Ashford Kneitel1 Abstract Since Nevada legalized gambling in 1931, casinos have proliferated into the vast majority of states. In 2015, commercial casinos earned over $40 billion. This is quite an impressive growth for an activity that was once relegated to the backrooms of saloons. Indeed, American casino companies are even expanding into other countries. Casino games have a predetermined set of rules that all players—and the casino itself—must abide by. Many jurisdictions have particularized statutes that allow for the prosecution of players that cheat at these games. Indeed, players have long been prosecuted for marking cards and sliding dice. And casino employees have long been prosecuted for cheating their employers using similar methods. But what happens when casinos cheat their players? To be sure, casinos are unlikely to engage in tradi- tional methods of cheating for fear of losing their licenses. Instead, this cheating takes the form of perfectly suitable—at least in the casinos’ eyes—game protection counter- measures. This Article argues that some of these countermeasures are analogous to traditional forms of cheating and should be treated as such by regulators and courts. In addition, many countermeasures are the product of a bygone era—and serve only to slow down games and reduce state and local tax revenues. Part II discusses the various ways that cheating occurs in casino games. These methods include traditional cheating techniques used by players and casino employees. The broadcasts fed to teams typically made use of centerfield cameras, which often offered the best look at pitches as they were delivered to batters. The cameras captured the hand signals catchers flashed to pitchers in order to suggest a particular pitch, as well as the sequences in which those signals were flashed. The application program allowed someone watching the live feed to log an opposing catcher’s sequence of hand signals, and the actual signals flashed, into a spreadsheet, along with the pitches thrown which corresponded to those signs. These lessons illuminate and inform human behav- ior in other contexts, including the adversarial world of criminal litigation. As critiques of the legitimacy and fairness of the criminal justice system increase, the philosophy and jurisprudence of sport offer a comparative legal system to examine criminal litigation. Allegations of gamesmanshipÐthe aggressive and strategic use of rules that violate some sense of decorum or culture yet remain within the formal rules of engagementÐcut across both contexts. This Article examines what sports can teach us about gamesmanship in criminal litigation.     “Cheating, Gamesmanship, and the Concept of a Practice” Brian P. Palmiter Harvard University In 1980, the Virginia Senate had to decide whether to ratify the Equal Rights Amendment. In order for ratification to succeed, an absolute majority of the Senate (21 of 40) was required to support the amendment. Leading up to the vote, support for ratification was evenly split, with twenty senators in favor and twenty opposed. If a tie occurred on the official vote, Senate rules provided that the Senate’s presiding officer, Lieutenant Governor Charles Robb, would be granted a vote to break the tie. On this issue, Robb was projected to support ratification. Thus, the anticipated result was that the amendment would be ratified, 21-20. In practice, however, ratification of the E.R.A. failed despite no one changing his or her mind on the merits of ratification. Paradoxically, the amendment was defeated because Senator John Chichester, an E.R.A. opponent, decided not to vote against the bill, choosing instead to abstain. By abstaining, his vote counted neither for nor against the amendment, making the final vote 20-19, with one abstention. Since Chichester’s abstention meant there was no tie, and thus no need for the lieutenant governor to cast a tiebreaking vote, the amendment failed to meet the twenty-one vote threshold required for ratification. After the amendment’s defeat, Lieutenant Governor Robb observed that Chichester’s decision was one the senator would “have to wrestle over with his own conscience,” implying Chichester’s voting trick was ethically dubious despite being consistent with the existing rules.1 This incident, recounted in William Riker’s classic The Art of Political Manipulation, is a paradigmatic example of gamesmanship.
