershed was delineated using contours derived from a surface consisting of a digital elevation model (Natural Resources Canada) and limited survey undertaken by TBTE. To determine the rainfall intensity, an Intensity-Duration-Frequency (IDF) curve was obtained from the MTO IDF Curve Lookup web-based application. Soil characteristics were estimated based on the Geology Terrain Study mapping. Using the Rational Method, an estimated peak flow of 0.20 m3/s was determined for a 25- year storm event. Based on Manning's Equation for open channel flow, a 0.5 metre deep ditch with a 0.5%

No: TBTE19357 Bass Lake Road, Shuniah Ontario grade and 2:1 side slopes can accommodate the 25 year peak flow. The 25-yr peak flow results in flow velocities of less than 1 m/s which indicates a grass lined ditch is acceptable.

It is recommended that an 8 metre wide drainage easement is provided to accommodate future ditching. A maximum ditch depth of approximately 2.5 metres will be required at the peak along the new north property limit to ensure positive drainage. At this location, using 1.5:1 side slopes will ensure the ditch is within the 8 metre wide easement footprint. To mitigate erosion at this location, it is recommended that rip rap and/or erosion control blanket be constructed along ditch side slopes.

6.0 Recommendations

As discussed herein, it was determined that relocating the drainage easement to the new north limit of the property is the most functional and feasible alternative that can accommodate the Municipality's and property owner's requirements. This alternative best replicates the conditions of the existing drainage easement. Currently, ditching does not exist along the west side of Bass Lake Road. Should the Municipality elect to undertake ditching in the future to control runoff from the Bass Lake Road right-of-way, the proposed drainage easement can serve as an outlet to Bass Lake.

The following is a summary of findings and recommendations for relocation of the easement:

• Relocation of the existing drainage easement to the new north property limit proved to be the most feasible and functional alternative; • A minimum ditch depth of 0.5 metres with 2:1 side slopes and a 0.5% longitudinal grade is recommended to accommodate the 25-year peak flow; • Based on flow velocities a grass line ditch is acceptable and rip rap or erosion control blanket may be used to line the ditch where side slopes are steepened to 1.5:1; • An 8 metre wide easement is required to accommodate the grading limits of future ditching

Relocating the drainage easement to the proposed north property limit will not have an impact on the existing drainage of Bass Lake Road or the adjacent properties since ditching is currently not present to contain drainage on the west side of Bass Lake Road or within the existing drainage easement.

The recommendations within this report are intended for the purpose of determining a feasible easement relocation option and demonstrate a functional drainage ditch can be constructed along the proposed drainage easement. Should the municipality deem the proposed drainage easement as presented in this report acceptable, the property owner will require a legal survey to proceed with property acquisition and establishment of the drainage easement.

BACKGROUND:

During the Council meeting on February 11, 2020, Council requested that administration look at how other municipalities deal with councillor absenteeism. Council also requested a report and review on remuneration compared to other municipalities. Attached is a chart with the various comparisons

DISCUSSION:

When speaking with the various municipalities, they all indicated that they do not have an issue with councillor absenteeism. They did indicate that if this did become an issue, they would have to figure out how they could adjust for the absence. One of the municipalities pays council per meeting so this eliminates the problem of paying individuals when they are not in attendance for long periods.

Municipality comparisons were compared by budget amount as this was the most accurate number available.

Stage 1 ensures that applicants meet the basic eligibility requirements.

Stage 2 requires a detailed project description and supplementary information that will be assessed and scored against evaluation criteria.

Applications open on July 9, 2020. Stage 1 applications for the first intake are due on August 21, 2020. Other deadlines can be found in the Improving Connectivity for Ontario (ICON) program guidelines.

Description

The Improving Connectivity for Ontario program (ICON) will help improve and expand broadband and cellular infrastructure in areas of need by investing $150 million over four years.

We’re inviting telecommunication service providers, municipal governments, Indigenous communities and non-profits to submit innovative proposals to lend their investment, expertise and experience to improve connectivity in communities across Ontario.

The ICON program is meant to promote industry partnerships that leverage investments across sectors and encourage innovative solutions to meet the connectivity needs of communities.

Page 57 of 59 Projects supported by the ICON program will achieve the following objectives:

• increase the number of households and/or businesses connected to broadband and cellular services in areas of need • if a broadband project, provide broadband connectivity speeds of at least 50 megabits per second (Mbps) download and 10 Mbps upload or greater for end users • if a cellular project, provide cellular access at the latest generally deployed mobile wireless technology (currently long-term evolution or LTE) • build scalable infrastructure for future needs of users.

Eligibility

The ICON program is open to:

• non-profit and for-profit entities that are incorporated in Canada • municipal entities • Band Councils

For Stage 1, applications must demonstrate that:

• the project is located in an area of need • at least one applicant on a proposal has a minimum of three years of experience building, owning, servicing and/or operating broadband or cellular infrastructure • the technology meets specified speed and/or capacity targets • the percentage of provincial support required does not exceed 25 per cent of total eligible project costs, and • there is local support for improving connectivity in the project area.
